Official Rules for the Expedia and Destination NSW’s ”Vivid 2019 Sweepstakes“ Competition
In these Official Rules, the term “you” refers to any person who enters, or who wishes to enter, the Competition.
1. NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
2. Promoter: The promoter of this Competition is Expedia Australia Pty Limited ABN 12101694946 of Level 18, 1 Martin Place, Sydney (”Expedia”) and the Sponsor of this Competition is Expedia, Inc., 333 108th Avenue NE, Bellevue, Washington 98004 USA.
3. Eligibility: The Competition is open only to legal residents of Australia who are at least eighteen (18) years old at the date of entry and who otherwise meet the requirements set out in these Official Rules. Employees of the Promoter or Sponsor, Destination NSW (“DNSW”), Jebbit Integration (“Jebbit”), their subsidiaries, affiliates, prize suppliers and advertising/promotion agencies as well as their respective immediate family (spouse, parents, siblings and children and each of their respective spouses, regardless of where they reside) and household members (whether or not related) of those employees are not eligible to enter.
4. Competition Period: The Competition Period begins at 9.00am AEST Monday 15 April 2019 and ends at 11.59pm AEST Saturday 4 May 2019. Entries submitted before or after the Competition Period will not be eligible. Promoter’s computer is the official time-keeping device for the Competition.
5. How to Enter: To enter the Competition, you must, at any time during the Competition Period, complete the following:
Visit the sweepstakes landing page at https://expedia.jebbit.com/yashtpea?L=Owned+Web&JC=onsite+banner;
Follow the instructions provided to complete all questions within the quiz;
Enter your first name, last name, phone number and email address;
Submit your completed information to receive one (1) entry in the Sweepstakes.
IMPORTANT NOTE: Standard text messaging, data and/or other rates apply to participants who submit a Post via a wireless mobile device. Wireless service providers may charge for airtime and/or data in relation to each standard text message sent and received. Please contact your service provider for pricing and service plan information and rates before mobile device participation.
All entries will have an equal chance of winning. Your answers to the provided quiz questions will not increase or decrease your chances of winning the prize.
There is a limit of one (1) entry per person. Entries will not be acknowledged. If you attempt to obtain more than one (1) entry by using multiple/different email addresses, identities, registrations, or logins, or through any other methods, Sponsor may exclude you from participating in the Sweepstakes. Participation is subject to Expedia’s Terms of Service. When you enter, you are providing information to Sponsor. No purchase necessary.
6. Random Drawing: On or about10 May 2019, at 10:00 am PT, at Level 18, No. 1 Martin Place, Sydney, NSW, Australia 2000, Promoter or its agent will select one (1) potential winner in a random drawing of all entries received during the Entry Period. The odds of being selected depend on the number of entries received. Prize winner will be notified by e-mail using the contact details provided in connection with the entry within two (2) days of the relevant draw. If a potential winner does not respond and comply with the instructions in the email message within five (5) days from the date the message was sent, and after one (1) attempt to contact a potential winner, he/she will forfeit the prize and Sponsor may award the prize to an alternate entrant. Only one (1) alternate entrant will be contacted for the Prize. Such newly selected potential winner will be notified by email within two (2) business days of the drawing, using the contact details provided by that person when entering the Sweepstakes. Except where prohibited, a potential winner will be required to complete and return an affidavit of eligibility and liability/publicity release. If the potential winner is a minor, his/her parent or legal guardian will be required to sign the documents on his/her behalf. Unclaimed prizes may not be awarded.
7. Prize: One (1) potential winner will receive a trip for winner and one (1) guest to Sydney during 31 May – 2 June 2019 (“Prize”). Prize includes round trip economy domestic airfare, minimum 4-star accommodations in Sydney, and a double pass to see Spike Lee at Sydney Town Hall on 1 June 2019. Sponsor will work with winner to book travel. Prize has an approximate retail value (‘’ARV’’) of up to AUD2,500.
The ARV is subject to change based on current market conditions and time of prize fulfillment and time of travel. Any difference between the ARV and actual value, if any, will not be awarded.
