The CommBank Cricket Club has a great relationship with our Aussie Men’s Cricket Team and a few of them would like to spend time with you – doing what you’d like to do.

We want your most imaginative* ideas!

Maybe you’d like to play a round of golf with them, get them to cook for you or challenge them to a ping-pong tournament. We’ll even fly you and a friend to Sydney for it!

CCC PLAYER APPEARANCE PROMOTION CONDITIONS OF ENTRY

1. Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet only.
ELIGIBILITY
2. Entry is only open to residents of Australia aged 13 years or older.
Entrants aged under 18 years must obtain the consent of their parent or legal guardian to enter the promotion and provide personal information about themselves. All entries of Entrants who are under the age of 18 years and enter the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or guardian consent (as and where required) will be deemed invalid. These Conditions of Entry will bind the Entrants and any parent or legal guardian who gives their consent (for Entrants aged under 18 years). If any prize winner is aged under 18 years, the prize will be awarded to the parent or legal guardian who consented to the winner entering the promotion on behalf of the winner, at the sole discretion of the Promoter and the winner must be accompanied by a parent or legal guardian.
3. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion.
PROMOTIONAL PERIOD
4. The promotion starts at 8.00am (AEDT) on 5/6/14 and ends at 9.00AM (AEDT) on 16/6/14
(Promotional Period). HOW TO ENTER
5. To enter the promotion, Entrants must, during the Promotional Period either: a. Internet Entry
i. log onto https://www.commbank.com.au/blog.html (Promotional Website);
ii. fully and correctly complete and successfully submit the online entry form in the manner required, including providing their full name, mobile telephone number, state of residence and current and valid email address and agree to the terms and conditions, privacy policy and subscribe to receive news and information from the CommBank Cricket Club and
iii. Complete in 25 words or less ‘What would you do if you had a few hours with players from the Aussie Men’s Cricket team?
6. Only one (1) Entry per person permitted. Any subsequent entry after the first valid entry is received will be deemed invalid.

7. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries.
8. Costs associated with accessing the Promotional Website remain an Entrant’s responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the Promotional Website by an Entrant will deem an entry invalid.
9. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
10. This promotion will be a considered a game of skill with the prize being awarded to the most creative response that the promoter and Cricket Australia deem achievable and reasonable for members of the Australian Cricket Team to fulfil within the dedicated four hour appearance.
JUDGING
11. The judging to determine the winners will take place at Darling Park, Tower 1, 201 Sussex St, 2000 on the 20th June, 2014. Winner will be notified by telephone and localities will be published on https://www.commbank.com.au/cricket on the 20th June, 2014, and will remain on that website for a minimum of twenty-eight (28) days. All reasonable steps to notify the winners of the results of the judging will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
PRIZING
12. Australian Cricket Team Player appearance: The entry judged to be the most creative, achievable and reasonable by the promoter and Cricket Australia from all entries received during the Promotional Period from Entrants will win access for the prize winner and 1 friend (or guardian if aged under 18) to a minimum of three (3) members of the Australian Men’s Cricket Team for a period of 4 hours between 8am and 12 midday on Sunday the 29thth June, 2014 in a location to be confirmed in Sydney. The players selected by Cricket Australia will be based on availabilities and current commitments. The player appearance is held over a 4 hour period and is inclusive of travel from the nearest capital city to where the prize is awarded in Sydney. Prize includes the filming of the activities completed in the 4-hour period. No additional talent, location or catering included in the prize. Prize activities may not be the same as those in the winner’s entry and will be determined at the sole discretion of the Promoter. Where the winner is below the age of 18, they must nominate the parent or legal guardian who consented to the winner entering the promotion as their companion, and that parent or legal guardian must be aged 18 years or older. Any other persons attending performance and filming of activities are considered to be invitees of the winner and the winner (or their parent/guardian) is responsible for their safety as well as any requisite consent for their image, voice or likeness to appear in recordings. The Promoter reserves the right to exclude any person from attending.
13. By claiming the prize, the winner accepts all aspects of the prize and waives all usage rights for the video content produced throughout the four hour window. This content may be used across Commonwealth Bank’s owned media assets (e.g. website or digital merchandising) and shared within social media on behalf of the bank and Cricket Australia digital channels for an unlimited period. The content may also be used, in whole or in part, in any broadcast or advertising as determined by the Promoter. All the foregoing consents and waivers are given by winners and their respective parents/guardians.

