Coates Hire ‘Leaderboard’ Challenge Terms & Conditions (“Conditions of Entry”)
Note: Any capitalised terms used in these Conditions of Entry have the meaning given in the following table, unless stated otherwise.

Promotional Period:
Start Date: 12.01am AEDT on 20th February 2017
End Date: 11:59pm AEDT on 26th November 2017 or once 100,000 entries are received (whichever is first to occur).

There is up to a maximum of 100,000 entries allowed across the total Promotional Period (collective across all 15 Events), once all entries are fulfilled the Promotional Period will close, even if the total 15 Events and/or the Promotional Period has not elapsed. The Promoter may at its discretion accept more than 100,000 entries if they obtain the 100,000-entry cap is reached before the close time of 11.59pm AEDT 26/11/17. However, the Promotion will end no later than 11.59pm AEDT 26/11/17.

Eligible entrants:
Entry is only open to Australian residents who are 16 years and over. Entrants under 18 years of age must obtain parent or legal guardian approval to enter this Promotion.
How to Enter:
To enter the Promotion, an entrant must complete the following steps during the Entry Period for a respective Event (subject to the closing time restrictions outlined in the Promotional Period definition above):
a) Visit www.coateshire.com.au/leaderboardchallenge prior to the commencement of the relevant Event; and
b) Guess the Top 10 Finishing order of the respective Specific Event Race for the Event, provide the requested personal details and submit their guesses.
Entries permitted:
Multiple entries into the Promotion are permitted per person, however:
(a) Only one (1) entry is permitted per person, per phone number and per email address for each
Event; and
(b) Each entry must be submitted separately and in accordance with the entry instructions.

Winner Determination:
Each entrant that correctly selects the Top 10 Finishing order for a Specific Event Race will be deemed a winner (and notified at the conclusion of the Promotional Period, or once 100,000 entries are received (whichever is first to occur).
Final race results of a Specific Event Race as at 8pm (VIC time) on the day following the Specific Event Race will be used to determine the winners for this Promotion.
In the event that a participant in a Specific Event Race is disqualified for any reason or any other issue occurs which results in the Top 10 Finishing order being different after 8pm (VIC time) on the day following the Specific Event Race from the Top 10 Finishing order as at 8pm (VIC time) on the day following the Specific Event Race, those results established after 8pm (VIC time) on the day following the Specific Event Race will not be referred to in determining the winners for this Promotion.
If there are any delays with the first announcement of the results of a Specific Event Race, which results in no official race results being announced until after 8pm (VIC time) on the day following the Specific Event Race, the official results first announced by the Specific Event Race organisers after this date/time will be used to determine the Promotion winner for that respective Specific Event Race.
Total Prize Pool:
AUD$100,000
Prize:
The prize received by each winner will be a portion of $100,000, which will be determined by the number of Promotion winners. (For example, if there are 15 winners across all 15 Events, each winner will receive 1/15 of $100,000 (which in this example would be $6,666.67)).
For clarity, if 1 entrant successfully guesses the top 10 Finishing order for 2 Specific Event Races and there is 1 other winner, they will receive 2/3rds of the $100,000 prize, while the remaining 1 other winner will receive 1/3rd of the $100,000 prize.
No part of this prize is exchangeable or transferable.
The winner must provide their bank account details to the Promoter. The prize will be awarded to the winner’s bank account within 20 calendar days after their bank account details are provided to the Promoter. Winners are responsible for any tax on winnings where applicable.
Winner notification:
The Promotion winner(s) will be contacted by email and phone within 48 hours of the end of the Promotion (by 29th November 2017, 11.59pm AEST). The winner(s) will be published in The Australian newspaper on 14th December 2017.
1. The entrant agrees and acknowledges that they have read these Conditions of Entry (including Schedule) and that entry into the Promotion is deemed to be acceptance of these Conditions of Entry (including Schedule).
2. The Promotion commences on the Start Date and ends on the End Date (“Promotional Period”). Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission or deposit by the entrant. Records of the Promoter and its agencies are final and conclusive as to the time of receipt.
3. Valid and eligible entries will be accepted during an Entry Period (subject to the entry closing time restrictions specified in the Promotional Period definition above).
4. Employees (and the immediate family members) of agencies/companies directly associated with this Promotion, the Promoter, its distributors, suppliers, subsidiary companies/businesses and associated companies and agencies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
5. All reasonable attempts will be made to contact each winner.
6. If an Event is cancelled for any reason, then there will be no Promotion winner for that respective Event.
7. If any winner chooses not to take their prize (or is unable to), or does not take or claim a prize by the time specified by the
Promoter, they forfeit the prize and the Promoter is not obliged to substitute the prize.

8. No entry fee is charged by the Promoter to enter the Promotion.
9. Each prize will be awarded to the person named in the respective winning entry and any entry that is made on behalf of an
entrant or by a third party will be invalid. If there is a dispute as to the identity of an entrant or winner, the Promoter
reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
10. An Entry and any copyright subsisting in an Entry irrevocably becomes, at time of entry, the property of the Promoter.
Entrants’ personal information will be collected by the Promoter. Personal information will be stored on the Promoter’s database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at http://www.coateshire.com.au/privacy-policy. The Promoter’s privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants’ personal information to third parties including its contractors and agents, prize suppliers, service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Unless otherwise indicated by the Promoter, the Promoter may disclose entrants’ personal information to entities outside of Australia, and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the Promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
11. For the purposes of public statements and advertisements, the Promoter may only publish the winner’s surname, initial and State/Territory or postcode of residence.
12. It is a condition of accepting the prize that a winner may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize.
13. Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Competition and Consumer Act 2010 (Cth).
14. If for any reason any aspect of this Promotion is not capable of running as planned, including by reason of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter, the Promoter may in its sole discretion cancel, terminate, modify suspend the Promotion and invalidate any affected entries, or suspend or modify a prize, subject to State or Territory regulation.
15. ThePromoterreservestheright,atanytime,tovalidateandchecktheauthenticityofentriesandentrant’sdetails(including an entrant’s identity, age and place of residence). In the event that a winner cannot provide suitable proof as required by the Promoter to validate their entry, the winner will forfeit the prize in whole and no substitute will be offered. Incomplete, indecipherable, inaudible, incorrect or illegible entries, as applicable, may, at the Promoter’s discretion, be deemed invalid and not eligible to win. Entries containing offensive or defamatory comments, or which breach any law or infringe any third- party rights, including intellectual property rights, are not eligible to win. The use of any automated entry software or any other mechanical or electronic means that allows an individual to automatically enter repeatedly is prohibited and may render all entries submitted by that individual invalid.
16. ThePromoterreservestherighttodisqualifyentriesintheeventofnon-compliancewiththeseConditionsofEntry.Inthe event that there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
17. ThePromoteranditsassociatedagenciesandcompanieswillnotbeliableforanyloss(including,withoutlimitation,indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or willful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

18. The entrant will participate in and co-operate as required with all reasonable marketing and editorial activities relating to the Promotion, including (but not limited to) being recorded, photographed, filmed or interviewed and acknowledges that the Promoter may use any such marketing and editorial material without further reference or compensation to them.
19. The Promoter accepts no responsibility for any tax implications and the entrant must seek their own independent financial advice in regards to the tax implications relating to the prize or acceptance of the prize.
