1. The following definitions apply to these Terms and Conditions:
a) “Closing Date” means 19:29 on Friday 05 September 2014.
b) “Commencement Date” means 19:30 on Monday 28 July 2014.
c) “Codeword” has the meaning given in clause 10.
d) “Draw Date” means 15:00 on Monday 08 September 2014.
e) “Entrant” means a person who enters the Promotion.

g) “Major Prize Winner” means the Entrant who wins the Major Prize.

2. All times and dates are times and dates in Sydney, NSW which may be AEST or AEDT depending on the date. All times are stated using the 24-hour clock. 00:00 is the start of a day and 24:00 is the end of a day.
PARTICIPATION
3. The Promotion is conducted by the Promoter.
4. The Promotion is a game of chance, and skill plays no part in determining the Winners.
5. Entry to the Promotion constitutes acceptance of these Terms and Conditions. By entering the Promotion, Entrants accept and acknowledge full responsibility for their decision to participate in the Promotion and to take a Prize if they are a Winner.
6. All entry instructions and prize information published by the Promoter form part of these Terms and Conditions.

8. An individual is eligible to enter this Promotion if they:
a) are a permanent resident of Australia; and
b) are either: (a) a Foxtel, Optus TV featuring Foxtel, or Foxtel from Telstra subscriber; or (b) live in a household with a Foxtel, Optus TV featuring Foxtel, or Foxtel from Telstra subscription and have the subscriber‟s permission to enter the Promotion; and
c) the relevant Foxtel subscription account is not in arrears and is active from the Commencement Date until the Unclaimed Prize Draw Date; and
d) are over the age of 18; and
e) are able to take the Major Prize (if drawn as the Major Prize Winner) sometime between 7 April 2015 and 31 August 2015;
and are not:
f) employees of:
i. the Promoter, Optus, or Telstra;
ii. the Supplier;
iii. any corporations or agencies related to the entities in paragraphs (i) and (ii)

a) Tune in to “Wild Australia”, which will air on the Nat Geo Wild channel (channel 616) and National Geographic (channel 610) during the Promotion

b) Submit an entry via one (1) of the following methods:

ii. Website Entry: log onto the Website and click on the Promotion link, then complete all of the required data entry fields (which will include supplying the

11. Only Codewords supplied at the time of the original transmission of the Program each Entry Period will be valid. The Codeword will change weekly and entries which quote an incorrect or out-dated codeword will be ineligible for entry. Entrants acknowledge that Codewords which appear in subsequent playbacks of the Program, including where the Program is recorded and viewed after the original transmission, may be invalid for entry if the relevant Entry Period for that Codeword has closed.
12. Entrants must have premium service access. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. 13. An Entrant‟s entry must not be:
a) late;
b) delayed;
c) incomplete;
d) incomprehensible;
e) unlawful;
f) obscene;
g) defamatory;
h) libellous;
i) threatening;
j) pornographic;
k) harassing;
l) hateful;
m) racially or ethnically offensive;
n) capable of encouraging conduct that would be considered a criminal offence;
o) capable of violating any law; and/or
p) capable of giving rise to civil liability.
14. Entry to the Promotion is limited to one (1) entry per person per Entry Period.
15. Entrants must ensure that their entries are received by the Promoter during the relevant Entry Period. All entries are deemed to be received at the time of receipt by the Promoter, not the time of transmission by the Entrant. The Promoter takes no responsibility for late, lost or misdirected entries or for any delays or failures in any telecommunications services or equipment.
16. SMS entry cost is $0.55c (including GST) which is charged by the Entrant‟s mobile phone carrier provider.
17. Entry via the Website is free. However, any costs associated with accessing the Website are the responsibility of the person seeking access and are dependent on the Internet service provider used.

