Rimmel London – Win Moisture Renew Lipstick giveaway

TERMS & CONDITIONS
This document sets out the terms of participation in Coty Australia’s Moisture Renew Giveaway Competition (the “Competition”).
Eligibility
1. The promoter of the Competition is Coty Australia Pty Ltd (the “Promoter”) (ABN 96 058 696 549) of Level 31, 1 Market Street, Sydney, NSW, 2000, 02 9267 5500.
2. The Competition is open to all Australian residents who are 13 years of age or over (Entrants’). An Entrant must be an individual and not a company or organisation. Employees of the Promoter and their immediate families and any organisation or individual associated with the provision of the prize(s) are not eligible to enter.
3. Each entry must be made in accordance with these Terms and Conditions. By entering the Competition, you agree to be bound by these Terms and Conditions. The Promoter reserves the right to verify the eligibility of entries and the Entrant’s (including an Entrant’s identity, age and place of residence). The Promoter may in its discretion refuse to award any prize to any Entrant who fails to comply with these Terms and Conditions. All relevant instructions on the Promoter’s website form part of these Terms and Conditions.
4. Entry into the Competition is free. Only one (1) entry permitted per person for the duration of the Competition.
Competition
5. The Competition opens at 10am (AEST) on Sunday 23rd March 2014 and closes at 11:59pm (AEST) on Saturday 19th April 2014 (“Competition Period”). Any entry received after the Competition Period will be deemed invalid. No responsibility is accepted for late, lost, delayed or incorrect entries.
6. Entrants must tell us in 10 words or less: “Tell us why you love to drench your lips in this shade.” 7. All times referred to in these Terms and Conditions are in AEST.
How to enter
8. To enter the Competition you must:
a. Log on to Facebook (www.facebook.com/rimmellondonau);
b. Either already ‘like’ the Rimmel London Australia profile page or ‘like’ the Rimmel London Australia profile page by selecting the ‘like’ icon appearing on that page (and therefore become our “Fan”);
c. Select your favourite Moisture Renew lipstick colour from the colour selection menu;
d. Tell us in 10 words or less “Tell us why you love to drench your lips in this shade”;
e. Register your first name, surname, mailing address, email and phone number;
e. Agree to these Terms and Conditions on the Rimmel London Australia page accessed from (www.facebook.com/rimmellondonau) (the “Competition Page”).
How to win
9. There will be 1 winner (“1st Prize Winner”) and 140 winners (“2nd Prize Winners”) each week for the duration of the competition (Competition Period is 4 weeks in total);
a. There will be 4 winners (“1st Prize Winners”) and 560 winners (“2nd Prize Winners”) in total;
i. There will be 1 winner (“1st Prize Winners”) each week, and;
ii. There will be 20 winners (“2nd Prize Winners”) each day.
b. Each Entry will be individually judged based on the judges’ opinion of the literary and creative merit of the Entry.
c. Each 1st Prize Winner will receive a Rimmel London Moisture Renew Lipstick Pack
i. Rimmel London Moisture Renew Lipstick Pack includes 13 shades of Moisture
Renew.
ii. Rimmel London Moisture Renew Lipstick Pack is valued at RRP $181.35.
d. Each 2nd Prize Winner will receive a Rimmel London Moisture Renew Lipstick shade of winners choice;
i. Rimmel London Moisture Renew Lipstick is valued at RRP $13.95.
ii. Rimmel London Moisture Renew lipstick shade is determined by the shade selected
upon entering the competition by the Entrant.
10. No element of chance is used to determine the 564 winning entries of the Rimmel Moisture Renew Giveaway Competition.
11. The total recommended retail value of the maximum prize pool of the Competition is AU $8,537.40 broken down as follows;
a. 1st Price Winners: 4 x $181.35 = $725.40
b. 2nd Prize Winners: 560 x $13.95 = $7,812.20
c. Total prize value = $8,537.40
The Promoter takes no responsibility for any variation in Prize value.
12. The Prize cannot be exchanged or transferred and cannot be redeemed for cash. In the event that any of the Prizes become unavailable due to circumstances beyond the Promoter’s control, the Promoter reserves the right to provide a similar product to the same or greater value as the original prize, subject to any applicable laws or written directions made under applicable legislation. In the event of an Entrant being unable to satisfy these terms and conditions or forfeiting or not claiming the Prize, the Promoter reserves the right to award the Prize to the Entrant with the entry judged to be the best of the remaining entries.
13. If a prize item is unavailable the item would be replaced with a similar one of equal or greater value, in case a particular item has sold out.
14. All Winners shall be notified through email at the conclusion of each week (no later than COB the Tuesday following the weekly competition) confirming they have won and prizes will be sent in the post. This will also be announced on Facebook.
15. The Entries will be judged on a weekly basis, on the following Monday at 10am. The judging of the winners will be determined by a HM Group staff member at HM Group’s offices; Level 2, 146 Arthur Street, North Sydney NSW 2060. Judging will take place in line with the following times and dates:

16. The Prize will be sent to the Winner’s registered address by Monday 19th May 2014.
17. All Entries become the property of the Promoter and cannot be returned. You assign all copyright in your Entry to the Promoter. You consent to the Promoter, its employees, contractors and licencees doing or omitting to do anything anywhere in the world which, but for this consent, would infringe your moral rights [as defined in the Copyright Act 1968 (Cth)] in the Entry or its contents. Entries that are found to have been derived or copied from the intellectual property of a third party will be considered invalid and, if awarded a Prize, that Prize must be returned to the Promoter. Entrants may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the
Promoter reserves the right to take legal action against anyone found to have breached this term. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion.
18. The Promoter’s legal rights to recover damages or other compensation are reserved.
19. You agree that the Promoter may use your Entry and any personal details provided to the Promoter for any promotional, marketing and publicity purposes of the Promoter in any media without notice and without any fee being paid to you.
20. Decisions of the Promoter are final and will be binding on each person who enters the Competition and no correspondence will be entered into.
21. If there is any event that prevents or hinders the Promoter’s conduct of the Competition or the Promoter’s ability to deliver the prize to the prize winners, the Promoter may, in its discretion, cancel the Competition and may recommence it at another time under the same or various conditions.
22. The Promoter is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in the Competition, or for any technical error that may occur in the course of the administration of the Competition (including in the voting). The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
23. To the full extent permitted by the law, the Promoter will not be liable for any injury, damages, expenses, or losses whatsoever (whether direct or inconsequential) in relation to the competition or with respect to any matter relating there to or arising there from.
24. By entering the Competition, you acknowledge that:
a. You provide both the Promoter and Facebook with a complete release from any liability arising in connection with the Promoter.
b. The Competition is in no way sponsored, endorsed or administered by, or associated with Facebook.
c. Any information you provide to the Promoter in relation to this Competition you are providing to the Promoter, and not to Facebook.
25. The Promoter respects your personal information (PI). All PI collected by the Promoter will be dealt with under the Coty Australia privacy policy. PI is collected to enable the Promoter to administer and promote this Competition and the winners. The Promoter may also use PI collected for future promotional, marketing and publicity purposes. Any person is entitled to contact the Promoter and request access to any PI the Promoter holds about them, at any time. If an entrant does not truthfully provide all the requested PI on the competition entry form they may not be eligible to enter this Competition or win any prize.
26. Entries that contain content that the Promoter, in its sole discretion, considers to be obscene, offensive or inappropriate will not be considered eligible Entries. The Promoter will moderate the Entries posted and reserves the right to remove the content of any Entry at its discretion.
