Promotion Terms and Conditions

Information on how to enter, the prizes and rules for redeeming the prizes form part of the terms and conditions of entry for the Promotion. Participation in the Promotion is deemed acceptance of these terms and conditions (Terms) and any other notices referenced herein.

The Terms include:

the Promotion Specific Terms & Conditions set out in Part A below; and
the General Terms & Conditions set out in Part B below.

In these Terms, the term “you” refers to the any person who enters, or who wishes to enter, the Promotion.

Part A – Promotion Specific Terms & Conditions

A.1 The Promoter The Promoter is Expedia Australia Pty Limited ACN 101 694 946 of Suite 1, Level 2, 77 King Street, Sydney NSW 2000.

The Sponsor is Westpac Banking Corporation ABN 33 007 457 141 of 275 Kent Street, Sydney NSW 2000.
A.2 Promotion Period The Promotion consists of two (2) separate stages, as follows:
(a) Stage 1, which involves weekly rounds commencing at 10:00:01 AEST on Monday, 16 June 2014 and closing at 23:59:59 AEST on Sunday, 27 July 2014 (Stage 1 Promotion Period); and

(b) Stage 2, which commences at 09:00 AEST on Thursday, 31 July 2014 and ends at 14:00 AEST on Thursday, 31 July 2014 (Stage 2 Promotion Period),

collectively, the (Promotion Period),
unless the Promotion ends earlier or later in accordance with these Terms.

IMPORTANT NOTE: In order to be able to participate in the Stage 2 Promotion Period for the chance to with the grand prize, participants must present in Sydney, NSW between 20:00 AEST on Wednesday, 30 July 2014 and 20:00 AEST on Thursday, 31 July 2014 (or at a later date, at the discretion of the Promoter, depending on weather) for participation in the Race in the city of Sydney, NSW, Australia.
A.3 Who may enter (a) Entry to the Promotion is open to residents of Australia only who are aged 18 years or older at the date of entry and who otherwise meet the criteria set out in these Terms.

(b) Employees and officers of the Promoter or the Sponsor, the agencies associated with this Promotion and their immediate family members are not eligible to enter the Promotion or to be awarded any prizes in connection with the Promotion.
A.4 How to enter The entry requirements for each stage of the Promotion are:

in relation to Stage 1, as set out in paragraph A.5 below; and
in relation to Stage 2, as set out in paragraph A.6 below.

Please note that only the winners of Stage 1 of the Promotion are eligible to enter Stage 2 of the Promotion. If any such winner cannot attend Stage 2, they may appoint a proxy who must comply with these Terms & Conditions (as they relate to that proxy), or the Promoter may appoint a person to participate in his or her place.
A.5 Stage 1:
Weekly Rounds Stage 1 involves a series of Weekly Rounds (6 rounds in total during the Stage 1 Promotion Period), commencing on Monday, 16 June 2014.

To enter Stage 1 of the Promotion, you must, at any time during the Stage 1 Promotion Period:

visit www.expedia.com.au/westpac (Promotion Page); and
once on the Promotion Page follow the instructions to:
(i) correctly identify a city, country location through a series of photos and questions for that Weekly Round;
(ii) register your details including, without limitation, name and e-mail address; and
(ii) indicate, where prompted, your acceptance of the Terms + Conditions of the Promotion.

Failure to provide accurate and complete information will render the entry invalid.

All valid and correctly answered questions received by the Promoter for each Weekly Round will be entered into a draw at the end of that Weekly Round (refer to A.11 below).

Entries submitted by any other method will be automatically deemed invalid.
A.6 Stage 2:
The Race: The winner from each Weekly Round (drawn in accordance with paragraph A.12 below) will be eligible to participate in Stage 2 of the Promotion, the Race, on 31 July 2014 (Team Leader). Each Team Leader must select a teammate to participate with them in the Race – such teammate may be of the Team Leader’s choice, but must be over the age of 18 and must have read and agreed to these terms and conditions, to the extent that the terms and conditions apply to that teammate).

To participate in the Race, the Team Leader and his or her teammate must report to the office of the Promoter by 09:00:00 AEST on Thursday, 31 July 2014. The Race will finish no later than 14:00 AEST on 31 July 2014. The Race will be conducted at various locations in and around Sydney, as determined by the Promoter.

Race participants will be provided with a map of Sydney, a set of Rules and a series of 11 clues to enable participants to solve each clue and reach each of the intended 11 destinations. Participants may use the internet to help them solve clues. Two Austereo radio hosts, appointed at the discretion of the Promoter, may also provide supplementary clues to participants should the participants choose to engage with the hosts.

