“Hong Kong Summer Spectacular” Game of Skill Competition 2014

CONDITIONS OF ENTRY

1. Competition and Promoter

1.1. By entering the “Hong Kong Summer Spectacular” Game of Skill Competition (Competition) and in consideration of the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of these Conditions of Entry.

1.2 The promoter of the Competition is “Hong Kong Tourism Board Australia (ABN 18001360225)” (Promoter).

2. Who may enter

2.1. Entry into the Competition via Facebook is open to all permanent residents of Australia aged 18 years or over who “Like” the “Discover Hong Kong (Australia)” page on Facebook at http://www.facebook.com/discoverhongkong.au. Persons who are eligible to enter are referred to as “Eligible participants”.

2.2 The officers, management, employees and contractors of the Promoter, their related entities, suppliers, retailers and partners associated with this Competition are not eligible to enter.

2.3 Each Eligible participant may enter as many times as he/she wishes provided that each entry is separate and unique and is in accordance with these Conditions of Entry. There is only one winner.

3. Competition Period

3.1 The Competition commences at 10am Australian Eastern Standard Time (AEST) on 1st April 2014 and closes at 5pm AEST on 30th April 2014.

3.2 All complete and valid entries will be entered into the Competition.

3.3 Entries not received by the Promoter during the Competition Period or not completed in accordance with these Conditions of Entry or otherwise invalid will be void.

4. How to enter

4.1 To enter the Competition, Eligible participants must, during the Competition Period enter via the Discover Hong Kong (Australia) Facebook Page.

(a) To enter an Eligible participant must “Like” the official Discover Hong Kong (Australia) Facebook page and must:

(i) use the Hong Kong Summer Spectacular application on the Discover Hong Kong (Australia) Facebook Page http://www.facebook.com/discoverhongkong.au/ to generate an entry form for the Competition in accordance with the instructions ; and

(ii) enter the details requested in the entry form, including the Eligible participant’s real and complete name (same as the Eligible participant’s travel document), telephone number and email address; and

(iii) answer the game of skill question (referred to as “Entry” hereinafter): “Tell us in 25 words or less, What travel type are you and why would you enjoy a trip to Hong Kong?

4.2 If an Eligible participant fails to comply with all of the requirements in paragraph 4.1(a), the entry will be deemed incomplete and will be void.

5. Judging of Entries

5.1. Judging of all Entries will be conducted by Hong Kong Tourism Board Australia at Hong Kong House, Level 4, 80 Druitt Street, Sydney NSW 2000 on 6th May 2014 for the Prize.

5.2. The Eligible participant who submits a complete and valid entry and provides the most creative and unique Entry for the game of skill competition (as judged by the Promoter in its sole discretion) will be the Winner of the Prize.

5.3. The judges’ decision is final and no correspondence will be entered into.

6. Prize and notification

6.1. There are two prizes to be won where each Winner of the Prize will win a return trip to Hong Kong for 2 adults- Australian residents and four (4) nights at either the InterContinental Grand Stanford Hong Kong or the Hotel Indigo Hong Kong Island. Each prize will be selected by the judges to be allocated to the respective winners. Travel must be taken from 9 May- 9 November 2014 (Black-out dates apply) and travel is subject to availability at time of booking. The two Prize winners are advised to book both flights and accommodation at the earliest time.

6.2 Each Prize consists of

a) 2 Qantas Return Premium Economy Class air tickets, including taxes and charges from any city in Australia that Qantas flies directly to Hong Kong. Both travellers must be Australian residents. Bookings must be made and ticketed by Qantas and are valid on Qantas operated services only.

b) Accommodation for 2 people staying 4 nights at either the InterContinental Grand Stanford Hong Kong in twin share Premier Harbour View Room (2 adults twin share) with daily buffet breakfast for 2 persons or the Hotel Indigo Hong Kong Island in twin share (2 adults twin share)with daily buffet breakfast for 2 persons.

c) Return airport transfers by Airport Express Link from Hong Kong International Airport to downtown for 2 people.

The prize does not include travel insurance, passports, spending money, visas, meals, ground transportation- other than Airport Express Link train transfers to downtown as specified herein, or any other costs of a personal nature not stated. Compliance with any health or other government requirements is the responsibility of the prize winner.

The prize must be booked and ticketed on or before 1st November 2014 and must be flown between 9 May -9 November 2014 and is subject to availability at time of booking. The prize is not valid for travel during Australian school holidays and the winner will not accrue Qantas Frequent Flyer points on the prize travel.

The prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize. The prize is not exchangeable or redeemable for cash or other goods or services. The prize cannot be transferred to any other person. No changes are permitted to travel arrangements once tickets are issued. If the prize is not utilised as stated it will be forfeited.

