Terms and Conditions
1. Information on how to enter forms part of the terms of entry. Entry into the
competition is deemed acceptance of these terms and conditions.
2. Entry is open to all residents of Australia who are 18 years of age or over. However,
employees and their immediate families of Salmat Digital Pty Limited and their
associated agencies and companies are not eligible to enter.
3. The competition commences on 02/07/2014 at 00:01am AEST and concludes on
22/07/2014 at 11:59pm AEST.
4. The competition may be advertised in television ads, various sports magazine ads,
BWS stores, on the BWS website, through the BWS email newsletters and on the
BWS facebook page.
5. Definitions within this Promotion:
a. Participating Store
means a Beer Wine Spirits – BWS store located within Queensland, Western
Australia, South Australia, the Australian Capital Territory, Victoria, New
South Wales, Tasmania or the Northern Territory.
b. Promoter
The Promoter and permit holder is Woolworths Ltd (ABN 88 000 014 675), 1
Woolworths Way, Bella Vista, 2153, NSW. Ph: 1300 767 969
c. Promotion
means the Woolworths Limited – BWS “Poliakov Extreme Snow Adventure
Competition” governed by these Terms & Conditions of Entry.
d. Promotional Period
means 00:01am 02/07/2014 AEST to 11:59pm 22/07/2014 AEST
e. Eligible Purchase
means a purchasing a participating product as outlined in these Terms and
Conditions of entry.
f. Participating Product
means the following product: Poliakov Vodka 700mL
ENTRY CONDITIONS
6. To enter the Promotion, the entrant must meet the entry requirements as specified in
clause 2 of these Terms and Conditions of entry and must;
i) purchase any Participating Product (“Eligible Purchase”) at a Participating Store
during the Promotional Period; AND
ii) go online to www.bws.com.au/poliakov and follow the prompts to complete the
online entry form to enter the draw; OR
iii) SMS their full name, Eligible Purchase receipt number, state and postcode to
19919907 to enter the draw.
7. SMS costs are $0.55c inc gst per SMS entry. For SMS help call 1300 131 276.
8. The SMS entry mechanic is only open to consumers with a SMS compatible mobile
phone connected to a service provider which permits text messaging to the
promotional SMS number. It is recommended that entrants check with their individual
service provider in this regard.
9. Inaudible, illegible, incomprehensible and incomplete entries will be deemed invalid.
10. Entrants in the competition may enter more than once but only one entry is permitted
for each Eligible Purchase receipt. However, only one prize per person is permitted
(SA residents are entitled to win more than one prize).
11. The Promoter reserves the right to request winners to provide proof of identity, proof
of residency at the nominated prize delivery address and/or proof of entry validity
(including phone bill or store receipt for purchase requirement) in order to claim a
prize. Proof of identification, residency and entry considered suitable for verification is
at the discretion of the Promoter. In the event that a winner cannot provide suitable
proof, the winner will forfeit the prize in whole and no substitute will be offered.
12. The Promoter reserves the right to verify the validity of entries and to disqualify any
entry which, in the opinion of Promoter, includes objectionable content, profanity,
potentially insulting, inflammatory or defamatory statements, disqualify any entrant
who tampers with the entry process, who submits an entry that is not in accordance
with these Terms & Conditions of Entry or who has, in the opinion of Promoter,
engaged in conduct in entering the Promotion which is fraudulent, misleading,
deceptive or generally damaging to the goodwill or reputation of the Promotion and/or
Promoter. This includes, but is not limited, to entrants and households using multiple
email addresses, postal addresses, PO Box addresses or SIM cards to register single
or multiple purchases. The Promoter reserves the right to disqualify a winner if
Promoter becomes aware that the winner and/or the winner’s entry is of a type
described in this clause.
13. Entries must be received by 11:59pm AEST on 22/07/2014. The time of entry will in
each case be the time the SMS message/online entry is received by the BWS
website and/or Salmat Digital Pty Limited. The Promoter accepts no responsibility for
any late, lost or misdirected entries including SMS messages not received by the
Promoter or delays in the delivery of the SMS message due to technical disruptions,
network congestion or for any other reason. SMS entries via the internet or computer
generation and not attributable to a valid mobile phone account is invalid and will not
be accepted.
