TERMS AND CONDITIONS
1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Entry is only open to residents of NSW, VIC, SA, WA, QLD and ACT. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. To be eligible, entrants must be an Active Hoyts Rewards member at the time of entry. An Active member is one who has not expired and who has successfully provided their personal details online.
4. Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion.
5. Promotion commences on 12/2/14 and closes 11:59pm AEST on 19/2/14 (“Promotional Period”).
To enter, individuals must, during the Promotional Period log in to their Hoyts Rewards account and follow the prompts and input the requested details, and submit the fully completed form including answering a question in 50 words or less ‘What is your favourite meal to have on a date and why?’
6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
7. Incomplete or indecipherable entries will be deemed invalid.
8. Multiple entries permitted, subject to the following: (a) each entry must be submitted with a different email address; and (b) each entry must be submitted separately and in accordance with entry requirements.
9. The Promoter’s decision is final and no correspondence will be entered into.
10. Prizing is non-transferrable and cannot be exchanged in any way.

12. Twenty (20) Runners Up winners will each receive a ‘A Case of You’ on DVD valued at $39.95 each and a VIP HOYTS Kiosk Rental Card valued at up to $35. The HOYTS Kiosk VIP card is valid for a 3 month period and provides 10 movie rentals at zero cost. A maximum of 4 rentals per day are allowed from any HOYTS Kiosk. The user must provide a valid credit card upon each transaction at a HOYTS Kiosk. In order to receive the free movie rental a Promo Code needs to be entered by pressing the “Use Promo Code” button on the checkout screen PRIOR to swiping credit card. Rentals must be returned by 9pm the day after it is rented or the user will be charged an additional fee for each night. After 10 days if a movie has not been returned, the user will be charged $35 and the movie is then theirs to keep. The promo codes cannot be used in conjunction with any other promotion offered by HOYTS Kiosk. HOYTS Kiosk machines are located in NSW, VIC, QLD, TAS, ACT, SA and WA. DVD and Blu-ray titles will vary from kiosk to kiosk.
13. In the event that any prize item is unavailable, the Promoter reserves the right, subject to the approval of any relevant trade lottery authority, to substitute a prize item of equal or greater value.
14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize.
17. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and as required, to regulatory authorities. Entry is conditional on providing this information. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.
