TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions. Registration and entry in this promotion is deemed acceptance of these Terms and Conditions.
2. The Promoter is American Express Australia Limited (ABN 92 108 952 085) of 12 Shelley Street, Sydney NSW 2000 (“the Promoter”).
3. Promotion commences at 9.00am AEST on Monday 4th August 2014 and closes at 11.59pm AEST Sunday 28 September 2014 (“Promotion Period”). Entries received outside the Promotion Period will not be accepted.
Eligible Entrants
4. Subject to clause 6, Entry is only open to residents of Australia aged 18 years or over.(“Eligible Entrants”).

5. Directors, management and employees (and their immediate families) of the Promoter, its agencies associated with this promotion and their respective related bodies corporate, are not eligible to enter this promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

6. To enter, Eligible Entrants must complete the following steps during the Promotion Period:

a) Visit the Promoter’s Facebook page at www.facebook.com.au/AmericanExpressAustralia (“Facebook Page”);
b) Click through to the donna hay comp on the Facebook Platform; and
c) Fully complete and submit the online entry form, which includes answering the competition question in 25 words or less.

The Prizes
4 There will be a maximum of 20 (twenty) Major Prizes.
5 Each major prize is valued at RRP$59.95 (including GST)
6 Each major prize includes 1 (one) personalised-by-name donna hay ‘The New Classics’ cookbook

How to Enter
6 To enter the competition for a chance to win one of the Major Prizes, Eligible Entrants must:
i. Go to the American Express Facebook Page and click through to the donna hay comp Tab.
ii. Write in 25 words or less the answer to the competition “question” – if you could ask Donna Hay 1 question, what would it be and why?
7 Eligible Entrants can enter the competition only once over the promotion period. Any subsequent attempts to enter will not be accepted as a valid entry.
8 Eligible Entrants must agree to these Terms and Conditions and to being contacted by the Promoter in conjunction with this promotion.
Judging Criteria
9 The entries will be judged by 4 Members of the American Express Australia Public Affairs and Brand Marketing teams on Friday 3rd October 2014.(“Judging Panel”)
10 The judging criteria for all entries answering the Question are as follows:
a. Must answer the Question in 25 words or less; and
b. The response must be appropriate to share with people of all ages & walks of life.
c. The response will be judged on creativity and relevance to the question
11 The Judging Panel will:
d. Short list up to 30 entries based on the most creative and unique answers to the Question.
e. Score each of the shortlisted entries out of 10. 10 being the highest score, 1 being the lowest.
12 The top 20 best, valid entries, with the highest score as determined by the Judging Panel, will win the Major Prizes. The judge’s decision is final and no correspondence will be entered into.
13 This is a game of skill and chance plays no part in determining the winners.
14 Winners will be contacted by email by no later than close of business on Monday 6th October 2014. Major prizes will be awarded to the respective winners. In the event the prize winner is unable to accept the prize or does not respond to the email by COB Monday 20th October, the Eligible Entrant with the next best entry as judged by the judges as per clause 10, will be deemed the new winner of the prize. The Eligible Entrant that is deemed the new winner will be notified by email within two (2) business days of the judge’s decision.
General Conditions
15 The prize is not transferable or exchangeable and cannot be taken as cash in part and/or in full. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by The Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
16 Prize winners are advised that Tax implications may arise from their prize winnings and they should seek independent financial advice prior to the acceptance of the prize.
17 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result.
18 The Promoter reserves the right to request winners to provide proof of identity and proof of employment in order to claim a prize. Proof of identification and employment for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
19 Unless expressly stated in these terms and conditions all other expenses become the responsibility of the Major Prize winner. This includes, but is not limited to, meals and drinks (outside of those indicated) and transport.

20 If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation.

21 The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

22 In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.

23 Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.

24 It is a condition of accepting the major prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements.

25 It is a condition of accepting the major prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

26 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation.

27 The Promoter and their related bodies corporate, their officers, employees and agents shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.

28 The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.

29 The Promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserve the right to take any action that may be available.

30 If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation.

31 By entering the promotion, unless otherwise advised, each Eligible Entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Eligible Entrant.

32 If required, Eligible Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. A request to access, update or correct any information should be directed to the Promoter.

33 In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right (subject to any written directions under applicable law) to cancel, terminate, modify or suspend the promotion.

34 No responsibility is accepted for late, lost or misdirected entries.

35 Incomplete or indecipherable entries will be deemed invalid

36 All entries become the property of American Express. The winner agrees to allow American Express to use his/her particulars for the purposes of marketing, publicity, promotional or direct mailing (unless they have already notified American Express Australia Limited to not do so).

Privacy Consent

37 To provide this competition, the Promoter needs to collect personal information about the Eligible Entrant. If the Eligible Entrant does not provide the information requested, the Promoter may not be able to provide the Eligible Entrant with the competition entry. The American Express Privacy Policy Statement sets out policies on management of personal information. To arrange access to personal information about Eligible Entrant, request a copy of the American Express Privacy Policy Statement or enquire generally about privacy matters, write to the Promoter. The Eligible Entrant agrees that subject to the Privacy Act, the Promoter or their agents may do the following:

• Transfer personal information confidentially to the Promoter’s related companies or organisations that provide services in relation to this competition. This includes transferring personal information to the USA or other countries for data processing and servicing;
• Disclose Eligible Entrants’ personal information to State and Territory lottery departments (if required);
• Publish winners’ names as required under the relevant lottery legislation (if required); and
• Use the winner’s personal information in any media for publicity purposes associated with the competition without any further payment or other compensation, unless the winner otherwise notifies the Promoter at time of accepting the prize.