14. Any entry that is made on behalf of an Entrant by a third party will be invalid.
PRIZES
15. There is 1 (one) major prize and 6 (six) minor prizes to be won.
16. The major prize is an extreme snow adventure trip for 3 adults valued at $16,750.
The prize includes:
• Return economy class flights from winner’s nearest Australian state capital city to
Queenstown, including checked luggage and taxes – for 3 people
• 6 day car hire – Nissan X-Trail or similar
• 5 nights’ accommodation at the Scenic Suites in a 2 bedroom suite – for 3 people
• 3 day ski equipment hire – for 3 people
• 3 day clothing – for 3 people
• 3 day lift pass for Coronet Peak and The Remarkables – for 3 people
• 1 day Heli Ski experience – for 3 people
17. Each minor prize is 1 x 2014 Burton Clash Snowboard & 1 x 2013 Burton Freestyle
Binding in Medium size and colour Black. There are 6 minor prizes to be won and
each minor prize is valued at $600. The total minor prize pool value is $3600.
18. Total competition prize pool value is $20,350 (including GST)
PRIZE RESTRICTIONS
19. Prizes cannot be transferred or redeemed for cash.
20. The winner and their companions are responsible for all other expenses including
spending money, meals (unless specified), drinks, transfers (unless specified),
laundry charges, activities (unless specified), incidentals, taxes (excluding departure
and any other flight associated taxes included within the prize), energy surcharges,
gratuities, services charges, passports, visas, travel insurance and all other ancillary
costs. Travel insurance is highly recommended to protect against the additional costs
incurred in the event of unforeseen circumstances.
21. The winner and travelling companions must travel at the same time, must depart from
the same capital city and are responsible for transport from their residence to their
nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or
Perth). (If the winner is from Tasmania, ACT or NT connecting flights from these
cities to the nearest flight departure capital city will be included in the prize package
for the winner and travelling companions only – if applicable.)
22. The prize must be taken within 12 months of the draw date and is subject to hotel and
flight availability. New Zealand Ski Season is from early June to early October. The
prize is not available during peak times such as public holidays and cannot be
changed once the booking has been made. The prize must be booked within 2
months of the draw date.
23. Air tickets are available on the regular scheduled services of each airline. Flight
itinerary may have to be adjusted depending on the airlines departure city and their
current flight schedule. Frequent Flyer points are not available from any airline.
24. A credit card imprint or cash deposit may be required from the winner at check-in to
the hotel for all incidental charges. Once accommodation vouchers are issued they
are non-changeable.
25. It is the travellers’ personal responsibility to ensure that they have valid
documentation, including but not limited to valid passports and visas, which meet the
requirements of immigration and other government authorities at every destination.
Any fines, penalties, payments or expenditures incurred as a result of such
documents not meeting the requirements of those authorities will be the sole
responsibility of the traveller/s.
26. Woolworths Limited and Salmat Digital Pty Limited make no representation as to the
safety, conditions or other issues that may exist at any destination. International travel
advice can be obtained from various sources, including government, local consular
offices and the web site of the Australian Department of Foreign Affairs and Trade.
27. By entering this competition, entrants accept and acknowledge full responsibility for
their decision to participate in this ski adventure trip should they be chosen as
winners. The winners release the promoter and other organisers, their related bodies
corporate, affiliates, officers, agents and employees, from all liabilities, loss and
damage of any kind arising at any time out of or in connection with the acceptance of,
and participation in, the prize. Without limiting the foregoing, the released parties not
be liable for any injury, sickness or death, property loss or damage or other direct or
indirect loss or damage of any kind, howsoever sustained or incurred, in connection
with or arising out of the ski adventure trip or any other aspect of the prize. The
winner acknowledges that they have been warned that snowsports are dangerous
activities and there is a possibility of an accident causing injury, death or property
damage in accepting the prize.
28. The winner must comply with all car hire company agreements at the time of the loan.
The vehicle cannot be driven out of 200km from the metropolitan area it is loaned
from and must only be driven on sealed roads.
29. In the event that the vehicle is involved in an accident or damaged in anyway, an
Accident/Damage Report in the form required by car hire company must be
completed and forwarded to the car hire company dealer that the vehicle was
collected from within 24 hours of the damage occurring. Repairs to the vehicle are not
to be undertaken without the written consent of the car hire company or its appointed
assessor.
