Conditions of Participation
Article 1 Online Game
The Comité interprofessionnel du vin de Champagne (hereafter referred to as « Comité
Champagne »), located at 5 Rue Henri Martin, 51200 Épernay, France, will be putting in place an
online game with the help of the digital communications agency Vanksen.
The online game, entitled « Champagne Day 2017 », is a free online prize draw, entailing no
obligation to purchase, which will be held from the 12th of October 2017 to the 20th of October 2017.
This online game will be free, and without any obligation to purchase. The game will allow the user,
either through the Comité Champagne’s website or Facebook page (or the Bureaux de Champagne
website or Facebook pages) to participate in an online prize draw which allows participants the chance
to win a one-off meal in a partnering restaurant (the complete description of the endowment is
available in article 4 of this regulation).
The online game will be accessible through a tab on either the Comité Champagne Facebook page, or
any of the Bureaux de Champagne Facebook pages (www.facebook.com/ChampagneOfficialPage,
www.facebook.com/ChampagneBureauDE/, www.facebook.com/champagne.benelux,
www.facebook.com/champagnebureauaustralia, www.facebook.com/ChampagneBureauItalia/,
www.facebook.com/champagnebureauUK, www.facebook.com/champagne.jp/. The game will be
made available via a customized tab, developed by the Comité Champagne and Vanksen, on a
dedicated Facebook application and on the Comité Champagne’s website
(https://www.champagne.fr/).
It is specified that the online prize draw is developed and managed by the Comité Champagne,
excluding any sponsorship or intervention from Facebook Inc, which is merely being used to host the
game through its platform (hereafter referred to as the Platform).
The present document constitutes the regulations of the Online Prize draw, referred to hereafter as
‘The Regulations’. This document may be completed and/or modified at any point during the online
game, with any additional clauses coming into effect immediately on the basis of their online
publication by the Comité Champagne.
Upon accessing and registering for the Game, participants are deemed to have read, understood, and
accepted – without reserve – the Regulations in their entirety, especially the article which relates to
personal data.
The entirety of the aforementioned articles will be made accessible and available to any user and
participant for the duration of the Game. It is asked that they save a copy and/or print of these texts in
order to be able to refer to them if and when necessary.
Article 2 Participants
The Game will be open to any natural or legal person who is over 18 years of age upon participating.
Participants must be domiciled in the following countries: France, Luxembourg, Belgium, Italy,
Netherlands, Japan, Australia, United Kingdom, Germany, Austria.
Access to the online game is forbidden to Comité Champagne staff and Bureaux du Champagne staff
abroad, as well as members of the Comité interprofessionnel du vin de Champagne, and any natural
or legal person having worked on or currently working on the organization of the online Game,
including any close family member of any one of these people (e.g. spouse, cohabitee, child,
sister, brother, parent, registered partner).
Article 3 Participation
3.1 To take part in the Game, the participant must fill in all of the fields which are compulsory to
their registration. By participating in this prize draw, the participant accepts the participation
conditions completely and without reserve. The participant can only participant in the Game
once.
In order to ensure that each participation conforms with the Game regulations, the Comité
Champagne reserves the right to use technical or management measures (e.g. limiting each IP
address or email address to a single and unique participation). The Comité Champagne may
not be held accountable or responsible for any participation which is refused, not possible, or
not registered.
3.2 The participant accepts that within the context of this Game, their personal details and data will
be collected and used by the Comité Champagne, the Bureaux du Champagne abroad and/or
partner organisations specially authorized in conformity with data protection laws.
3.3 In addition to this, the participant agrees to:
Not cause any malfunctioning or interruption of the system which links the network or
the servers of third parties to the website.
Conform with the entirety of regulations, codes of conduct and procedures of internet
use.
Not attempt to infiltrate IT systems without authorization.
Not disrupt the utilization or operation of the website or any other similar service.
Not take the identity of a third person and not use a fake name.
Respect the legal provisions (especially those which are linked to the Evin act).
Not use any means, technological or otherwise, (e.g. the use of groups of votes on
social networks) to increase theirs or any other person’s chances of winning.
Any person who violates these obligations or adopts a behaviour which is similar to the above
can be excluded and/or lose the right to obtain the winning prize. The Comité Champagne also
reserves the right to take legal or administrative measures if this behaviour infringes or
prejudices the law.
