Entry Restrictions Open only to Australian residents who:

are aged 18 or over;
are able to take the prize in February and/or March 2015 on dates to be advised by the Promoter; and
hold a current and valid Australian driver’s licence.

Directors, officers, management and employees (and the immediate families of directors, officers, management and employees) of the Promoter or of the agencies or companies associated with this competition (including principals or staff members of venues or outlets in Australia who have been invited by the Promoter to enter the Cape Mentelle Coast House Trade Incentive Promotion) are not eligible to enter.

Prize Pool The total prize pool is valued at up to $8,950 (inc GST).
Entry Limits Limit of 1 entry per person.
Winner Notification and Publication The winner will be notified by phone and in writing within two days of the draw and their name and state/territory of residence will be published in The Australian on 19/12/14.
Prize Claim Date and Time The prize must be claimed by 5pm (AEDT) on 31/12/14.
Unclaimed Prize Draw Details 12.00pm (AEDT) on 02/01/15 at the same location as the original draw.
Unclaimed Prize Draw Winner Notification and Publication Any winner in the Unclaimed Prize Draw will be notified by phone and in writing within two days of the Unclaimed Prize Draw and their name and state/territory of residence will be published in The Australian on 09/01/15.

The competition will be conducted during the Competition Period.
Entries must be received during the Competition Period. Entries are deemed to be received at the time they are received by the Promoter’s database and not at the time of submission by the entrant. The Promoter has no control over communications networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. Entrants who enter using multiple email addresses or aliases may be disqualified. Consumers are responsible for their own costs associated with accessing the Internet. Automatically generated entries may be disqualified.
The Promoter is not liable for late, lost, incomplete, misdirected, incorrectly submitted, delayed or illegible entries, correspondence or claims for prizes due to error, omission, tampering, theft, destruction or otherwise.
The draw will be conducted at the time, on the date and at the location as stated in the Draw Details.
The prize is as stated in the Prize Details and consists of the following for the winner and their companion:
return transfers between the winner’s place of residence and their closest Australian capital city airport (maximum distance for transfers is 100km);
return economy airfares (including airfare taxes) from the winner’s nearest Australian capital city to Perth, WA (flights are not included if the winner resides in WA);
car hire or other transport arrangements for transfer between Perth, WA and Margaret River (as determined by the Promoter, depending on the prize supplier(s) conditions);
2 nights accommodation at the ‘Coast House’ property, including selected meal hampers (contents as determined by the Promoter), a 750ml bottle of Cape Mentelle wine on arrival, an on-site 3 course gourmet dinner experience with a private chef and a 1 hour on-site massage;
gourmet breakfast at the White Elephant Cafe, Gnarabup Beach to the combined value of $100 (inc GST);
a 1 hour private guided walk to Cape Mentelle;
a 2 hour private Cape Mentelle winery tour including return transfers between the Coast House property and Cape Mentelle winery;
dinner and a movie screening at Cape Mentelle winery; and
a 20 minute scenic helicopter flight.
Flights, activities and accommodation are subject to booking and availability. The prize must be taken on dates to be advised by the Promoter in February/March 2015. The Promoter is not liable if the winner is unable to take the prize on the dates advised, for any reason. All other costs associated with the prize, including but not limited to any additional transfer costs, additional meals, additional taxes, insurance and other ancillary costs are the responsibility of the winner and his/her companion, as incurred. The winner and their companion must depart and return at the same time. The prize is subject to any additional terms and conditions specified by the prize supplier(s).
In the event that the value of the breakfast at White Elephant Cafe offered as part of the prize is less than the amount specified by the Promoter, the balance will be forfeited and no cash will be supplied in lieu. Any costs incurred over the specified amount for the breakfast are not the responsibility of the Promoter and must be borne by the winner and their companion, as incurred.
The winner will be notified in accordance with the Winner Notification and Publication section of these conditions. By entering this competition, each entrant requests that his or her full address not be published.
The winner (and their companion) must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their names and images in promotional material.
Entrants (and their companion) acknowledge that there are inherent risks in some aspects of the prize and that using the prize involves participating in dangerous activities. By entering this competition and/or accepting the prize, entrants and their companions accept that risk.
In order to participate in the activities awarded as part of the prize, the winner and their companion must comply with applicable height, weight, health and fitness requirements and any other requirements normally associated with the relevant activities. It is the winner’s responsibility to ensure that they and their companion are sufficiently healthy and fit so as to safely take the trip and undertake the activities awarded as part of the prize. The Promoter reserves the right to deem that the winner and their companion are not sufficiently healthy or fit. The winner and their companion must comply with all requirements and directions of the people responsible for the conduct of the relevant activities. The winner and their companion may be required to sign an indemnity and exclusion of liability form (provided by the Promoter) in favour of all parties involved in this competition and/or providing the prize prior to undertaking the activities included in the prize.If the winner or their nominated companion does not sign the form provided by the Promoter within the time requested by the Promoter, the winner’s entry or claim will be deemed invalid.
The Promoter may require the winner to provide proof of identity, proof of age and proof of residency. Identification considered suitable for verification is at the Promoter’s discretion.
If a winning entry is deemed not to comply with these conditions of entry including if the winner is unable to take the prize on dates to be agreed with the Promoter in February/March 2015, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 5.
The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person (including without limitation the winner or their companion) who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent or effect of annoying, abusing, threatening or harassing any other person or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate. The winner is fully responsible for the acts and omissions of their companion and the Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, the winner and their companion if their companion breaches these conditions, whether or not legally bound by them.
The Promoter may in its absolute discretion cancel the prize or otherwise cease to provide any benefit of the prize to the winner (and their companion) if the winner (or their companion), in the opinion of the Promoter, is under the influence of alcohol or any other drug, behaves aggressively or offensively, or behaves in a manner which may diminish the good name or reputation of the Promoter or any of its related bodies corporate or the agencies or companies associated with this competition, is contrary to law or is otherwise inappropriate.
The Promoter’s decision is final and no correspondence will be entered into.
The prize is not transferable or exchangeable and cannot be redeemed for cash. If for any reason the winner or their companion does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited and cash will not be supplied instead. The Promoter accepts no responsibility for any variation in prize value. If the prize or any element of the prize is unavailable for any reason, the Promoter may substitute for the prize or element of the prize another item of equal or higher value as determined by the Promoter, subject to the approval of the relevant gaming authorities if required.
Notwithstanding paragraph 17, if an event and/or activity awarded as part of the prize is abandoned, called off or postponed for any reason, the winner and their companion forfeit their entitlement to that component of the prize, and no cash or alternative prize will be substituted for that component of the prize.
If the prize has not been accepted or claimed in accordance with the Prize Claim Date and Time, the winner’s entry will be deemed invalid and the Promoter will conduct a further draw in accordance with the Unclaimed Prize Draw Details as is necessary to distribute the prize, subject to any requirements of the relevant gaming authorities. Any winner in this draw will be notified as stated in the Unclaimed Prize Draw Winner Notification and Publication.
