Isuzu UTE Max Run Challenge 2014 (“Promotion”)
Prizes

Major Prize: A brand new Isuzu MU-X 4×2 LS-M, automatic, current national drive away price of $36,990 which includes one year vehicle registration, CTP insurance, dealer delivery and statutory charges. Excludes metallic/mica/pearlescent paint. The vehicle is to be collected by the winner from the Isuzu UTE dealer nominated in the entrant’s entry form. Total major prize pool value up to $36,990 including GST.

Minor Prizes: a weekly prize consisting of 1 x $250 Caltex fuel voucher to be given away to 1 person per week over 12 weeks. Total minor prize pool $3,000 ($250 x 12) including GST.

Total prize pool value: $39,990 including GST.
Conditions

1. The promoter is Isuzu UTE Australia Pty Ltd ABN 80 129 563 (“Promoter”) of 1000 Wynnum Road, Cannon Hill QLD 4170 (“Promoter’s Premises”) Phone: 07 3151 5888.

2. Entry for the Major Prize is via an online entry form accessible at www.isuzuute.com.au.

3. The promotional period commences at 9am AEST on 01/07/14 and final entries close at 11:59pm AEST on 30/09/14 (“Promotional Period”).

4. Only one entry per person is permitted for the Major Prize and only one successful entry per person per week for the Minor Prizes. In the case that two or more entries are submitted only the first entry will be counted.

5. The entry form for the Major Prize will require entrants to submit their entry guess, first name, last name, address, phone number, email address, their nearest Isuzu UTE Dealer and how they heard about the Promotion.

6. The Major Prize winner will be the person who estimates to the nearest metre the distance an Isuzu MU-X 4×2 LS-M automatic will have travelled on 1 Tank (65 Litres) of Caltex Vortex Diesel fuel, whilst being driven by the Promoter’s nominated expert economy driver and/or co-driver over an unknown route in Australia. For the avoidance of doubt, the Major Prize will be a brand new vehicle, not the actual vehicle used in this challenge.

7. The winner of the Major Prize will be announced via social media and the Promoter’s or participating partners’ (including Caltex) marketing collateral and post campaign material (including, but is not limited to, Max*D Magazine, D-MAIL eDM and Facebook). The winner’s name, photos and details of the Major Prize will be used in these materials and publications.

8. Fuelling verifications will be conducted at the start and finish location of the route. Each fuel verification will be conducted by a representative of a contractor to the relevant state/territory motorist association/club or other responsible person, who will supervise the fuelling procedure, formally witness in writing fuel volume intake and relevant odometer readings and seal and break numbered security seals on the vehicle’s fuel filler flap at such fuelling locations.

9.The Major Prize winner will be determined at 4pm AEST on 01/10/14.

10. In the event that two or more entrants submit the same closest estimate for kilometres and hundred metres travelled, the Major Prize winner will be determined by a random draw of those entrants to be conducted at 10am AEST on 02/10/14 at the Promoter’s Premises, 1000 Wynnum Road, Cannon Hill QLD 4170 in the presence of an independent witness.

11. The Major Prize winner will be notified in writing within two days of the draw and the winners first initial, surname and State/Territory will be published on 3/10/14 at www.isuzuute.com.au for a minimum period of 28 days and in The Australian Newspaper on 6/10/14.

12. The Promoter will endeavour to accommodate the winner’s choice of colour for the Major Prize, however the Promoter will have the right to substitute any other colour based on the Promoter’s sole discretion.

13. In addition to entering the Major Prize, entrants will be able to complete a different online quiz/game each week at www.isuzuute.com.au during the Promotional Period. All entrants who complete a quiz/game will go into a weekly draw, to be held at 10.00am at 1000 Wynnum Road, Cannon Hill QLD 4170. Minor Prizes (12 in total). A Minor Prize winner will be drawn at random on each of: July 11th, 18th, 25th; August 1st, 8th, 15th, 22nd, 29th; September 5th, 12th, 19th, 30th at the Promoter’s Premises.

14. The entry form for the Minor Prize will require entrants to submit their first name, last name, address, phone number, email address and their nearest Isuzu UTE Dealer.

