Terms and Conditions of Entry for the Telstra Send and See Promotion (“Promotion”)
1. Information on how to enter and prize details form part of these conditions. Entry into this
Promotion is deemed acceptance of these terms and conditions of entry.
2. The Promoter is Telstra Corporation Limited ABN 33 051 775 556 of Level 7, 175 Liverpool
Street, Sydney NSW 2000 (“Promoter”).
3. The Promotion will be open from 12.00 pm Australian Eastern Daylight Savings Time
(“AEDST”) on 24 March 2014 and will continue until 12:00 pm AEST on 11 April 2014
(“Promotion Period”).
4. Entry is open to all Australian residents, over the age of 18 years, other than management,
employees or contractors of the Promoter and other agencies, firms or companies associated
with the Promotion (including suppliers of Send & See Gifts), and their immediate families
(“Eligible Entrants”).
5. To enter and be eligible to win, Eligible Entrants must during the Promotion Period:
a) visit the Telstra Count Me In website located at telstra.com/sendandsee (“Website”);
b) navigate to the competition page;
c) nominate your gift (“Send & See Gift”), gift recipient and where you would like the gift
delivered (including delivery city and State);
d) tell us in up to 400 words why you’d love to surprise your Mum (“Send & See Story”);
e) complete the details in the entry form providing your full name, age, email address
and phone number; and
f) agree to the terms and conditions,
(“Eligible Entry”).
6. Eligible Entrants can nominate their Mum, regardless of their physical distance or proximity to
their Mum in Australia.
7. By entering the Promotion, Eligible Entrants acknowledge and agree that:
a) their entry is their original and independent creation; and
b) their entry does not infringe any third party rights, including intellectual property rights
or privacy.
8. Only one Eligible Entry per Eligible Entrant will be accepted.
9. Judging of all Eligible Entries received during the Promotion Period will take place between 11
April 2014 and 14 April 2014. The judging will take place at Level 7, 175 Liverpool Street,
Sydney NSW 2000. The judging will be conducted by a representative of the Promoter.
10. The Eligible Entrants deemed by the judges, in the judge’s sole and absolute discretion, to
have the most heartfelt and imaginative Send & See Stories will be shortlisted and asked to
participate in a phone interview to answer a series of questions to support their entry
(“Shortlisted Entrants”). The Shortlisted Entrants will be contacted by phone on 15 April
2014. In order to demonstrate that a Shortlisted Entrant has a real relationship with the
nominated gift recipient, the Shortlisted Entrant may be asked to send a photo of themselves
with the nominated gift recipient to the Promoter.
11. The Shortlisted Entrant deemed by the judges, in the judges’ sole and absolute discretion, to
have the most heartfelt and imaginative Send & See Story overall will receive from the
Promoter their Send & See Gift delivered to their nominated gift recipient as set out in clause
5(c), valued at up to $500 (inc GST) (“Prize”). The Promoter will secretly film the reaction of
the gift recipient when they receive the Send & See Gift and (subject to the gift recipient’s prior

consent), send the winner a copy of this video. The video may be sent up to two hours after
the delivery has taken place. Please note that the Promoter will seek the consent from the gift
recipient prior to use of any recording of them, and the gift recipient may request the video
footage be destroyed before it is used or shared with anyone.
12. The Prize winner will be notified by phone and in writing on 16 April 2014. The Eligible Entrant
will be required to sign a release and indemnity form in favour of the Promoter and return that
document to the Promoter prior to being awarded the Prize.
13. The judges’ decision (including any decisions as to prize distribution) is final and the Promoter
will not enter into correspondence regarding the result.
14. If the Prize has not been claimed by 5.00pm AEST on 17 April 2014, they will be distributed at
the Promoter’s absolute discretion.
General
15. The total Prize pool value is up to $500 (including GST).
16. By submitting a Send & See Story, the Eligible Entrant agrees:
a) their story is a genuine story;
b) they will be available on 15 April 2014 to participate in a phone interview if selected as
a shortlisted entrant;
c) they must be available for filming between the 28 and 29 April 2014;
d) the gift recipient is over 18 years of age;
e) agrees to the best of their knowledge that the gift recipient is likely to agree to take
part in the Send & See experience and would not object to being secretly filmed for
the purposes of this Promotion;
f) they will assist the Promoter with co-ordination and communication throughout the
campaign to ensure the gift recipient is at the correct place at the correct time; and
g) agree to participate in any reasonable marketing activities relating to the Promotion as
set out in clause 29.
17. The Send & See Gifts must:
a) be valued at a maximum of $500 (inc GST) or under;
b) not include any wildlife, alcohol, cigarettes, illegal substances or anything unsuitable
for minors; and
c) not include products from a competitor of the Promoter.
18. All other costs associated with the Send & See Gift are the responsibility of the gift recipient.
The gifts are not transferrable, exchangeable or redeemable for cash.
19. The Promoter shall not be liable for any Prize that may be lost, stolen, forged, damaged or
tampered with in any way after it leaves the Promoter.
20. The Promoter accepts no responsibility for any variation in the value of a Prize.
21. If the Promoter is unable to provide a winner with the nominated Prize, the Promoter reserves
the right to supply an alternative prize of equal or greater monetary value.
22. If a winner chooses not to take their Prize (or is unable to), they forfeit the prize and the
Promoter is not obliged to substitute the Prize.