Teams may also be required, in the Promoter’s sole discretion, to document their Race on the GoPro cameras awarded in Stage 1.The first team to solve each of the 11 clues and reach the final destination, having correctly completed the Race in accordance with the Rules and any directions provided by the Promoter, will be deemed the winning team. The grand prize (as described in paragraph A.9) will be awarded to the Team Leader only, and the teammate will not be entitled to receive any prize from the Promoter or the Sponsor).
A.7 Number of entries You may submit a maximum of one entry per person per Weekly Round (i.e. maximum of 6 entries during Stage 1) to the Promotion. Any entries in addition to this will be automatically disqualified and the Promoter may, in its absolute discretion, disqualify your participation in the Promotion.
A.8 Stage 1 Prizes Each winner of each Weekly Round in Stage 1 of the Promotion will receive the following prizes:

One (1) AU$1,000 travel vouchers for use on Expedia.com.au, in accordance with all voucher terms and conditions;
One (1) GoPro Hero3 White Edition Camera (valued AUD $365.00); and
Participation in Stage 2, the Race, on 31 July 2014.

If the winner of a weekly round does not live in NSW, the winner will also receive two (2) return economy class airfares from the winner’s nearest Australian capital city to Sydney at the time directed by the Promoter for the winner and their teammate, one (1) nights’ accommodation for two (2) in a standard 4 star equivalent hotel chosen by the Promoter. In the event that a winner of the Weekly Round lives in NSW, the flights and accommodation component of the Weekly Round prize for the winner and/or that winner’s travel companion, will be forfeited, and no other prize in lieu of that component will be awarded to that winner.
A.9 Stage 2 Prizes There is one grand prize, which will be awarded to the Team Leader of the winning team, as follows:

Return business-class airfares and hotel accommodation for 2 adults to one of the following destinations: Australia, United States of America, Hong Kong, Europe, Japan, Canada, United Kingdom, New Zealand, Singapore, South Africa, Thailand up to a value of $7,500; and
AUD$10,000 cash to be used at winner’s discretion.

Prize redemption is subject to the booking terms and conditions notified to the prize winner at the time of booking and includes, without limitation, the following conditions:

The 2 adults participating the grand prize must travel at the same time.
Travel in connection with the grand prize cannot be taken during blackout dates as advised to the travellers (which includes, but is not limited to, Australian public holidays and school holidays).
The grand prize must be redeemed by 31 October 2015, and all travel in connection with the prize must be taken by 31 December 2016.

A.10 Prize Exclusions The following are not included in this prize and are the responsibility of the travellers:

Applicable taxes for the airfares (including any fuel surcharge) which are payable to the airline at the time of booking.
Incidentals, including, without limitation, the costs, and the obtaining, of a valid passport, and travel insurance.
In respect of the grand prize, spending money in addition to the $10,000 cash prize.
All airport transfers.

A.11 Prize Value and Numbers A total of seven (7) prizes will be awarded in connection with this promotion (being 6 prizes for the Weekly Rounds in Stage 1, and 1 grand prize at the end of the Race in Stage 2).
The total combined prize value is a maximum of AU$30,000.
A.12 Draws and Prize Winner Notification Stage 1: Weekly Round

(a) Draws will take place for each Weekly Round prize at the office of the Promoter set out in paragraph A.1 above on the following dates:

Week 1: 23 June 2014 at midday.
Week 2: 30 June 2014 at midday.
Week 3: 7 July 2014 at midday.
Week 4: 14 July 2014 at midday.
Week 5: 21 July 2014 at midday.
Week 6: 28 July 2014 at midday.

(b) The first valid entry randomly drawn from all valid entries for each of the Weekly Round prize draws, will win the Weekly Round Prizes described in paragraph A.9 above. Each valid entry has an equal probability of winning.
(c) All Weekly Round prize winners will be notified by e-mail using the contact details provided in connection with the entry within two (2) days of the relevant draw.
(d) The name of each Weekly Round prize winner will be published on www.expedia.com.au/westpac for a period of 28 days from 2 July 2014 in respect of Weeks 1 and 2, from 16 July 2014 in respect of Weeks 3 and 4, and from 30 July 2013 in respect of Weeks 5 and 6.

Stage 2: The Race
(a) The Team Leader of the first team to complete the Race will be notified in person at the conclusion of the Race on 31 July 2014, and will receive written confirmation of this within two (2) days.
(b) The name of the Grand Prize winner will be published on www.expedia.com.au/westpac for a period of 28 days from 5 August 2014. .
A.13 Redraws/Unclaimed Prizes (a) As the Weekly Round prizes must be taken before 31 July 2014, so that winners may attend the Race, in the event that a weekly prize winner fails to claim his or her prize by 5:00 pm AEST on 29 July 2014, the weekly prize winner will be deemed to have forfeited the prize and will not be entitled to any supplementary prize or benefit.

