“MotoGP Experience” Game of Skill Competition
CONDITIONS OF ENTRY
1. Competition and Promoter
1.1 By entering the “MotoGP Experience” Competition (Competition) and in
consideration for the opportunity to participate in the Competition, each
entrant agrees to be bound by and observe these Conditions of Entry.
Information on how to enter and prize details form part of these Conditions of
Entry.
1.2 The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN
16 065 445 418 of 4 Broadcast Way, Artarmon NSW 2064 (Promoter).
2. Who may enter
2.1 Subject to paragraphs 2.2 and 2.3, entry into the Competition is open to all
permanent residents of Australia aged 18 years or over at the date of entry.
2.2 The officers, management and employees (and immediate family members of
officers, management and employees) of the Promoter and their related
corporations and associated agencies are not eligible to enter the
Competition.
2.3 Each entrant may submit an unlimited number of entries in the Competition
Periods (defined below), provided that each entry is unique and otherwise
complies with these Conditions of Entry.
3. Competition Period
3.1 The Competition commences at 9:00am Australian Eastern Standard Time
(AEST) on 11 September 2017 and ends at 11:59pm Australian Eastern
Daylight Time (AEDT) on 8 October 2017 (Competition Period).
3.2 Entries not received during the Competition Periods or not completed in
accordance with these Conditions of Entry will not be eligible to win.
4. How to enter
4.1 The entry question for the Competition is, “What is your favourite moment
from Phillip Island and why?” (Entry Question).
4.2 Eligible entrants must, during the Competition Period,
(a) go to the Competition website and follow the link to the Competition;
(b) enter the details requested; and
(c) tell us in 25 words or less, “In 25 words or less, tell us your favourite
moment from Phillip Island and why?” (Entry Question).
(each, an Entry).
4.3 Without limiting paragraph 10 below, by submitting an entry to the Promoter,
each entrant acknowledges that the Promoter may (but does not guarantee
that it will) read or display the entrant’s Entry on the Competition Website
(www.foxsports.com.au), the FOX SPORTS channels and on FOX SPORTS’
social media platforms.
4.4 To be eligible to win a prize, entrants must have a public Twitter, Instagram or
Facebook account and must not remove their entry from their account until 22
October 2017. Entries that are removed prior to this date will not be
considered in the Competition.
5. Prize and notification
5.1 Judging of all entries received during the Competition Period will be
conducted by the Promoter at 4 Broadcast Way, Artarmon NSW 2064 on 9
October 2017.
5.2 The five entrants who submitted the most creative and unique answers to the
Entry Question during the Competition Period (as judged by the Promoter in
its sole discretion) in accordance with these Conditions of Entry will each win
a Moto GP experience, valued at A$1,400, consisting of:
(a) one double pass for admission to the Pit Roof Gold Suite over 3 days
(20 – 22 October 2017) at the Moto GP Phillip Island (Event);
(b) one Pit Canopy experience for the prize winner and their companion at
the Event;
(c) one Pit Lane Walk for the prize winner and their companion on each
day of the Event;
(d) one Main Straight Walk for the prize winner and their companion on
Sunday, 22 October 2017;
(e) two commemorative lanyards;
(f) One double Pooled Paddock Pass; and
(g) a photo opportunity with the winner’s trophy for the prize winner and
their companion.
5.3 The maximum total prize value is A$7,000 (including GST).
5.4 The prize winners will be notified by message on 9 October 2017. The prize
winners must accept or reject the prize by 99:00am AEDT on 16 October
2017. If two or more entrants submit substantially similar answers to the Entry
Questions, the prize will be awarded to the entrant who first submitted their
entry.
5.5 An entrant will be eligible to win one prize during the Competition Period.
5.6 The Promoter accepts no responsibility for any variation in the value of a
prize. The prize is not transferable or exchangeable. The prize is not
redeemable for cash and must be taken as offered. If for any reason the prize
winner does not take an element of the prize during the stated period and on
the conditions stipulated by the Promoter or any third party, that element of
the prize will be forfeited and cash will not be awarded in lieu of that element
of the prize.
5.7 In the event that any element of the prize is not available, the Promoter
reserves the right to substitute a prize of equal or greater value.
5.8 The prize winner is responsible for all expenses not specified in these
Conditions of Entry, including but not limited to, transport to and from the
Event at Phillip Island (VIC), all transfers, accommodation, meals, drinks,
insurance (including medical, travel and health), items of a personal nature
(including but not limited to in-room charges, tips, telephone and laundry) and
all other ancillary costs.
5.9 The prize winner acknowledges that the prize is subject to additional terms
and conditions imposed by third party prize suppliers including Australian
Motorcycle Grand Prix and venue operators. The prize winner and their
companion must become acquainted with any such additional terms and
conditions prior to taking the prize. The prize winner and their companion
must comply with all ticket conditions, supplemented by the conditions of
entry imposed by any venue operator and the prize winner and their
companion may be required to sign a waiver and indemnity. The Promoter
does not accept responsibility and is not liable for any conditions imposed on
the taking of the prize by any other third party prize supplier. At all times
whilst participating in the prize, the prize winner and their companion are
required to comply with the prize supplier’s and the Promoter’s policies and
procedures, including in particular, any policies and procedures or reasonable
direction in relation to work health and safety.
6. Unclaimed prizes
If the prize is unclaimed by 9:00am AEDT on 16 October 2017, it will be
awarded to the entrant who submitted the next most creative and unique
answer to the Entry Question during the Competition Period (as determined
by the Promoter in its absolute discretion). The unclaimed prize winner will be
notified by message on 16 October 2017. The process will be repeated every
24 hours until a prize winner is contacted and the prize is claimed. The prize
remains the property of the Promoter until it is collected by the selected prize
winner or unclaimed prize winner as the case may be.
