1. Introduction
1.1 These terms and conditions (Terms) apply to the Containers for Change Swan
Competition (Competition).
1.2 By submitting an entry into the Competition, entrants represent and warrant that they
have read, understood and agree to be bound by these Terms.
2. The promoter of the Competition is WA Return Recycle Renew Ltd ACN 629 983 615
(Promoter) of Unit 2, 1 Centro Avenue, Subiaco, Western Australia.
2.1 These Terms will be published on the Promoter’s website: https://cfcswan.com.au
(Website).
3. Duration
3.1 The Competition will commence at 9.00am (AWST) on Saturday, 19 September 2020
and all entries must be received before 11.59pm (AWST) on Wednesday 30 September
2020 (Competition Period).
4. Eligibility
4.1 Entry to the Competition is only open to individuals who are, at the time of entry:
(a) a permanent resident of Western Australia; and
(b) at least 18 years of age.
4.2 The following persons are ineligible to participate in the Competition and may not
redeem any prizes offered in the Competition:
(a) employees and the immediate families of the Promoter, its related bodies
corporate, Competition sponsors and the suppliers of Competition prizes;
(b) a person who uses or attempts to use more than one name in entering the
Competition;
(c) a person whose entry is incomplete or incomprehensible or whose entry, in the
opinion of the Promoter, includes any content which may be or is unlawful,
profane, inflammatory, defamatory and/or damaging to the goodwill or
reputation of the Promoter; and
(d) a person who breaches any of these Terms.
4.3 The Promoter reserves the right to verify the validity of entries and to disqualify the entry
of any person who, in the opinion of the Promoter, is ineligible to participate in the
Competition under clause 4.2 above.
4.4 The Promoter reserves to the right to disqualify any entrant who, in the in the opinion of
the Promoter, tampers with the entry process, submits an entry that is not in accordance
with these Terms, or who has, in the opinion of Promoter, engaged in conduct in
entering the Competition which is fraudulent, misleading, deceptive or damaging to the
goodwill or reputation of the Competition or the Promoter. The Promoter reserves the
right to disqualify a winner if the Promoter becomes aware that the winner or the
winner’s entry is of a type described in this clause.
5. Method of Entry
5.1 To enter the Competition, entrants must register at the Website by providing the
following information:
(a) first and last name;
(b) email address; and
(c) suburb or postcode.
5.2 Entries received after the end of the Competition Period will be deemed invalid and will
not be eligible for any prize.
5.3 If an entrant’s contact details change during the Competition Period, it is the entrant’s
responsibility to notify the Promoter of that change.
5.4 The entrant is responsible for the accuracy of their entry details.
5.5 The Promoter has no responsibility or liability for lost or misdirected entries.
6. Number of Entries
6.1 Each entrant is only entitled to:
(a) one entry in the Competition; plus
(b) an additional entry for a chance to win the grand prize (but not to win any
instant prizes) if the entrant shares the promotion on Facebook pursuant to the
link on the Website; plus
(c) an additional entry for a chance to win the grand prize (but not to win any
instant prizes) if the entrant shares the competition URL pursuant to the link on
the Website; plus
(d) an additional entry for a chance to win the grand prize (but not to win any
instant prizes) if the entrant visits the Containers for Change WA website
pursuant to the link on the Website; plus
(e) an additional entry for a chance to win the grand prize (but not to win any
instant prizes) if the entrant clicks the link to the Containers for Change
Instagram page (@4changeWA) pursuant to the link on the Website.
6.2 The Competition is in no way conducted, sponsored, endorsed or administered by, or
associated with, Facebook, Instagram or Twitter or other third party social media
platform.
7. Selection of Winners
7.1 A total of 60 (sixty) instant prizes of $100 will be selected by chance by the Promoter
during the Competition Period.
7.2 The Promoter will select a single grand prize winner by chance on 1 October 2020.
7.3 The Promoter’s decision on all winners is final and the Promoter will not enter into
correspondence regarding the Competition result.
