“Berocca Ultimate Summer” Facebook COMPETITION RULES (“OFFICIAL RULES”)

1. General

a) Registration Instructions form part of these Official Rules. Entries must comply with all of these Terms and conditions to be valid.

b) By registering for the Competition, the Entrant agrees to be bound by these Official Rules.

c) Competition registration is open from 00:01am AEST on 18/11/2013 and closes at 23:59pm on 02/03/2014 (” Entry Period “). No late registrations will be accepted.

d) This Competition is a game of skill in which chance plays no part in determining the winners.

e) This promotion is not sponsored, endorsed, administered by, or associated with Facebook. Any questions, comments or complaints will be directed to Bayer. Facebook is not associated with this promotion and by entering; you fully and completely release Facebook from any liability arising out of this promotion.

2. Promoter

a) The Promoter is Bayer Australia Limited (ABN 22 000 138 714) a company incorporated in Australia and having its registered office at Bayer Australia Ltd, 875 Pacific Highway, Pymble, NSW, 2073, Australia (“Promoter”).

3. Participating Countries

a) This Competition will be held in the following countries: Australia (” Participating Countries “).

4. Eligibility and Entry Conditions

a) Registration for this Competition is open to residents of the participating countries who have attained the age as specified as at Competition Start Time: Australia (18 years of age) ( “Age of Legal Majority” ).

b) Where an Entrant, resident in these countries has not attained the Age of Legal Majority in his or her country of residence, the Entrant may still enter in the Competition if he or she has obtained the consent of his or her parent or legal guardian to enter the Competition and the Entrant’s parent or legal guardian agrees to these terms and conditions on the Entrant’s behalf.

c) Employees of the Promoter and/or its related companies and/or any agencies associated with the Competition, and members of their respective immediate families*, are not eligible to participate in the Competition. *”Immediate family” means spouse, de facto spouse, parent, natural or adopted child, and sibling (whether natural, or adopted by a parent), whether or not they live in the same household as the employee.

d) In registering for this Competition, Entrant shall warrant that he or she is an eligible Entrant.

e) Users can enter the competition as many times as they want.

5. Cheating, Abuse and Disorderly Behaviour

Any Entrant may be disqualified from this Competition at the discretion of the Promoter for any failure to comply with these Terms and Conditions or cheating in any way such as

a) Using any cheats, hacks or other party “helper” applications or “bots” to simulate human interaction;

b) Exploiting the application in any way or using the application in any way that circumvents the purpose and conditions of the Competition.

Abusive behaviour, including any use of harassing, negative, or profane language in Entrant submissions will not be tolerated and will also constitute grounds for immediate disqualification.

6. Format and Structure

a) To enter, an Eligible Entrant must have a current Facebook Account for the duration of the Entry Period of the promotion.

b) To register for the “Berocca Ultimate Summer” Facebook Competition (this “ Competition ”) and have a chance to win great prizes, all you need to do is to go to the Berocca Australia Facebook fan page (http://www.facebook.com/BeroccaAustralia) and register through the competition application tab “Berocca Ultimate Summer” (“ Entrant ”) during the Entry Period.

c) To ensure that you complete the entry correctly, you must then follow prompts that take you through to completion of the Competition:

i.To begin the entry process, the entrant must answer the fortnightly question in 25 words or less.

ii.Each entrant must enter their full, first and last Names, Email address, Postal Address, Contact telephone number, Date of Birth and Berocca Usage and then agree to these Terms and Conditions.

iii.All entries must be legible and the original work of the entrant. Incomplete, damaged or incomprehensible entries will be deemed invalid.

d)Within 5 working days of the completion of each Competition week as stipulated in Section 7, the Promoter will decide a winner from all the entries submitted and the winner will be judged on who gives the most creative response in 25 words or less for the respective question (“Winner”) .

7. Timing

a)There will be ONE winner drawn after the completion of each fortnight during the Competition (“Round”) from Entrants who have entered between the following dates.

8. During the Competition Period entrants should:

9. Winner Prize Conditions

a) Unless satisfactory proof of age any other is received within this period, the Promoter reserves the right to disqualify Winner and select another Entrant to receive the Prizes that the disqualified participant would have been awarded were it not for his or her disqualification.

b) If the value of a Winner Prize is specified in Section 8, to the fullest extent permitted by law the Promoter takes no responsibility for any variations in that value.

c) Except with the written consent of the Promoter, Winner Prizes are not transferable or exchangeable and non-cash prizes cannot be taken as cash. The Promoter has absolute discretion as to whether to provide such consent and is under no obligation to provide any reasons to any person for providing, or withholding, consent.

d) In the event that any Winner Prize is unavailable, the Promoter reserves the right to substitute the Winner Prize with cash or another prize of equal or greater value.

