Terms and Conditions of Entry
1. Promoter
The Promoter is Village Cinemas Australia Pty Ltd ABN 36 006 735 002 of Level 2, 180 St Kilda Road, St Kilda Victoria (“the Promoter”).
2. Who may enter
The only persons who may enter and be awarded prizes are:
(a) who are residents of Victoria and Tasmania
(b) who are not employees of the Promoter or its related bodies corporate or advertising agencies, or the immediate family of such employees. “Immediate family” means spouse, parent, child or sibling, whether or not they live in the same household as the employee; and
(c) if under 18 years of age have obtained their parent or guardian’s consent to enter and whose parent or guardian has agreed to these Terms and Conditions.
(d) who have a Facebook profile and ‘Like’ Village Cinemas Australia on Facebook.
3. Conditions of Entry
By entering the competition, you agree to be bound by these terms and conditions.
4. How to Enter
‘Like’ the Village Cinemas Australia fan page on Facebook and access the ’12 Days til Christmas’ application. Click on the current date in the calendar and follow the prompts to instantly see if you’ve won a prize from our prize pool. Limit one entry per fan per hour between 9:00AM EDT on Friday 13 December 2013 and closes at 9:00PM EDT on Tuesday 24 December 2013. Any cost associated with accessing the competition website is your responsibility and is dependent upon the internet service provider used.
5. Duration
The promotion commences at 9:00AM EDT on Friday 13 December 2013 and closes at 9:00PM EDT on Tuesday 24 December 2013.
6. Selection of winners
The competition is a game of chance. Winners will receive an on-screen notification inside the Facebook application and also via email that they have won. Upon notification on screen, the winners will have the option to download the PDF of their prize. Upon notification via email, the winners can view the PDF of their prize and save it from their email. The Promoter’s decision in relation to any aspect of the competition is final and binding on every entrant. No correspondence will be entered into.
7. Prizes
Prizes include:

Total Prize Pool: $3,000 AUS
All prizes must be taken as offered and are not exchangeable or transferable. In the event that a prize is unavailable, the Promoter reserves the right to substitute a prize of equal or greater value. Prize values are the recommended retail value as provided by the supplier at the time of printing. No responsibility is accepted for any variation in the value of the prizes. Any incidental costs relating to the prize are the responsibility of the prize winner.
8. Prize Conditions
· Redeemable at any Village Cinemas in Victoria or Tasmania.
· Prize is subject to availability at the time of booking.
· One prize is awarded to a fan every hour between 9:00am and 9:00pm from Friday 13th December 2013 to Tuesday 24th December 2013.
· Each winner is chosen randomly via the Facebook application.
· Contact details are requested upon entry for the purpose of contacting the winner only. Village Cinemas does not collect any data or personal information captured in this application.
· By entering this competition, you are consenting to Village Cinemas contacting you if you are a winner. Users can only enter once per hour. Prizes are generated randomly.
· One prize from the prize pool will win every hour for a total of 12 hours being 12 prize winners per day. Winners will be notified via instant notification on-screen in the application or via email.
9. Notification of winners
Winners will receive an on-screen notification inside the Facebook application and also via email that they have won. Upon notification on screen, the winners will have the option to download the PDF of their prize. Upon notification via email, the winners can view the PDF of their prize and save it from their email.
10. Entries
All entries become the property of the Promoter. Entries not completed in accordance with the conditions of entry or received after the closing date will not be considered. Indecipherable or incomplete entries will be disregarded. No responsibility is taken for late or misdirected email.
11. Publication of names
The Promoter reserves the right to announce or publish the winner’s name and/or photograph for publicity purposes. The winner’s personal information may be disclosed to State departments and published as required by the relevant legislation regulating trade promotions.
12. Privacy
The personal information collected as part of the entry is collected to enable identification of the winner and for marketing and promotional purposes. In addition to any required disclosures referred to in Clause 10 above, your personal information will be disclosed to the Promoter and its related bodies corporate for these purposes. You can contact our Privacy Officer if you would like details of the personal information that the Promoter may hold about you or if you would like it to be corrected. 13. Conduct of competition
If for any reason the competition does not run for its duration due to a computer virus, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter that corrupts or affects the administration, security, fairness, integrity or proper conduct of the competition, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the competition. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or has engaged in conduct to jeopardize the fair and proper conduct of the competition. The Promoter is not responsible for any:
(a) malfunction, delay or traffic congestion on any communication network or line, computer on-line system, servers or providers, computer equipment, software, or website;
(b) failure of any SMS, email or entry to be received by the Promoter; nor
(c) any injury or damage to entrants or any other person related to or resulting from participation in the competition or downloading any materials in a competition.
14. Limitation of liability
The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any goods or services offered as prizes. To the extent permitted by law, the Promoter, its employees and agents are not liable for any loss suffered to person or property by reason of any act or omission, deliberate or negligent, by the Promoter or its employees or agents, in connection with the arrangement for the supply, or the supply, of goods and services by any person to the prize winner and, where applicable, to any persons accompanying the prize winner. This clause does not affect any rights a consumer may have which are unable to be excluded under Australian law. To the fullest extent permitted by law, any liability of the Promoter or its employees or agents for breach of any such rights is limited to the payment of the costs of having the prize supplied again.
15. Printing errors
All valid prize claims in excess of the advertised prize pool will be honoured. Printing or other quality control errors will not invalidate an otherwise valid prize claim.
