2014 Australian Motorcycle Grand Prix Get on the Grid Promotion Terms & Conditions
1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.
o The Promoter is Network Ten Pty Limited (ACN 052 515 250); and
o The Prize Supplier is Australian Grand Prix Corporation, Level 5, 616 St
Kilda Road, Melbourne VIC 3004 (ABN 86 947 927 465).
2. Entry is only open to Australian residents aged 18 years or over who are available to travel to Phillip Island, Victoria, from 15/10/14 to 20/10/14, to attend the 2014 Australian Motorcycle Grand Prix. Employees (and their immediate families) of Network Ten, the Australian Grand Prix Corporation (AGPC), contractors working through or with Network Ten and any other agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. Promotion commences at 10:00 am (AEST) on Friday 29/08/2014 and closes at 10:00am (AEST) on Friday 3/10/2014 (the Promotion Period).
4. Entrants are required to complete the online entry form on tenplay.com.au/win with the requested details. Entrants will be required to answer a question in order to be eligible to enter the promotion.
Which rider will defy the rules of nature and win the 2014 Australian Motorcycle Grand Prix and why?
5. The promotion will be advertised on Network Ten and ONE, www.tenplay.com.au. Online entry is open to TEN website members (existing and new during the Promotion Period). It is free to become a member however fraudulent memberships/entries will not be accepted and will be deemed invalid. These promotion Conditions of Entry apply in conjunction with the Network Ten Online Members rules.
6. Judging will commence from 10am on Monday 06/10/14 at the office of The Promoter, 1 Saunders St, Pyrmont NSW 20009. This is a game of skill and chance plays no part in determining the winner. Each entry will be individually judged based on literary and creative merit of the answer provided to the question. The prize winner will be notified by telephone and in writing within 2 days of the Prize determination date.
7. The most creative answer, as determined by the judges (Winner), will win a trip to Phillip Island, Victoria for the Winner and a prize companion to attend the 2014 Australian Motorcycle Grand Prix – 17 – 19 October 2014 (the Event), valued at up to AU$9,680 depending on point of departure. Prize Companions must be 18 years of age or older. Prize includes:
o Two (2) x return economy class airfares from either Sydney, Adelaide, Hobart, Brisbane or Perth (whichever is closest to the Winner’s place of residence) to Melbourne (Tullamarine Airport), departing on 16th October 2014 and returning on 20th October 2014, valued at up to $3,000 depending on the Winner’s point of departure. If the Winner is from Victoria, the flight component of the prize will not be included.
o Return chauffeured limousine transfers for two (2) adults from Melbourne Tullamarine Airport to Phillip Island Accommodation, valued up to $900.
o Four (4) x nights’ house accommodation in Phillip Island, Victoria for two (2) adults in a valued at $2,000 (from 16th to 19th October 2014);
o Two (2) x Undercover Gardner Straight Grandstand Packages (Friday and Saturday) to the Event, valued at $780;
o One (1) x exclusive access to the MotoGP grid on Sunday (19th October 2014) of the event, valued at $2000;
o A guided tour of the MotoGP Paddock for two (2), valued up to $1,000.
Total prize pool is $9,680 (“Prize”).
8. Prizes cannot be transferred, exchanged or redeemed for cash.
9. To submit a complete and valid online entry, entrants will be required to provide various personal details including full name, email address, residential address, contact phone number/s, date of birth and gender for the purpose of verifying eligibility. Any contact details entered incorrectly shall invalidate the entry. Online entry is free however internet connection rates apply.
10. One (1) online entry per person per day is permitted throughout the promotion period, subject to each entry being submitted in accordance with entry requirements. Each entrant must be a member of the relevant Network Ten website to submit a valid entry.
11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Conditions of Entry or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. This includes, but not limited, to entrants and households using multiple email addresses, postal addresses, and PO Box addresses. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
12. Entries must be received by 10:00 am (AEST) on Friday 3 October 2014. The time of entry will in each case be the time the entry is received by the Promoter’s database. The Promoter accepts no responsibility for any late, lost or misdirected entries including entries not received by the Promoter or
delays in the delivery of the entry due to technical disruptions, network congestion or for any other reason.
13. The cost of accessing the promotional website will be dependent on the entrant’s individual Internet Service Provider.
14. The Promoter, the Prize Supplier, and their associated agencies reserve the right to refuse to allow a winner to take part in any or all aspects of the Prize, if the Prize Supplier determines, in its absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the Prize. It is a condition of accepting the Prize that the winner may be required to sign a legal release in a form determined by the Prize Supplier or its associated agencies in its absolute discretion.