15. The first initial, surname, suburb and State/Territory of each Minor Prize winner will be published on www.isuzuute.com.au and the Isuzu UTE Australia Facebook page on the day each winner is drawn (July 11th, 18th, 25th; August 1st, 8th, 15th, 22nd, 29th; September 5th, 12th, 19th, 30th 2014). Minor Prize winners will be notified in writing within two days of each draw. Additionally, the Promoter and partners can announce the winners of each weekly prize through their own channels, including but not limited to social media, eDMs, websites and print.

16. The first initial, surname, suburb and State/Territory of all Minor Prize winners will be published two days after each draw on www.isuzuute.com.au for a minimum period of 28 days.

17 Prizes are not transferable or redeemable for cash.

18. Information regarding how to enter, how to claim and details of prizes form part of these conditions of entry. Entry into this Promotion is deemed to be acceptance of these conditions of entry.

19. Entry is only open to Australian permanent residents aged 18 years or over, excluding the directors, management and employees of the Promoter and its promotional partners, and their related companies and agencies (and their immediate families).

20. As a condition of accepting a prize, the Winner must sign any documentation as and in the form required by the Promoter in its absolute discretion, including but not limited to a release and indemnity form.

21. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. In the event that an error occurs, the Promoter accepts no responsibility for costs incurred, responses received or any other consequences. The winners of prizes must notify the Promoter if their contact details change during the Promotional Period.

22. The Promoter may require winners to validate their details at any time prior to being eligible to claim a prize. The Promoter reserves the right to request winners to provide proof of identity and residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Promoter.

23. If for any reason any aspect of this Promotion is considered in the reasonable opinion of the Promoter to no longer be practical or desirable to run as planned for any reason, is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify, extend or suspend the Promotion and the promotional period, subject to any written directions of any relevant authority. In taking such action the Promoter may deem that the Promotion closed on a date different to that provided for in these terms and conditions, including a date that has already occurred.

24. The Promoter reserves the right, in its sole discretion, to disqualify entry from any person, and prohibit that person’s further participation in this Promotion, who tampers with, or benefits from any tampering with, the process or the operation of the Promotion, acts in violation of these terms and conditions, acts in a disruptive manner, or acts with the intent to annoy, abuse, threaten or harass any other person.

25. Subject, where relevant, to any directions given under the legislation regulating the Competition, if any prize is not being accepted or claimed within 3 months of the completion of the Promotion the Promoter reserves the right to conduct such further draws at 4pm AEST on 13/01/15 at the Promoter’s Premises, 1000 Wynnum Road, Cannon Hill QLD 4170. All winners of unclaimed prizes will be notified in writing within two days of the draw, with details of how to claim their prize. The name, suburb and State/Territory of residence of the winners of any unclaimed prizes will be published on www.isuzuute.com.au for a minimum period of 28 days and in The Australian Newspaper on 16/1/15.

26. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered (including but not limited to that arising from any person’s negligence) in connection with this Promotion and/or any aspect of any prize (including the transfer of any prize), except any liability that cannot be excluded by law in which case that liability is limited to the minimum allowable by law.

27. The Promoter and their associated agencies and companies accept no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of the competition results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

28. All entries will be the property of the Promoter. The information selected entrants provide will be used by the Promoter & associated partners (including Caltex), for the purpose of conducting this Promotion and to contact entrants that have opted in for offers and promotions or information regarding the Promoter’s products or those of its promotional partners (including Caltex) or associated companies and agencies. The Promoter may disclose selected entrants’ personal information to its dealers, contractors and agents to assist in conducting this Promotion or communicating with selected entrants and to State and Territory lottery departments and winners’ names may be published as required under the relevant legislation. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988. By contacting the Promoter, entrants can request access to the personal information the Promoter holds about them and/or request not to be contacted by the Promoter and/or its associated companies or agencies for marketing purposes. The personal information collected by the Promoter will be handled in accordance with the Promoter’s privacy policy available at http://www.isuzuute.com.au/privacy-policy.aspx.
