“FOX FOOTY ‘So You Think You Can Commentate'” Game of Skill Competition
CONDITIONS OF ENTRY
1. Competition and Promoter
1.1 By entering the “FOX FOOTY ‘So You Think You Can Commentate’
Competition” (Competition) and in consideration for the opportunity to
participate in the Competition, each entrant agrees to be bound by and
observe these Conditions of Entry. Information on how to enter and prize
details form part of these Conditions of Entry.
1.2 The promoter of the Competition is FOX SPORTS Australia Pty Limited ABN
16 065 445 418 of 4 Broadcast Way, Artarmon NSW 2064 (Promoter).
2. Who may enter
2.1 Subject to paragraphs 2.2 and 2.3, entry into the Competition is open to all
permanent residents of Australia.
2.2 Any entrant aged under 18 years must obtain consent from their
parent/guardian prior to entering the Competition.
2.3 The officers, management and employees (and immediate family members of
officers, management and employees) of the Promoter, the Australian
Football League (AFL) and their related corporations and associated
agencies are not eligible to enter the Competition.
2.4 Each entrant may submit unlimited entries to the Competition during in the
Competition Period (defined below), provided each entry is unique.
3. Competition Period
3.1 The Competition commences on 11 February 2019 at 12:00pm Australian
Eastern Daylight Time (AEDT) and ends at 12:00pm AEDT on 3 March 2019
(Competition Period).
3.2 Entries not received during the Competition Period or not completed in
accordance with these Conditions of Entry will not be eligible to win.
4. How to enter
4.1 Eligible entrants must, during the Competition Period,
a) record a selfie video, of not more than thirty (30) seconds in length, either
demonstrating their best commentary impersonation or putting their own
commentary skills to the test; and
b) upload the video on the entry page on either the Competitions section of
the FOX SPORTS Website.
(each an Entry).
4.2 Without limiting paragraph 10 below, by submitting an entry to the Promoter,
each entrant acknowledges that the Promoter may (but does not guarantee
that it will) display the entrant’s Entry on FOX SPORTS’ broadcast television
channels, or FOX SPORTS’ social media platforms.
4.3 To be eligible to win a prize, entrants must not remove their entry from the
FOX FOOTY competition page before 3 March 2019. Entries that are
removed will not be considered in the Competition.
5. Prize and notification
5.1 Judging of all entries received during the Competition Period will be
conducted by the Promoter at 4 Broadcast Way, Artarmon NSW 2064 on 4
March 2019.
5.2 The entrant who submitted the most creative and unique Entry during the
Competition Period (as judged by the Promoter in its sole discretion) in
accordance with these Conditions of Entry will win:
(a) the opportunity to provide five minutes of on-air commentary as part of
the FOX FOOTY commentary team during the 2019 JLT Community
Series Round 2 match between Geelong Cats and Essendon
Bombers at GMHBA Stadium, Geelong, Victoria on 7 March 2019,
valued at a maximum of A$1,500; and
(b) travel expenses for the prize winner and one travel companion,
including return economy airfares for the prize winner and one travel
companion from the Australian capital city nearest to the prize
winner’s place of residence to Melbourne, up to a maximum of
A$1,500.
5.3 The total prize value is A$3,000 (including GST).
5.4 The Promoter will contact the prize winner by message on 4 March 2019. The
prize winner must accept or reject the prize by 12:00pm AEDT on 5 March
2019.
5.5 The Promoter accepts no responsibility for any variation in the value of a
prize. The prize is not transferable or exchangeable. The prize is not
redeemable for cash and must be taken as offered. If for any reason the prize
winner does not take an element of the prize during the stated period and on
the conditions stipulated by the Promoter or any third party, that element of
the prize will be forfeited and cash will not be awarded in lieu of that element
of the prize. If the capital city nearest to the prize winner’s place of residence
is Melbourne, the economy class airfares for that element of the prize will not
form part of the prize.
5.6 AFL reserves the right in its absolute discretion to change or amend the JLT
Community Series fixture without notice. Neither the Promoter nor AFL accept
responsibility for the cancellation or delay of any match connected with this
Promotion for any reason beyond the control of the Promoter or AFL.
5.7 By entering this promotion entrants agree to comply, and ensure that each
subsequent ticket holder complies, with the ticket conditions which
accompany any tickets won in conjunction with the promotion. Entrants also
agree to comply, and ensure that each subsequent ticket holder complies,
with AFL’s ticket and entry conditions supplemented by conditions of entry
imposed by the venue operator.
