TERMS AND CONDITIONS
1. Information on how to enter, the prizes and Items (as defined below) form part of these
Terms and Conditions. Participation in this promotion is deemed acceptance of these
Terms and Conditions.
2. The promoter is Caltex Australia Petroleum Pty Ltd (ABN 170 00 032 128) of L24 2
Market Street, Sydney, NSW 2000, telephone (02) 9250 5000 (“Promoter”).
3. Entry is only open to Australian residents aged 16 years or over. Entrants under 18 years
old must have parental/guardian approval to enter and further, the parent/guardian of the
entrant must read and consent to these Terms and Conditions. Parents/guardians may be
required by the Promoter to enter into a further agreement as evidence of consent to the
minor entering this promotion.
4. Employees (and their immediate families) of the Promoter, Participating Caltex Stores (as
defined below) and agencies associated with this promotion are ineligible to enter.
Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child
or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-
grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st
cousin.
5. Promotion commences at 12:00am AEST on 14/09/2017 and ends at 11.59pm AEDST on
11/10/2017 (“Promotional Period”). The Promotional Period is divided into three (3)
components, Component 1, Component 2 and Component 3.
Component 1
6. To enter Component 1, individuals must complete the following steps during the
Promotional Period:
a) Spend $5 or more in one (1) transaction on fuel and/or in-store items in a
participating Caltex store, excluding telco, tobacco, StarCash and gift card
products/purchases (“Qualifying Transaction”). A participating Caltex store is any
Caltex store in NSW that displays advertising material featuring this promotion
(each a “Participating Caltex Store”).
b) Once they complete their Qualifying Transaction, individuals must ensure that they
receive (and retain) their purchase receipt for the Qualifying Transaction;
c) Visit www.caltex.com.au and follow the prompts to the competition entry page;
d) Input the requested details including their contact details, receipt details and
confirm if they already have a ticket for Day 3 (7/10/2017) or Day 4 (08/10/2017) of
the 2017 Supercheap Auto Bathurst 1000 race held in Bathurst (for the purposes of
Component 2). For clarity entrants that do have tickets will be asked to confirm
which day they have tickets for, being either Day 3 (Saturday), Day 4 (Sunday) or
both (Saturday and Sunday). Entrants with tickets for any other day of the 2017
Supercheap Auto Bathurst 1000 race will not be eligible for Component 2; and
e) Submit the fully completed online entry form.
Each entrant will be notified instantly online whether or not they are a provisional
instant winner. Provisional instant winners will only be deemed winners once
verified by the Promoter. All valid entries received from non-winners of an instant
prize will be automatically placed into the 2nd chance draw for any unclaimed
instant win prizes.
7. There are one hundred and ninety three (193) instant win prizes to be awarded at random
during the Promotional Period (each an “Instant Prize”). The Instant Prizes available to
be won during the Promotional Period are as follows:
8x $250 Caltex StarCash Cards;
35x $100 Caltex StarCash Cards;
50x $50 Caltex StarCash Cards; and
100x $20 Caltex StarCash Cards;
8. Any ancillary costs associated with redeeming a Caltex StarCash Card are not included.
Any unused balance of a Caltex StarCash Card will not be awarded as cash. Redemption
of a Caltex StarCash Card is subject to any terms and conditions of the issuer including
those specified on the Caltex StarCash Card. Caltex StarCash Cards will be valid for 12
months from the date of issue.
9. Winners of an Instant Prize will be announced online at www.win.caltex.com.au from
20/10/2017.
10.Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise
due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of
the advertised prize pool will be honoured. Any instant win prizes that are part of the
advertised total prize pool and are won but remain unclaimed will be awarded in the
unclaimed prize draw. Instant win game materials void if stolen, forged, mutilated or
tampered with in any way.
11.A draw for any Instant Prizes that are won, but remain unclaimed will be held at 10:00am
AEDST at Peazie, Peazie Tower, Level 2, 27 St Edmonds Street, Prahran VIC 3181 on
21/10/2017, subject to any directions from a regulatory authority. Winners (if any) will be
notified in writing within two (2) business days of the draw and their names will be
announced online at win.caltex.com.au from 25/10/2017
Component 2
12.Entry into Component 2 opens at 12:00am AEST on 14/09/2017 and ends at 11.59pm
AEDST on 03/10/2017 (“Component 2 Promotional Period”).
