TERMS AND CONDITIONS OF APPLICATION INTO ST.GEORGE KICK START YOUR START UP BUSINESS GRANT PROMOTION (THE “PROMOTION”)
1. Information on how to enter and Grant details form part of these terms and conditions; however, to the extent that there is any inconsistency between these terms and conditions and any other published material, these terms and conditions will prevail. By participating in this Promotion, each participant fully and unconditionally agrees and acknowledges that these terms and conditions are binding. This Promotion is a game of skill; chance plays no part in determining the winner/Grant recipient.
2. The promoter is St.George Bank – A Division of Westpac Banking Corporation ABN 33 007 457 141 of 275 Kent St, Sydney, NSW (“St.George” or the “Promoter”), tel: 13 33 30. The Promoter and its related bodies corporate (as that term is defined in the Corporations Act 2001 (Cth)) will be known as the “Westpac Group”.
3. The Promotion commences at 12.01am Australian Eastern Daylight Savings Time (AEDT) on 28 January 2014 and closes at 11.59pm AEDT on 31 March 2014 (the “Promotion Period”).
4. Entry is open to all New South Wales, Queensland, and Western Australian residents who are 18 years of age or older who:
(a) operate (or intend to operate) a business in New South Wales, Queensland, and Western Australian where:
a. the current business has operated for a period of no more than 12 months since the commencement date of this Promotion; or
b. the business will begin operating within 12 months from the commencement date of this Promotion, as the case may be; and
(b) submit a valid application in accordance with clause 5 during the Promotion Period (an “Eligible Applicant”).
Employees and contractors of the Westpac Group and their immediate families are ineligible to enter.
5. To enter this Promotion, an Eligible Applicant must during the Promotion Period, visit Visit www.stgeorge.com.au/kickstart and;
a. Download and complete the application Entry Form at at www.stgeorge.com.au/kickstart, or
b. prepare a detailed Business Plan, either your own Business Plan or a Plan using the template at www.stgeorge.com.au/kickstart;
and email the Entry Form / Business Plan together with your name and contact details to to kickstart@stgeorge.com.au.
(each an “Application “).
No responsibility will be accepted by the Promoter for lost, late, incomplete, illegible, or misdirected Applications.
The Promoter acknowledges that the Entry is confidential information, and that the intellectual property in the Entry belongs to the Entrant. The Promoter undertakes to ensure that only the judging panel will have access to the Entry and all unsuccessful Entries will be destroyed after the completion of this Promotion.
6. Multiple Applications are not permitted. Eligible Applicants may only submit one Application. All subsequent Applications will be discarded.
7. There are 10 grants available. Each grant consists of $10,000 deposited into a St.George Bank transaction or savings account held in the Winner’s business or personal name (“Prize”) at time of publication (the “Grant”). In the event the Grant Recipient does not have an existing St.George Bank transaction or savings account, they are required to open an account to receive the Prize. The total retail value of all Grants offered under this Promotion is $100,000 at time of publication. The Grant is not transferable or exchangeable. St.George Bank transaction or savings accounts are subject to account opening requirements. If a Grant Recipient is unable to meet these requirements, the Prize will be forfeited.
8. The winning Applications will be those determined to be the most worthy, innovative, insightful and viable, as judged by a panel of judges appointed by the Promoter (the “Grant Recipient/s”). Judging of Applications will be conducted between 1 April 2014 and 21 April 2014 (the “Judging”). The judges’ decision will be final and no correspondence will be entered into. The allocation of the Grants to the Grant Recipients is final and the Promoter will not enter into any correspondence in relation to the Grant(s) or the Promotion. The judges, in their sole discretion, may not allocate any Grant(s), or fewer than the number of Grant(s) stated above (including in circumstances where insufficient Applications are received or Applications are judged to be of a poor standard).
9. The Grant Recipients will be notified by telephone using the number disclosed on the Application and by email/mail to the address disclosed on the Application by 5 May 2014. In the event the Grant Recipient can not be contacted on this day, the Promoter will continue to attempt to contact the Grant Recipient up until 5 August 2014. Eligible Applicants are responsible for keeping the Promoter informed of any changes to their contact information during and immediately following the Promotion Period.
10. The Grant will be credited to the Grant Recipient’s nominated St.George Bank Account within 14 days of the Winner nominating that Account.
11. The Grant Recipients may be liable to declare the Grant for taxation purposes and will be liable for any tax payable in respect of a Grant. Eligible Applicants should seek independent financial advice in relation to any tax payable on the Grant and the potential impact on their personal financial situation prior to entering the Promotion.
12. If any Grant is not claimed by 5 August 2014, the Promoter may conduct such further judging of the Applications received as may be necessary to apportion the as such unclaimed Grant. Any subsequent judging will take place at the same place as the original Judging, by the same panel of judges. The Grant Recipient will be notified by telephone using the number disclosed on the Application and by email to the address disclosed on the Application on or around 12 August 2014.
13. Except for guarantees, warranties and conditions implied by law which cannot be excluded, neither the Promoter nor any other member of the Westpac Group make any guarantees, representations or warranties, express or implied, regarding the quality or suitability of any Grants awarded under these terms and conditions.
14. To the maximum extent permitted by law, the Promoter and all other members of the Westpac Group expressly disclaim liability for any loss or damage whatsoever (including but not limited to indirect or consequential loss) or for any personal injury which is suffered or sustained in connection with any participant’s participation in this Promotion or the acceptance of any Grant. The Grant Recipient indemnifies the Promoter and all members of the Westpac Group against any liability, injury, loss or damage which may be suffered,

incurred or sustained by the Promoter or any member of the Westpac Group arising out of, relating to, or in any way connected with, any act or omission (including negligence) by the Grant Recipient, or its use of the Grant, or its breach of these terms and conditions.
15. The Promoter collects personal information from all participants in order to conduct the Promotion. If the information requested is not provided, the participant may not participate in the Promotion or claim a Grant and their Application may be discarded. It is a condition of entry into the Promotion that the Grant Recipient/s consents to the publication of their name and city of origin in any advertisements or articles relating to the Promotion or the Grant and participates in any media releases which may include photographs of the Grant Recipients by the Promoter or any other member of the Westpac Group. By entering this promotion, participants consent to the use of their names and likenesses in this manner. The Promoter’s treatment and storage of personal information will be handled in accordance with all applicable laws in Australia. Your information will not be used to contact you for marketing purposes.
16. Neither the Promoter nor any other member of the Westpac Group will be responsible for any problems or technical malfunction of any computer online systems, servers or providers, computer equipment, software, failure of any email or Application to be received by the Promoter on account of technical problems or traffic congestion on the Internet.
17. If this Promotion is not capable of running as planned for any reason (including but not limited to failure or malfunction of any computer equipment by reason of infection by computer virus, power failure, bugs, tampering, unauthorized intervention, fraud, or technical failures or any other causes which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right in its sole discretion to disqualify any individual who undermines the integrity or fair running of the Promotion for other Applicants, including by tampering with the Application process, and, after consulting with the relevant legislative authorities, to cancel, terminate, modify or suspend the Promotion.