5.8 In the event that any element of the prize is not available, the Promoter
reserves the right to substitute a prize of equal or greater value.
5.9 The prize winner is responsible for all expenses not specified in these
Conditions of Entry, including but not limited to, expenses with regard to the
documents and requirements set out in paragraph 5.10 below, excess
baggage charges, any spending money not stated above, meals, drinks,
insurance (including medical, travel and health), transport to and from the
prize winner’s nearest capital city, all transfers, items of a personal nature
(including but not limited to in-room charges, tips, telephone and laundry) and
all other ancillary costs..
5.10 The prize winner and their companion are responsible for travel
documentation and compliance with any health or other government
requirements.
5.11 The prize winner acknowledges that the prize and participation in the prize is
subject to additional terms and conditions imposed by the Promoter, AFL and
third party prize suppliers. The prize winner must become acquainted with
any such additional terms and conditions prior to taking the prize. The
Promoter does not accept responsibility and is not liable for any conditions
imposed on the taking of the prize by any other third party prize supplier.
5.12 The Promoter will determine the travel dates in consultation with the prize
winner and the prize suppliers. Prize travel is subject to fare rules and other
conditions of carriage. Tickets will not be exchanged for another destination.
The prize winner and their travel companion cannot upgrade any prize travel
or prize accommodation using cash or frequent flyer points and will not
accrue frequent flyer points on any prize flights or with any prize
accommodation. The prize winner and their travel companion must travel
together on the same flights on all sectors and stay together at the nominated
hotel. Prize travel must be taken in order to coincide with the prizes in
paragraph 5.2 above. Prize travel may not be changed by the prize winner or
travel companion under any circumstances. If the prize winner cannot travel
in accordance with these Conditions of Entry and on the flights nominated by
the Promoter, the prize will be forfeited. Bookings will be made by the
Promoter. Flight schedules and accommodation arrangements are subject to
change without notice.
6. Unclaimed prizes
If the prize is unclaimed by 12:00pm AEDT on 5 March 2019, it will be
awarded to the entrant who submitted the next most creative and unique
Entry during the Competition Period (as determined by the Promoter in its
absolute discretion). The unclaimed prize winner will be notified by message
on 5 March 2019. The process will be repeated every 24 hours until a prize
winner is contacted and the prize is claimed. The prize remains the property
of the Promoter until it is collected by the selected prize winner or unclaimed
prize winner as the case may be.
7. Information for Prize Winner
All entrants agree to provide the Promoter with identification and/or proof of
age if selected as a prize winner. In accepting a prize, the prize winner agrees
to the release set out below. The form of identification and/or proof of age are
at the discretion of the Promoter.
8. Limitation of Liability
8.1 Except for any liability that cannot by law be excluded (including as set out
under paragraph 8.3), the Promoter, AFL and their related corporations and
associated agencies (and any of their personnel) exclude all liability for any
loss (including any damage, claim, injury, cost or expense) which is suffered
or incurred by any entrant (including the prize winner) in connection with the
Competition or a prize, including, without limitation: (i) any indirect, economic
or consequential loss; (ii) any loss arising from the negligence of the
Promoter, AFL and their related corporations and associated agencies (and
any of their personnel); and (iii) any liability for personal injury or death.
8.2 No responsibility will be taken by the Promoter or its authorised agents for
lost, ineligible, misdirected or late entries due to technical reasons or any
other reason. Entries that are not genuine or are incomplete, late or in any
way fraudulent will be declared void.
8.3 Nothing in these Conditions of Entry limits, excludes or modifies, or purports
to limit, exclude or modify, the statutory implied guarantees/warranties as
provided under the Competition and Consumer Act 2010 (Cth) and the ASIC
Act 2001 (Cth), including the statutory consumer guarantees under the
Australian Consumer Law, or similar laws in the States and Territories of
Australia.
9 Privacy
9.1 By entering the Competition, the entrant understands and agrees that the
Promoter may use and disclose the entrant’s personal information to assist in
conducting the Competition and communicating with the entrant in regard to
special offers from the Promoter and its related entities. Entrants in the
Competition acknowledge that the Promoter may share an entrant’s personal
information with the Promoter’s Australian and foreign related entities which
may contact the entrant with marketing messages and special offers. Without
limiting the foregoing, the Promoter may disclose the prize winner’s personal
information to third parties for the purpose of fulfilling the prize. If an entrant
elects to receive information from other third parties, the Promoter may also
disclose the entrant’s personal information for that purpose. The Promoter is
bound by the Australian Privacy Principles in the Privacy Act 1988 (Cth).
