Promotion opens 27 March 2014 and closes 28 May 2014 at 11:59am AEST. Entry is open to all residents of Australia aged 18 years and over who is currently a Mother. For the removal of doubt a “Mother” includes (but is not limited to) adopted, foster and biological mother of a child that is 6 months and over. For the purposes of this promotion a mother may be nominated by another person or may nominate themselves. One entry per person will be permitted. This is a game of skill, not a game of chance. Entry is open to all residents of Australia aged 18 years and over who is currently a Mother. For the purposes of this promotion a mother may be nominated by another person or may nominate themselves. The entrant will be deemed to be the mother nominated. Employees of the Promoter, associated agencies and their immediate families, are not eligible to enter.
It is a condition of accepting the Major prize that the Major Prize winner is available to travel to Sydney on 23 September 2014 to 25 September 2014 to coincide with the Mother & Baby Awards ceremony.
Only one entry per person will be permitted.
The promotion commences on 27 March 2014 and closes 11.59 AM AEST on 28 May 2014. The judging will be done by a panel of judges appointed by the Promoter. The judging will take place at the Promoter’s premises 54 Park Street Sydney NSW 2000. There will be two stages of judging. The first stage of judging will determine the five (5) finalists for the competition and the second round of judging to determine to overall winner. The first stage of judging will begin on 4th June 2014. The second round of judging will begin on 30th June 2014.
To enter, individuals must during the promotional period go to http://www.motherandbabyawards.com.au/ and follow the prompts to the competition page and fill in the entry form including full name, full name of nominee (mother), date of birth, address, email address, daytime telephone number, child/s date of birth and answer the competition question in no more than 150 words “Why you, or someone you know, deserves to be Mum of the Year?” In the event you are nominating a person who is not yourself – please provide the name and contact details of the mother you are nominating in the contact information on the entry form and submit the entry as instructed.
This is a game of skill, chance plays no part in determining the winner. Each entry will be individually judged based on its literary and creative merit of the answer to the question provided and suitability to the Promotion. The judges’ decision in relation to any aspect of the competition will be final and binding on every person who enters. No correspondence will be entered into.
The Entrant warrants to the Promoter that the entry submitted is an original artistic work of the Entrant that does not infringe the rights of any third parties. If the entry or any part of the information provided to the Entrant in relation to the entry was provided by a third party, the Entrant warrants that they have obtained the relevant copyright permission to submit the entry for the purposes of this promotion. The entrant agrees to indemnify the promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
The Promoter is entitled to use any of the entries submitted in any manner and for any purpose at its absolute discretion, including using the entries for future promoter’s or their agents book publications, promotional, marketing and publicity purposes without any further reference or payment or other compensation to the entrant. The promoter is entitled to amend, edit, select, crop, retouch, add to or delete from any part of the submitted entry.
Entries must not be offensive, defamatory or racist. Any entry which the judges deem inappropriate will be invalid. The entrant agrees to indemnify the Promoter.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence, availability to redeem the prize and mother status) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The first stage of judging: The first round of judging will begin on 4th June 2014 to determine the best five (5) valid entries to be deemed the Finalist of the competition. The five (5) finalists will be notified in writing and by telephone using the contact details given in their entry. It is a condition of accepting the finalist status that the Finalist (entrant) agrees to be interviewed, photographed and filmed at any time during 4th June 2014 to 30th June 2014 by the Promoter or their agents for a story or feature on this promotion to be developed and featured in Mother & Baby Magazine, website, social media pages or by Coles Baby and Toddler Club (or any other form of media the Promoter and Coles Baby and Toddler Club (“Sponsor”) deems suitable) without further remuneration or reference to the participant. Details may feature in Mother & Baby magazine, on the Mother & Baby website, on Mother & Baby social media sites, on the Sponsors site and/or in the Sponsors Baby & Toddler magazine on a date to be determined by the Promoter. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times.
Finalists must disclose any issues that may generate negative publicity and impact on the success of this promotion and/or Mother & Babymagazine. The Promoter can disqualify an entrant for failure to disclose any issues that may generate negative publicity and impact on the success of the Original Mother & Baby 2014 Mum of the Year, Mother & Baby Awards and/orMother & Babymagazine.
The Promoter reserves the right to disqualify an entrant if, in their complete discretion the Promoter deems that nominee’s continued involvement in the Original Mother & Baby 2014 Mum of the Year, Mother & Baby Awards promotion will (in any way) negatively impact on the success of the promotion and negatively influence the general purpose of the promotion. For the removal of doubt the Promoter has the right to remove and/or disqualify a participant at any stage of the promotion. No correspondence will be entered into.
The 2nd round of judging will begin The second round of judging will begin on 30th June 2014 to determine the overall winner from the five (5) finalists. The best (1) entry as determined by the judges will be deemed the Major Prize Winner and will be deemed the “Mother & Baby Magazine 2014 Mother of the Year”. The overall winner will be notified by telephone and in writing using the contact details provided in their entry. The overall winner will be notified by 7th July 2014.
The Major Prize winner will receive the Major Prize package valued at up to $12,058.00. Prize package includes:
One (1) x return economy flight from the winner’s nearest major capital city to Sydney valued at up to $938.00 (including taxes, depending on point of departure)
Two (2) nights’ accommodation in a standard room at the Sheraton On The Park in Sydney valued at up to $720.00
One (1) x ticket to the Mother & Baby 2014 Awards ceremony in Sydney on 24 September 2014.
$200 spa voucher – to be redeemed as a package and taken at a time coinciding with the prize winning trip to Sydney. The Spa treatment and venue will be booked and selected by the Promoter at its complete discretion.
One (1) year’s supply of groceries from Coles valued at $10,400 – awarded in the form of Coles Gift cards equating to $200.00 per week for fifty-two (52) weeks (one (1) year).
Total prize pool is valued at up to $12,058.00 (includes GST) (including taxes) (depending on point of departure). Any ancillary costs associated with redeeming the prize are not included. These are the responsibility of the winner.

