COMPETITION TERMS AND CONDITIONS
Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.
Entry is only open to Australian residents aged 18 years and over.
Employees (and their immediate families) of the Promoter, directors and management of the Promoter and agencies directly associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Competition commences 12.01am AEST Thursday 20/03/2014 and closes at 11:59pm AEST on Wednesday 23/04/2014 (“Competition Period”).
To enter, eligible individuals must complete the following steps during the Competition Period:
(a) visit the Women’s Confidential Facebook Page at http://www.facebook.com/womensconfidential (“Facebook Page”);
(b) become a fan of the Facebook Page by clicking the ‘like’ button (if not already a fan);
(c) follow the prompts to the competition entry form, input the requested details as prompted including their first name, last name, valid email address, phone number, and state; Upload a photo of their ‘outfit of the day’
(d) Answer the question “What is your most trusted fashion staple and why?”, in 25 words or less; and
(e) submit the fully completed entry form.
Multiple entries are permitted per person, subject to the following:
(a) each entry must be unique; and
(b) each entry must be submitted separately on a different day, and in accordance with entry requirements.
Each entry must:
(a) not be offensive, defamatory, unlawful or likely to cause offense to other persons;
(b) be free of any claims, including copyright claims, by other parties;
(c) not promote or specify any illegal or negligent activity; and
(d) not be in breach of clause 35 of these Terms and Conditions.
There are a total of five (5) Weekly Prizes and one (1) Voting Prize (People’s Choice) to be won.
Entries received throughout the Competition Period will be judged by the Promoter. There will be one judging event taking place each Friday from Friday 28/03/2014 to Friday 25/04/2014 – a total of 5 judging events. This judging will take into account all valid entries received during the previous week (i.e. between 12.00am the previous Friday to the judging event date, until 11.59pm the Thursday immediately before the judging event date, excluding the first week where entries open at 12 noon), and any non-winning entries received prior to that week but during the Competition Period. Any draws which are scheduled to occur on a Public Holiday will take place the following business day. The Voting Prize will be drawn at the same time as the fifth Weekly Prize.
Each entry will be judged based on its creative merit for the answer provided to the question “What is your most trusted fashion staple and why?” and also how creatively they represent their outfit of the day in their photo entry.
The best entry, as determined by the Promoter, for each Weekly Prize judging event will each be deemed a winner of a Weekly Prize. The Weekly Prize is one (1) Myer Gift Card, valued at $500. Total of five (5) Weekly Prizes to be won.
The Promoter may select additional reserve entries that it determines to be the next best in the event of an unclaimed prize or an invalid entry or ineligible entrant being selected as a winner.

In the event that there is a tie for the highest number of votes, each tied entry will be judged by the Promoter. The tied entry deemed best by the Promoter, based on creative merit will be deemed the Voting Prize winner.
The Promoter may select additional reserve entries that it determines to be the next best in the event of an unclaimed prize or an invalid entry or ineligible entrant being selected as a winner.
Weekly Prizes are limited to one (1) per person. However, entrants are eligible to win both one (1) Weekly Prize and the People’s Choice Award if they independently meet the judging criteria for both the Weekly and People’s Choice Award.
All prize winners will be notified in writing by email, after which all prize winners will be announced on the Facebook Page every week from Monday 31/03/2014 – 28/04/2014 (with weekend winners announced on the following Monday throughout the Competition Period).
This is a game of skill and chance plays no part in determining the winners.
The Promoter’s decision is final and no correspondence will be entered into.
Total prize pool value is $4,500.
The Promoter reserves the right, at any time, to verify the validity of entries, (including an entrant’s identity, age, place of residence and Bayer Australia Ltd employment status) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter reserves the right, at any time: (a) to invalidate any entries which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information; and/or (b) entries that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts.
Incomplete or indecipherable entries will be deemed invalid.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
The Promoter accepts no responsibility for late entries, or technical difficulties.
If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.
If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification.
The Promoter will not be responsible for lost prizes caused by incorrect addresses provided by the prize winner. The Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
Prizes are not transferable or exchangeable and cannot be taken as cash or resold by the winner.
If this competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant/s; or (b) to modify, suspend, terminate or cancel the competition, as appropriate.
By entering, entrants give the Promoter permission to publish their first initial of their first name, their full last name and their State/Territory of residence on the Facebook Page and associated Bayer Australia Ltd publications (in the event they are determined as a prize winner).
Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
When an entrant submits any materials via the competition including answers to the promotional question, comments, recordings and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty- free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.
Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) the Content is their original work and does not infringe the rights of any third party; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
Any cost associated with accessing the Facebook Page is the entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Entry and continued participation in the competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this competition must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the competition (including taking/use of a prize), except for any liability which cannot be excluded by law.