15. The Prize must be taken in accordance with these Conditions of Entry.
16. Flights cannot be changed once booked. Travel must be taken to coincide with the Event and is based on two adults travelling together and sharing one room at the accommodation. Airline travel is based on scheduled flights in economy class to and from nearest Australian capital city excluding Prize Winners from Victoria. Flights are not provided if the Winner resides in Victoria, and this component of the Prize will not be redeemable for cash.
17. Travel is subject to seat availability at the time of booking. It is the Prize Winner and their companion’s responsibility to ensure that they have valid documentation at the time of departure. Any fines, penalties, payments or expenditure incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the Prize Winner and their companions.
18. The Winner and their Prize Companions must make their own way to their nearest capital city at their own expense. Flights will depart from Sydney, Perth, Adelaide, Hobart and Brisbane airports. If the winner is from Tasmania, ACT or NT connecting flights from these cities to the nearest flight departure capital city will be included in the prize package for the winner and travelling companion only If the winner resides in Victoria then the flight component of the Prize will not be included and the Winner and their Prize Companions will be responsible for making their own way to and from the Phillip Island accommodation.
19. Accommodation is supplied on a room only basis. All other costs associated with the Prize including but not limited to any meals, room service, transfers, items of a personal nature, in room charges, mini-bar items, loss of hotel property, damage to hotel property, telephone calls, beverages, laundry services, spending money, travel insurance and all other ancillary costs not expressly provided, as well as obtaining any of these, are the responsibility of the Prize Winner and their travel companions. Personal expenses unrelated to the Prize including shopping transportation to local sites during free time and not part of the tour and food expenses specified will be at the Prize Winner and their companions’ own expense. We highly recommend that the Prize Winner and their companions take out travel insurance prior to departure.
20. Frequent flyer points will not form part of the Prize. The Winner may be required to present a credit card at time of accommodation check in. The
Prize is subject to the standard terms and conditions of individual prize and service providers.
21. All components of the Prize must be taken together. Accommodation and travel is subject to booking, accommodation and flight availability. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee, at the cost of the Winner. These Terms apply in conjunction with any relevant travel voucher rules travel and accommodation may be arranged by a licensed travel agent nominated by the Promoter.
22. The winner must, and must procure that his/her travel companions, agree to read and comply with the Attendance Conditions to the Event (a copy of which is displayed at entrances to the Event or available at www.motogp.com.au). The winner acknowledges and agrees that those elements of the prize relating to the Event will be subject to any additional conditions or directions imposed by the Prize Supplier, the Event promoter, rights holder and race officials, including regarding participation in elements of the Prize, attendance times and attending briefings for participation in elements of the Prize and the signing of the release and waiver of liability form referred to above, in such form as may be required by the Prize Supplier in its absolute discretion.
23. ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT, AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING WITHOUT LIMITATION PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN.
24. Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in a prize is at entrants’ own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of motor vehicles / motorcycles (or parts of them) colliding with other motor vehicles, motorcycles, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and section 139A of the Competition and Consumer Act 2010 (Cth), hereby exclude, release and forever discharge the Promoter, AGPC, the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), Dorna Sports S.L and all its affiliate companies, Dorna Worldwide Freight Services b.v., Dorna Worldwide S.L., Externpro S.L., Motor Medical Team S.L.; Federation Internationale de Motorcyclisme, International Events Services SL, Promotor Special Events Worldwide SL, National Motorcycle Federation, PI Circuit Pty Ltd, PI Graydens Pty Ltd, PI Sunrise-McGuigan Pty Ltd, PI Visitor Centre Pty Ltd, PI Operations Pty Ltd, Linfox Property Group Pty Ltd, Fox Group Holdings Pty Ltd, International Road Racing Teams Association, Motorcycling Australia Ltd and Motorcycling Victoria, teams, service companies, national and international officials, race direction, clerks of the course, sporting technical stewards, timekeepers, marshals, sponsors, all VIP guests from the above mentioned bodies, all other interested parties for their rights and interests involved in the conduct, promotion and organisation of the Event, and their respective personnel (Associated Entities) from all liability for any present or future claim, loss, damage, cost or expense arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or
connected with participation in Recreational Services (as defined below) at the Event, including a prize.
