Terms and Conditions

1. Information on how to enter and prizes form partof these Terms and Conditions. Participation in this promotion is deemedacceptance of these Terms and Conditions.

2. The promotion is open to all residents of NSW,QLD, VIC, WA and SA aged 18 and over, except employees (and their immediatefamilies) of the Promoter and its affiliate companies, agencies and anyoneprofessionally connected with the promotion.

3. Entries open at 6pm AEDST on Thursday 9thJanuary 2014 and close at 11:59pm AEDST on the 12th January 2014 (“PromotionalPeriod”).

4. No purchase is necessary to enter orparticipate. Entries must be submitted via direct message on the Smirnoff Facebookpage.

6. The Promoter reserves the right, at any time, toverify the validity of entries and entrants (including an entrant’s identity,age and place of residence) and to disqualify any entrant who submits an entrythat is not in accordance with these Terms and Conditions or who tampers withthe entry process. Errors and omissions will be accepted at the Promoter’sdiscretion. Failure by the Promoter to enforce any of its rights at any stagedoes not constitute a waiver of those rights.

7. The Promoter reserves the right, at any time, toinvalidate any entries which it reasonably suspects have been submitted usingfalse, incorrect, fraudulent or misleading information, including but notlimited to personal details and contact information and/or entries that havebeen submitted through the use of multiple identities, email addresses oraccounts.

8. If there is a dispute as to the identity of anentrant, the Promoter reserves the right, in its sole discretion, to determinethe identity of the entrant.

9. Incomplete, indecipherable or illegible entrieswill be deemed invalid.

10. Multiple entries permitted, subject to thefollowing: (a) each entry must be substantially unique; and (b) each entry mustbe submitted separately and in accordance with entry requirements.

11. This is a game of skill and chance plays nopart in determining the winner. Entries will be individually judged based ontheir creativity and the panel of experts will consist of Smirnoff Australiacommunity managers. The winners will be notified by direct message on Facebookand asked to email ID and contact details. The winners mayalso have their full name published in the news feed on the Smirnoff AustraliaPage on the Facebook platform at www.facebook.com/SmirnoffAustralia from Monday 13th January2014.The Promoter’s and judges’ decisions are final and no correspondence willbe entered into.

12. The best entry from each State, as determined by the judges, willwin the prize of tickets to the event in their State as detailed below:

For each of these cities there will be one winnerwho can then nominate 3 friends aged 18 years or over to attend using the othertickets.

13. No travel or accommodation is included in theprize. Any other additional ancillary costs are not included.

14. Prizes, including any unused portion, are nottransferable or exchangeable and cannot be taken as cash.

15. The Big Day Out tickets prize is subject to theevent venue and ticket terms and conditions, including any applicable agerestriction. The Promoter and event organisers hereby expressly reserve theright to eject the winner (and/or his/her companion/s) for any inappropriatebehaviour, including but not limited to intoxication, whilst participating inany element of the prize.

16. Any prize winner and his/her guest(s) chosen toparticipate in the prize must be available to attend the event stated above onthe date stated. These dates and locations are not flexible. If for any reasona winner does not redeem a prize, or part of the prize, at the time stipulatedby the Promoter, then the prize, or part of the prize, will be forfeited.

17. If the prize is unavailable, the Promoter, inits discretion, reserves the right to substitute the prize with a prize to theequal value and/or specification.

18. The winners must claim their prize by 5:00pm AEDSTon 15 January 2014. In the event that any winner does not claim their prize by5:00pm on the applicable date, the judges reserve the right to judge additionalentries, to determine the next best entry from the relevant State to award therelevant prize to. The winner of any unclaimed prize will be notified by viathe contact details requested by direct message and they may have their fullname published in the news feed on the Smirnoff Australia Page on the Facebookplatform. The winner of any unclaimed prize must claim their prize before 3:00pmAEDST 17 January 2014 or they forfeit their prize.