23. The Promoter accepts no responsibility for any entries not received for any reason during the
Promotion Period. Entries will be deemed to be accepted at the time of receipt by the
Promoter and not at the time of transmission. No responsibility will be taken for lost, late or
misdirected entries. The Promoter is not responsible for technical difficulties with the entry
mechanism and does not warrant that the entry mechanism will be available at all times.
24. The judges’ decision is final and binding and no correspondence will be entered into.
Incomplete, illegible and incorrect entries or entries containing offensive or defamatory
comments, or which breach any law or infringe any third party rights, including intellectual
property rights, are not eligible to win.
25. If, for any reason, the Promotion is not capable of running as planned, including due to
infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure
or any other causes beyond the control of the Promoter, which corrupt or affect the
administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter
reserves the right in its sole discretion to take any action that may be available, subject to
State and Territory regulations.
26. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry
mechanism in any way, or who does not properly comply with the entry process, will be
ineligible to win.
27. The Promoter reserves the right to disqualify entries in the event of non-compliance with these
terms and conditions of entry. In the event there is a dispute concerning the conduct of the
Promotion, the decision of the Promoter is final and binding on each entrant and no
correspondence will be entered into.
28. By entering the Promotion, the entrant understands and agrees that the Promoter may use
and disclose the information provided by the entrant for the purpose of conducting this
promotion and on the terms and for the purposes (including marketing) set out in the
Promoter’s Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html
or by calling 1800 039 059, as if they were a customer of the Promoter. The entrant agrees
that the Promoter can continue to contact them even after this Promotion ends. If the entrant
would like to access or correct the personal information that the Promoter holds about the
entrant, or if the entrant does not wish the information to be disclosed, the entrant should
advise the Promoter by phoning 1800 039 059.
29. By entering into the Promotion, the entrant agrees and acknowledges that:
a) they may be contacted by the Promoter to provide comments about the Promotion and
the Promoter (or an agent of the Promoter) may take photos and recordings of them;
b) the Promoter may use such comments, photos or recordings, and/or the Eligible
Entrant’s entry submission including name and other entry details (the “Materials”) for
the Promoter’s current or future promotional and marketing purposes without further
reference or compensation to them;
c) the Materials may be used in whatever form, including but not limited to, television,
radio, publishing on the Telstra website, media releases or uploaded on to the
Promoter’s Facebook and Twitter pages for Telstra’s marketing purposes, including
promoting and marketing the Promotion;
d) the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter
wishes at any time, anywhere, and by any means. The Promoter may license,
authorise or otherwise transfer the rights in the Materials to others to do the same;
e) they grant to the Promoter on creation of the Materials a royalty free, perpetual,
exclusive and irrevocable licence to use the Materials for whatever purpose;
f) they unconditionally and irrevocably consent to any act or omission that would
otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the
Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by
statute anywhere in the world whether occurring before or after this consent is given
(“Moral Rights”);
g) they waive all Moral Rights in the Materials that arise outside Australia; and

h) they agree not to institute, maintain or support any claim or proceeding for infringement
of their Moral Rights in the Materials.
30. To the extent permitted by law, the Promoter shall not be liable for any loss or damage
whatsoever (including but not limited to direct or consequential loss) or personal injury
suffered or sustained in connection with this Promotion.
31. The Promoter accepts no responsibility for any tax liabilities that may arise from winning the
Prize.
