Channel Nine AFL Footy Show – Win $45,000 and $5,000 Home Timber & Hardware voucher (submit video)

These rules (as changed or supplemented by Nine from time to time in its discretion) will apply for the clips competition of Almost Football Legends to be conducted by Nine and incorporated into the television program known as The Footy Show
CONDITIONS OF ENTRY (“THE RULES”)
1) Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions
2) By submitting an entry in the Program, all Entrants warrant to the Promoter that each visual entry media submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
3) All entry media submitted becomes the property of Nine Network. As a condition of entering into this promotion, each entrant agrees to assign all of their rights (future and present), title and interest (including copyright) in and to their entries to the Nine Network.
4) The promoter will not be liable for any breach of copyright. The entrant will be solely responsible for their own entry and the consequences of submitting them. The entrant represents and warrants that to the Promoter that the submitted entry is their own and:
a) they own or have all necessary licences, rights, consents and permissions to use and authorize the Promoter to use the entry to enable inclusion and use of the entry in the manner contemplated by these terms and conditions; and
b) they have the written consent, release, and/or permission of each and every identifiable individual person appearing in the entry to use the name or likeness of each and every such identifiable individual person (including if the individual is a child – the child’s parent or legal guardian) to enable inclusion and use of the entry in the manner contemplated by these Terms and Conditions.
5) All decisions relating to the conduct of the Program and Promotion, including, but not limited to, the selection of any and all parts of an entry to be broadcast, and the awarding of prizes, are at the sole and exclusive discretion of Promoter and are final and not subject to appeal. The judge’s decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into.
6) Failure to comply with any term or condition may result in disqualification and/or forfeiture of Prizes at the Promoter’s sole discretion.
7) This is a game of skill and chance plays no part in determining the winner/s. Each entry of the Almost Football Legends competition will be individually judged based on but not limited to talent, entertainment and creative merit. The Almost Football Legends entry can include but not limited to goals, marks or other moments during or involving an AFL match, training or activity that are deemed to be of high excellence, humour or general entertainment to viewers. All decisions made by the promoter will be deemed final.
ELIGIBILITY
8) Entry is open to all residents of Australia aged 18 years and over except employees of the Promoter and their immediate families, associated or otherwise connected with the prize suppliers.
9) At the Promoter’s absolute discretion, any entries which have previously been broadcast on the Program prior to the 06 March 2014 are not eligible entries into the Promotion.
METHOD OF ENTRY
10) To enter, Participants must record a video (maximum 90 seconds) of an “Almost Football Legend” moment of an amateur AFL Player. Entries must be submitted on either DVD or VHS to:

Entrants must include their full name, address, daytime and evening telephone number, and name of their nominated football club with their entry.
All files must be in MP3, MP4 or Video format
OR
Participants can log onto the website www.ninemsn.com.au/footyshow and follow the prompts to the competition page & upload a video (maximum length of 90 seconds )
All files must be in MP3, MP4 or Video format Entries must be limited to under 6MB
AND must not be:
Late;
Delayed;
Incomplete;
Incomprehensible; Unlawful;
Obscene;
Defamatory;
Libelous;
Threatening;
Pornographic;
Harassing;
Hateful;
Racially or ethnically offensive;
Capable of encouraging of conduct that would be considered a
criminal offence;
Capable of violating any law
Capable of giving rise to civil liability
11) The Promoter accepts no responsibility for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever. Entrants should not send in original copies/master copy of their DVD’s. No responsibility will be taken by the promoter in the event that the original entry is lost or damaged in editing.
12) Multiple entries are permitted, but each entry must be unique and submitted individually. DVD footage should be no longer than 90 seconds duration. Judges will cease viewing entries at the 90 seconds cut off.
13) Entry is free, however postage fees may apply. Postage fees vary and are subject to the location of the sender and the Australia Post rate of postage at time of sending. Entrants are advised to contact Australia Post for rates of postage at the time of sending.
14)It is the entrant’s responsibility to ensure that they do not send in original copies/master copy of their DVD’s as entries will not be returned.
15) The Promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry and to use any of the entries submitted for any purposes at its discretion, including for any future promotion, marketing and publicity purposes.
16) The Entrant acknowledges that their entry may be broadcast on the Nine Network together with their name and communicated on the internet for the promotion of the AFL Footy Show and the Nine Network generally.
17) The Entrant acknowledges that the Promoter will determine the time and date of broadcast of the entry, if any, at its absolute discretion. Broadcast of an entry (including but not limited to creative control) will remain at the complete discretion of the Promoter.
PROMOTION PERIOD
18) The Promotion commences on Thursday 6 March 2014 at 00:01 AEDST and final entries close Wednesday 17 September 2014 at 17:00 AEDST. All times are
AEST and AEDST during daylight savings periods in NSW. The Judging will take place at The Nine Networks premises at 717 Bourke St, Docklands VIC throughout the promotional period. Winners from all entry periods as stipulated in Table A below will be notified by phone, mail and on-air and have their details published in the Australian on the date indicated also within Table A below.
19) No responsibility accepted for late, lost or misdirected entries. Incomplete, inaudible or indecipherable entries will be deemed invalid.
20) For the removal of doubt, entrants only need to submit their entry once for it to be considered for the entire Promotion Period.
21) Judging for entries closes weekly as per Table A below, with all entries received up until the 17:00 AEST/AEDST on the Entry Close date (including entries that have not yet been deemed finalists) being entered into the Weekly Judging Period.
22) In the event that the scheduled episode is not broadcast at all during a week, the competition will not be commenced or announced to viewers and the prize for the AFL Almost Football Legends will not be awarded. In the event the broadcast time for a scheduled episode is changed, the competition start and end times for those episodes will be moved in line with the new broadcast times for that episode. The total time available for viewers to enter will remain the same, with the close time being advised during the broadcast.