19. When entrants submit any materials via thepromotion, including comments, recordings and images (“Content”), the entrant,unless the Promoter advises otherwise, license and grant the Promoter, itsaffiliates and sub-licensees a non-exclusive, royalty-free, perpetual,worldwide, irrevocable, and sub-licensable right to use, reproduce, modify,adapt, publish and display such Content for any purpose in any media, withoutcompensation, restriction on use, attribution or liability. Entrants agree notto assert any moral rights in relation to such use. Entrants warrant that theyhave the full authority to grant these rights. Entrants agree that they arefully responsible for the Content they submit. The Promoter shall not be liablein any way for such Content to the full extent permitted by law. The Promotermay remove any Content without notice for any reason whatsoever. Entrantswarrant and agree that: (a) they will not submit any Content that is unlawfulor fraudulent, or that the Promoter may deem in breach of any intellectualproperty, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic,sexually inappropriate, violent, abusive, harassing, threatening, objectionablewith respect to race, religion, origin or gender, not suitable for childrenaged under 18, or otherwise unsuitable for publication; (b) their Content shallnot contain viruses or cause injury or harm to any person or entity; and (c)they will comply with all applicable laws and regulations, including withoutlimitation, those governing copyright, content, defamation, privacy, publicityand the access or use of others’ computer or communication systems.

Without limiting any other terms herein, theentrant agrees to indemnify the Promoter for any breach of the above terms.

Entrants consent to the Promoter using theirname, likeness, image and/or voice in the event they are a winner (includingphotograph, film and/or recording of the same) in any media for an unlimitedperiod without remuneration for the purpose of promoting this promotion(including any outcome), and promoting any products manufactured, distributedand/or supplied by the Promoter.

22. If this promotion is interfered with in any wayor is not capable of being conducted as reasonably anticipated due to anyreason beyond the reasonable control of the Promoter, including but not limitedto technical difficulties, unauthorised intervention or fraud, the Promoterreserves the right, in its sole discretion, to the fullest extent permitted bylaw: (a) to disqualify any entrant; or (b) to modify, suspend, terminate orcancel the promotion, as appropriate.

23. Any cost associated with accessing thepromotional website is the entrant’s responsibility and is dependent on theInternet service provider used.

24. The use of any automated entry or any othermechanical or electronic means that allows an entrant to automatically enterrepeatedly is prohibited and will render all entries submitted by that entrantinvalid.

Nothing in these Terms and Conditions limits,excludes or modifies or purports to limit, exclude or modify the statutoryconsumer guarantees as provided under the Competition and Consumer Act, as wellas any other implied warranties under the ASIC Act or similar consumerprotection laws in the State and Territories of Australia (Non-ExcludableGuarantees). Except for any liability that cannot by law be excluded, includingthe Non-Excludable Guarantees, the Promoter (including its respective officers,employees and agents) excludes all liability (including negligence), for anypersonal injury; or any loss or damage (including loss of opportunity); whetherdirect, indirect, special or consequential, arising in any way out of thepromotion.

Except for any liability that cannot by law beexcluded, including the Non-Excludable Guarantees, the Promoter (including itsrespective officers, employees and agents) is not responsible for and excludesall liability (including negligence), for any personal injury; or any loss ordamage (including loss of opportunity); whether direct, indirect, special orconsequential, arising in any way out of: (a) any technical difficulties orequipment malfunction (whether or not under the Promoter’s control); (b) anytheft, unauthorised access or third party interference; (c) any entry or prizeclaim that is late, lost, altered, damaged or misdirected (whether or not aftertheir receipt by the Promoter) due to any reason beyond the reasonable controlof the Promoter; (d) any variation in prize value to that stated in these Termsand Conditions; (e) if any prize event is cancelled or delayed for any reasonbeyond the reasonable control of the Promoter; (f) any tax liability incurredby a winner or entrant; or (g) attendance at a prize event.

27. As a condition of accepting a prize, a winner (and any companion)must sign any legal documentation as and in the form required by the Promoter and/orprize suppliers in their absolute discretion, including but not limited to alegal release and indemnity form.