Qantas Airways Limited, its related bodies corporate, their officers, employees and agents will not be liable for any loss, damage or personal injury whatsoever (including but not limited to direct, indirect and consequential loss) suffered or sustained in connection with this competition, the promotion of this competition or the use of any prize, except for any liability which cannot be excluded by law.

Qantas will not be liable for any taxation, including FBT that may be levied as a result of winning.

6.3. The maximum total prize value of each Prize is approximately AUD$$7,850.00, depending on the city of departure and allocated hotel.

6.4 The Prize Winner will be notified by email or telephone as per the details provided in the entry form on 9th May 2014. The Promoter may require the Winner to provide proof of identity, proof of age and proof of residency in Australia. Identification considered suitable for verification is at the Promoter’s discretion.

6.5. The name of the Prize Winner will be published on the Discover Hong Kong (Australia) Facebook Page on 9th May 2014.

6.6. The Promoter accepts no responsibility for any variation in the value of a prize between 1st April 2014 and the date on which the prize is claimed. The prize is not transferable or exchangeable. The prize is not redeemable for cash and must be taken as offered. In the event that any element of the prize is not available, the Promoter reserves the right to substitute a prize of equal or greater value.

6.7 The Prize Winner acknowledges that the prize may be subject to additional terms and conditions imposed by third party prize suppliers. The Prize Winner must become acquainted with any such additional terms and conditions prior to accepting the prize. The Promoter does not accept responsibility and is not liable for any additional conditions imposed on the taking of the prize or the breach of those conditions by any person.

6.8 The Winner’s travel companions must be aged 18 or over and shall travel together with the Winner at the same exit port in Australia. All components of the prize must be taken together.

6.9 Any other travel costs are not included. Spending money, meals, tips, transfer fees (other than specified) domestic travel to and from departure point, passports, excess baggage, travel insurances, hotel incidentals (including mini bar, telephone and other incidentals) and other personal expenses are not included and must be paid for by the Winner.

7. Unclaimed prize

If the prize is unclaimed or forfeited by 9am AEST on 15th June 2014, the Eligible participant who submitted a complete and valid entry and provided the next most creative and unique answer to the game of skill question (as judged by the Promoter in its sole discretion) will be the alternate winner. The alternate winner will be notified by email or telephone as per details provided in the entry form by Hong Kong Tourism Board Australia.

8. Limitation of Liability

8.1 To the full extent permitted by law, each participant releases, the Promoter, Mindshare Pty, Facebook, their related entities, suppliers, retailers and partners associated with this Competition and their officers, management, employees and contractors from and against all liability for any loss or damage (including but not limited to any claim, injury, cost or expense) which is suffered or sustained to person or property or otherwise incurred by any person, Eligible participant or Prize Winner in connection with or in any way related to the Competition and/or using or participating in the prize, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter, Mindshare Pty, Facebook, their related entities, suppliers, retailers and partners associated with this Competition and their officers, management, employees and contractors ; and (iii) any liability for personal injury or death. It is a condition of accepting the prize that the Winner (or the alternate winner as the case may be) and his/her travel companions may be required to sign a legal release form determined by the Promoter in its absolute discretion.

8.2 It is the responsibility of the Winner and his/her travel companions to organise their own travel insurance.

8.3 The Promoter makes no representations or warranties as to the quality, suitability or merchantability of any of the goods or services offered as the prize, except as required by law.

8.4 The Promoter accepts no responsibility for any delay in delivery, or failure of safe delivery of a prize.

9. Privacy

9.1 By entering the Competition, the participant understands, agrees and consents to the Promoter collecting, using and disclosing the participant’s personal information for the purposes of conducting the Competition and if nominated by the participant on his/her entry form, communicating with the participant regarding special offers from the Promoter. Participants acknowledge that the Promoter may disclose personal information to Mindshare Pty and other distributors, agencies, suppliers and publishers involved in conducting the Competition for the purpose of conducting the Competition and awarding the prize. If a participant elects to receive information from third parties, the Promoter may also disclose the participant’s personal information for that purpose. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). The Promoter’s Privacy Policy is available at http://www.discoverhongkong.com/eng/about-hktb/privacy-policy.jsp. Participants may access the personal information the Promoter holds about them, notify the Promoter that they do not wish the information to be disclosed or notify the Promoter on subsequent changes or that they do not wish to receive further promotional material by contacting Hong Kong Tourism Board Australia (Promoter).

10. General

10.1 Upon winning a prize, the Prize Winner hereby assigns all of his/her copyright in his/her entry to the game of skill question in his/her entry form (image and/or text), without further compensation. The Prize Winner will sign any documentation required in order to perfect the assignment of these rights.

10.2 Eligible Participants warrant that they own the copyright in the Entry (image and/or text) they have submitted in their entry form.

