“SNAP UP A HOLIDAY” PROMOTION CONDITIONS OF ENTRY

1. Information on how to enter and prize details set out in all communications regarding the Snap Up a Holiday Promotion (the “Promotion”) form part of these Conditions of Entry. Any entry not complying with these Conditions of Entry is invalid. Entry into this Promotion and the acceptance or receipt of a prize by a winner is deemed as acceptance of these Conditions of Entry.
2. The Promoter is Commonwealth Bank of Australia (ABN 48 123 123 124) of 201 Sussex Street, Sydney, NSW 2000.
Promotional Period
3. Promotion commences at 9:00am AEST on 29/07/2014 and ends at 5:00pm AEST on
11/08/2014 (“Promotional Period”). Entry Instructions
4. Entry is only open to residents of Australia aged 18 years or over. Individuals must have a Facebook account in order to access the promotional page and submit an entry.
5. Employees and members of their immediate families (spouse, parent, sibling or child) of the Promoter and agencies associated with this promotion are ineligible to enter.
6. To enter, individuals must complete the following steps during the Promotional Period:
a) visit the Commonwealth Bank Facebook Page at
www.facebook.com/CommonwealthBank (“Facebook Page”);
b) follow the prompts to the Promotion entry page;
c) click the ‘allow’ button as prompted, to permit the Promoter access to their basic
information; and
d) confirm the requested details (including their full name, telephone number, and a
valid email address);
e) upload an original and creative photograph that depicts their favourite travel moment
(“Photograph”); and
f) submit the fully completed entry form so it is received by 5:00pm AEST on
11/08/2014.
Each entrant warrants to the Promoter that each Photograph submitted is an original creative work of the entrant that does not infringe on the rights of any third party. The Content featured in each Photograph must comply with the provisions contained in clause 35.
Uploaded files must be submitted in JPEG format and must not exceed 5 MB file size.
7. Upon completion of the above steps, subject to verification by the Promoter, individuals will then have their Photograph uploaded onto the Facebook Page for public voting. All Photographs will be reviewed by the Promoter for compliance with these Conditions of Entry. Photographs that contain prohibited or inappropriate content, or are otherwise in breach of these Conditions of Entry, as determined by the Promoter, will at the discretion of the Promoter be removed from the Facebook Page. In addition, any entrant that submits such content will not be eligible to win.
8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant

who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
9. Incomplete or indecipherable entries will be deemed invalid.
10. Multiple entries permitted, subject to the following: (a) each Photograph must be substantially unique; (b) each entry must be submitted separately and in accordance with entry requirements; (c) a maximum of three (3) entries per person and per Facebook account is permitted; (d) a maximum of one (1) Finalist Entry (defined below) per person and per Facebook account; and (e) a maximum of one (1) prize per person and per Facebook account.
Voting Instructions
11. Voting is only open to residents of Australia aged 13 years or over. Individuals must have a Facebook account in order to access the promotional page and cast a vote.
12. To vote, individuals must complete the following steps during the Promotional Period:
a) visit the Facebook Page;
b) follow the prompts to the Voting Gallery contained on the Snap Up a Holiday Application; and
c) click the “like” button corresponding to the Photograph they determine to be the most original and creative.
13. No prize will be awarded for the act of voting.
14. The Promoter reserves the right, at any time, to verify the validity of votes and voters (including a voter’s identity, age and place of residence) and to disqualify any voter who submits a vote that is not in accordance with these Conditions of Entry or who tampers with the voting process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. The Promoter reserves the right, at any time: (a) to invalidate any votes which it reasonably suspects have been submitted using false, incorrect, fraudulent or misleading information, including but not limited to personal details and contact information and/or votes that have been submitted through the use of multiple identities, email addresses or accounts, including but not limited to social networking accounts; and/or(b) to disqualify any entrant (orinvalidate his/her entry)that the Promoter reasonably suspects has paid, bartered, offered payment or offered incentives for others to vote for them (e.g. cash incentive) or to not vote for or decrease the number of votes for any other entry, or other consideration to another person in exchange for votes or in exchange for refraining from voting for decreasing the number of votes for any other entry, or has otherwise encouraged or procured any person to submit votes contrary to these Conditions of Entry.
16. Multiple votes permitted, subject to the following: (a) each vote must be submitted separately and in accordance with voting requirements; and (b) a maximum of one (1) vote is permitted per person per Photograph. For the sake of clarity, individuals are eligible to vote for multiple Photographs, however, they may only vote for each Photograph once.