To the extent permitted by law (in particular section 22 of the Australian Consumer Law and Fair Trading Act 2012 (Vic) and section 139A of the Competition and Consumer Act 2010 (Cth)), entrants acknowledge that (in the event that they are a Winner) to the extent to which they participate at the Event and/or in the prize in:
o a sporting activity or similar leisure time pursuit; or o an activity that:
i. involves a significant degree of physical exertion or physical risk; and
ii. is undertaken for the purposes of recreation, enjoyment or leisure, (Recreational Services)
including, without limitation, participation in a prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law.
WARNING: If you participate in these activities your rights to sue the supplier under the Australian Consumer Law and Fair Trading Act 2012 (Vic) if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in these Terms and.
NOTE: The change to your rights as set out in these Terms and Conditions, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Australian Consumer Law and Fair Trading Regulations 2012 (Vic).
For the purpose of these Terms and Conditions “the supplier” will mean and include the Associated Entities.
Nothing in these Terms and Conditions generally affects your rights under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law and Fair Trading Act 2012 (Vic) or similar legislation regarding consumer guarantees, implied conditions and warranties to the extent that such consumer guarantees, implied conditions or warranties cannot be excluded by law.
A reference to legislation or to a provision of legislation includes a modification or re-enactment of it, a legislative provision substituted for it and a regulation or statutory instrument issued under it.
Without limiting any other release or limitation of liability contained in these Terms and Conditions, to the extent permitted by law, the Associated Entities will not be liable for any indirect or consequential loss (including but not limited to loss of earnings) suffered by any entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event or a prize.
25. The Prize must be taken as offered and cannot be varied. The Prize is not transferable, exchangeable or redeemable for cash. The prize must be taken between 15th and 20th October 2014 at a time determined by the Prize Supplier. No extension or variation of these dates will be permitted. No compensation will be payable if the Prize Winner, or their travel companions, are unable to use any element of the Prize for whatever reason. Any part of the Prize that is not taken as specified by the Promoter and for any reason is forfeited subject to State regulations.
26. If for any reason a Prize becomes unavailable due to circumstances outside of the Promoter or the Prize Supplier’s reasonable control, the Promoter and/or Prize Supplier reserves the right to, but is not obliged to, award a similar substitute Prize of equal value, subject to State or Territory legislation. AGPC will not be responsible if any element of the prize is cancelled or not available and will not be obliged to replace any element of the prize.
27. Entrants must only enter in their own name. The Promoter and/or Prize Supplier reserves the right to request the Prize Winner and their companions to produce appropriate photo identification or other documentation (to the Promoter or Prize Supplier’s satisfaction) in order to confirm their identity, age, eligibility to enter and claim a Prize and any information submitted by the entrant in entering the promotion before issuing a Prize. If the documentation required by the Promoter and/or Prize Supplier is not received by the Promoter and/or Prize Supplier (or its nominated agent) or the winning entrant has not been verified or validated to the Promoter’s satisfaction within the time requested, that entry will become invalid. The Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
28. The Promoter reserves the right to request the Prize Winners’ travel companions or guests (as applicable) to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm their identity and age before issuing a Prize.
29. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter.
30. If the Prize Winner (for whatever reason) is unable to attend the event on the specified dates or if the prize remains unclaimed by 9am Friday 10 October 2014 the judges reserve the right to select the next best entry judged from all valid entries received. The winner of the unclaimed prize determination will be notified by telephone and in writing within 2 days of the unclaimed prize determination.
31. Except for any liability that cannot be excluded by law, the Promoter, the Prize Supplier and their associated agencies and companies (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury or death which is suffered or sustained; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion (including all elements of the Prize), including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s/Prize Supplier’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their
receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter or the Prize Supplier; (d) any variation in Prize value to that stated in these Conditions of entry; (e) any tax liability incurred by a winner or entrant; or (f) the use of or participation in the Prize. Entrants expressly acknowledge that the Prize Supplier, and not the Promoter is supplying and administering the provision of the Prize to the Prize Winner.
32. In the event of war, terrorism, state of emergency or disaster (including natural disaster) or any other circumstance beyond the reasonable control of the Promoter, subject to any applicable laws or written directions made under applicable State or Territory legislation, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion.
33. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter or the Prize Supplier which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.
34. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for (i) tampering with the entry process (ii) submitting an entry which is not in accordance with these Conditions of Entry and/or (iii) if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
35. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
36. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, or any other technical failures including any damage to entrant’s or any other person’s computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
37. Entrants consent to the Promoter and the Prize Supplier using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or the Prize Supplier. The winner agrees to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
38. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained via the website www.ten.com.au.
