Terms and conditions of entry
1. By entering this Promotion, entrants agree to the entry requirements below and these terms and conditions. Entry is open to all residents of Australia over the age of 18.
2. The Promotion is conducted by the Promoter, which is Carpet Court Australia Ltd (ABN 77001195697) of Level 3, 541 Blackburn Road, Mount Waverley, VIC 3149 Australia.
3. Entry is not open to employees and immediate families of the Promoter, associated companies and agencies and prize givers.
4. The entrant must have legal right to ownership of all entries submitted by the entrant.
5. The Promotion commences at 9.00 AEST Sunday 17th August and closes at 17.00 AEST, Tuesday 30th September 2014.
6. An entrant can submit more than one entry, provided each entry is new and original. 7. To be eligible to win, entrants must:
a) visit a Carpet Court store and obtain the unique entry code from the Interactive Display Screen located within the Carpet Court store;
b) Visit the Carpet Court website at http://www.carpetcourt.com.au/promotions (“Promotion Website”) or the Carpet Court Facebook page https://www.facebook.com/CarpetCourt; and
c) complete the form with your contact details, enter the unique entry code obtained from the
Interactive Display Screen and:
i. upload an original photo of a space or object in your home that captures your
design style; or
ii. provide explanation of what inspires your design style in 50 words or less.
8. The Promoter will not be liable for any entries lost or corrupted during online submission. It is the entrant’s responsibility to maintain original copies of any entries submitted.
9. No responsibility is accepted by the Promoter for late, lost or misdirected entries.
10. All entries must include all mandatory information as required, including but not limited to the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth.
11. Entries that are considered of an offensive nature will be rejected and deemed invalid.
12. One Prize Winner (“Prize Winner”) will be chosen by the Promoter at the conclusion of the Promotion and the Prize (“Prize”) will consist of:
a) Provincial Lane Flooring (including delivery and installation) up to the maximum value of $10,000.00 (including GST), based on consultation by the Promoter with the Prize Winner of the Prize Winner’s home.
– The Prize Winner may select flooring and/or carpets from the any of the Provincial Lane by Darren Palmer products as follows; Arles, Pont Des Amoureux, Premier Soft, Timber, Designer Range Laminate, Strandwoven Bamboo and European Vinyl Planks.
b) Three course lunch for Prize Winner and one guest with Shelley Craft and Darren Palmer at The Bridge Room to the value of $200.00 per head including GST.
– The lunch must be taken on Wednesday 12th November 2014 at 1:00pm and there is no flexibility around this date.
c) Travel and accommodation expenses up to the total value of $2,000.00 (including GST) for the purposes of attending the lunch.
– The Prize Winner will be responsible for booking their own travel and accommodation and Carpet Court will reimburse these upon receipt of proof of purchase. The $2000.00 budget will only be reimbursed for travel and accommodation to the lunch and not for any other date. The budget can be used for any combination of travel and accommodation that the Prize Winner chooses.
– If the budget exceeds the $2,000 (including GST), the Prize Winner acknowledges that the additional costs will be the responsibility of the Prize Winner.
– All other ancillary costs and expenses in using the Prizes, are the responsibility of the Prize Winner (unless expressly stated).
– If the Prize Winner is unavailable or unable to travel and/or attend the lunch on the specified date, components b) and c) of the Prize will be forfeited in full, and no alternative date, option or compensation will be offered.
13. The total maximum Prize pool value is $12,400 (including GST). The Prize value is the recommended retail value as provided by the Promoter and is correct at the time of printing. All Prize values are in Australian dollars. If the estimated costs exceed the total maximum Prize pool value, the Promoter must advise the Prize Winner before commencement of the work that any additional costs incurred in completing the flooring installation will be the responsibility of the Prize Winner.
14. Any change in the value of the Prize claimed is not the responsibility of the Promoter.
15. The Prize Winner is advised that tax implications may arise from their Prize winnings and they should seek independent financial advice prior to acceptance of their Prize.
16. If any of the product ranges listed in clause 12 a) are unavailable at the time of redemption, for whatever reason, the Promoter reserves the right to substitute the Prize for a Prize of equal or greater value, subject to State regulation. It is a condition of accepting the Prize that the Prize Winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements. The Prize must be taken as stated and no compensation will be payable if the Prize Winner is unable to use the Prize as stated or provided.
17. The Promotion will be judged on the basis of creativity and originality by the Promoter at Carpet Court Australia, Level 3, 541 Blackburn Road, Mount Waverley, VIC on Friday 3rd October 2014. Chance plays no part in selection of the Prize Winner.
18. The Prize Winner will be announced on Monday 6th October 2014. The Prize Winner will be notified by phone or email (via the details provided in their entry form) by the Promoter or its agent and the name of the Prize Winner will be published on the Promotion Website and the Carpet Court Facebook page.