Entrants may find out more information about how the Promoter collects, uses
and discloses personal information by reading the Promoter’s Privacy Policy,
which is available at. Entrants may access the personal information the
Promoter holds about them by writing to the Promoter at the address set out
below. If the Promoter limits or denies an entrant access to their personal
information in certain circumstances, the Promoter will tell the entrant why
access was limited or denied. The entrant can contact the Promoter by writing
to the Promoter at 4 Broadcast Way, Artarmon NSW 2064.
10 General
10.1 All entries must be original to and created solely by the entrant. All entries
and all copyright and other rights in such entries and/or other materials
become the property of the Promoter and will not be returned. Each entrant
agrees to provide a written assignment of all rights to the Promoter if
requested. By submitting an entry and any other materials (save for any
personal information) to the Promoter in connection with the Competition,
each entrant:
(a) specifically authorises the Promoter to use and/or licence third parties
to use such entry in whole or in part, throughout the universe, in
perpetuity in or on any and all media, whether currently in existence or
developed in the future, and alone or together or as part of other
information, content and/or material of any kind or nature;
(b) represents and warrants that all elements contained in the entry or
other material:
(i) are original to the entrant and fully cleared for use as
contemplated in these Conditions of Entry;
(ii) do not and will not, in any way, violate or breach any of the
terms of any other agreement the entrant may be a party to;
(iii) do not contain defamatory, tortious or otherwise unlawful,
untrue or inaccurate information, infringe or violate any
copyright or other right; or contain any matter the publication or
sale of which will violate any law;
(iv) are not obscene or likely to cause offence;
(v) are not in any way cruel or abusive; and
(vi) will not require the Promoter to pay or incur any sums to any
person or entity as a result of Promoters’ use or exploitation of
the same; and
(c) unconditionally and irrevocably consents to any act or omission which
would otherwise infringe any of their moral rights in the entry and
waives all moral rights in the entry that arise outside Australia.
10.2 This Competition is a game of skill. Chance plays no part in determining the
prize winner.
10.3 Acceptance of the prize constitutes consent on the prize winner’s part to allow
the use of the prize winner’s name, image, voice and/or likeness by Promoter
and AFL for editorial, advertising, promotional, marketing and/or other
purposes without further compensation except where prohibited by law.
10.4 No correspondence will be entered into and the judges’ decision is final and
binding.
10.5 If for any reason the Competition is not capable of running as planned,
including due to infection by computer virus, bugs, tampering, technical
failures or any other causes beyond the control of the Promoter, which corrupt
or affect the fairness or integrity or proper conduct of the Competition, the
Promoter reserves the right in its sole discretion to disqualify any individual
who tampers with the entry process and to cancel, modify, terminate or
suspend the Competition.
10.6 The prize winner is advised that tax implications may arise from the prize and
should seek independent financial and taxation advice prior to their
acceptance of the prize. The prize winner is responsible for all taxes
(excluding GST) which may be payable as consequence of receiving a prize.
10.7 The prize winner (and their companion) acknowledges that:
(a) participation in the prize is on a voluntary basis only and for their own
benefit;
(b) the prize in no way creates a principal/contractor or an
employer/employee relationship;
(c) for the duration of the prize they are not a “worker” within the meaning
of the Work Health and Safety Act 2011, the Workplace Injury
Management and Workers Compensation Act 1987 (NSW) or other
relevant state or territory workers compensation legislation, and are
not entitled to claim under the Promoter’s workers’ compensation
insurance;
(d) the prize is primarily for their benefit, is unpaid and any activities that
they may perform (including those activities under paragraph 5.2
above) are purely incidental to their prize experience; and
(e) they are not entitled to any employment related conditions including
but not limited to a wage, superannuation, paid leave or the terms of
any award or other industrial instrument.
10.8 As part of participating in the prize and their companion may become privy to
the Promoter’s confidential information. Confidential information refers to any
information, in whatever form, which is not publicly available. The prize winner
and their companion must preserve as confidential, and not reveal to anyone
or use for themselves or anyone else, any of the Promoter’s confidential
information that they may become aware of, unless the Promoter provides its
prior written consent to such use or disclosure.
11 Contact details
11.1 It is the entrant’s responsibility to inform the Promoter of any change to the
entrant’s contact details, including their email address.