18. Entrants must make their Website entries manually using an Internet browser. The Promoter may reject an entry if it reasonably forms the opinion that the entry has been made using automated entry means or by use of a computer entry service.
19. Should an Entrant‟s contact details change at any time between the date on which they enter the Promotion and the Unclaimed Prize Draw Date, that Entrant must notify the Promoter of their correct contact details immediately.
20. All entries to the Promotion may be subject to verification by the Promoter. An Entrant must, within 7 days of being asked, at the Promoter‟s cost, allow the Promoter to inspect and copy any documents the Promoter may request establishing eligibility to enter the Promotion, including but not limited to evidence of age, residence and/or identity.
21. The Promoter may decide in its sole discretion which documents are considered suitable for establishing eligibility to enter or win. In the event that a Winner cannot provide suitable proof of eligibility, that Winner will forfeit their Prize in whole and no substitute or compensation will be offered.
22. Any entry that is made on behalf of an Entrant by a third party, or otherwise by proxy, will be invalid.
23. The Promoter may, at its absolute discretion, declare any or all entries made by an Entrant to be invalid if the Entrant:
a) fails to establish their entitlement to win the Promotion to the Promoter‟s satisfaction; or
b) fails to produce items as required by clause 20 or produces items that appear to be illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or
c) appears, to the Promoter, to have tampered with, or benefited from tampering with, the entry process; or
d) has submitted an entry that is not in accordance with these Terms and Conditions.
DRAW & WINNERS
24. There will be 1 Major Prize Winner and 1 Runner-Up Prize Winner drawn from all entries received during the Promotion Period. Each Winner will receive 1 Prize. For the sake of clarity, all entries received during each of the four (4) Entry Periods will all be entered into one (1) draw.
25. The Winners will be drawn electronically on the Draw Date by The Consortium Centre at 1 Basalt Road, Pemulwuy, 2145 NSW.
26. The Promoter‟s decisions are final and no correspondence will be entered into.
27. The Winners will be notified by phone and email within two (2) business days of the Draw Date. The Winners‟ names will be published in The Australian newspaper on the Publication Date.
28. All reasonable attempts will be made to contact the Winners. Subject, where relevant, to any directions given under the legislation regulating the Promotion, if a Prize is:
a) not claimed by the Winner by 8:59 on the Unclaimed Prize Draw Date; or
b) forfeited for any reason,

MAJOR PRIZE
29. The first valid entry drawn will win The Major Prize, which is valued at a maximum of $35,115.00 and consists of a 15 night trip around Australia for the Major Prize Winner and one (1) guest, which will include the following:
two (2) nights‟ twin-share accommodation at Southern Ocean Lodge in a Flinders Suite on Kangaroo Island, SA (including selected meals, selected beverages, transfers and entertainment and activities selected by the Promoter and/or the Supplier in their absolute discretion);
one (1) night‟s twin-share accommodation in a standard room at Crowne Plaza, Adelaide, SA;
two (2) nights‟ twin-share accommodation in a deluxe room at the Cicada Lodge, Katherine, NT (including breakfast and entertainment selected by the Promoter and/or the Supplier in their absolute discretion);
three (3) nights‟ twin-share accommodation in a standard room at Bullo River Station, NT (including selected meals, selected beverages and entertainment and activities selected by the Promoter and/or the Supplier in their absolute discretion);
one (1) night‟s twin-share accommodation in a deluxe marina view room at the Shangri La Hotel in Cairns, QLD;
three (3) nights‟ twin-share accommodation in a garden room at Silky Oaks Lodge, QLD (including a full day private Daintree tour, breakfast, selected beverages as well as entertainment and activities selected by the Promoter and/or the Supplier in their absolute discretion);
three (3) nights‟ twin-share accommodation in a Sunset Point Villa at a hotel on Lizard Island, QLD (including selected meals, selected beverages and entertainment and activities selected by the Promoter and/or the Supplier in their absolute discretion); and
transport for the Major Prize Winner and their guest originating at and returning to the capital city in Australia closest to the Major Prize Winner‟s place of residence and between each destination listed above, in a manner to be determined by the Supplier in its absolute discretion.
30. The Major Prize Winner or their guest must have a valid Australian drivers‟ licence. The Major Prize Winner‟s guest must be over the age of 10 and, if under the age of 18, must be accompanied by a parent or guardian on the Major Prize.
31. Unless expressly stated, all costs and expenses associated with taking the Major Prize become the responsibility of the Major Prize Winner, including:
a) additional taxes (excluding departure and any other flight-associated taxes, if applicable);
b) additional transfers;
c) travel insurance;
d) spending money;
e) additional meals;
f) transport to/from an airport departure or return point;
g) any extra sightseeing or activities; and
h) all other incidental and ancillary costs incurred by the Major Prize Winner and/or
their guest as a direct or indirect result of taking the Major Prize.
32. The Major Prize Winner and the Major Prize Winner‟s guest are responsible for any amendment fees issued by airlines or suppliers once booking is confirmed and ticketed.
33. All aspects of the Major Prize must be taken together as a package. The Major Prize must be taken sometime between 7 April 2015 and 31 August 2015 (subject to availability at the time of booking). The Major Prize Winner must confirm their dates of travel with the

