Amart Furniture “Ultimate Backyard Cricket” Promotion 2017 Terms and Conditions

1. The Amart Furniture “Ultimate Backyard Cricket” Promotion (Promotion) is conducted by Super A-Mart Pty Limited t/a Amart Furniture ABN 65 009 810 324 c/- Amart Furniture Support Office Rochedale Motorway Estate, 41 Brickworks Place, Rochedale QLD, 4123 Australia. (Promoter, us” or we). These terms and conditions (Terms and Conditions) which include without limitation the information on how to enter and Prize details which we publish in relation to the Promotion apply to the Promotion. By entering the Promotion, you acknowledge that you have read and understood, and agree to be bound by these Terms and Conditions. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS YOU MUST NOT ENTER THE COMPETITION.

Entering the Promotion
2. The Promotion runs from Sunday 17th December 2017 at 12:01am Australian Eastern Standard Time (AEST) until 4 February 2018 at 11.59pm AEST (Promotional Period).
3. Entry is only open to residents of New South Wales only.
4. Employees and their families of the Promoter are not eligible to enter.
5. If you are aged under 18, you must seek the consent of your parent or legal guardian before entering this Promotion.
6. To enter and be eligible to win, Entrants (Entrants) must enter online at www.amartfurniture.com.au/competitions and provide their email address, phone number and post code (Entry).

Prize
7. The Prize includes:
• 4 Sydney Thunder W/BBL player appearances (value $5,000) to attend the winners home location for a backyard cricket match.
• $5,000 Amart Furniture gift card (value $5,000)
• Ziggy by Ziegler & Brown Triple Grill Natural Gas Barbecue with Cart (value $848)
• Sydney Thunder signed bat (value $1,000)
Should the winner not have an appropriate sized venue, or if the venue is deemed too far for player appearance travel, Amart Furniture will source an alternative location within the central Sydney region. Transportation to this alternative location is not included.
8. The Prize will be drawn at 1.00pm on 9 February 2017 at the offices of the Promoter located at Rochedale Motorway Estate, 41 Brickworks Place, Rochedale QLD, 4123 Australia.
9. The Prize will be made available to the Winner within 45 days of the Winner being drawn (Winner) and a date for the event will be coordinated between the Winner, Amart Furniture & Sydney Thunder.
10. Dates for the player appearances are dependent upon player availability at the discretion of Sydney Thunder and Cricket Australia.
11. The total maximum value of the Prize is $11,848 including GST. Prize value is correct at time of printing.
12. If a person under the age of 18 years is the Winner, the Prize will be awarded on their behalf to their nominated parent or guardian at the Promoter’s discretion.
13. The Promoter will endeavour to contact the Winner by telephone and in writing via email within 2 business days of them winning the Prize to confirm their address details.
14. 14. The Winner will have their name and postcode published in the Public Notices section of The Australian newspaper on 13 February 2018.
15. If the Prize remains unclaimed by close of business on 28 February 2018, the Promoter will conduct a redraw at the same place as the original Prize draw at 1pm 2 March 2018, subject to any written directions received from any regulator responsible for supervising the conduct of the Promotion (each a Regulator). The Winner of any redraw will be contacted by telephone and in writing by email and will have their name and postcode published in the Public Notices section of The Australian on 7 March 2018.
16. By entering the Promotion, the Entrant agrees and acknowledges that:
• they may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of them;
• the Promoter may use such comments or photos (Materials) for the Promoter’s future promotional and marketing purposes without further reference or compensation to them;
• the Promoter may duplicate, alter, adapt, and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means. The Promoter may license, authorise, or otherwise transfer the rights in the Materials to others to do the same;
• they grant to the Promoter on creation of the Materials a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
• they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given (Moral Rights);
• they waive all Moral Rights in the Materials that arise outside Australia; and
• they agree not to institute, maintain, or support any claim or proceeding for infringement of their Moral Rights in the Materials.

Disclaimers
17. The Promoter reserves the right, at any time, to verify the validity of Entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
18. Incomplete, indecipherable, or illegible Entries will be deemed invalid.
19. If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant for the purposes of the Promotion.
20. The Promoter is not responsible for any late, lost or misdirected entries.
21. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the Promotion, subject to any directions received from any Regulator.
22. If for any reason the Promotion is not capable of running to completion due to (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control or which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any directions given by any Regulator), to cancel, terminate, modify or suspend the Promotion.

Exclusions and our liability
23. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including without limitation direct, indirect and consequential loss and damages) or for personal injury suffered or sustained as a result of entering or attempting to enter the Promotion or accepting the Prize offered as part of the Promotion, except for any liability which cannot be excluded by law.

Termination
24. We may terminate or cancel your entry in the Promotion immediately in our reasonable discretion or if you breach any of your obligations under these Terms and Conditions.

Personal Information
25. By entering the Promotion, each Entrant understands and agrees that the Promoter may use and disclose the information provided by the Entrant for the purposes of conducting this Promotion and on the terms and for the purposes (including marketing) set out in the Promoter’s Privacy Statement. Each Entrant agrees that the Promoter can continue to contact them even after this Promotion ends. If an Entrant would like to access or correct the personal information that the Promoter holds about the Eligible Entrant, or if an Eligible Entrant does not wish the information to be disclosed, they should advise the Promoter by emailing competitions@amartfurniture.com.au

You indemnify us
26. You release and agree to keep the Promoter indemnified from any claim, cost, demand, tax, liability or damage (including legal costs on a full indemnity basis) suffered or incurred by us, our directors, employees, agents and representatives arising out of your entry in the Promotion or any claim by a third party arising from an act or omission by you.

Failure to comply and severability
27. We are not liable for any failure to comply with these Terms and Conditions. If any part or provision in these Terms and Conditions is found to be invalid, unenforceable or illegal for any reason, that part or provision shall be severed and the remaining provisions shall continue in full force and effect.

Entire agreement and governing law
28. These Terms and Conditions constitute the entire agreement between you and us as to its subject matter. By entering the Promotion, subject to the requirements of any Regulator, you accept that this agreement is to be interpreted, and any disputes are to be determined by the relevant court having appropriate jurisdiction.

29. Authorised under NSW Permit no.