7.4 A winner of an instant prize of $100 is not eligible to be selected as the winner of any
other instant prize but is eligible to be selected as the winner of the grand prize.
7.5 Prize winners acknowledge and agree that tax implications may arise from their prize
winnings and they are responsible for seeking independent financial advice prior to the
acceptance of the prize.
8. Prize Details
8.1 The winner of the grand prize will receive $10,000.00 in cash.
8.2 The winner of each instant prize will receive $100.00 in cash.
8.3 The entitlement to a prize is not transferrable.
9. Notification
9.1 Subject to a prize winner having provided the Promoter with accurate contact details,
the prize winner will be notified by email within 24 hours of their selection as a winner.
10. Prize Collection
10.1 The $100.00 instant prizes will be paid to winners no later than 11.59pm on Friday 30
October and will receive the money via a digital pre-paid gift card sent to the email
address provided upon entry.
10.2 The $10,000.000 will be paid to the winner no later than 11.59pm on Friday 30 October
2020 by electronic transfer into such bank account as is nominated in writing by the
winner to the Promoter.
10.3 The Promoter reserves the right to require winners to provide, to the satisfaction of the
Promoter in the Promoter’s absolute discretion, proof of age, identity, residency and/or
other proof of entry validity. In the event that a winner cannot provide such proof, the
winner will forfeit the prize in whole and no substitute will be offered.
10.4 If:
(a) the Promoter cannot contact a winner; or
(b) a prize has not been claimed by the winner; or
(c) in respect of the grand prize, the winner has failed to provide the Promoter with
account details for payment, or
(d) in respect of an instant prize, the winner has failed to provide the Promoter with
a valid email address to which the digital pre-paid gift card can be sent,
by 5pm AWST on Friday 30 October 2020 the relevant prize will be forfeited to the
Promoter and that winner will have no claim or recourse against the Promoter in relation
to the forfeited prize.
11. Copyright and Publicity
11.1 All entrants in the Competition agree that if they are selected as a winner of the
Competition, the Promoter may use and publicise their names, likenesses, images
and/or voices and their winning amount in any media for an unlimited period without
remuneration for the purpose of promoting the Competition (including any outcome),
and promoting the Western Australian container deposit scheme.
12. Liability
12.1 To the extent permitted by law, all entrants release the Promoter from, and indemnify
the Promoter against, all liability, cost, loss or expense arising out of acceptance of any
prize(s) or participation in the Competition including (but not limited to) loss of income,
loss of opportunity, personal injury and damage to property, whether direct or
consequential, foreseeable, or due to some negligent act or omission or otherwise.
13. Privacy
13.1 By providing the Promoter with personal information, each entrant agrees with the terms
of the Promoter’s privacy policy which can be found at: https://warrrl.com.au/privacy-
policy.
13.2 Each entrant consents to the Promoter using the entrant’s personal information for the
purposes of contacting the entrant to advise about the entrant’s success or lack of
success in participating in the Competition.
13.3 Each entrant consents to the Promoter, after the completion of the Competition using
the entrant’s personal information for the purposes of periodically contacting the entrant
in relation to the Western Australian container deposit scheme.
13.4 Upon contact, each entrant will have the option to opt out of future communications from
the Promoter.
14. Failure to Enforce Terms
14.1 A failure by the Promoter to enforce any one of these Terms in any instance will not give
rise to any claim or right of action by any other person or entrant. The Promoter will not
enter into correspondence in relation to such matters.
15. Amendment of Terms and Termination of Competition
15.1 Subject to first obtaining the written approval of the Commission under the Gaming and
Wagering Commission Act 1987 (WA), the Promoter may at any time and in its absolute
discretion:
(a) amend these Terms; and/or
(b) terminate this Competition.
15.2 If the Competition is terminated before the end of the Competition Period, the Promoter
will not award any prize that, at the date of termination, has yet to be drawn.
16. Further Terms and Conditions
16.1 These Terms are governed by the laws in force in Western Australia.