Supplier within 2 weeks of accepting the Major Prize. In the event that for any reason whatsoever the Major Prize Winner does not take the Major Prize at the time stipulated by the Promoter, the Major Prize will be forfeited and no substitute or compensation will be offered.
34. If the Major Prize Winner is a resident of SA or QLD they will forfeit the domestic flights to/from that location.
35. Frequent Flyer points are not available for any of the flights included in the Major Prize.
36. Airline tickets included in the Major Prize cannot be used as part-payment of another airfare.
37. If the Major Prize Winner and/or their guest determine that travel insurance is required, they will be responsible for arranging and paying for such travel insurance.
38. The Major Prize Winner and their guest must depart from and return to the same point of departure and travel together.
39. A credit card imprint or cash deposit may be required from the Major Prize Winner and/or their guest at check-in to each hotel, for all incidental charges.
40. The Promoter makes no representation as to the safety conditions or any other conditions that may exist at any destination.
41. Itinerary of the Major Prize to be determined by the Promoter in its absolute discretion.
RUNNER-UP PRIZE
42. The next valid entry drawn will win The Runner-Up Prize, which consists of a $5,000.00 voucher to 5Star4Less travel.
43. The Runner-Up Prize will be valid until 01 July 2016 and must be redeemed online at www.5star4less.com.
44. To redeem the Runner-Up Prize, the Entrant must:
a) Go online to www.5star4less.com and register to find luxury accommodation and tour
deals;
b) Apply the coupon discount (i.e. Pick a luxury hotel or tour and select room type,
number of quests and rooms and click „Book‟, enter contact and payment information as instructed, and enter the code provided on the Runner-Up Prize in the „Discount Coupon‟ field to apply the discount); and then
c) Complete the purchase (i.e. total fees will reduced by the amount specified on the Runner-Up Prize, and you can continue to complete the purchase by following the prompts on the website).
45. The Runner-Up Prize cannot be redeemed against taxes, supplier fees, cancellation or change penalties, administrative fees or other miscellaneous charges, which are the sole responsibility of the customer.
46. The Runner-Up Prize cannot be used for any booking previously made and will be deemed fully redeemed once a qualifying booking has been made.
47. The Runner-Up Prize will not be refunded and cannot be redeemed for cash. The user will be responsible for any charges in excess of the amount specified on the Runner-Up