Winner and his/her chosen companion must travel on the same itinerary. Tickets are not transferrable, changeable or refundable. Other terms and conditions may apply.
The winner is responsible for paying any applicable federal, state, local, income and withholding taxes, if any, and any and all other costs and expenses not listed herein as being provided, including but not limited to all ground transportation, luggage fees, meals and beverages, hotel incidentals, souvenirs and gratuities. In the event that any tax withholding is required by law for the prize, winner authorizes Sponsor to make the corresponding deduction. Any prize details not specified above will be determined by Sponsor, in its sole discretion. Sponsor will not be liable for any airline or hotel fees incurred as a consequence of changing or cancelling air or hotel reservations. Sponsor will not replace any lost or stolen prizes or prize components. Winner may not transfer, assign, or substitute the prize, or redeem the prize for cash, except at the sole discretion of the Sponsor, who reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value. Prize is awarded “as is” without any warranty or guarantee, either express of implied by Sponsor.
8. Unclaimed Prizes: If the prize is forfeited, the Promoter will conduct a random redraw from all entries submitted during the Entry Period at 6:00 pm AEST within 4 days of the original draw at the same location as the original draw. The unclaimed prize draw winner will be notified by email within 24 hours of the redraw, using the contact details provided by that person when entering the Sweepstakes. Disposal of any unclaimed prize may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.
9. General Conditions: In the event that the operation, security, or administration of the Competition is impaired in any way, the Promoter may, in its sole discretion, (a) suspend the Competition to address the impairment and then resume the Competition; or (b) award the prize according to the criteria set forth above from among the eligible entries received up to the time of the impairment. Promoter reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Competition, violates these Official Rules, or acts in a disruptive or unsportsmanlike manner. Promoter’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to the Promoter or the Sponsor by mail shall not be deemed proof of receipt of that communication by the Promoter or the Sponsor (as applicable). The Competition is subject to federal, state, and local laws and regulations, and is void where prohibited.
10. Entrant’s Personal Information: Information collected from entrants is subject to the Sponsor’s privacy policy, which can be found here: https://www.expedia.com/p/info-other/privacy-policy.htm. By entering this Competition or providing personally identifiable information you consent to the collection, processing, maintenance and transfer of such information in and to the United States and other applicable territories outside of the country where the data was collected from you. The data protection and other privacy laws of the Unites States and such other countries may not be as comprehensive as those in your country. The Released Parties (as defined below) will take all steps reasonably necessary to ensure that your personal information is treated securely and in accordance with Sponsor’s Privacy Policy and these Official Rules in respect of such transfer, but will not otherwise take steps to ensure compliance with applicable laws in your country of residence. By participating in the Competition, participants expressly agree to such transfer. In the event of an inconsistency between these Official Rules and the Sponsor’s Privacy Policy, these Official Rules shall prevail.
11. Release and Limitations of Liability: By entering, you agree to release and hold harmless the Promoter and Sponsor, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Competition or receipt or use of any prize, including, but not limited to: (a) unauthorised human intervention in the Competition; (b) technical errors related to computers, servers, providers, or telephone, or network lines; (c) any errors on the Competition site that may impact may entry; (d) printing errors; (e) lost, late, postage-due, misdirected, or undeliverable mail; (f) errors in the administration of the Competition; or (g) injury or damage to persons or property. You further agree that in any cause of action, in no event shall the Released Parties be liable for attorney’s fees. You waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
12. Disputes: Entrants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Competition or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in New South Wales, Australia. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Promoter or the Sponsor in connection with the Competition, shall be governed by, and construed in accordance with, the laws of New South Wales, Australia, without giving effect to any choice of law or conflict of law rules (whether of NSW or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than New South Wales, Australia.
13. Results: The winner will be announced within 2 business days of the prize draw on the following expedia.com.au subdomain: https://www.expedia.com.au/g/pt/ms-dest-dnsw-vivid2019-td-au and displayed for a period of 28 days.