19. All reasonable attempts will be made to contact the Prize Winner. If the Prize Winner cannot be contacted or does not claim the Prize within 30 days from the first email contact by the Promoter, the Promoter reserves the right to announce a new Prize Winner on 9.00 am 3rd November 2014 at Carpet Court Australia, Level 3, 541 Blackburn Road, Mount Waverley, VIC. The new Prize Winner will be notified by phone or email and the name of the new Prize Winner will be published on the Promotion Website and the Carpet Court Facebook page. The new Prize Winner must claim the Prize within 3 months days of notification.
20. If a Prize Winner cannot be contacted or does not claim the Prize within the stipulated time frames, then the Prize will be forfeited and a substitute Prize will not be offered in lieu of the Prize.
21. The judges’ decision is final. No correspondence will be entered into.
22. The Promoter reserves the right to request the Prize Winner provides proof of identity, prior to distribution of the Prize. The verifications required are at the sole discretion of the Promoter and if these requirements cannot be satisfied, the Prize Winner will forfeit the Prize in whole and no substitute will be offered or compensation paid.
23. The Promoter reserves the right to withdraw the Prize in the event of an entrant claiming to be a Prize Winner being unable to satisfy the entry requirements or these terms and conditions. In such event, no substitute will be offered or compensation paid.
24. It is a condition of the awarding of the Grand Prize that the Prize Winner must, if requested to do so by the Promoter:
a) participate in and co-operate as required with all reasonable publicity and media editorial requests relating to the Grand Prize, including without limitation, participating in a photo, video and/or film session, and other interviews (including without limitation, at the time at which the Prize is awarded to the winner), and the Prize Winner acknowledges that the Promoter or any appointed third party agency has the right to use such publicity photos, videos and/or films (including the winner’s name and likeness) in any medium (including, without limitation, the internet) and in any reasonable manner it sees fit and without compensation; and
b) sign and return any release of liability or waiver documentation provided to the Prize Winner by the Promoter – the failure to return the signed documentation may result in the entitlement to the Grand Prize being forfeited in whole and no substitute will be offered.
25. By entering the Promotion, entrants acknowledge that the photograph or written content entered is their own and entirely original, and that they have not infringed the intellectual property rights (including copyright) or any the rights of any other individual or third party.
26. Each entrant grants to the Promoter a non-exclusive, perpetual, worldwide, irrevocable, transferable and royalty-free licence to the content of each entry (including written content and photographs), for use, reproduction or publication for the purposes of the Promotion, including on the Promoter’s promotional material, website and Facebook page. The Promoter reserves the right to exhibit and publish all entries within the context of the Promotion.
27. Each entrant consents to any act or omission by the Promoter which may infringe any of the entrant’s moral rights (within the meaning of the Copyright Act 1968 (Cth)), including: i) failing to attribute (or correctly attribute) the entrant’s authorship of the entry; or ii) making any modification, variation or amendment of any nature to the entry, whether or not it results in a material distortion or derogatory treatment of the entry.
28. The Promoter, associated agencies and companies associated with this Promotion, will take no responsibility for Prizes damaged or lost in transit.
29. Entrants enter the Promotion at their sole risk. The Promoter will not be liable for any loss or damage whatsoever suffered, including but not limited to, direct or consequential loss arising from the Promotion, or in connection with the redemption of and/or use of the Prize.
30. The Promoter makes no warranties or representations about the fitness for purpose or suitability of any element of the Prize and will not accept responsibility for the quality or fitness for any purpose of any element of the Prize, or the failure of any element of the Prize to be of merchantable quality.
31. The Promoter reserves the right, in its absolute discretion, to at any time, cancel or vary the Promotion or to cancel or vary the award of the Prizes
32. In the event that the Promoter cancels or varies the Competition or varies or withdraws the Prizes it shall not:
a) be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; or
b) be required to conduct the Promotion at any other time.
33. Each entrant indemnifies the Promoter for any costs or loss incurred by the Promoter as a result of the entrant’s participation in the Promotion, the entrant’s non-compliance with these terms and conditions, the entry and the Prize itself.
34. The Promoter will collect and handle entrant’s personal information (as that term is defined in the Privacy Act 1988) in accordance with the Australian Privacy Principles.
35. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, its agents (including PR Edge) and Prize suppliers for the purposes of administering the Promotion and Prize fulfilment.
36. Unless otherwise advised, entrants consent to the storage of their personal information on the Promoter’s database and the Promoter may use this information for future promotion, marketing and publicity purposes regarding its products, including contacting the entrant via electronic messaging.
37. Entrants can request to access, update or correct their personal information which the Promoter holds about them or may request that they not receive further promotional or marketing communications from the Promoter by contacting the Promoter at the address above. Should an entrant’s contact details change during the Promotion Period, it is the entrant’s responsibility to notify the Promoter and the Promoter will not be responsible for a misdirected Prize claim.