10.3 Participants must not submit any Entry which is obscene, cruel, abusive, likely to cause offence, defamatory or otherwise in breach of any applicable law.

10.4 By submitting an Entry to the Promoter, each participant:

(a) represents and warrants that:

(i) the Entry is original work that has been created by the participant and has not been copied or reproduced or published or modified from anywhere else;

(ii) the Entry does not and will not violate or breach any of the terms of any other agreement the participant may be a party to;

(iii) the participant has not assigned his/her rights of the Entry to any other person;

(iv) the Entry does not contain defamatory, tortious or otherwise unlawful, untrue or inaccurate information;

(v) the Entry is not obscene, cruel, abusive or likely to cause offence;

(vi) the Entry does not breach any applicable law and does not infringe or violate any right of any person;

(vii) the Promoter will not be required to pay or incur any sums to any person or entity as a result of Promoter’s use or exploitation of the Entry as contemplated in these Conditions of Entry; and

(viii) the participant shall be solely liable to his/her Entry and shall fully and effectually indemnify the Promoter against all cost, claims and damages that it may suffer or incur due to or in connection with the participant’s Entry.

(b) unconditionally and irrevocably consents to any act or omission which would otherwise infringe any of his/her moral rights in the Entry.

10.5 This Competition is a game of skill.

10.6 The Prize Winner consents to the use of the Prize Winner’s name, suburb of residence, image, voice, photographs and Entry by the Promoter for editorial, advertising, promotional, marketing and/or other purposes and agrees to participate in promotional activities and such other publicity as reasonably requested by the Promoter, without further compensation except where prohibited by law. The Promoter owns the copyright in the Entry and in all images, photographs and material incorporating the images and photographs of the Prize Winner. This is a condition of winning a prize.

10.7 The prize remains the property of the Promoter until it is collected by the selected Prize Winner or alternate winner as the case may be.

10.8 The Promoter and Facebook do not represent or warrant that the site will be accessible without interruption or that any materials on the site, or the service that makes this available, are free from errors, defects, design flaws or omissions or from viruses or other harmful components. The Promoter and Facebook assume no responsibility for any delay in operation or transmission, communication line failure problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software of failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at the site, or any combination thereof. Any material and/or data downloaded or otherwise obtained through the use of the site is at the entrants own discretion and risk and no responsibility will be taken for damage to the entrant’s computer system or loss of data that results from the download of such material and/or data.

10.9 If for any reason this Competition is not capable of being conducted as planned, including infection by computer virus, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter or Facebook which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion, to disqualify any individual who was involved in the tampering of the entry process, and to cancel, terminate, modify or suspend the Competition.

10.10 The Promoter reserves the right to disqualify any individual who conspires with others to gain an unfair advantage or who is otherwise involved in manipulating, interfering or tampering with the entry process or any other element of the Competition. The use of any automated entry software or any mechanical, electronic or other means which allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

10.11 The Promoter reserves the right, in its absolute discretion, to remove, modify or not display any Entry submitted for the Competition.

10.12 Neither the Promoter, Facebook nor their authorised agents are responsible or liable in any manner for the Entry or other materials submitted or posted by participants or third parties in relation to the Competition.

10.13 Neither the Promoter, Facebook nor their authorised agents will take any responsibility for lost, ineligible, misdirected or late entries due to technical reasons, telecommunications issues or any other reason. Entries that are not genuine, are incomplete or late or are in any way fraudulent will be declared void. The Promoter and Facebook are not liable nor responsible for any error, omission, interruption, deletion, defect, delay in operation of transmission, communications line failure, theft, destruction, unauthorised access to, or alteration of, entries.

10.14 The Promoter may at any time disqualify an entrant or refuse entry of an entrant if the entrant fails to comply with these terms and conditions, the entrant is engaged in practices which subvert or are intended to subvert these terms and conditions or the Promoter determines that an entrant is tampering with the entry process or the operation of the Competition.

10.15 The Promoter is not responsible for receipt of incorrect, inaccurate or incomplete information caused by website users or by any of the equipment or programming associated or utilised in this Competition, or by any technical error that may occur in the course of administration of this Competition

10.16 Prize Winner is advised that tax implications may arise from winning a prize and should seek independent financial advice prior to accepting a prize. Prize Winner is responsible for all taxes which may be payable as a consequence of receiving a prize (except as otherwise specified in these Conditions of Entry).

10.17 The Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.

10.18 A Prize Winner will forfeit his/her prize if he/she is in breach of any of these terms and conditions or is involved in any unlawful use of the prize.

10.19 All entries remain the property of the Promoter.

10.20 In this Conditions of Entry, unless the context requires otherwise, the singular includes the plural and vice versa.

11 Contact details

11.1 It is the entrants’ responsibility to inform the Promoter of any change to the entrants’ contact details, including their email address.