23) All entries received up until each entry period closing time will be entered into the Weekly Judging. For the removal of doubt, this includes any entries received in previous weeks but which were not selected as Weekly Finalists. If you do not wish for your entry to be carried over into any judging period, please notify the Promoter in writing prior to your entry being broadcast.
24) All entries are deemed to be received at the time of receipt by the Promoter and NOT at the time of being sent by the entrant.
JUDGING AND PRIZES
WEEKLY PRIZES
25) The best three (3) entries as judged by a panel of judges each week appointed by the promoter, as per the criteria stipulated in clause 7 will be deemed Weekly Finalists. For the removal of doubt, all weekly finalist winners will be deemed to be the individual person whom has submitted the entry to the competition. Weekly Finalists will be broadcast on an episode of the AFL Footy Show as per the Winner Announced / Broadcast Date in Table A above.
26) The weekly winner (“weekly winner”) that is selected as the best entry from all three (3) Weekly Finalists will receive a $1000 – awarded in the form of a cheque made in favour of the winner.
The next two (2) best entries as determined by the judges will be deemed the runner’s up finalists and will receive $500 – awarded in the form of a cheque made in favour of the winner.
The total Weekly Finalist Prize Pool over the promotional period is valued at up to $56,000 inc. GST, (to be distributed over 28 weeks, with 1 Weekly Winner per week and 2 weekly runner’s up per week).
27) Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way.
28) For the removal of doubt the maximum number of weekly finalists is limited to three (3). The best entry as judged by the promoter from all weekly finalists will be deemed the Weekly Winner. The maximum value of prizes to be awarded to the weekly finalists is $56,000 which will be divided over the 28 weeks the show is scheduled to run.
29) For the removal of doubt, the Promoter reserves the right to record/broadcast more than three (3) entries per episode of the Program but only three (3) entries will be deemed Weekly Finalists. A broadcast of an entry does not automatically deem that entry to be a Finalist. Determination of finalist status is determined by the Promoter in its complete discretion.
MAJOR PRIZE
30) From the 19 September 2014 all “weekly winners” entries will be entered into the Grand Final Judging. Grand Final Judging will be conducted by the Promoters based the judging criteria as stipulated within clause 7.
31) The best entry from all “weekly winners”, as determined by the judges will be deemed the Grand Final Winner and win the following Major Prize.
The Grand Final Winner will receive:
$45,000 – awarded in the form of a cheque made in favour of the winner. $5,000- Home Timber and Hardware Voucher
Total prize pool is valued at up to $50,000
32) It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion. Liability for any tax arising out of participation in this promotion (including acceptance of a
prize) is the sole responsibility of the entrant. Entrants should seek independent financial advice in this regard.
GENERAL CONDITIONS
33) It is a condition of entry that all entrants agree acknowledge that by virtue of participating, their recording, images, voices, and any or all part of their entry may be put live on air during the Program and consent to such recording and airing. Entrants acknowledge that although there is no obligation upon the Promoter to use such recording(s), images or footage, if the Promoter elects to do so, the winner consents to the Promoter using their name, image, likeness and/or voice in any media for the purpose of promoting this competition, (including any outcome), The Program or the Promoter itself, for an unlimited period of time without remuneration.
34) If in the Promoter’s sole discretion an exigent circumstance has occurred, the Promoter reserves the right to reschedule a Weekly Winner to a future episode of the Program.
35) Any Entrant who provides incomplete or incorrect information may be disqualified.
36) Any person attempting to defraud or in any way tamper with the Program or any aspect thereof, will be disqualified and may be subject to both civil and criminal proceedings and may also be prosecuted to the full extent of the law.
37) If for any reason the Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Program, the Promoter may suspend or end the Promotion, and reserves the right to:
i. disqualify any individual who tampers with the entry process; and
ii. re-do any part of the Program again.
38) All Participants acknowledge and agree that they have no claim against the Program in the event that (i) and/or (ii) occur.
39) The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process
40) The promoter is not responsible for any error, omission, interruption, deletion, defect in operation or transmission, communications line failure, theft, destruction or unauthorized access to, or alteration of entries occurring in relation to the conduct of the Promotion.
41) Entry details remain the property of the Promoter. Entrants’ personal information will be collected by the Promoter for the purpose of conducting and promoting this Competition (including for the purpose of identifying and notifying winners).
Without limiting the foregoing, the Promoter may disclose entrants’ personal information to other parties assisting in the administration of the Competition including to the Promoter’s related entities, prize suppliers, external service providers and authorities that regulate this Competition. If the entrant consents, the Promoter, its related entities and business partners (as applicable) may also use the entrant’s personal information for the purpose of sending direct marketing messages with respect to programs, products and services available through any or all of them. Nine will handle the entrants’ personal information in accordance with Nine’s Privacy Policy which is available on its website. 42) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; (f) participation in the promotion and/or (g) redemption of the prize.
43) The Promoter reserves the right to review these Conditions of Entry at any given time and the Conditions of Entry for any given episode will be governed by the most recent version of these Conditions of Entry as available prior to recording and/or broadcast of that episode of the Program.