30. The car hire company retains the title to the vehicle and the winner must not purport
to sell, pledge, mortgage, lend, transfer, or in anyway encumber the vehicle. All costs
relating to insurance, registration, service, repairs, etc, of the vehicle will be borne by
the car hire company except for the following items which the winner will be
responsible for including but not limited to any negligent act performed by the driver
or passengers involving the said vehicle: any loss or damage caused to, or by, the
vehicle should the winner (or driver) be intoxicated or under the influence of
medication or drugs whilst in control of the said vehicle: or any fines or penalties
incurred for traffic infringements whilst the vehicle is in the custody and control of the
winner (or nominated driver). The winner is to return the car to the car hire company
immediately upon completion of the allocated period and if the winner fails to do this
the car hire company is irrevocably authorised to enter any premises in which they
believe the vehicle to be situated and take possession of and remove the vehicle.
31. The winner will be responsible for, including but not limited to any negligent act
performed by the driver or passengers involving the said vehicle: any loss or damage
caused to, or by, the vehicle should the winner (or driver) be intoxicated or under the
influence of medication or drugs whilst in control of the said vehicle: or any fines or
penalties incurred for traffic infringements whilst the vehicle is in the custody and
control of the winner (or nominated driver). The driver of the car must have a current
Australian State or Territory license (which is not under suspension or cancellation)
as at the date on which the winner (or companion) is to drive the vehicle.
32. Unless expressly stated in these terms and conditions all other expenses become the
responsibility of the winner.
33. Prize is subject to availability at time of booking. If the prize is unavailable, for
whatever reason, the Promoter reserves the right to substitute the prize for a prize of
equal or greater value, subject to State regulation.
34. The Promoter reserves the right to refuse to allow a winner to take part in any or all
aspects of the prize, if the Promoter determines, in their absolute discretion, that a
winner is not in the mental or physical condition necessary to be able to safely
participate in the prize. It is a condition of accepting the prize that the winner may be
required to sign a legal release in a form determined by the Promoter in its absolute
discretion.
35. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility
for prizes damaged, delayed or lost in transit.
36. By accepting the prize, the winner agrees to participate in and co-operate as required
with all reasonable media editorial requests relating to the prize, including but not
limited to, being interviewed and photographed, filmed and/or chaperoned throughout
the duration of the prize.
37. In the event that for any reason whatsoever a winner does not take an element of the
prize at the time stipulated by the Promoter then that element of the prize will be
forfeited by the winner and cash will not be awarded in lieu of that element of the
prize.
38. Prize values are based upon the recommended retail prices at the time of printing
(inclusive of GST). The promoter accepts no responsibility for change in prize value
between now and the ultimate prize redemption date.
39. Independent financial advice should be sought as tax implications may arise as a
result of accepting the prize.
PRIZE DRAWS
40. Each valid entrant who has entered the competition over the duration of the
Promotional Period will be entered into the draw. The first valid entrant will be drawn
at random to become the major prize winner. The next 6 valid entries drawn will
become the minor prize winners. The draw will take place at Salmat Digital Pty
Limited, Level 2, 116 Miller Street, North Sydney NSW 2060, on 28/07/2014 at 2pm
AEST.
41. If any particular draw is scheduled on a public holiday, the draw will be conducted on
the following business day.
42. The winners will be notified within 2 days of the draw. The winners will be notified of
their prize in writing. Winners of prizes valued over $250 will have their details
published in the Public Notices section of The Australian newspaper on 04/08/2014.
43. Prizes will be awarded to the person named in the entry. However, in a dispute, will
be awarded to the account holder of the entry mechanism used to submit their entry
(i.e. mobile phone account holder or land line account holder).
44. Should an entrant’s contact details change during the promotional period, it is the
entrant’s responsibility to notify the Promoter. A request to access or modify any
information provided in an entry should be directed to Promoter.
45. Subject to any direction given under relevant State legislation, an unclaimed prize
draw will take place at Salmat Digital Pty Limited, Level 2, 116 Miller Street, North
Sydney NSW 2060 on 28/10/2014 at 2pm AEDT. The winners will be notified within 2
days of the draw. The winners will be notified of their prize in writing. Winners of
prizes valued over $250 will have their details published in the Public Notices section
of The Australian newspaper on 04/11/2014.
46. The promoter’s decision is final and the promoter will not enter into correspondence
regarding the Competition result.
