Information on how to enter and the prizes form part of these Terms and Conditions. By participating, Entrants agree to be bound by these Terms and Conditions. Promotion is not valid in conjunction with any other special, discount or promotional offer unless indicated otherwise.
Entry is only open to Australian and New Zealand residents aged 15 years or over (Entrants). Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering this promotion. If a winner of a prize is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.
Employees (and the immediate families) of the Promoter, retailers of Mentos products and agencies associated with this promotion are ineligible to enter. The Promoter is:
in respect of the prizes awarded to Australian Entrants – Stuart Alexander & Co Pty Ltd (ABN 43 000 058 677) of Level 3, 1- 3 Smail Street, Ultimo NSW 2007 Australia; and
in respect of the prizes awarded to New Zealand Entrants-DKSH New Zealand Limited, 97 Walkers Road, Longburn, Palmerston North 4477 New Zealand.
The Mentos Cash Promotion (Promotion) commences 2 June 2014 at 9:00am AEST and entries close at 11:59pm AEST on 19 September 2014 (Promotional Period).
To enter the Promotion, Entrants must (during the Promotional Period), purchase one (1) specially marked Mentos product (Qualifying Purchase) and follow the prompts to submit a valid entry form online

(Purchase Entry). Entrants must retain the wrapper from their Qualifying Purchase in order to complete a valid entry form and for prize claim in accordance with clause 11.
Purchase Entries must be submitted online via one of the following methods (Entry Requirements):

Australian residents:
enter via the promotional website at www.WinWithMentos.com (Website) by visiting the Website and selecting the option to complete a Website entry and:
fully complete the Website entry form (including the promotional code printed on the inside of the wrapper of the Qualifying Purchase); and
follow the prompts to submit the Website entry form.

OR
enter via the Mentos Australia Facebook page either by accessing the page directly at www.facebook.com/MentosAustralia (AU Facebook Page) or by clicking the Facebook entry option on the Website and:
“Like” the AU Facebook Page (if Entrant hasn’t already done so);
locate the “Mentos Cash Promotion” application at https://www.facebook.com/MentosAustralia/app_182337661935609 and accept the permissions requested;
fully complete the Facebook entry form (including the promotional code printed on the inside of the wrapper of the Qualifying Purchase); and
follow the prompts to submit the Facebook entry form.
New Zealand residents:
enter via the promotional website at www.WinWithMentos.com (Website) by visiting the Website and selecting the option to complete a Website entry and:
fully complete the Website entry form, (including the promotional code printed on the inside of the wrapper of the Qualifying Purchase); and
follow the prompts to submit the Website entry form.

OR
enter via the Mentos New Zealand Facebook page either by accessing the page directly at www.facebook.com/MentosNewZealand (NZ Facebook Page) or by clicking the Facebook entry option on the Website and:
“Like” the NZ Facebook Page (if Entrant hasn’t already done so);
locate the “Mentos Cash Promotion” application at https://www.facebook.com/MentosNewZealand/app_423581454428630 and accept the permissions requested;
fully complete the online entry form (including the promotional code printed on the inside of the wrapper of the Qualifying Purchase); and
follow the prompts to submit the Facebook entry form.
Entrants who have submitted a valid Purchase Entry will also have the opportunity to play the Mentos game (Game) to earn additional entries. To play the Game, Entrants must follow the prompts provided immediately after the submission of the Purchase Entry and collect as many of the ten (10) available bonus entries that they can within the given time period. The entrant will receive an additional entry for each bonus entry which they collect (Game Entry). Each Game Entry is awarded in addition to the original Purchase Entry. Entrants may only play the Game once per day.
Multiple entries permitted, subject to the following: (a) only one (1) Purchase Entry and up to ten (10) Game Entries permitted per day; (b) each Purchase Entry must be submitted separately and in accordance with the Entry Requirements; (c) only one (1) promotional code per entry is permitted; and (d) unrecognised codes will be deemed invalid.
All entries must be received by the Promoter during the Promotional Period. Entries received before the start date or after the closing date will not count towards the Promotion. Records of the Promoter are final and conclusive as to time of receipt. Incomplete, illegible or indecipherable entries will be deemed invalid.
Entrants can only enter in their own name. The Promoter reserves the right, at any time, to verify the validity of entries, Game scores and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry or Game score that is not in accordance with these Terms and Conditions, or who tampers with the entry or Game process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an Entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Entrant.
Entrants must retain original promotional wrapper of the specially marked Mentos product for each entry clearly showing the promotional code used to enter as proof of purchase for up to twenty-eight (28) days after the unclaimed prize draw date. Failure to produce the original promotional wrapper of the specially marked Mentos product when requested may, in the absolute discretion of the Promoter, result in invalidation of the winner’s entry and forfeiture of any right to a prize.
All draws will take place at Message Media Interactive, Level 22, 385 Bourke Street, Melbourne VIC 3000. The winners will be notified in writing by email within two (2) business days of the relevant draw.