17. The Promoter may, at its discretion, elect not to disclose the final number of votes cast or may elect, at any time during the Promotional Period or thereafter, to mask the number of votes cast.
Determination of Finalist Entries, Major Prize Winner and Runner-Up Winners
18. This is a game of skill and chance plays no part in determining the winners.
19. Subject to clause 23, at the end of the Promotional Period, the six (6) valid Photographs that received the highest number of valid votes (“Finalist Entries”) will then be judged by professional photographer Richard I’Anson to determine the Major Prize winner (defined below). In the event that an entrant has two (2) or more of their Photographs qualify to be a Finalist Entry, only their top ranking Photograph (i.e. the Photograph to receive the highest number of votes) will be a Finalist Entry, and the remaining Photograph/s will be disqualified.
20. Each Finalist Entry will be individually judged based on originality, creative merit, and how well the Photograph encapsulates the promotional theme. Richard I’Anson may select additional reserve Photographs which he determines to be the next best, and record them in order of merit, in case of an invalid entry or ineligible entrant.
21. Winners will be notified by email.
22. The best valid entry from all Finalist Entries, as determine by Richard I’Anson, will win a AU$4,000 Flight Centre Gift Card and a AU$2,000 CommBank Travel Money Card (“Major Prize”).
23. The remaining five (5) Finalist Entries will each win a AU$500 Flight Centre Gift Card and a AU$500 CommBank Travel Money Card (“Runner-Up Prize”).
24. In the event of a tie between two (2) or more entrant for one of the Finalist Entry positions, Richard I’Anson will judge each of these tied entries against each other based on the criteria outlined in clause 18, and will select which tied entry will be deemed the Finalist Entry.
25. The following terms apply to the Flight Centre Gift Cards issued on behalf of Flight Centre Limited (“FCL”) trading as “Flight Centre”, “Student Flights”, “Escape Travel”, “Travel Associates”,“Cruiseabout”, “My Adventure Stores” or “Travel Club” (each a “Gift Card”). By purchasing, redeeming or attempting to redeem a Gift Card, individuals agree to the following terms:
i. Gift Cards are redeemable at participating FCL retail stores located within Australia;
ii. Unless otherwise stated on the Gift Card, Gift Cards are valid for use within 12
months from the date of issue;
iii. Gift Cards may only be applied up to the maximum value loaded onto the Gift Card
which is unspent at the time of use. Where the cost of purchase exceeds the available balance of the Gift Card, the excess amount must be paid by another payment method;
iv. Gift Cards may be redeemed in whole or part during the validity period. Where used in part, no change will be given. Any unused balance may be used against future purchases, but will not be refunded or credited when the Gift Card expires;
v. Gift Cards cannot be reloaded;
vi. Gift Cards may not be redeemed or exchanged for cash, traveller’s cheques, cash
passports or any other form of currency;
vii. Individuals are responsible for the use and security of their Gift Card. Lost or stolen
Gift Cards may not be replaced or refunded. Individuals are liable for all transactions on their Gift Card except those caused by fraud or negligence by FCL or its

