Conditions of Entry

Participation in this promotion is deemed acceptance of these terms and conditions.
The Promoters are Bayer Australia Pty Ltd of 875 Pacific Highway, Pymble, NSW 2073, (ABN 22 000 138 714) Ph: (02) 9391 6000 & Priceline Proprietary Limited, (ABN 18 005 968 310) of 250 Camberwell Road, Camberwell, Vic 3124 Ph: (03) 8855 3000 (Promoter).
This offer is open to all Australian residents. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this Promotion are ineligible to enter. Participants under the age of 18 must first seek permission from their parent or legal guardian.
The competition commences on 14.08.2014 at 12.01am, and concludes on 26.08.2014 at 11.59pm (Promotional Period). All times are AEST.

How to enter

To enter, consumers must visit www.pricelinecompetition.com.au/canesten, enter the requested details (including their full name, mobile number, residential address and a valid email address) and state in 25 words or less ‘Where will you show off your toenails in your new designer shoes’ and submit the full completed entry form.
There will be 40 winners drawn. Each winner will win one of 40 pairs of Shoes of Prey designer shoes, valued at $250 each. Total prize value is AUD$10,000.
Entries will be judged at Priceline Proprietary Limited, 250 Camberwell Road, Camberwell, Vic 3124, judging will be completed by 09.09.2014. The judges reserve the right to select additional reserve entries which they determine to be the next most creative and literate entries, and record them in order of merit, in case of an invalid entry or ineligible entrant (Reserve Entries).
The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters. This is a game of skill. Chance plays no part in determining the winner. All entries will be judged individually on merit. No correspondence will be entered into.
The winners will be notified by telephone and/or email on 10.09.2014. The names of the winners will be published on the Priceline website at www.pricelinecompeition.com.au/canesten on 12.09.2014.
Entrants are limited to one entry during the Promotional Period.
If any of the winners cannot be contacted by telephone or email by 12.10.2014, their prize will go to one of the Reserve Entries. The new winner will be notified by telephone or email (within 2 business days of the draw date) and will be published on the Priceline website at the address detailed herein on 14.10.2014.
It is the responsibility of each eligible entrant to ensure that their details, including their phone number, email address and Priceline Sister Club membership details are correct and up to date when filling out the voting form.
Any contact details entered incorrectly shall invalidate the entry. The Promoter is not responsible for receipt of incomplete, damaged or incomprehensible entries. All such inaccurate entries will be deemed invalid. No responsibility is accepted for late, lost or misdirected entries. Any entry that does not comply with these terms and conditions will be invalid.
In the event that the prizes are not available despite the Promoter’s reasonable endeavours to procure the prize, the Promoter reserves the right to substitute prizes of equal recommended retail value, subject to any written directions from a relevant Regulatory Authority. The Promoter accepts no responsibility for any variation in the prize value.

The Promoter reserves the right to verify the validity of entries (including an entrant’s identity, age and place of residence) and to disqualify any eligible entrant where the Promoter believes that the entry or the entry process has been tampered with or where any entry has been submitted not in accordance with the Terms and Conditions.
All entries become the property of the Promoter. Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter accepts no responsibility for any lost, late, misdirected claims or correspondence due to incorrect entrant information.
The Promoter collects entrants’ personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not be able to participate in the promotion. All personal information collected will be dealt with in accordance with the Promoter’s Australian privacy laws and the Promoter’s Privacy Policy, which can be viewed at www.priceline.com.au. The Promoter will not disclose this information to anyone other than contractors who provide services to the Promoter for the purposes of conducting this promotion unless compelled or permitted by law.
If the prize is unavailable, the Promoters, in their discretion, reserve the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
The Promoter reserves the right, at its sole discretion and without notice, to cancel, modify or suspend these terms and/or this promotion in whole or in part, including, but not limited to in the event of fraud, technical or other difficulties or if the integrity of the Promotion is compromised, subject to any written directions from the various lottery departments and without liability to the participant. The contact details of the winning entry may be passed onto a third party for prize notification and fulfilment.
The prizes cannot be assigned, transferred, redeemed for cash, or substituted except by the Promoter who may at their sole discretion, subject to the relevant state authorities, substitute any prize with one of comparable value if the advertised prize is or becomes unavailable for any reason. The Promoter will not replace any lost or stolen prizes, or take responsibility for any broken products in the delivery of the product or after it has been delivered. It is not the responsibility of the Promoter to insure any products.
The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be taken as cash.
In the event of war, terrorism, state of emergency or disaster, the Promoters reserve the right to cancel, terminate, modify or suspend the promotion or suspend or modify a prize, subject to any written directions from a relevant regulatory authority.
Entrants consent to the Promoter using the entrant’s name, likeness, image and/or voice in the event that they are a winner (inc. photograph, film, and/or recording of the same) in any media for an unlimited time without notice or remuneration for the purpose of promoting this competition.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including their respective officers, employees and agents) are not responsible for and exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters’ control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.