Prize Draws
The Promotion is comprised of a total of one hundred and ten (110) daily draws (i.e. one (1) daily draw in respect of entries submitted each day during the Promotional Period) and one (1) major prize draw.

a) Daily Draws
The daily draws will take place at 10:00am AEST every day during the period commencing on 3 June 2014 and ending on 20 September 2014. Entries for each daily draw will be the entries submitted for the Promotion during the period from 12:00am AEST to 11:59pm AEST on the day before the draw is scheduled to take place.
Entries in each daily draw will NOT be included in any subsequent daily draw but will be entered into the major prize draw.
The first one hundred (100) valid entries drawn from all entries received in each daily draw will each win $10 cash awarded in the form of an EFT transfer into each daily draw winner’s nominated bank account. In the case that a daily draw winner does not have a bank account, the $10 cash will be awarded in the form of a cheque in the daily draw winner’s name.
In the event any daily prize is not claimed for an allocated day, the daily prize will roll-over into the unclaimed prize draw (see clause 24).

b) Major Prize Draw
The major prize draw will take place at 10:30am AEST on 22 September 2014.
The first valid entry drawn from all entries received during the Promotional Period will win $20,000 cash awarded in the form of an EFT transfer into the major prize draw winner’s nominated bank account. In the case that the major prize draw winner does not have a bank account, the $20,000 cash will be awarded in the form of a cheque in the major prize draw winner’s name.

Prizes
Winners of each draw will be notified in writing via email within two (2) business days of the relevant draw. This notification email will be sent regardless of whether an Entrant chooses not to opt-in to receive future promotional and marketing messages, in accordance with clause 34 below. Entrants must follow the instructions in the notification email in order to claim their prize. The major prize winner will have their name published on www.facebook.com/MentosAustralia and www.facebook.com/MentosNewZealand from 26 September 2014.
Winners must claim their prize within three (3) months after the date on which they are notified.
Prizes will be awarded based on the winner’s local currency. To clarify, any valid Australian daily draw winner will receive AU$10 and any valid New Zealand daily draw winner will receive NZ$10. Any valid Australian major prize draw winner will receive AU$20,000 and any valid New Zealand major prize draw winner will receive NZ$20,000.
A total of11,001 prizes will be awarded. Total available prize pool is valued at AU$130,000/NZ$130,000.
A draw for any prize, which remains unclaimed, may take place on 5 January 2015at the place as the original daily draws at 10:00am AEDST, subject to any directions from a regulatory authority. The winner/s, if any, will be notified in writing by email within two (2) business days after the draw. In the case of a major prize winner, their name will be published on www.facebook.com/MentosAustralia and www.facebook.com/MentosNewZealand from 12 January 2015.

General
The Promoter’s decision is final and no correspondence will be entered into.
Prizes are not transferable or exchangeable, unless otherwise specified.
Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used.
The use of any automated entry or Game software or any other mechanical or electronic means that allows an Entrant to automatically enter or play the Game repeatedly is prohibited and will render ALL entries (i.e. each Purchase Entry and Game Entry) submitted by that Entrant invalid.
Entrants who win a prize consent to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same), in any media, for an unlimited period and without remuneration, for the purpose of promoting this Promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Any cost associated with entering the Promotion, or accessing the Website or the AU or NZ Facebook Pages in the Entrant’s responsibility.
If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia and New Zealand (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e)any tax liability incurred by a winner or Entrant; or (f) use of a prize.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian and New Zealand regulatory authorities. Entry is conditional on providing this information. The Promoter will collect, store, use and disclose personal information as set out in its Privacy Policy, which can be viewed at http://www.stuartalexander.com.au/privacypolicy.php (Australia) or http://www.dksh.co.nz/htm/634/en_NZ/Privacy.htm (New Zealand). In addition to any use that may be outlined in the Promoter’s Privacy Policy, for Entrants who ‘opt-in’ at the time of entry, the Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. The Privacy Policy also contains information about how Entrants may ‘opt-out’, access, update or correct their personal information, how Entrants may complain about a breach of the Australian or New Zealand Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose personal information to entities overseas, including entities located in Singapore, Australia and New Zealand.
For Entrants who enter via Facebook, continued participation in the Promotion is dependent on these Entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities. These can be viewed at www.facebook.com/terms.php.
This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants who enter via Facebook understand that they are providing their information to the Promoter and not to Facebook. The information an Entrant provides will only be used by the Promoter for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this Promotion must be directed to the Promoter and not to Facebook.
The laws of Australia apply to this Promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.
