CONDITIONS OF ENTRY
1. Information on how to enter and prizes form part of these Conditions of Entry. Participation in this competition is deemed acceptance of Conditions of Entry.
2. Entry is open to residents of Australia aged 13 years and over, who are current or new fans of the Take 5 Facebook page or who are current or new members of TENplay at TENplay.com.au during the promotional period. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to these Conditions of Entry. Employees of the Promoters and their immediate families, participating outlets and the agencies associated with this competition are ineligible to enter.
3. One entry permitted per person per day during the entire promotional period.
4. The Promotion commences at 00:01am (AEST) on 4 September 2014 and closes at 17:00pm (AEST) on 21 September 2014 (“Promotional Period”).The judging will be done by a panel of judges appointed by the Promoters. The judging will take place at Bauer Media premises at 54 Park Street, Sydney, NSW 2000 and will begin on 25 September 2014. The winners will be notified in writing using the contact details provided in their entry. The major prize winner’s name will be published in Take 5 Magazine Issue 47 on sale 13 November 2014.
5. To enter, individuals can enter via one (1) of the following ways:

b) Indicate that they “LIKE” the page
c) Follow the prompts to the competition entry form on the Take 5 Magazine Australia Facebook page and fill in the entry form including full name, address, date of birth, current email address, day time telephone number and answer to the competition question in 25 words or less “why your Dad deserves to win?” and submit the entry as instructed during the Promotional Period.
TENPlay: Individuals must visit www.tenplay.com.au during the promotional period, and either registering to become a member of TENPlay or any of its affiliated websites. Follow the prompts to the competition page and fill in the entry form including full name, address, date of birth, current email address, day time telephone number, interests and answer to the competition question in 25 words or less “why your Dad deserves to win?” and submit the entry as instructed during the Promotional Period. If already a member, individual’s must sign into their account and then following the prompts to the competitions tab and then submit their entry form (as stipulated above) during the Promotional Period.
6. It is free to become a member of TENPlay, however, the cost of accessing the promotional website is dependent on the entrant’s individual service provider. These Terms and Conditions apply in conjunction with the TEN Members rules. These rules can be located at http://tenplay.com.au/terms-of-use.
7. Promoters’ decision in relation to all aspects of this competition is final and binding on all who enter and no correspondence will be entered into.
8. In the event the entrant enters via Take 5 Facebook page, the entrant must remain a fan of the Take 5 Facebook page from the time of entry throughout the remainder of the Competition Period to be eligible to win a prize.
9. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoters and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Conditions of Entry. Any questions, comments or complaints about this competition must be directed to the Promoters and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is

suffered or sustained by an entrant, as a result of participating in the competition (including taking/use of a prize), except for any liability which cannot be excluded by law. Entry and continued participation in the competition is dependent on entrants following and acting in accordance with the Facebook Statement of Rights and Responsibilities, which can be viewed at www.facebook.com/terms.php.
10. This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
11. The Entrant warrants to the Promoters that the entry submitted is an original literary work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the Promoters against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
12. The Promoters is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future Promoters or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The Promoters is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
13. Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoters.
14. The Promoters reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoters discretion. Failure by the Promoters to enforce any of its rights at any stage does not constitute a waiver of those rights.
15. Major Prize:
The first (1) valid entry as determined by the judges will be deemed the major prize winner and will win:

Runner’s up prize:
The next one hundred (100) valid entries as determined by the judges will be deemed the runner’s up winners and will win:
 One (1) x Ryobi New 18V Drill 1.5+Li battery including one (1) x 4.0 Ah battery 1h charger and one (1) x nylon bag (Model No. R18DD-LL99S) valued at up to $199.00.
The total prize pool is valued at up to $39,043.90 (including GST). Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.
16. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoters accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
17. The prize does not include any installation or set-up of any of the products.
18. Products included in prize package (including but not limited to titles, colour, design, sizing, model, finish, style etc) will be determined by the Promoters in its complete discretion. All prizes must be taken as offered.
19. If the winner is under the age of 18 years, the prize will be awarded to the winner’s parent or legal guardian on behalf of the winner. It is the responsibility of the winner’s parent/legal guardian to prove their parental status/ legal guardianship at the time of winner notification. In the event that for any reason whatsoever a person/s mistakenly represents themselves to be a winners parent and/or legal guardian, then that person will be liable for all costs associated with relocating and/or re-awarding the prize (including but not limited to and administrative fees incurred by the Promoters). Where relevant, the Promoters is only responsible for ensuring that the prize is awarded to a person who is either a parent or legal guardian of the winner. The Promoters is not responsible for determining any other delivery details or taking direction that relates to any ongoing family law negotiations and/or determinations. These are the responsibility of the winner and their respective parent/s and/or legal guardian/s.
20. The prize will be delivered to the nominated address of the Prize winner. Delivery of the Prize is valid to any state and/or city in Australia.
21. In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.
22. In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoters, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
23. In the event that a prize, or part of a prize, is unavailable, the Promoters reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.
24. The Promoters is neither responsible nor liable for any late lost or misdirected mail (including but not limited to prizes).
25. The Promoters is not responsible nor liable for any prize damaged in transit in the delivery of their prize
26. Any cost associated with accessing the promotional website is the entrant’s responsibility
and is dependent on the Internet service provider used.
27. In the event of unforeseen circumstances, war, terrorism, state of emergency or disaster (including but not limited to natural disaster) the Promoters reserves the right to subject to reference to all relevant state and territory rules and regulations, to cancel, terminate, modify or suspend the promotion.
28. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
29. If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoters. Method of validation (without limitation) will be determined by the Promoters in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoters requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoters. It is a condition of accepting the prize the winner sign any such legal documentation.
30. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non- Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
31. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
32. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, the Promoters reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

The Promoter is bound by the Australian Privacy Principles (APPs) in the Privacy Act 1988 (Cth) and by entering the Competition, you (the entrant) are taken to consent to Network TEN’s privacy policy which contains information, amongst other things, about how you may access personal information that is held by Network TEN about you and seek correction of such information. Our Privacy Policy also contains information about how you may complain about a breach of the APPs, or a registered code that is binding on our organisation and how Network TEN will deal with such complaints. You consent to Network Ten collecting your personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the

winner and prize fulfilment). Your personal information may be disclosed to third party service providers for this purpose. Your personal information may be and winners’ names may be published as required.. For purposes of public statements and advertisements the Promoter will only publish the winner’s surname, initial and state. A request to access, update or correct any information should be directed to the Promoter. If you are not willing for this to occur you cannot participate in the promotion.
34. Bauer Media Privacy:
Bauer Media collects personal information (“PI”) in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. Bauer Media will also use and handle PI as set out in its privacy policy, which can be accessed by visiting http://www.bauer- media.com.au/privacy.htm. In addition to any use that may be outlined in the Bauer Media’s Privacy Policy, Bauer Media may also, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