10. Taxes

a) Any taxes which may be payable as a consequence of a Winner receiving a prize are the sole responsibility of the Winner. Without prejudice to the foregoing, the Promoter reserves the right to deduct any taxes owing in respect of such Winner Prize from any cash amounts payable, to the extent applicable.

11. Adverse Experience Reporting and Recalls

a) If Promoter or Winner becomes aware of any defect, fault or other condition, actual, potential or threatened, in any Products in which Winner has taken possession such that they should not be offered for sale to the public (“adverse experience”) having regard to the nature and the extent of the threat, then that party must immediately give notice to the other party of the Products affected by reference to invoice numbers, product descriptions, batch codes, best before/used by date codes, APN’s, item code numbers, quantities supplied, date of possession and any other unique identifier.

12. Recordings, Media and Publicity

a) In registering for this Competition, each Entrant authorises the Promoter to use, publish and display his or her name and likeness or any reproduction or modification thereof, in any manner and medium throughout the world for advertising, trade, promotion, exhibition and any other lawful purpose.

13. Exclusion of Liability

a) By registering for this Competition each Entrant assumes sole liability for any personal injury and/or damage to property caused or claimed to have been caused to him or her as a result of or in connection with participating in this Competition and/or any Winner Prize.

b) To the extent permitted by law, the Promoter is not responsible or liable for:

i. inaccurate registration information or unsuccessful registration,

ii. purported entries that are not received for any reason, including because they are lost, misdirected or stolen, or that are received, but are late, illegible, or incomplete

iii. any problems or technical failures of any kind, including malfunction of any communication network or lines, computer online systems or network, servers or providers, computer equipment, or software,

iv. the unavailability or inaccessibility of any service whether or not caused by traffic congestion on the Internet or at any website,

v. unauthorised human intervention in any part of this Competition,

vi. electronic or human error which may occur in the administration of this Competition,

vii. any loss, damage or injury suffered or incurred by any Entrant or any other person as a result of or in connection with participation in this Competition and/or any Qualifier or Winner Prize, howsoever caused;

viii. any injury or damage to persons or property, including to the Entrant’s or any other person’s computer related to, or resulting from, participation or downloading any materials in connection with this Competition.

c) These Official Rules do not affect, and are not intended to affect, any rights or remedies a consumer might have, which cannot be excluded under applicable consumer protection laws. To the fullest extent permitted by law, any liability of the Promoter or its servants or agents for breach of any such rights is limited to the payment of the cost of having the Prize supplied again.

14. Tampering and other Failures

a) If for any reason this Competition are not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process or who may benefit form such tampering, and/or to cancel, terminate, modify or suspend this Competition.

15. Privacy

a) In order to participate in the Competition, the Promoter will collect personal data from all Entrants for the following purposes:

i. to administer and promote the Competition, its Entrants and any entries received

ii. to contact Entrants regarding the Competition.

b) The personal data of all Entrants may be provided to third parties who perform certain tasks for the Promoter in connection with the Competition including but not limited to the Promoter’s contractors, agents or other operators.

c) If an Entrant does not truthfully provide all personal data requested by the Promoter, the Promoter may determine that the Entrant is not eligible to win any prizes.

d) By checking the relevant box at the time of providing his or her personal information, all Entrants consent to the use of their personal data for the Promoter’s promotional and marketing purposes in connection with the Competition and agree to participate in reasonable promotional activities in connection with the Competition as requested by the Promoter.

e) The Promoter will make all reasonable efforts to maintain appropriate safeguards to ensure the security, integrity, accuracy and provide of the information provided.

f) If any Entrant wishes to request access to their personal data or to correct it, the entrant may contact the Privacy Administrator at their nearest address found on http://www.bayer.com.au to request access to any of their collected personal information that is still held. 16. Governing Law and Jurisdiction

a) These Conditions are governed by the laws of New South Wales, Australia and the parties submit to the non-exclusive jurisdiction of its courts for the resolution of any dispute, difference, controversy or claim arising in connection with these Official Rules and/or this Competition.