13.Individuals that enter Component 1 during the Component 2 Promotional Period and
select “Yes” when asked if they already have a ticket to Day 3 (7/10/2017), Day 4
(08/10/2017) or both Day 3 and Day 4 of the 2017 Supercheap Auto Bathurst 1000 race
will be placed into a draw according to the day in which they will attend the 2017
Supercheap Auto Bathurst 1000 race, either Day 3, or Day 4 (or both draws if they are
attending on both days). The draws will take place at 10:00am AEDST at Peazie, Peazie
Tower, Level 2, 27 St Edmonds Street, Prahran VIC 3181 on 04/10/2017. The Promoter
may draw additional reserve entries and record them in order in case an invalid entry or
ineligible entrant is drawn. Winners will be notified by phone and email within 24 hours of
the draw and their names will be announced online at win.caltex.com.au on 04/10/2017.
14.The first sixteen (16) valid entries drawn, from all those valid entries that selected Day 3
(07/10/2017) as the day that they have a ticket/s to the 2017 Supercheap Auto Bathurst
1000 race will each receive a double pass VIP upgrade to a V8 Race Pit viewing suite
(between 10:30am and 12:00pm noon) on Day 3 of the 2017 Supercheap Auto Bathurst
1000 race on 07/20/2017. Each double pass upgrade is valued at $300.
15.The first sixteen (16) valid entries drawn, from all those valid entries that selected Day 4
(08/10/2017) as the day that they have tickets to the 2017 Supercheap Auto Bathurst
1000 race will each receive a double pass VIP upgrade to a V8 Race Pit viewing suite
(between 10:30am and 12:00pm noon) on Day 4 of the 2017 Supercheap Auto Bathurst
1000 race on 08/20/2017. Each double pass upgrade is valued at $300.
16.Winners will be given 24 hours to respond to their winner notification. If a winner fails to
respond and claim the prize within 24 hours of being notified, the prize will be forfeited and
the Promoter will award the prize to the next valid reserve entry drawn. This process will
continue until 5pm AEDST on 06/10/2017. Any prizes that remain unclaimed after 5pm
AEDST on 06/10/2017 will be forfeited.
Component 3
17.At the time of submitting an entry into Component 1, entrants will be required to select an
item that they would like to win (from a list of three items) for the purposes of a
promotional ‘auction’. Each entry a person submits in accordance with Component 1
equates to one (1) bid towards the item they select. An entrant can choose to select the
same item or a different item each time they submit an entry/bid.
18.The items (“Items”) available to bid on during the Promotional Period, and their estimated
values, are as follows:
Tyre rubber from Craig Lowndes race vehicle from the 2017 Supacheap
Auto Bathurst 100 race event presented in a Perspex box valued at $50;
Craig Lowndes racing Gloves presented in a Perspex box from the 2017
season valued at $200; and
Craig Lowndes racing boots presented in a Perspex box from the 2017
season valued at $200.
19.At the end of the Promotional Period, the Promoter will tally the number of entries
submitted by each entrant (and subsequently the number of bids they submitted) and
award each Item to the entrant who submitted the highest number of bids for that Item.
Entrants will be required to provide the Promoter with the exact number of Qualifying
Transaction purchase receipt/s associated with their winning highest bid. In the event the
entrant cannot produce the required number of purchase receipt/s when requested by the
Promoter, the entrant will forfeit their bid and any rights to the Item. The Promoter will then
award the Item to the entrant with the next highest bid for that Item. This process will
continue until each Item has been successfully awarded.
20.In the event of a tie, between two (2) or more entrants with the same highest number of
bids (and each tied entrant is able to produce the relevant number of purchase receipt/s
associated with their winning bid) the Promoter will conduct a random draw between those
tied entrants and the Item will be awarded to the first entrant drawn. If a draw is required
to award an Item, it will take place at 10:00am AEDST at Peazie, Peazie Tower, Level 2,
27 St Edmonds Street, Prahran VIC 3181 on 28/10/2017.
General
21.Entrants must retain their original purchase receipt(s) for all entries/bids as proof of
purchase. Failure to produce the proof of purchase for all entries/bids when requested
may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s
entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the
Participating Caltex Store of purchase and that the purchase was made during the
Promotional Period but prior to entry.