(b) If the prize is forfeited, the Promoter will conduct a random redraw in respect of that prize from all entries submitted during the Weekly Round attaching to that prize at 6:00 pm AEST on 29 July 2014 at the same location as the original draw. Disposal of any unclaimed prizes may be made subject to any written directions given by any government authority and pursuant to any relevant legislation.

(c) The unclaimed prize draw winner will be notified by email within 24 hours of the redraw, using the contact details provided by that person when entering the Promotion and the unclaimed prize draw winner will also be announced on www.expedia.com.au/westpac on that same date and displayed for a period of 28 days.

(d) In the event the Team Leader of the winning team of the Race fails to claim the Grand Prize by the time set out above, the Team Leader will be deemed to have forfeited said prize and will not be entitled to any supplementary prize or benefit.

(e) If the Grand Prize is forfeited, the Promoter will award the Grand Prize to the Team Leader of the runner-up team. The Team Leader will be notified in writing by email, using the contact details provided by each of those members when entering the Promoter, and will be announced on www.expedia.com.au/westpac on that same date and displayed for a period of 28 days.
A.14 Game of Chance and Skill The Promotion is a mixed game of skill and chance.

Part B – General Terms & Conditions

The Promoter reserves the right, at any time, to verify the validity of entries and participants in the Promotion (including an entrant’s identity, age and place of residence).
The Promoter may, at its absolute discretion, declare any or all entries made by you to be invalid if you:

fail to establish their entitlement to enter the Promotion to the Promoter’s satisfaction; or
submit an entry which is not in accordance with these Terms.
All entries and any content created and submitted in connection with the entries or the Promotion become and remain the property of the Promoter.
If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or who may benefit from such tampering and, subject to the approval of those authorities that have issued permits for the conduct of this Promotion, to cancel, terminate, modify or suspend the Promotion.
Without limiting paragraph B.4 above, if the Promoter becomes aware, or has reason to believe (in its reasonable opinion), that an entrant or a prize winner has:

created more than one eligible entry through the Promotion Page; or
otherwise engaged in conduct which impacts on the fairness, integrity or proper conduct of this Promotion,

the Promoter may, in its absolute discretion:
disqualify the entrant from the Promotion; or
in the case of a prize winner, declare the prize winner’s entry as void and select a new prize winner.

If a prize winner’s entry is declared void in accordance this paragraph, the prize winner will be deemed to have forfeited the prize and will not be entitled to any supplementary prize, benefit or compensation. The Promoter will then select a new prize winner of the forfeited prize.
In the case of any act, agent or event which prevents or hinders the Promoter’s ability to proceed with the Promotion on the dates and in the manner described in these terms and conditions, the Promoter may, in its absolute discretion but subject to the approval of those authorities that have issued permits for the conduct of this Promotion, to cancel, terminate, modify or suspend the Promotion cancel the Promotion.
All prizes awarded, and travel undertaken, in connection with the Promotion are subject to the standard terms and conditions applicable to such prizes and/or travel, as notified to you at the time of booking or at the time of redeeming the prize.
The prize winners consent to the use of their name, place of residence, travel destination, the travel-related item booked, likeness, image and/or voice (including photograph, film and/or recording of the same) for promotional and marketing purposes in any media for an unlimited period without remuneration. Prize winners agree to participate in reasonable promotional activities as requested by the Promoter.
Except with the written consent of the Promoter, prizes are not transferable or exchangeable and non-cash prizes cannot be taken as cash. The Promoter has absolute discretion as to whether it will provide such consent and need not provide any reasons to any person for providing or withholding consent.
In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.
To the maximum extent permitted by law, the Promoter excludes all liability (including negligence) arising out of or in connection with:

inaccurate / incorrect transcription of entry information;
purported entries that are not received for any reason, including because or any transmission errors or if they are misdirected or stolen;
any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;
the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website (including, without limitation, the Website);
any variation in the Terms;
any theft, unauthorised access or third party interference in any part of the Promotion;
electronic or human error which may occur in the administration of the Promotion;
any loss or damage (including loss of opportunity) suffered or sustained, to person or property and including, but not limited to, direct, indirect, special or consequential loss (including economic loss) by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a prize winner;
any injury or damage to persons or property, including to the participant’s or any other person’s computer related to, or resulting from, participation or downloading any materials in this Promotion.
A prize winner, and his or her team mates or guests (if any), must sign and return any liability release and indemnity provided by the Promoter and/or its contractors as a condition of a prize being awarded and adhere to all directions provided by the Promoter, including any Rules provided by the Promoter for the conduct of the Race.
The Promoter’s decisions in relation to all aspects of the Promotion are final and the Promoter will not enter into any correspondence.
Any taxes which may be payable as a consequence of a prize winner receiving a prize are the sole responsibility of the prize winner.
The Promoter collects personal information in order both to conduct the Promotion. The Promoter may disclose such information to third parties, including, but not limited to, prize suppliers, agencies associated with the Promotion, and to Australian regulatory authorities. Participation is conditional on providing this information. The Promoter and third parties to whom the Promoter provides this information may, for an indefinite period unless otherwise advised, use the information for announcing prize winners (name and suburb/postcode only) and for direct marketing, research and debt collection purposes. Participants in the Promotion should direct any request to access, update or correct information to the Promoter. By participating in the Promotion, Australian residents agree to use of their information in accordance with the Privacy Policy accessible at http://www.expedia.com.au/pub/agent.dll?qscr=hgen&hfnm=PrivacyPol.htx
All entrants in the Promotion acknowledge that:

