1. The Promoter is lastminute.com.au Pty Ltd ABN 34091825142, at 173-185 Sussex Street, Sydney NSW 2000.
2. Information regarding prizes and how to enter form part of these terms and conditions. Entry into the competition constitutes acceptance of these Terms and Conditions.
3. Entry to the competition is free (excluding internet charges) and is only open to Australian residents who are 18 years or over. Directors, officers, management, employees (and their immediate families) of the Promoter or the organisations associated with this promotion, and their related entities are ineligible to enter. If the winner is under 21 years then their nominated companion must be an Australian resident aged 21+ with a current valid Australian drivers licence.
4. The promotion commences at 10am AEDST, Monday 3 March 2014 and closes at 10am AEDST, Friday 14th March 2014 (“Promotional Period”).
5. Only one entry per person is permitted. Should more than one entry be submitted only the first entry will be considered for the promotion, with additional entries deleted.
6. To enter the promotion, participants must, during the Promotional Period, go to http://www.liveeverylastminute.com.au/detox-in-daylesford-a-destination-guide/ and answer the following question in 25 words or less:
(a) Who would you take on a Daylesford luxury weekend away and why?
and fully complete and submit the online entry form, by providing their full name, date of birth, email address, telephone number, state and postcode.
7. The Promotion is a game of skill; chance plays no part in determining the winner. Each valid entry will be individually judged by representatives of the Promoter. The judge’s decision is final and no correspondence will be entered into.
8. The one eligible entrant whose
answer to the question set out in clause 6(a) is judged as the most original and creative entry by the Promoter, will be deemed the winner. One winner will be selected.
9. This judging will take place at at 173-185 Sussex Street, Sydney NSW 2000 at 12pm AEDST, Friday 14 March 2014. The winner will win:
• Two (2) return economy flights to Melbourne from the nearest AU capital city. If the winner is from Melbourne the flights component of the prize will not be included;
• Three (3) day car hire from Melbourne, Tullamarine airport including GPS
• Two (2) nights double room accommodation at Hotel Frangos, Daylesford
• AU$100 food & beverage credit at Hotel Frangos
• 2 x 1-hour relaxation massages at Endota Day Spa, Daylesford
10. The Promoter reserves the right to verify or require the entrant to verify that the entry is the entrant’s original work. The entrant warrants to the Promoter that the entry submitted is an original work of the entrant that does not infringe the rights of any third parties. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
11. The maximum total value of the prize pool is AU$3350.00. The Promoter accepts no liability in relation to the variation of the prize values.
12. The winner will be notified by email and phone the day of the judging. The winner’s details will also be published at www.lastminute.com.au/account/competition-winners on Monday 17th March 2014 for a period of 3 months.
13. If the Promoter, after making all reasonable attempts to contact a winner, is unable to contact the winner or a prize is not accepted by Monday 17th March 2014, the relevant winner’s entry will be deemed invalid and an unclaimed prize judging will take place at 11am Monday 17th March 2014 at 173-185 Sussex Street, Sydney NSW 2000. The new winner will be notified by email or phone on the day of the judging.
14. The winner redeems the prize by emailing lovelies@lastminute.com.au. All bookings are subject to availability and any terms and conditions imposed by the relevant prize providers. The prize must be booked and used by June 30 2014. The prize may not be booked for travel on long weekend periods, public holidays and within school holiday periods* that fall before the prize expiration period of June 30 2014.
15. All elements of the prize must be booked together for the winner and their companion in the order stipulated. The Promoter will not be responsible for booking any additional travel or guests. Two flights must be utilised at the same time, for the same travel dates, to and from the same destination.
16. Any additional costs incurred by the winner (or their companion), other than those that expressly form part of the prize, are the responsibility of the winner, including all transfers, flights, other transport, luggage costs, meals or beverages, health and travel insurance, medical or health related services, spending money, and any incidental, non room-only charges, including but not limited to, room service, telephone calls and internet usage or other ancillary costs. Travel insurance is also not included in the prize and is advisable. The winner and their companion are responsible for ensuring that they have all necessary travel insurance. Car hire insurance will be covered in the prize.
17. All prizes are non-transferable, non-refundable, non-exchangable, non-replaceable and non-redeemable for cash. Prizes cannot be used to purchase gift certificates or lay-buys, nor can they be re-sold. Prizes must be taken as offered. No modifications or exchanges will be possible. The Promoter accepts no responsibility for any veration in the value, performance or availability of any prize. If a prize or any element of a prize is unavailable for any reason, the Promoter may substitute for that prize or element of that prize another item of equal or higher value as determined by the Promoter.
18. Once the prize has been arranged by the Promoter, if there are changes to the accommodation and other prize arrangements, these must be made and are at the expense of the winner. Any alterations or extensions to confirmed prize details must be approved in advance by the Promoter (at its sole discretion) and will be at the expense of the winner.
19. The Promoter expressly reserves the right to resolve any discrepancies, disputes or otherwise unforeseen circumstances as it deems fit subject to state regulation and the Promoter’s decision will be final and binding upon every person who enters. No correspondence will be entered into. The Promoter expressly reserves the right to change or alter these Terms and Conditions at any time.
20. The Promoter accepts no responsibility for incomplete, incorrectly submitted, delayed, misdirected or illegible submissions.
21. The Promoter may require entrants to verify their identity and age. Failure to provide this to the Promoter’s satisfaction will result in the entry of the entrant being invalid.
22. In order to claim the prize outlined in clause 9, entrants (and their chosen companion) must be at least 18 years of age, with appropriate identification. Identification considered suitable for verification is at the host’s discretion. If the winner is under 21 years then their nominated companion must be an Australian resident aged 21+ with a current valid Australian drivers licence.
23. Entries must only be submitted in accordance with these conditions and will not be accepted in any other form. Computer generated or other automated entries will not be accepted. If a winning entry is deemed not to comply with these conditions of entry, the entry will be discarded and a new winner will be determined in accordance with these conditions of entry.
24. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
25. The Promoter shall not be responsible for any entries that are not received or are otherwise interfered with due to problems with the internet or telecommunications services.
26. If this promotion is not capable of running as planned due to any reason, including unauthorised intervention, fraud, or any other causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right (subject to any applicable law) in its sole discretion to cancel the competition or to disqualify any individual who has tampered with the entry process.
27. In order for you to participate in this promotion the Promoter will collect your full name, telephone number, email address, state of residence and postcode. The purpose for collecting this personal information is to enable the Promoter to administer the promotion. The Promoter may disclose your personal information to companies or agencies connected with this promotion.
28. As a condition of participating in the prize, the winner’s companion accepts these conditions.
29. By entering this promotion you agree that the Promoter may use the aggregate information collected from the competition for related research and marketing purposes.
30. All entries will be the property of the Promoter. All entrants by entering this competition consent to being subscribed to the lastminute.com.au email newsletter. Use of your personal information is governed by lastminute.com.au’s Privacy Policy http://www.lastminute.com.au/home/privacy.html.
31. The winners in this promotion agree that their identity and their winning entry may be disclosed in winner announcements and promotional material free of charge.