47. It is a condition of accepting the prize that the winner must comply with all the
conditions of use of the prize and the prize supplier’s requirements.
48. It is a condition of accepting the prize that the winner may be required to sign a legal
release in a form determined by the promoter in its absolute discretion.
49. In the case of the intervention of any outside act, agent or event which prevents or
significantly hinders the Promoter’s ability to proceed with the competition on the
dates and in the manner described in these terms and conditions, including but not
limited to vandalism, power failures, tempests, natural disasters, acts of God, civil
unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion
cancel, terminate, modify or suspend the competition subject to any directions given
under State Regulation.
DISCLAIMER AND RELEASE
50. Certain legislation may imply warranties or conditions or impose other obligations
including statutory consumer guarantees which cannot be excluded, restricted or
modified except to a limited extent. To the extent permitted by law, the Promoter
excludes all guarantees, warranties, conditions or other terms that apply under or are
implied by statute, common law or trade custom or usage.
51. If in the conduct of this Competition the Promoter is liable for a breach of any
guarantee, warranty, condition or other term that applies under the Australian
Consumer Law or is implied by any other Commonwealth, State or Territory law that
cannot be excluded, the Promoter’s liability under that legislation is limited, to the
extent permitted by law, to the cost of replacement of any benefit or prize won.
52. The Promoter shall not be liable for any loss or damage whatsoever which is suffered
(including but not limited to indirect or consequential loss) or for any personal injury
suffered or sustained in connection with any prize/s except for any liability which
cannot be excluded by law. The Promoter is not responsible for any incorrect or
inaccurate information, either caused by the phone user or for any of the equipment
or programming associated with or utilised in this competition, or for any technical
error, or any combination thereof that may occur in the course of the administration of
this competition including any omission, interruption, deletion, defect, delay in
operation or transmission, communications line or telephone, mobile or satellite
network failure, theft or destruction or unauthorised access to or alteration of entries.
53. The Promoter reserves the right in its sole discretion to disqualify any individual who
the Promoter has reason to believe has breached any of these conditions, or
engaged in any unlawful or other improper misconduct calculated to jeopardise the
fair and proper conduct of the promotion. The Promoter’s legal rights to recover
damages or other compensation from such an offender are reserved.
54. Entry and continued participation in the Promotion is dependent on entrants following
and acting in accordance with the Facebook Statement of Rights and

with, Facebook. Entrants understand that they are providing their information to the
Promoter and not to Facebook. The information an entrant provides will only be used
for the purposes outlined in clauses 59 to 61 of these Terms and Conditions. Any
questions, comments or complaints about this promotion must be directed to the
Promoter and not to Facebook.
57. All entrants unconditionally and irrevocably release and discharge Facebook from any
and all liability in relation to this Promotion.
58. Woolworths Limited, Salmat Digital Pty Limited and their associated agencies and
companies assume no responsibility for any error, omission, interruption, deletion,
defect, delay in operation or transmission, communications line failure, theft or
destruction or unauthorised access to, or alteration of entries, and reserves the right
to take any action that may be available.
59. If for any reason this competition is not capable of running as planned, including due
to infection by computer virus, bugs, tampering, unauthorised intervention, fraud,
technical failures or any causes beyond the control of the Promoter, which corrupt or
affect the administration, security, fairness or integrity or proper conduct of this
promotion, the Promoter reserves the right in its sole discretion to disqualify any
individual who tampers with the entry process, take any action that may be available,
and to cancel, terminate, modify or suspend the competition, subject to any direction
given under State Regulation.
COLLECTION OF PERSONAL INFORMATION
60. By participating in the Competition entrants agree that Salmat Digital Pty Ltd, on
behalf of the Promoter, may use the entrant’s personal information for the purposes
of running the Competition and awarding Prizes, and in the event the entrant is a
winner, the Promoter may publish the winning entrant’s name and locality in any
media, as required under applicable state and territory legislation.
61. If an entrant opts in to receiving further communications from the Promoter, the
Promoter may use the entrants’ names, addresses, telephone numbers and e-mail
addresses for future promotional, marketing and publicity purposes in any media
worldwide without notice and without any fee being paid unless otherwise advised by
the entrant. By opting-in, entrants confirm that they allow their details to be used for
this purpose.
62. The Promoter is bound by the Australian Privacy Principles contained in the Privacy