the Promoter does not own or operate the website located at Expedia.com.au; and
the websites are owned and operates by Expedia, Inc, a company incorporated in Washington, USA.

Part C – Coupon Terms & Conditions

The coupon code is a single-use coupon and is offered by Expedia, Inc, a Washington corporation (“Expedia”).
The coupon code may be used to book one Expedia hotel or flight + hotel package booking online at www.expedia.com.au (“Website”) in accordance with all applicable:

booking dates;
travel dates;
required payment options;
other restrictions on use,

advised to you at the time of issuing the coupon code (together the “Redemption Requirements”).
The coupon code cannot be redeemed against flight only or car bookings. Provided that you make a new booking in accordance with the Redemption Requirements, the coupon code entitles you to the discount displayed with the coupon code, before the application of any taxes, applicable fees or additional costs. The coupon code may only be used in relation to a single booking. In the event that the entire value of the coupon code is not used in the single booking, the residual value of the coupon code is forfeited by the recipient, and the recipient will not be entitled to any monies, refund, further coupon code or any other compensation in respect of the residual value.
The coupon code may not be used:

when making a booking using the “pay at the hotel later” option; or
with other discount coupons, promotions or special offers.
The coupon code cannot be redeemed against taxes, supplier fees, cancellation or change penalties, administrative fees or other miscellaneous charges, which are the sole responsibility of the customer.
In relation to the Expedia Price Match, while the coupon code may be used in conjunction with a booking made once the Expedia call centre representative has confirmed the eligibility of a Price Match claim, the coupon code cannot be used to reduce the value of a booking for the purpose of making a Price Match claim.
A limit of one (1) coupon code may be used per person and per booking. The coupon code cannot be used for any booking previously made and will be deemed fully redeemed once a qualifying booking has been made.
The coupon code has no cash value and no refunds or cash alternative will be offered. Improper use of the coupon code by you including but not limited to publication or selling of the coupon code is prohibited and may constitute fraud.
All bookings are subject to availability, the Website Terms of Use and all applicable terms and conditions which would otherwise apply to that booking.
The coupon code may not be used by employees of Expedia group companies or any other person professionally connected with this promotion.
Expedia reserves the right to vary the coupon code conditions of use or to withdraw the coupon code at any time. Expedia’s decision is final in all matters relating to this promotion.
The coupon code is an offer from Expedia and may only be used by Australian residents aged 18 years and over. Expedia reserves the right to require coupon code recipients to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the discretion of Expedia.
If we become aware, or have reason to suspect (in our reasonable opinion), that you have:

made multiple bookings on the Website using the coupon with a view to re-selling any accommodation;
breached, or otherwise do not comply with, the Redemption Requirements or these Terms and Conditions; or
otherwise engaged in conduct which impacts on the fairness, integrity or proper conduct of this offer,
we may, in our absolute discretion, cancel all bookings made by you using the coupon code and/or cancel the coupon code.
In the event that:

the booking made using the coupon code is cancelled for any reason; or
the coupon code is cancelled pursuant to these terms and conditions,
the full value of the coupon code is forfeited by the recipient, and the recipient will not be entitled to any monies, refund, further coupon code or any other compensation in respect of the coupon code.
To the maximum extent permitted by law, Expedia excludes all liability (including negligence) arising out of or in connection with:
any problems or technical failures of any kind, including malfunction of any telephone network or lines, computer online systems or network, servers or providers, computer equipment, or software;
the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website;
any variation in of these terms and conditions;
electronic or human error which may occur in the administration of the Promotion or the prize(s); and
any loss or damage suffered by any person redeeming the coupon code and/or their accompanying traveller (if applicable) in connection with their redemption of the coupon code or any travel or other activities associated with the booking.
Coupon code is void where prohibited or restricted by law.
These coupon code terms and conditions shall be governed by and construed in accordance with the laws of New South Wales, Australia. All parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