employees;
viii. Defaced, mutilated or altered Gift Cards may not be accepted, replaced or refunded;
ix. Gift Cards may not be used for payment of credit or retailer accounts;
x. Personal information collected in relation to the Gift Card will be handled in
accordance with FCL’s Privacy Policy which is available at www.flightcentre.com.au
or in store;
xi. The laws of Australia apply to these terms and conditions and any disputes arising in
relation to them; and
xii. Questions or problems relating to Gift Cards should be directed to FCL’s Gift Cards
department on gift_cards@flightcentre.com or (03) 9026 3859. Complaints about purchases made with a Gift Card should be resolved directly with the store concerned.
26. In the event that a winner already has a CommBank Travel Money Card, they will receive the sum of AU$2,000 (for the Major Prize winner) or AU$500 (for a Runner-Up Prize winner) loaded on to their existing CommBank Travel Money Card account. In the event that a winner does not have a CommBank Travel Money Card, they will need to register for a CommBank Travel Money Card before the relevant funds can be loaded. To register for a CommBank Travel Money Card, individuals will need to show identification and follow the Travel Money Card Conditions of Use found in the Product Disclosure Statement (available at www.commbank.com.au/travelmoneycard). Any ancillary costs associated with using the CommBank Travel Money Card are not included. Any unused balance of the CommBank Travel Money Card will not be awarded as cash. Redemption of the CommBank Travel Money Card is subject to any terms and conditions of the issuer including those specified on the CommBank Travel Money Card.
27. Total prize pool value is AU$11,000.
General
28. The Promoter reserves the right to request that the winners demonstrate their eligibility for a prize as a condition of receipt of a prize. Identification considered suitable for verification is at the discretion of the Promoter. This may also include requiring winners to execute any documentation which the Promoter deems necessary or desirable to confirm eligibility.
29. The Promoter’s decision is final and no correspondence will be entered into.
30. The Promoter will arrange for delivery of the prizes within Australia, after the selection of the winning entries, by mutual agreement with the winners.
31. In the event that for any reason a winner does not take a prize (or an element of a prize) at/by the time agreed by the Promoter, then that prize (or that element of the prize) will be forfeited by that winner and cash will not be awarded in lieu of the prize.
32. The Promoter will use its best endeavours to provide the prizes listed. If any prize/s are unavailable for whatever reason, the Promoter, reserves the right to substitute that prize for a prize of an equivalent value.
33. Prizes are not transferable or exchangeable and cannot be taken as cash.
34. The winners accept the prize ‘as is’ and acknowledge that the Promoter accepts no responsibility for any tax implications that may arise from the prize. The winner should seek advice from the Australia Tax Office or their own taxation adviser or independent financial adviser.

35. The Promoter accepts no responsibility for late, lost or misdirected entries.
36. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to Photographs (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that.
(a) they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
(b) their Content shall not contain viruses or cause injury or harm to any person or entity;
(c) they will obtain prior consent from any person or from the owner(s) of any property that
appears in their Content;
(d) the Content is the original artistic work of the entrant that does not infringe the rights of
any third party;
(e) they consent to any use of the Content which may otherwise infringe the Content
creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that
they have the full authority to grant these rights; and
(f) they will comply with all applicable laws and regulations, including without limitation,
those governing copyright, content, defamation, privacy, publicity and the access or use of others’ computer or communication systems.
Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.
37. As a condition of entering this promotion, each entrant licenses the Promoter to manage and publish their Content to the Facebook Page for public viewing, public voting, and judging, as outlined in these Terms and Conditions, for the duration of the Promotional Period.
38. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome).
39. If for any reason this Promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may take any action that may be available including cancelling, terminating, modifying or suspending the Promotion. The Promoter reserves the right in its sole discretion to disqualify the individual who tampers with the entry process.
40. Any cost associated with accessing the Facebook Page is dependent on the Internet Service Provider used and is the responsibility of the entrant/voter.
41. To the extent permitted by law, the Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, technical problems or traffic congestion on the internet or any website, or any combination thereof (including, but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or downloading materials in this Promotion.

42. To the extent permitted by law, the Promoter and its related entities and its and their respective directors, officers, employees and agents, will not be liable for any personal injury, loss or damage, whatsoever which is suffered or sustained (including, but not limited to) indirect or consequential, financial or other loss) to or by a winner.
43. Nothing in these Conditions of Entry limits, excludes or modifies or purports to limit, exclude
or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non- Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
44. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; or (e) taking and/or use of a prize.
45. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
Your Privacy
46. The Promoter collects entrants’ personal information so that it may process their entry, administer this Promotion and contact entrants, for the period of the campaign only unless otherwise advised. Information may be disclosed to third parties who assist the Bank in administering the competition. Whether the recipients are located in Australia or overseas. Entry is conditional on provision of this information. Entrants may access and correct their information by contacting the Privacy Officer, Customer Relations, Commonwealth Bank Group, Reply Paid 41, NSW 2001, by calling the Promoter on 13 2221 or by visiting any branch of the Promoter.