14. The winner will be entitled receive a copy of the footage from the appearance subject to the following conditions (i) the footage will be provided for the winner’s personal use only; (ii) the footage must not be uploaded or shared on the internet including YouTube, Facebook or any other social media; and (iii) the footage must not be commercialised, sold, provided to members of the public or otherwise exploited without the prior written approval of Cricket Australia.
PRIZE TERMS
15. Prize value is up to $20,000.00. Prize is not transferable or exchangeable and cannot be taken as
cash. The Promoter reserves the right to determine the manner of fulfilment of a prize and the prize must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST, depending on point of departure (if applicable).
16. The prize must be taken on the dates nominated by the Promoter to coincide with the applicable prize experience (as applicable), otherwise the entire prize is forfeited. No extension or variation of the prize dates nominated by the Promoter permitted. All components of the prize (if applicable) must be taken together and when offered or are forfeited. Any element of a prize not taken will be deemed to be forfeited.
17. All additional costs not expressly stated, but which may be incurred in acceptance and use of a prize, are NOT included in the prize and remain the sole responsibility of the winner and their companion(s) (if any). Such additional costs include, but are not limited to, meals and beverages, transport, telephone calls and laundry services.
18. The Promoter and any prize supplier in their absolute discretion reserve the right to change or amend a prize schedule/timings without notice. Neither the Promoter nor Cricket Australia accept responsibility for the cancellation, rescheduling or delay of the prize due to player availability.
19. The Promoter reserves the right to disqualify the winner or their companion(s) (if any), prohibit the winner’s or their companion(s)’ (if any) participation in a prize or any component of a prize, or otherwise cease to provide any prize benefit to the winner or their companion(s) (if any), if the winner or their companion(s) (if any) act in a way, or cause material to be published, which the Promoter in its sole discretion deems to be inappropriate, aggressive, defamatory, offensive, or contrary to law, to diminish the good name or reputation of any prize supplier and/or the Promoter, its products and/or services or any of its related bodies corporate or sponsorship partners (including Cricket Australia, its staff and/or any players), or is otherwise not in keeping with the spirit of the promotion. For the avoidance of doubt, the winner can be disqualified after the winner is notified and published if the winner is found to have not acted in accordance with these Conditions of Entry. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
GENERAL
20. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the Entrant in entering the promotion, before issuing a prize (including confirming consent of an Entrant’s parent or legal guardian and the name, age and address of the parent or legal guardian that gave their consent, where an Entrant is under 18 years of age). the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.
21. The Promoter reserves the right to request the winner’s companion(s) (if any) produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the companion(s)’ (if any) identity and age before issuing a prize and/or as and when required during participation in a prize.
22. It is a condition of accepting a prize that the winner and their companion(s) (if any) may be required to sign a legal release or releases in a form determined by the Promoter in its absolute discretion or any agencies associated with this promotion, including without limitation Cricket Australia in its absolute discretion.
23. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
24. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an Entrant, the Entrant agrees to indemnify the Promoter for those losses, damages and costs.
25. IMPORTANT: If a prize or element of a prize becomes unavailable, for any reason beyond the Promoter’s reasonable control, then the Promoter reserves the right to award a substitute prize in lieu, subject to any written directions made under applicable State or Territory legislation, which will comprise (at the Promoter’s discretion) one or more of the following: Cricket Australia merchandise, match tickets and/or other opportunities to meet one or more members of the Australian Men’s Cricket Team. The Promoter makes no representation regarding value of any such substitute prize or prize element but will use all reasonable endeavours to provide prizes at a value of no less than $2,500. For the avoidance of doubt, no cash will be awarded to winners in the event that a prize becomes unavailable.
26. If this promotion is not capable of running as planned for any reason, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize or prizes, subject to any written directions made under applicable State or Territory legislation.
27. The Promoter, its associated agencies and companies and Cricket Australia excludes all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the Australian Consumer Law), for any direct or indirect injury, loss and/or damage arising in any way out of the promotion. This includes, but is not

limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims.
28. As a condition of entering this promotion, an Entrant consents to, in the event they are a winner, the Promoter and Cricket Australia using the Entrant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Entrant agrees that, in the event they are a winner, the Entrant will participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents.
29. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter. The Promoter collects personal information about an Entrant to include the Entrant in the promotion and, where appropriate, award prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. An Entrant also agrees that the Promoter may, in the event the Entrant is a winner, publish or cause to be published the Entrant winner’s name and locality in any media, as required under the relevant State or Territory lottery legislation. An Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer at: Customer Relations, Commonwealth Bank Group, Reply Paid 41, NSW 2001, or by calling the Promoter on 13 22 21 or by visiting any branch of the Promoter. All personal information will be stored at the office of the Promoter. 30. By participating in the promotion, an Entrant also acknowledges that a further primary purpose for collection of the Entrant’s personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and for the Promoter’s CommBank Cricket Club to contact the Entrant in the future with information on special offers or to provide the Entrant with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. Entrants may be asked to consent to the Promoter sharing information with its Australian related companies or partners who may contact the Entrant with special offers or information about their products and services. By entering the promotion, an Entrant acknowledges and agrees that the Promoter may use the Entrant’s personal information in the manner set out in this condition.
31. By submitting ideas and entering the competition, entrants consent to the Promoter sharing their personal information with Cricket Australia (ABN 53 006 089 130) of 60 Jolimont Street, Jolimont VIC 3002 and storage of this personal information on Cricket Australia’s database. Cricket Australia may use Entrants’ information for future promotional and marketing purposes regarding Cricket Australia’s products including contacting the entrant via electronic messaging.