7. Information for Prize Winner
All entrants agree to provide the Promoter with identification and/or proof of
age if selected as a prize winner. In accepting a prize, the prize winner agrees
to the release set out below. The form of identification and/or proof of age are
at the discretion of the Promoter.
8. Limitation of Liability
8.1 Except for any liability that cannot by law be excluded (including as set out
under paragraph 8.3), the Promoter, its related corporations and associated
agencies (and any of their personnel) exclude all liability for any loss
(including any damage, claim, injury, cost or expense) which is suffered or
incurred by any person (including the prize winner or their companion) in
connection with the Competition or a prize, including, without limitation: (i) any
indirect, economic or consequential loss; (ii) any loss arising from the
negligence of the Promoter, its related corporations and associated agencies
(and any of their personnel); and (iii) any liability for personal injury or death.
8.2 No responsibility will be taken by the Promoter or its authorised agents for
lost, ineligible, misdirected or late entries due to technical reasons or any
other reason. Entries that are not genuine or are incomplete, late or in any
way fraudulent will be declared void.
8.3 Nothing in these Conditions of Entry limits, excludes or modifies, or purports
to limit, exclude or modify, the statutory implied guarantees/warranties as
provided under the Competition and Consumer Act 2010 (Cth) and the ASIC
Act 2001 (Cth), including the statutory consumer guarantees under the
Australian Consumer Law, or similar laws in the States and Territories of
Australia.
9 Privacy
By entering the Competition, the entrant understands and agrees that the
Promoter may use and disclose the entrant’s personal information to assist in
conducting the Competition and communicating with the entrant in regard to
special offers from the Promoter and its related entities. Entrants in the
Competition acknowledge that the Promoter may share an entrant’s personal
information with the Promoter’s Australian and foreign related entities which
may contact the entrant with marketing messages and special offers. Without
limiting the foregoing, the Promoter may disclose the prize winner’s personal
information to third parties for the purpose of fulfilling the prize. If an entrant
elects to receive information from other third parties, the Promoter may also
disclose the entrant’s personal information for that purpose. The Promoter is
bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth).
Entrants may find out more information about how the Promoter collects, uses
and discloses personal information by reading the Promoter’s Privacy Policy,
which is available at http://www.foxsports.com.au/about-us/privacy. Entrants
may access the personal information the Promoter holds about them by
writing to the Promoter at the address set out below. If the Promoter limits or
denies an entrant access to their personal information in certain
circumstances, the Promoter will tell the entrant why access was limited or
denied. The entrant can contact the Promoter by writing to the Promoter at 4
Broadcast Way, Artarmon NSW 2064.
10 General
10.1 All entries must be original to and created solely by the entrant. All entries
and all copyright and other rights in such entries and/or other materials
become the property of the Promoter and will not be returned. Each entrant
agrees to provide a written assignment of all rights to the Promoter if
requested. By submitting an entry and any other materials (save for any
personal information) to the Promoter in connection with the Competition,
each entrant:
(a) specifically authorises the Promoter to use and/or licence third parties
to use such entry in whole or in part, throughout the universe, in
perpetuity in or on any and all media, whether currently in existence or
developed in the future, and alone or together or as part of other
information, content and/or material of any kind or nature;
(b) represents and warrants that all elements contained in the entry or
other material:
(i) are original to the entrant and fully cleared for use as
contemplated in these Conditions of Entry;
(ii) do not and will not, in any way, violate or breach any of the
terms of any other agreement the entrant may be a party to;
(iii) do not contain defamatory, tortious or otherwise unlawful,
untrue or inaccurate information, infringe or violate any
copyright or other right; or contain any matter the publication or
sale of which will violate any law;
(iv) are not obscene or likely to cause offence;
(v) are not in any way cruel or abusive; and
(vi) will not require the Promoter to pay or incur any sums to any
person or entity as a result of Promoters’ use or exploitation of
the same; and
(c) unconditionally and irrevocably consents to any act or omission which
would otherwise infringe any of their moral rights in the entry and
waives all moral rights in the entry that arise outside Australia.
10.2 This Competition is a game of skill. Chance plays no part in determining the
prize winner.
10.3 Acceptance of the prize constitutes consent on the prize winner’s part to allow
the use of the prize winner’s name, image, voice and/or likeness by Promoter
for editorial, advertising, promotional, marketing and/or other purposes
without further compensation except where prohibited by law.
10.4 No correspondence will be entered into and the judges’ decision is final and
binding.
10.5 If for any reason the Competition is not capable of running as planned,
including due to infection by computer virus, bugs, tampering, technical
failures or any other causes beyond the control of the Promoter, which corrupt
or affect the fairness or integrity or proper conduct of the Competition, the
Promoter reserves the right in its sole discretion to disqualify any individual
who tampers with the entry process and to cancel, modify, terminate or
suspend the Competition.
10.6 The prize winner is advised that tax implications may arise from the prize and
should seek independent financial and taxation advice prior to their
acceptance of the prize. The prize winner is responsible for all taxes
(excluding GST) which may be payable as consequence of receiving a prize.
10.7 The Competition is not sponsored, endorsed or administered by, or
associated with, Facebook, Twitter or Instagram.
11 Contact details
11.1 It is the entrant’s responsibility to inform the Promoter of any change to the
entrant’s contact details, including their email address.
