Moments promotion (“Promotion”)
Terms and conditions
1. Information on how to enter and prizes form part of these terms and conditions. Submission of an entry is deemed acceptance of these terms and conditions.
2. Entry is only open to Australian residents aged 18 years or over.
3. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter.
4. To enter, entrants must, during the Promotional Period complete the entry form on the dedicated tab found on the official Nurofen Australia Facebook page. Entrants will be asked to share a magical moment with their baby and why it was special.
Entrants will then be required to do the following:
i. Submit a photo or video depicting a magical ‘first moment’ of or with their bub
ii. Answer, in 25 words or less the question ‘Tell us a little bit about your magical moment”.

5. Multiple entries per person are permitted, however entrants will only be able to win one Weekly Prize, as detailed in clause 10, over the duration of the Promotion. Once an entrant’s entry is selected as a winning entry, the entrant’s remaining entries are no longer eligible to win a Weekly Prize however they will then be eligible to win the Grand Prize.
6. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions, who tampers with the entry process or who submits an entry that the Promoter, in its sole discretion, deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the promotion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. Incomplete, indecipherable, or illegible entries will be deemed invalid. Any incorrect details submitted may render the corresponding entry invalid.
8. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
9. Promotion commences 09:00 AEDST on 09 January 2014. Entries close and must be received by 23:59 AEDST on 23 February 2014 (Promotional Period).

Judging Criteria – Weekly Prize
11. This is a game of skill and chance plays no part in determining the winners. Each valid entry will be individually judged on the basis of creativity and uniqueness of the answer to the Question. Each week, the winner will be selected from the entrants with the best entries (as determined by the judges in their sole discretion).
12. The Promoter’s decision is final in relation to all matters in this promotion and no correspondence will be entered into.
13. There are seven (6) weekly prizes to be won, with one (1) prize winner drawn each week during the Promotional Period. Each week, the entry chosen by the Nurofen marketing team at Reckitt Benckiser (Judges) as the best entry in accordance with the criteria referred to in clause 11 will be awarded a Nurofen for Children prize pack valued at $400, consisting of the following:
a) a term pass to Gymbaroo for a child in his/her nearest available city
b) a $200 Ella Bache gift voucher
c) a Magic of Discovery book

Grand Prize
14. There is one (1) grand prize. The Grand Prize is valued at $1799 consisting of the following:
a) a Canon EOS 100D Digital SLR Camera with 18-55mm IS STM Single Lens Kit
b) a $1,000 AUD gift voucher for Toys R Us
c) the Grand Prize winner and baby will be featured in the Nurofen for children ad and will be
used within print, point of sale, digital and tv channels (at the Promoter’s discretion).
15. The Grand Prize winner will be chosen in the week following the Promotional Period. The Grand Prize winner will be chosen from one of the six Weekly Prize winners, by the Judges according to the entry which the judges consider in their absolute discretion was the most creative and original answer to the Question of the seven Weekly Prize winners.

16. It is a condition of entry that the Eligible Entrant selected as the Grand Prize winner agrees to participate in a photo shoot for the purpose of being photographed with his or her baby and agrees to be featured in the Nurofen for Children advertisement without further remuneration.
17. Judging will take place at the promoter’s premises at 44 Wharf Road, West Ryde, NSW 2114. Judges will, at the end of each weekly period referred to in clause 10, judge all entries submitted during the Promotional Period together with any new and additional entries submitted up until the end of each judging week in order to determine the Weekly Prize winners.
18. The Weekly Prize and/or Grand Prize will be delivered to winners within 28 days of the notification date. Redemption of the Weekly Prize and Grand Prize is subject to any terms and conditions specified on the ticket/s or voucher/s and to the standard terms and conditions of the providers of the Weekly Prize and Grand Prize.
19. If a prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with an alternative prize to the equal value and/or specification, unless to do so would be prohibited by law.
20. If for any reason whatsoever beyond the reasonable control of the Promoter, the Promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in its sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) to cancel, suspend, modify, terminate or cancel the Promotion.
21. Unless expressly stated within these terms and conditions regarding all prizes, all other expenses become the responsibility of the winner.
22. Total prize pool value is $4599 AUD.
23. Prizes, or any unused portion of a prize, are not transferable or exchangeable and are not redeemable for cash.
24. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this Promotion.
25. Each submission submitted as an entry or part of an entry becomes the property of the Promoter. Submission(s) will not be returned to any entrant. As a condition of entry, each entrant irrevocably grants to the Promoter a non-exclusive perpetual worldwide licence to use and exploit all intellectual property rights (including without limitation, copyright) in and to the submission, including the photograph and answer to the Question, and consents to the Promoter doing (or omitting to do) any acts in respect of the submission which may otherwise constitute an infringement of the entrant’s moral rights. For the avoidance of doubt, the Promoter may use all or any part of an entrant’s submission(s) for any purposes at its discretion, including, without limitation, using the entrant’s submission(s) for promotional, marketing or publicity purposes, whether in respect of this promotion, the Promoter, or otherwise. Each entrant warrants to the Promoter that the submission submitted is an original work of the entrant which does not infringe any rights of any third party. A breach of the warranty set out in this condition will result in the entrant’s entry being invalid. In addition, each entrant indemnifies the Promoter against all loss, damages and costs incurred by the Promoter arising from that entrant’s breach of the warranty set out in this condition.
26. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether

arising in tort (including without limitation negligence), contract or otherwise, for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any tax implications; (e) any variation in reward value to that stated in these terms and conditions; (f) any tax liability incurred by an entrant and/or (g) the Weekly Prize or Grand Prizes or use of the Weekly Prize or Grand Prize.
27. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information (including the photograph, and any personal information in the answer to the Question) to third parties, including, but not limited to, prize suppliers. Entry is conditional on providing this information. Unless otherwise advised, the Promoter may also use the information for promotional, marketing and publicity purposes of the Promoter and/or third parties. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
28. In participating in the Competition. Eligible Entrants consent to the Promoter using the Eligible Entrant’s photograph, name, or likeness, in any media including on Facebook for an unlimited period of time without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
29. The laws of New South Wales apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New South Wales.