22.The Promoter reserves the right, at any time, to verify the validity of entries, bids and
entrants (including an entrant’s identity, age and place of residence) and reserves the
right, in its sole discretion, to disqualify any entrant who the Promoter has reason to
believe has breached any of these Terms and Conditions, tampered with the entry
process or engaged in any unlawful or other improper misconduct calculated to jeopardise
fair and proper conduct of the promotion. Errors and omissions may be accepted at the
Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage
does not constitute a waiver of those rights. The Promoter’s legal rights to recover
damages or other compensation from such an offender are reserved.
23.Incomplete or indecipherable entries will be deemed invalid.
24.Multiple entries/bids permitted, subject to the following: (a) only one (1) entry/bid permitted
per Qualifying Transaction/purchase receipt; and (b) each entry/bid must be submitted
separately and in accordance with entry requirements.
25.If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its
sole discretion, to determine the identity of the entrant.
26.The Promoter’s decision is final and no correspondence will be entered into.
27.If a winner of a prize or Item is under the age of 18 years, the prize/Item will be awarded
to the winner’s nominated parent or guardian on the winner’s behalf.
28.If for any reason a winner does not take a prize or Item by the time stipulated by the
Promoter, then the prize/Item will be forfeited.
29.If a prize or Item is unavailable, the Promoter, in its discretion, reserves the right to
substitute the prize/Item with a prize/Item to the equal value and/or specification, subject
to any written directions from a regulatory authority.
30.The total value of prizes and Items is $20,050
31.Prizes and Items are not transferable or exchangeable and cannot be taken as cash.
32.Entrants consent to the Promoter using their name, likeness, image and/or voice in the
event they are a winner (including photograph, film and/or recording of the same) in any
media for an unlimited period without remuneration for the purpose of promoting this
promotion (including any outcome), and promoting any products manufactured, distributed
and/or supplied by the Promoter.
33.If this promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the Promoter,
including but not limited to technical difficulties, unauthorised intervention or fraud, the
Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a)
subject to any written directions from a regulatory authority, to disqualify any entrant; or
(b) to modify, suspend, terminate or cancel the promotion, as appropriate.
34.Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit,
exclude or modify the statutory consumer guarantees as provided under the Competition
and Consumer Act (cth), as well as any other implied warranties under the ASIC Act (cth)
or similar consumer protection laws in the States and Territories of Australia (“Non-
Excludable Guarantees”). Except for any liability that cannot by law be excluded,
including the Non-Excludable Guarantees, the Promoter (including its respective officers,
employees and agents) excludes all liability (including negligence), for any personal injury;
or any loss or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of the promotion.
35. Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is not
responsible for and excludes all liability (including negligence), for any personal injury; or
any loss or damage (including loss of opportunity); whether direct, indirect, special or
consequential, arising in any way out of: (a) any technical difficulties or equipment
malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised
access or third party interference; (c) any entry or prize/Item claim that is late, lost,
altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to
any reason beyond the reasonable control of the Promoter; (d) any variation in prize/Item
value to that stated in these Terms and Conditions; (e) any tax liability incurred by a
winner or entrant; or (f) taking and/or use of a prize/Item.
36.As a condition of accepting a prize/Item, the winner must sign any legal documentation as
and in the form required by the Promoter and/or prize/Item suppliers in their absolute
discretion, including but not limited to a legal release and indemnity form. In the event a
winner is under the age of 18, a nominated parent/legal guardian of such person will be
required to sign the legal documentation required under this clause on their behalf.
37.The Promoter collects personal information (“PI”) in order to conduct the promotion and
may, for this purpose, disclose such PI to third parties, including but not limited to related
entities, agents, contractors, service providers, prize/Item suppliers and, as required, to
Australian regulatory authorities. Entry is conditional on providing the requested PI. The
Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed
at https://www.caltex.com.au/privacy-and-reporting-policy. The Promoter may, for an
indefinite period, unless otherwise advised, use the PI for promotional, marketing,
publicity, research and profiling purposes, including sending electronic messages or
telephoning the entrant. The Privacy Policy also contains information about how entrants
may opt out, access, update or correct their PI, how entrants may complain about a
breach of the Australian Privacy Principles or any other applicable law and how those
complaints will be dealt with. All entries become the property of the Promoter. The
Promoter may disclose entrant’s PI overseas, see the Privacy Policy for more details.