Prize. Any portion of the Runner-Up Prize which is not used will be retained and can be applied to future transactions, subject to the expiry date specified in clause 43 above.
48. Usual booking terms and conditions apply to the Runner-Up Prize and all bookings are subject to availability.
49. The Promoter or the Supplier may, in their absolute discretion, withdraw the Runner-Up Prize if they become aware, or have reason to suspect, that the bearer of that Runner-Up Prize has: (a) made multiple bookings on the website using the coupon with a view to re- selling any accommodation; or (b) otherwise engaged in conduct which impacts on the fairness, integrity or proper conduct of this Promotion.
50. The Runner-Up Prize may not, without the prior written consent of the Supplier and the Promoter, be resold or offered for resale at a premium (including via on-line auction sites) or used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If the Runner-Up Prize is sold or used in breach of this condition, the Promoter or the Supplier may, at their absolute discretion, withdraw that Runner-Up Prize.
GENERAL
51. All Prize values are correct as at Friday 27 June 2014 and are reflective of the recommended retail price and are in Australian dollars. The Promoter takes no responsibility for any variations in the Prize values.
52. THE TOTAL PRIZE POOL FOR THIS PROMOTION IS VALUED AT A MAXIMUM OF $40,115.
53. If any Prize (or any part of any Prize) is unavailable for any reason, the Promoter will, in its absolute discretion, substitute alternative goods or services of no lesser retail value and/or specification, subject to the approval of the authorities that have issued permits for the conduct of the Promotion. The Promoter accepts no other liability or responsibility for any loss incurred by any Winner or any other party if any Prize (or any part of any Prize) is unavailable for any reason.
54. If for any reason a Winner does not take a Prize (or an element of a Prize) by the time stipulated by the Promoter, then the Prize (or that element of the Prize) will be forfeited.
55. Prizes, or any unused portion of a prize, cannot be refunded or exchanged and cannot be taken as a monetary payment.
56. Prizes may be transferred at the Promoter‟s sole discretion. In the event that the Promoter exercises its discretion to allow a Winner to transfer a Prize, the transfer will be on the condition that the transferee accepts all terms and conditions set out in these Terms and Conditions and the Promoter may require such acceptance in writing at its absolute discretion.
57. The Promoter reserves the right to refuse to allow a Winner (or the Major Prize Winner‟s guest) to take part in any or all aspects of any Prize, if the Promoter determines, in its absolute discretion, that the Winner (or the Major Prize Winner‟s guest) is not in the mental or physical condition necessary to be able to safely participate in the Prize (if applicable).
58. Winners are advised that tax implications may arise from them winning a Prize and they should seek independent financial advice prior to accepting a Prize.
59. Once a Prize has left the Promoter‟s/Supplier‟s premises, the Promoter and the Relevant Parties will not be responsible for any delay in delivery or loss or damage to the Prize.
60. Prizes will be awarded to the people named in the winning entries.

61. Prizes cannot be used in conjunction with any other discounts or special offers.
62. The Major Prize Winner (and their guest) and the Runner-Up Prize Winner agree to unrestricted use by the Promoter and Relevant Parties of their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
63. The Promoter reserves the right to take any action necessary in its sole discretion at any time, subject to any direction given under State/Territory permit regulations.
64. If, for any reason, the Promotion is not capable of running as planned, including, without limitation, due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures, or any other causes beyond the control of the Promoter that corrupt or affect the administration, security, fairness or integrity, or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or take any other action, including to cancel, terminate, modify, or suspend the Promotion subject to any direction given under the relevant State/Territory permit regulations.
65. The Winners acknowledge that the Prizes may be subject to additional terms and conditions imposed by third parties. The Winners must become acquainted with any such additional terms and conditions prior to taking a Prize. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed on the taking of the Prizes, or for the breach of those conditions by any person.
66. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non- Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
67. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter‟s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a Prize.
68. Any attempt to cause damage to any website or the information on any website associated with this Promotion or to otherwise undermine the fair and legitimate operation of this Promotion may be a violation of criminal and civil laws. The Promoter reserves the right to seek damages in the fullest extent permitted by law in the event that any such attempt is made, whether or not that attempt results in any such damage, interference or undermining.
69. As a condition of accepting a Prize, each Winner (and the Major Prize Winner‟s guest) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and

indemnity form. In the event the Major Prize Winner‟s guest is under the age of 18, a nominated parent/legal guardian of such person will be required to sign the legal documentation required under this clause on their behalf.
70. These Terms and Conditions are governed by the laws of New South Wales and each of the relevant State/Territory authorities. The Promoter and all Entrants irrevocably submit to the non-exclusive jurisdiction of New South Wales.
71. These rules are Terms and Conditions and constitute the entire terms and conditions between the Entrant and the Promoter with respect to the Promotion and cannot be altered, modified, or amended.
72. All entries become the property of the Promoter.

PRIVACY
74. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988. The Promoter collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at http://www.foxtel.com.au/about-foxtel/privacy/default.htm. In addition to any use that may be outlined in the Promoter‟s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. These terms and conditions should be read in conjunction with those terms and conditions. If there are any inconsistencies these shall prevail. Any reference to „Prize(s)‟ in the relevant clauses should be replaced with the word „Vouchers(s)‟ for the purposes of the “Wild Australia” Guaranteed Offer Promotion.
