TERMS AND CONDITIONS
Participation
1. The promotion (‘the Promotion’) is conducted by Honda Australia Pty Ltd, (ABN 66 004 759 611) of 95 Sharps Road, Tullamarine VIC 3043 (“the Promoter”). All customer service queries should be directed to the Honda Customer Service Line: 1800 804 954.
Eligibility Criteria
2. Entry is only open to Australian residents aged 18 years or over who hold a current valid driver’s licence issued in an Australian State or Territory and are available to test-drive a Honda Odyssey VTi-L vehicle from 10/03/2014 to 18/03/2014 if selected as a Finalist (defined below). Individuals must have a Facebook account in order to access the promotional page.
3. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
Promotional Period
4. Promotion commences on 07/02/2014 and ends at 17:00pm AEDST on 05/03/2014 (“Promotional Period”).
How to Enter
5. To enter, individuals must complete the following steps during the Promotional Period:
(a) visit https://www.honda.com.au/bestcritic to be directed to the promotional application on the Honda Australia Facebook Page (“Facebook Page”);
(b) follow the prompts to the promotional entry page;
(c) input the requested details (including their full name, telephone number, postcode, date of birth and a valid email address);
(d) provide a description of who they will be carrying in their vehicle for the week;
(e) provide an original and creative review/critique of their current vehicle in 200 words or less;
(f) confirm if they are intending on purchasing a Honda (by selecting the relevant tick-box as prompted);
(g) select the tick-box agreeing to these Terms and Conditions; and
(h) submit the fully completed entry form.
Each entrant warrants to the Promoter that each review/critique submitted is an original creative work of the entrant that does not infringe on the rights of any third party. The content featured in each review/critique must comply with the provisions contained in clause 28. Each review/critique must be true, objective and accurate. Any reviews/critiques which contain misleading or incorrect information will be deemed invalid.
6. Incomplete or indecipherable entries will be deemed invalid. The Promoter takes no responsibility for late or misdirected entries.
7. Multiple entries permitted, subject to the following: (a) entry must be substantially unique; and (b) each entry must be submitted separately and in accordance with entry requirements.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Determination of the Finalists
10. This is a game of skill and chance plays no part in determining the winners.
11. Each entry will be individually judged based on the originality, literary merit and creative merit of the vehicle review/critique submitted, irrespective of the views expressed in the review/critique. The judges may select additional reserve entries which they determine to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant.
12. The best six (6) valid entries, as determined by the judges, will each win a $150 CALTEX Star Cash fuel voucher and use of a (fully fuelled) 2014 Honda Odyssey VTi-L vehicle to test-drive from 10/03/2014 to 18/03/2014 (“Finalists”). Each of the six (6) finalists will also win a GoPro camera to be used with their submission for the Major Prize (as contained in clause 17). The exact model of the GoPro camera to be awarded to the winner will be determined by the Promoter in its absolute discretion.
13. Finalists will be notified by telephone and email on 07/03/2014.
14. Any ancillary costs associated with redeeming the CALTEX Star Cash fuel voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.
15. The use of the 2014 Honda Odyssey VTi-L vehicle is subject to Honda standard terms and conditions in relation to test drives and similar arrangements. It is a condition of accepting the prize that the Finalist sign any such document as Honda may require prior to accepting the prize (including but not limited to a deed of release and indemnity). The driver must have a current valid driver’s licence issued in an Australian State or Territory. The car must be collected and returned to the nearest authorised dealer as nominated by the Promoter. Any traffic infringements incurred during the loan period are the responsibility of the winner. Any ancillary costs associated with redeeming the prize, including but not limited to, travel to and from the dealership, petrol and accommodation as required are the responsibility of the winner.
Determination of the Major Prize Winner
16. The six (6) Finalists will then have the opportunity to compete in a further game of skill competition for the chance to win the Major Prize (defined below).
17. To be eligible to enter, the Finalists must test-drive the Honda Odyssey VTi-L vehicle from 10/03/2014 to 18/03/2014 and document the test-drive using their GoPro camera installed in the vehicle provided. The Finalists will be given instructions on how to use the GoPro camera when the vehicle is provided. The Promoter will give finalists a list of scenarios they must shoot using the GoPro camera i.e. trip to the supermarket, dropping kids off at school, family weekend get-away etc. They must complete at least 70% of these tasks during the test-drive period. Each of the six (6) finalists will be required to return the vehicle along with the GoPro camera to their closest Honda Dealer at a pre-arranged time, which will occur between 9am on 18/03/2014 and 6pm on 19/03/2014, whereby the Promoter will retrieve the footage from the GoPro camera and return to the six (6) finalists once footage is retrieved.
18. To enter the Major Prize, the Finalists must then send an email tomelbourne@leoburnett.com.au between 14/03/2014 and 11:59pm AEDST on 17/03/2014, with the subject heading “All New Honda Odyssey Be Our Best Critic Promotion” and the body of the email containing an original and creative review/critique of the Honda Odyssey VTi-L in 600 words or less. The review/critique must outline their experience of the Honda Odyssey test-drive and address criteria such as the styling of the vehicle, interior space, quality finish, and drivability.
Each Finalist warrants to the Promoter that each review/critique submitted is an original creative work of the entrant that does not infringe on the rights of any third party, and that the review/critique of the Honda Odyssey VTi-L is true, objective and accurate. The content featured in each review/critique must comply with the provisions contained in clause 28.
19. The best entry (i.e. review/critique of the Honda Odyssey VTi-L), as determined by the judges in accordance with the criteria outlined in clause 11, will win a 2014 Honda Odyssey VTi-L with automatic transmission (“Major Prize”). Total vehicle value is up to AU$52,916 including registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary State by State). Additional insurance, options, petrol and all other ancillary costs are the responsibility of the winner. The Promoter may, in its absolute discretion accommodate the winner’s colour preference subject to availability. The winner must collect the prize from their nearest authorised Honda dealership.
20. The Major Prize winner’s review/critique of the Honda Odyssey VTi-L will also be featured in various media (at the Promoter’s discretion), and their review/critique combined with the footage captured on the GoPro camera during their test-drive of the Honda Odyssey VTi-L will be incorporated into a 60-second video review which will be featured on range of channels/media outlets (as determined by the Promoter in its absolute discretion), including but not limited to, cinema, the Promoter’s Facebook Page, the Promoter’s Youtube channel, digital display advertising, www.honda.com.au and on the MCN Network. The Major Prize winner will have the opportunity to work with the Promoter and a representative of the MCN Network to develop the 60-second video. In the event of a disagreement between the winner and the Promoter/MCN Network regarding the content of the video, the Promoter/MCN Networks’ decision will be final. By entering this promotion, entrants agree (in the event they are a winner) to the uses of their review/critique of the Honda Odyssey VTi-L along with footage they have taken using the GoPro camera, in accordance with this clause, without any remuneration.
21. The Major Prize winner will be notified by telephone prior to 03/04/2014 and their name will be published on the Facebook Page on 07/04/2014 after 09:00am AEDST.
22. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then the winner may assign the car to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form to be determined by the Promoter in its discretion.