3.4 The Comité Champagne is free to cancel all or part of the online game in case of irregularities,
especially by means of computer telecommunications and/or electronic technology, when it
comes to game participation or choosing winners. In this eventuality, the Comité Champagne
reserves the right to exclude these participants from the game and to not award them with their
prizes.
3.5 Clause regarding copyright law, in the event of a participant contribution.
The participant confirms that he or she is the sole author of the contribution which they post on
the website. The participant also confirms that they have not handed over the exclusive or non-
exclusive right of exploitation to third parties, discharging the organizer Comité Champagne
from any claim or complaint bearing on the tangible or intangible ownership of the contribution.
In addition, the participants confirms that they have the necessary rights for the diffusion and
publication of their contribution, especially if this exposes third parties. Under no circumstances
will the Comité Champagne be held responsible for the violation of rights belonging to a third
party for which it has no knowledge of the existence or degree. The participant commits to
respecting the legal requirements (especially those which relate to the Evin Act).
The participant agrees to relinquish all the rights of use for their contribution to the Comité
Champagne. Audiovisual, visual, or editorial contributions must not contain any element which
goes against laws and morality, especially in being offensive to humans and animals. If the
quality of the contribution submitted is insufficient, it may be excluded from the game.
Article 4 Prizes
4.1 For every country, one meal for 2 (two) people in a gourmet restaurant, chosen by the Comité
Champagne or one of the Bureaux de Champagne, with a value of 500€ (five hundred euros)
will be given for each country in the following list: France, Luxembourg, Belgium, Italy,
Netherlands, Japan, Australia, United Kingdom, Germany, Austria.
The winner will choose the date of the meal from a selection of dates which will be suggested to
them by the Comité Champagne or the Bureaux du Champagne. The price will include the meal
and drinks. Travelling costs remain at the expense of the winner.
4.2 Winners will be determined through a prize draw, between one to three working days after the
closing of the online game. This prize draw will be made from the database of users who
participated in the game having fulfilled all the required conditions as denoted in articles 2 and
3, as well as having responded to all questions correctly.
4.3 The prizes cannot be converted into or exchange for cash. The Comité Champagne can at any
given moment decide to replace the prizes by another prize of equivalent value.
4.4 The Comité Champagne and its suppliers do not accept any responsibility in the event that a
prize is not awarded for reasons which are outside of their control (winner’s details are incorrect
or incomplete, losses, postal strikes, etc). In addition, if the winner does not respond within 6
months of having been notified that they have won, they will irrevocably lose their right to collect
the prize which they won.
4.5 The winner is responsible for collecting their prize and assume any consequences of this. Any
charges, taxes, or fees related to the winning of a prize will be charged to the winner.
4.6 The Comité Champagne reserves the right to verify the veracity of information which has been
entered during the attribution of prizes. Prizes will only be given to participants whose details
are accurate. Participants commit to not usurping any other individual’s identity, or use fake
names. Where applicable, the Comité Champagne reserves the right to not give them a prize.
4.7 Winners will be notified via email.
Article 5 Responsability
5.1 The Comité Champagne reserves the right to shorten, prolong, modify, or cancel all or any part
of the online game if circumstances oblige them to do so. They will not be held responsible for
this and no compensation shall be paid nor may any be claimed in this regard.
5.2 The Comité Champagne reminds participants of the characteristics and limits of internet access
and refuses any responsibility in the consequences of participants connecting to this network via
partner websites.
5.3 In addition, the Comité Champagne will not be held responsible for material or immaterial
damage caused to participants, their computer equipment, or the data which is stored therein,
nor for the consequences which this might have on their personal, professional, or commercial
activities. As regards the usage of this site (navigation, voting process), participants agree that
they will not share any content of this website on third party websites.
5.4 The Comité Champagne will not be held responsible in the event that one or multiple
participants cannot register on the website www.champagne.fr or participate in the online game
due to technical difficulties or problems which relate to network congestion.
The Comité Champagne will not be held responsible for:
-Computer or network congestion problems which could limit, slow down, or disrupt connection,
telephones, telephone lines, telephone systems, website traffic, or the internet.
-Technical or mechanical malfunctions
-Hard-drive or software malfunctions
-Any other malfunctions
-Errors caused by equipment, programming, human error, or any other reason.
-Damage to the participants or any other person’s computer resulting from their participation in the
online game.
Article 6 Jurisdiction and Applicable Law
In the case of a dispute concerning the interpretation and application of the present participation
conditions, an amicable solution will be sought after. In the event that an amicable solution cannot be
found, the for est is in France. French law is applicable.
