Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian residents aged 18 years or over.

3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

4. Promotion commences at 9am AEDST on Monday 25th November 2013 and ends at 11.59pm (AEDST on Sunday 22nd December 2013 (“Promotional Period”).

5. To enter, individuals must complete the following steps during the Promotional Period:

(a) Go to the Website www.wildturkeybourbon.com.au/island_of_kentucky, select an area of the website map and register their details (name, birthdate, phone number, email and address)

(b) Answer in 25 words or less “Who would you take to the Island of Kentucky and Why?”

(c) Agree to the Terms and Conditions/Privacy Policy

(d) Confirm they are eighteen (18) years old or over

6. Only one (1) entry is permitted per person per week. A week is defined as running from [insert time] on Monday to [insert time] Sunday for seven (7) consecutive days. Each such week shall henceforth be referred to as one (1) “contesting week”.

7. Each week of the Promotional Period, one (1) major prize winner and one hundred and one hundred and twenty five (125) minor prize winners will be selected in accordance with the Judging Details. Over the Promotional Period, there will be four (4) major prize winners and five hundred (500) minor prize winners.

8.Major Prize: The best entries will be those that are both valid and deemed most creative as determined by the judging panel. The winners will receive one (1) 700ml bottle of Wild Turkey Spiced Bourbon (43% alc/vol). A maximum of four (4) major prizes are available.

9.Minor Prize: The best entries will be those that are both valid and deemed highly creative as determined by the judging panel. The winners will receive one (1) 50ml “mini” bottle of Wild Turkey Spiced Bourbon. A maximum of five hundred (500) minor prizes are available.

10. Incomplete or indecipherable entries will be deemed invalid.

11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

12. Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

13. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

14. The judging will take place weekly at Match Media, Ground Floor, 63-73 Ann St, Surry Hills, NSW 2010 on the Monday following each contesting week, commencing 2nd December 2013 from 12.00noon AEDST.

15. The judges may select additional reserve entries, which they determine to be the next best, and record them in order, in case of an invalid entry or ineligible entrant.

16. The winners will be notified by phone or email and will be asked to provide proof of valid photo ID to redeem their prize.

17. The Promoter and its associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

18. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on originality and literary and creative merit of the written entry.

19. The Promoter’s decision is final and no correspondence will be entered into regarding the result.

20. If for any reason a winner does not take a prize by the time stipulated by the Promoter, then the prize will be forfeited.

21. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize of a similar value and/or specification.

22. Total prize pool value is $2475 ([including/excluding] GST). Prize values are based upon the recommended retail prices at the time of printing([inclusive/exclusive] of GST). The Promoter accepts no responsibility for any change in prize value between now and the ultimate prize redemption date. The winner is not entitled to receive any money from any party if there is a difference between the maximum prize value and the actual prize value at the prize redemption date.

23. Prizes are not transferable or exchangeable and cannot be taken as cash.

24. If a Northern Territory resident is the winner, the winner will be awarded cash in lieu of the alcohol component of the prize.

25. When an entrant submits any materials via the promotion including answers to the promotional question, comments, interviews, recordings, photographs, videos and images (“Content”), the entrant, unless the Promoter advises otherwise, licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. Entrants agree not to assert any moral rights in relation to such use and warrant that they have the full authority to grant these rights.

Entrants agree that they are fully responsible for the Content they submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Entrants warrant and agree that: (a) they will not submit any Content that is unlawful, fraudulent, misleading, deceptive or that may cause damage to the goodwill or reputation of the Promoter, or that the Promoter may deem in breach of (or may be in breach of) any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, profane, insulting or potentially insulting, inflammatory, harassing, threatening, objectionable with respect to race, religion, origin or gender or otherwise unsuitable for publication; (b) they will obtain prior consent from any person or property that appears in their Content; (c) they will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; (d) their Content shall not contain viruses or cause injury or harm to any person or entity; and (e) they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.

Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

26. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winner agrees to grant the Promoter a perpetual and non-exclusive right to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media worldwide for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or its affiliates.

27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, computer viruses, bugs, tampering, technical failures, unauthorised intervention or fraud, the Promoter reserves the right, in its absolute discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

28. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may, in its absolute discretion, to the fullest extent permitted by law, cancel the competition and recommence it from the start on the same conditions.

29. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

30. The Promoter and its affiliates assume no responsibility for any error, omission, interruption, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available.

31. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Consumer Law or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

32. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and its affiliates (including their respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) taking and/or use of a prize; or (g) any failure of an entry to be received by the Promoter on account of technical problems or traffic congestion.

33. As a condition of accepting a prize, each winner must sign any legal documentation in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

34. The winner should seek independent financial advice about any tax implications that may arise from the prize winnings.

35. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers and prize suppliers. Entry is conditional on providing this information. The Promoter may, if selected by an entrant at the time of entry, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

36. It is a condition of accepting the prize that the winner must comply with all conditions of use of the prize and prize supplier’s requirements.

37. The Promoter encourages consumers to enjoy alcohol in moderation. Legal aged consumers are advised to consider the ‘low risk drinking’ guidelines recommended in the National Health & Medical Research Council Australian Alcohol Guidelines. Participation in the promotion is subject to relevant liquor legislation in each applicable State or Territory, including responsible service of alcohol.
