AMERICAN IDOL COMPETITION WITH TEN
By entering the ‘News.com.au & American Idol Competition, you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
2. WHO CAN ENTER
2.1 Subject to clause 2.2, entry is open to all residents of Australia who are 18 years of age and over (‘Eligible Entrants’).
2.2 Employees and their immediate families of News Limited Australia and Network Ten Pty Limited (together, the Promoter) and their associated agencies and companies are not eligible to participate in the promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
3. HOW TO ENTER
3.1 The competition commences on Monday 28 April 2014 at 09:00 AEST and concludes on Monday 5 May 2014 at 10am AEST. (“the Competition Period”).
3.2 To enter the competition, entrants must complete the online entry form at news.com.au/win. Entry details must include their completed answer, plus personal details including their full name, email address and contact telephone number in the competition.
3.3 The entry mechanic is only open to users with access to the internet, with a current and functioning email address. It is recommended that entrants check with their individual service provider in this regard.
3.4 Individuals can enter as many times as they wish. There will be 1 major prize winner and 3 minor prize winners.
3.5 The prize winners will be determined on Tuesday 6 May 2014 at 3.00pm AEST at News Limited, Level 3 Holt St, Surry Hills, NSW, 2010. The major prize winner will be the entrant who has the most compelling answer, in 25 words or less, to “Who is your favourite American Idol judge, and why?”
3.6 All winners will be announced in The Australian newspaper on Monday 12 May 2014.
3.7 The time of entry will be the time that it is received by News Limited, Level 3 Holt St, Surry Hills, NSW, 2010.
3.8 The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries.
3.9 Incomprehensible and incomplete entries will be deemed invalid. This will include entries with an invalid email registration.
4. DRAW
4.1 Each entrant who completes the online entry form during the Competition Period and registers their details in accordance with clauses 2 and 3 will be entered into the prize draw.
4.2 The prize winner will be notified by phone call and by email within 2 working days of the prize draw & announced in The Australian newspaper on Monday 12 May 2014.
4.3 The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.
4.4 Entries not completed in accordance with these terms and conditions will not be considered eligible and will not be included in the draw. Indecipherable or incomplete entries will be deemed invalid.
4.5 It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
4.6 The Promoter reserves the right to request that the winner provides proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
4.7 The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
5. PRIZES
5.1 Subject to Clause 4.2, the Major Prize winner will receive a trip for 2 people to Los Angeles, USA , valued at $8100. The prize includes:
• 2 x tickets to the SEMI FINAL filming of American Idol on May 20th
• 2 x tickets to the FINALE filming of American Idol on May 21st
• Return Flights to LA from your nearest capital city for 2 people
• Transfers from the airport, and to & from the filming each day
• 5 x nights accommodation in LA for 2 people
• $3000 AUD Cash spending money
5.2 The Major Prize must be taken as offered. No modifications or exchanges will be possible and prizes are not transferable or redeemable for cash or kind. Event tickets are only valid for the date or period specified on the tickets or by the provider, and are subject to any terms and conditions imposed by the provider. Once awarded, the Promoter is not liable for any ticket that has been lost, stolen, forged, damaged or tampered with in any way.
5.2a The prize is for the specified dates of the event only. If the winner (for whatever reason) is unable to travel or does not take an element of the prize within the time stipulated by the Promoter then the prize will be forfeited and cash will not be awarded in lieu of the major prize. The Promoter makes no representations or warranties about the attendance at the event of any individuals or groups involved in the marketing of the event.
5.3 Travel arrangements are subject to the terms of the Promoter or its assigned representatives. Compliance with any health or other government requirements is the responsibility of the prize winner and their travel companions. All prize travel will be subject to the carrier’s General Conditions of Carriage. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade
5.4 Once the Major Prize has been provided, changes to the travel or accommodation arrangements are at the expense of the winner. The winner/s and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure.
5.5 Any additional costs incurred by the Winner, other than those that form part of the prize, are the responsibility of the winner, including transfers, visas, spending money, and any incidental, non-room-only charges including but not limited to room service, telephone calls and internet usage. Travel insurance is also not included and is advisable.
5.6 The total maximum prize pool value is $8100.
5.7 Prize value is correct at Monday 7 April 2014. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Prize is not transferable or exchangeable and cannot be taken as cash. Prize must be taken as offered and cannot be varied.
5.8 Prizes cannot be transferred, exchanged or redeemed for cash. In the event that a winner does not take the prize as offered at the time stipulated, then the prize will be forfeited and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
5.9 Should any component of the prize package not be able to be fulfilled by the Promoter due to unforeseen circumstances, best endeavours will be made to fulfil the remaining prize components.
5.10 The winner must, on request by the Promoter, be able to provide evidence which, to the reasonable satisfaction of the Promoter, demonstrates that the winner is an eligible entrant (as per clauses 2.1 and 2.2) and has complied with these terms and conditions.
5.11 If the Major Prize remains unclaimed by Monday 9 May 2014, the Promoter can redraw the prize and choose another winner.
5.12 Any taxes (other than GST, if any) which may be payable as a consequence of the winner receiving this prize are the sole responsibility of the winner.
5.13 By accepting the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. In consideration for the Promoter awarding the prizes to the winners, the winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use.
5.14 The winner agrees that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
