Clearasil – Goodlife Festival Photo Competition
Terms and Conditions
1. Information on how to enter and prizes form part of these conditions. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.
2. The Promoter is Reckitt Benckiser (ABN 17 003 274 655) of 44 Wharf Road, West Ryde, 2114 NSW Australia (PH: 02 1800 022 046).
3. The competition opens 4:00pm AEDT 15th January 2014 and closes 5.00pm AEST 19th February 2014. (Competition Period).
Eligibility to Enter
4. Entry is open to residents of Australia who are between 13 to 18 years of age, who have obtained their parents or guardians consent and who have a Facebook account. (“Eligible Entrants”).
5. Employees and their immediate families of the Promoter and its agencies associated with this competition are ineligible to enter.
6. An Eligible Entrant will be eligible to win one (1) of the two (2) Prizes on offer.
There will be a total of twenty-four (24) ‘VIP Experience’ packaged as eight (8) ‘triple passes’ (three passes – one for you, two for your friends) to be won
These will be broken down as two (2) winning photos that are rewarded with triple passes for the following festivals:
There will be a total of forty-eight (48) ‘General Admission’ tickets packaged as sixteen (16) ‘triple passes’ (three passes – one for you, two for your friends) to be won
These will be broken down as the four (4) runner up photos that are rewarded with triple passes for the following festivals:
7. The MAJOR PRIZES prize pool value is $2,880 AUD. The MINOR PRIZES prize pool value is $4,560 AUD. The total prize pool value is RRP $7,440 AUD.
How to Enter
8. To enter, Eligible Entrants must complete the following during the Competition Period:
a. Log onto www.facebook.com and visit the Clearasil Australia Facebook page.
b. Become a ‘fan’ of the Clearasil Australia Facebook Page by “Liking” the Clearasil Australia Facebook page.
c. Go to the “Goodlife Festival” application.
Complete the application form by uploading a photo that relates to the direction of “Upload a pic that best shows you and your friends living the good life.” (“The Question”) and providing the following mandatory information (Text fields provided in entry form):
i. First Name
iv. Date of Birth
v. Mobile Phone number
vi. Post Code
vii. City of the Goodlife festival you are registering to attend
d. Eligible Entrants can only enter the Competition once.
e. Eligible Entrants must agree to the Terms & Conditions and to being contacted by the Promoter in conjunction with this competition.
The judging will be held on Thursday 20th February 2014.
The judging criteria for all entries submitted by a photo upload relating to “Upload a pic that best shows you and your friends living the good life.” is as follows:
The creativity of the photo.
Originality of the photo.
Relating the photo to the direction that features both friends in a social setting, and a representation of ‘the good life’ concept
The competition will be judged by a panel of 3 judges provided by the Promoter.
The entries which the judges deem in their absolute discretion have satisfied all components of the Judging will win. The judge’s decision is final and no correspondence will be entered into.
Winners will be notified by mobile phone and email at the details they provided in accordance with paragraph 8 by 5pm AEST on 21st February 2014. Prizes will be sent to the winners at the address provided by the Eligible Entrants in accordance with paragraph 8 by Tuesday 25th February 2014.
Prizes will be awarded to the person named on the application form as per clause 7(d).
In the event a winner is unable to accept any of the Prizes, the Eligible Entrant with the next best entry as judged by the judges in accordance with the Judging Criteria will be deemed the new winner of one of the Prizes. The Eligible Entrant that is deemed the new winner will be notified by email within 1 business day of the judge’s decision.
This is a game of skill and chance plays no part in the determination of the winner.
Prizes are not transferable and are not redeemable for cash. Any unused Prize is also not transferable or redeemable for cash. The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. Entries will be deemed void if illegitimate, forged, manipulated or tampered with in any way.
In the event that the Prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value, unless to do so would be prohibited by law.
Entry and continued participation in the Promotion is dependent on Eligible Entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at http://www.facebook.com/terms.php.
This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Eligible Entrants understand that they are providing their information to the Promoter and not to Facebook. The information an Eligible Entrant provides will only be used for the purposes outlined in this Terms and Conditions document. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook.
The Promoter reserves the right to request verification of age, identity, residential address of the Winners and any other information relevant to entry into or participation in this Competition. Verification is at the discretion of the Promoter, whose decision is final. The Promoter reserves the right to disqualify any individual who is involved in any way in interfering or tampering with the conduct of this Competition.
Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify any statutory consumer guarantees or any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non-Excludable Guarantees”). Subject to the limitations in the preceding sentence, the Promoter excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Guarantee, the Promoter (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the Competition, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry, Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms and conditions; (e) any tax implications; and/or (f) the Prize or use of the Prize.
In participating in the Competition. Eligible Entrants consent to the Promoter using the Eligible Entrant’s photograph, name, or likeness, in any media including on Facebook for an unlimited period of time without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
Each photograph uploaded/ submitted as an entry or part of an entry (“Work”) includes the copyright in the work and is owned by the Promoter. Work(s) will not be returned to any Eligible Entrant. For the avoidance of doubt, the Promoter may use all or any part of any Work(s) for any purposes at its discretion, including, without limitation, using the entrant’s Work(s) for promotional, marketing or publicity purposes, whether in respect of this Competition, the Promoter, or otherwise
Should an Eligible Entrant’s contact details change during the Competition Period, it is the Eligible Entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, (including but not limited to) any injury or damage to participants or any other person’s computer related to or resulting from participation in or down-loading any materials in this competition.
It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements.
It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, unless to do so would be prohibited by law.
The laws of New South Wales apply to this Competition to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of New South Wales.
