Terms and Conditions: How X-ing clever are you? Competition

1. Information on how to enter and prizes forms part of these Terms and Conditions of entry. Entry into the competition constitutes acceptance of these Terms and Conditions.

2. The promotion commences on Tuesday 04 February 2014 and ends at 5.00pm (AEST) on Friday 28 March 2014 (“Promotional Period”).

3. Only one entry is permitted per person.

4. Entry is only open to Victorian residents. Directors, management and employees of the Promoter (and their immediate families) or of the agencies or companies associated with this promotion are ineligible to enter.

5. There is one (1) major prize and five (5) runner-up prizes to be won.
a. The major prize consists of one (1) 128GB 11” Apple MacBook Air® valued at $1099.

b. Each of the five (5) runner-up prizes consists of one (1) Telstra BigPond® Movies voucher, valid until 30 December 2014, valued at $50.

c. There are a total of six (6) prizes to be won. The total prize value is $1,349 (inc. GST).

6. Prizes will be randomly drawn on Wednesday 02 April 2014 at 10am (AEST), at Level 9 750 Collins St, Docklands VIC 3008. The first valid entry will win the major prize and the next five (5) valid entries will win the runner-up prizes. The judges’ decision is final and no correspondence will be entered into. Prizes are not exchangeable or refundable and cannot be redeemed for cash.

7. To enter the competition, consumers must, during the Promotional Period, visit V/Line’s Facebook page www.facebook.com/vlinevictoria, successfully complete the ‘How X-ing clever are you?’ game and then fill out all required entry details. Incomplete or automated entries will be disqualified. Multiple entries from the same IP address, same email address or from automated competition entry services are invalid.

8. Winners will be notified by email and prizes will be sent by express post. Winners’ names will be published on V/Line’s Facebook page and www.vline.com.au on Thursday 03 April 2014. By entering this competition, entrants request that their full address not be published.

9. Winners who cannot be reached within 14 days at the email address provided on their entry will unfortunately be disqualified and the winner will be re-selected.

10. If the winner of any prize is under the age of 18 years at the closing date of the promotion, the relevant prize will be awarded to the winner’s parent or guardian (at the Promoter’s discretion).

11. If a winning entry is deemed not to comply with these Terms and Conditions of entry, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry in accordance with paragraph 6. The judges’ decision is final and no correspondence will be entered into.
12. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

13. Prizes must be claimed by Wednesday 30 April 2014.

14. V/Line’s privacy policy and privacy notice may be viewed at www.vline.com.au/privacy. Personal data collected from entrants by the Promoter as part of this competition will be used by the Promoter for the purpose of conducting this competition. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants or if disclosure is required or permitted by law. Personal information from entrants will not be used for any other purpose unless permission is provided by the entrant. Where permission is provided by the entrant, the entrant’s personal information will be stored in accordance with V/Line’s privacy policy. Entrants can request access to the personal information the Promoter holds about them by contacting the Promoter.

15. The Promoter and its associated agencies and companies will not be liable for any loss or damage whatsoever that is suffered by any entrant or winner (including but not limited to indirect or consequential loss or loss of profits), or for any expense, death or personal injury suffered or sustained, (whether or not arising from any person’s negligence) in connection with this competition or as a result of taking or using any prize, except for any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

16. In the event for any reason a winner does not take an element of a prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize. The Promoter accepts no responsibility for any variation in prize value. Where a prize is unavailable for any reason, the Promoter may substitute for that prize another item of equal or higher value as determined by the Promoter.

17. If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, the Promoter may in its sole discretion cancel, terminate, modify or suspend the competition, or invalidate any affected entries.

18. The Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes nor be liable for failure of Australia Post to deliver the prize to the winner’s nominated address.

19. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over telephone communications, the Internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.

20. The prize winners must, at the Promoter’s request, participate in all promotional activity (such as publicity and photography) surrounding the winning of any prize, free of charge, and they consent to the Promoter using their name and image in promotional material.

21. The Promoter may require winners to provide proof of identity, proof of age and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the Promoter’s discretion.

22. To the extent permitted by law, Facebook will not be liable for any loss, personal injury or damage whatsoever (including direct or consequential loss), whether as a result of participation in this Promotion, the Promoter’s negligence or otherwise.

23. The Promoter acknowledges that the Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