If the Major Prize winner is unavailable to travel on the dates stipulated by the Promoter, the finalist, having being contacted prior to the announcement of the winner, will forfeit their right to win the major prize which they are unable to redeem. In the event that for any reason whatsoever the winner is unable to redeem the prize on the dates stipulated by the Promoter, and the winner is unable to transfer the prize to a nominated person, then the prize will be forfeited by the winner and neither cash nor another prize will be awarded in lieu of the forfeited prize. Prize must be taken as offered. The prize, or any unused portion of the prize, is not exchangeable or cannot be redeemed as cash. The prize cannot be used in conjunction with any other special offer. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winner is advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass/ letter, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass/ letter. The Promoter will not be liable for any voucher / ticket / pass/ letter that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of prize at a venue is subject to the standard rules and regulations of that prize supplier.
The Coles Gift Cards are valid for two (2) years from the date of issue. Any unused balance of any voucher or gift card will not be awarded as cash. Redemption of any voucher or gift card is subject to any terms and conditions of the issuer including those specified on the voucher or gift card. Redemption of the voucher prizes are subject to the terms and conditions stipulated on the voucher. The Promoter will not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.
The spa voucher is valid for use between 23 September 2014 and 25 September 2014 only. Any unused balance of any voucher or gift card will not be awarded as cash. Redemption of any voucher or gift card is subject to any terms and conditions of the issuer including those specified on the voucher or gift card. Redemption of the voucher prizes are subject to the terms and conditions stipulated on the voucher. The Promoter will not be liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.
Excluding the Coles Gift Card component of the prize, the event based component of the prize must be redeemed in full and as a package between 23 September 2014 and 25 September 2014, to coincide with Mother & Baby Magazine Awards Ceremony. Redemption of prize is subject to booking and flight availability. Prize is a single event holiday and cannot be separated into different holiday vacations.
The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the Mother & Baby 2014 Awards ceremony is postponed, cancelled, rescheduled or relocated for any reason whatsoever.
The prize includes one (1) seat at a table (meal included) at the Mother & Baby 2014 Awards ceremony. The location/seat of the table will be determined by the promoter at it’s complete discretion. Any other meals and drinks (unless specified) are at the expense of winner.
Changes to flight schedules may require additional overnight accommodation at either commencement, during the itinerary, or on completion of the trip which is at the winners expense.
The winner is responsible for all other expenses including but not limited to taxes, surcharges, spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, travel insurance and all other ancillary costs.
A credit card imprint or cash deposit will be required from the winner at check-in of the hotel for all incidental charges. Once accommodation letter is issued they are non-changeable.
Transport to and from Departure point including but not limited to additional Domestic airfares if required, any additional meals, any extra sightseeing or activities, any additional accommodation, personal spending money, and all other ancillary costs, as well as obtaining any of these, are the responsibility of the winner and their travel companions. Prize also excludes medical expenses, items of a personal nature, beverages, optional tours not outlined, laundry, telephone calls, additional nights, room upgrades or other ancillary costs associated with redeeming the prize other than those specified. These costs and expenses are the responsibility of the winner. Any extension to the duration of the prize is at the winner’s sole expense and subject to availability at the time of booking. For the removal of doubt, taxes for domestic travel are included in the prize winning domestic airfares provided by the Promoter.
Prize values are based upon the full fare prices at the time of competition terms lodgement. The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
Unless expressly stated in these conditions of entry all other expenses (including travel to and from the departure point) become the responsibility of the winner.
The prize (or any part thereof) cannot be sold, is not transferable or exchangeable and cannot be taken for cash.
Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The Promoter’s decision is final and no correspondence will be entered into. It is the winner’s responsibility to ensure that they have all relevant documentation included but not limited to passports/visas in order to travel. All elements of the prize must be taken together within the one trip. The winner will not be compensated for unused portions of the prize.
Travel restrictions may apply. Prize does not include travel insurance. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.

In acceptance of the prize, the Winner acknowledges that they may incur ongoing costs associated with the prize which are the entire responsibility of the winner.

It is a condition of accepting the Major Prize that the winner sign all legal documentation (including but not limited to a legal release) as provided to them by the Promoter. Form of documentation will be determined by the Promoter in its complete discretion.
It is a condition of accepting the prize that the winner warrants to the Promoter that they understand that any arrangement entered into in relation to the redemption of this prize does not create a relationship between the winner and the Promoter of employer and employee, principal and agent, partnership or joint venture.
In the event that for any reason whatsoever the Winner does not take the prize at the time stipulated by the Promoter, then the prize will be forfeited by the Winner and cash will not be awarded in lieu of the prize.
In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize or part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments.

If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry.
If your entry is selected as a winning entry, validation of your circumstances/ the validity of your entry will be undertaken by the Promoter. Method of validation (without limitation) will be determined by the Promoter in its complete discretion. If the winning entry is deemed to be a winner, the winner will be notified as per the terms and conditions herein. In the event that the Promoter requests the entrant to sign any legal documents relating to the verification of their medical circumstance, the legal documents will take the form determined by the Promoter. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”).
