STANDARD TERMS
Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
WHO CAN ENTER
Subject to clause 2.2, entry is open to all residents of Australia who are 18 years of age and over (‘Eligible Entrants’).
Employees and their immediate families of News Limited Australia and Network Ten Pty Limited (together, the Promoter) and Antigua and Barbuda Tourism, and their associated agencies and companies are not eligible to participate in the promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
HOW TO ENTER
The competition commences on Friday 27 December 2013 at 09:00 AEST and concludes on Wednesday 15 January 2014 at 23:59 AEST. (“the Competition Period”).
To enter the competition, entrants must complete the online entry form at news.com.au. Entry details must include their completed answer, plus personal details including their full name, email address and contact telephone number in the competition.
The entry mechanic is only open to users with access to the internet, with a current and functioning email address. It is recommended that entrants check with their individual service provider in this regard.
Individuals can enter as many times as they wish. There will be 1 major prize winner and 3 minor prize winners.
The prize winners will be determined on Friday 17 January 2014 at 2.00pm AEST at News Limited, Level 3 Holt St, Surry Hills, NSW, 2010. The major prize winner will be the entrant who has the most compelling answer, in 25 words or less, to “Tell us which cricket stars would you like to go on holidays with, and why?”
All winners will be announced in The Australian newspaper on Monday 20 January 2014.
The time of entry will be the time that it is received by News Limited, Level 3 Holt St, Surry Hills, NSW, 2010.
The Promoter, its agents, affiliates or representatives will not be liable for any lost, late or misdirected entries. Incomprehensible and incomplete entries will be deemed invalid. This will include entries with an invalid email registration.
DRAW
Each entrant who completes the online entry form during the Competition Period and registers their details in accordance with clauses 2 and 3 will be entered into the prize draw.
The prize winner will be notified by phone call and by email within 2 working days of the prize draw & announced in The Australian newspaper on Monday 20 January 2014.
The Promoter’s decision in relation to any aspects of the competition is final and the Promoter will not enter into any correspondence regarding the result.
Entries not completed in accordance with these terms and conditions will not be considered eligible and will not be included in the draw. Indecipherable or incomplete entries will be deemed invalid.
It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
The Promoter reserves the right to request that the winner provides proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that the winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of the Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or entry, or who has, in the opinion of the Promoter, engaged in conduct in entering the promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
5. PRIZES
5.1 Subject to Clause 4.2, the Major Prize winner will receive a trip to Antigua and Barbuda up to the value of $25000, courtesy of Antigua and Barbuda Tourism, consisting of:
o 4 x return economy flights (2 adults, and 2 children) to Antigua, from the winner’s nearest Australian capital city (valued at up to $16,000)
o Transfers to and from the airport and resort in Antigua AU$1,095
o VIP meet and great at the airport in Antigua
o 7 x nights’ accommodation for four in a 5 star resort, fully inclusive of all food and beverage (valued at up to $7,700]
o Total Major Prize valued up to $24,795
5.2a The Major Prize is valid from 01/05/2014 – 30/11/2014 and is subject to booking and flight availability. This may affect chosen travel dates. Prizes must be taken as offered. No modifications or exchanges will be possible and prizes are not transferable or redeemable for cash or kind.
5.2b All travel arrangements are to be made at least 30 days prior to travel. Travel arrangements are subject to the terms of the Promoter or its assigned representatives.
5.2c All Prizes are subject to availability at the time of booking and, if any component of a prize is unavailable on the dates proposed by the winner, the Promoter will consult with the winner to determine alternative dates on which the prize will be booked.
5.2d Once the Major Prize has been provided by Antigua and Barbuda Tourism, changes to the travel or accommodation arrangements are at the expense of the winner.
5.2e Any additional costs incurred by the Winner, other than those that form part of the prize, are the responsibility of the winner, including transfers, visas, spending money, and any incidental, non-room-only charges including but not limited to room service, telephone calls and internet usage. Travel insurance is also not included and is advisable.
5.3 Three minor prize winners will receive a Cricket Pack from Sir Viv Richards, each valued at approximately $1000 per kit. Each kit includes:
 Gear bag, bat, gloves, pads, protective gear, cap, polo shirt
5.4 The total maximum prize pool value is $28000.
5.5 Prize value is correct at Friday 13 December 2013. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Prize is not transferable or exchangeable and cannot be taken as cash. Prize must be taken as offered and cannot be varied.
5.6 Prizes cannot be transferred, exchanged or redeemed for cash. In the event that a winner does not take the prize as offered at the time stipulated, then the prize will be forfeited and cash will not be awarded in lieu of the prize. Prizes must be taken as offered and cannot be varied. Any unused portion of the prize is not-transferable, non-refundable and non-redeemable for other goods or services and cannot be taken as cash.
5.7 Should any component of the prize package not be able to be fulfilled by the Promoter due to unforeseen circumstances, best endeavours will be made to fulfil the remaining prize components.
5.8 The winner must, on request by the Promoter, be able to provide evidence which, to the reasonable satisfaction of the Promoter, demonstrates that the winner is an eligible entrant (as per clauses 2.1 and 2.2) and has complied with these terms and conditions.
5.9 If the Major Prize remains unclaimed by Monday 3 February 2014, the Promoter may reallocate the prize to a future survey competition.
5.10 Any taxes (other than GST, if any) which may be payable as a consequence of the winner receiving this prize are the sole responsibility of the winner.
5.11 By accepting the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the promotion, including but not limited to being interviewed and photographed. In consideration for the Promoter
awarding the prizes to the winners, the winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use.
5.12 The winner agrees that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
6. NO LIABILITY
6.1 The Promoter, shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. Neither is the Promoter responsible for any incorrect or inaccurate information, either caused by the entrant or any of the equipment or programming associated with, or utilised in this competition, or for any technical error, or combination thereof that may occur in the course of the administration of this competition, including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite failure, theft or destruction or unauthorised access to, or alteration of, entries.
6.2 If for any reason, this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available and to cancel, terminate, modify or suspend the competition subject to any written directions given under State Legislation.
6.3 Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents), excludes all liability (including negligence) for any personal injury, loss or damage (including loss or opportunity) whether direct, indirect, special or consequential, arising in any way out of the promotion, including but not limited to, where arising out of the following:
a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
b) any theft, unauthorised access or third party interference;
c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
d) any variation in prize value to that stated in these conditions of entry;
e) any tax liability incurred by a winner or entrant;
f) the broadcast of any program relating to the competition or the publication of any material, including statements made by any compere, staff member, journalist, other entrants or any other person; and/or
g) participation in the prize.
6.4 Once prizes have left News Limited’s premises, the Promoter, and their associated agencies, take no responsibility for prizes damaged, delayed or lost in transit.
6.5 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
7. PRIVACY CONSENT
7.1 News Limited and Network Ten, as the Promoter of this competition, along with Antigua and Barbuda Tourism, will collect your personal information. Your personal information will be used to process your competition entries and, where you have agreed, to provide you with marketing material. We or any of our Australian related companies may be in touch by any means (including email or SMS) at any time to let you know about goods, services or promotions which may be of interest to you. We may also share your information with other persons or entities who assist us in providing our services, running competitions (including administering the competition or distributing prizes) or with other companies who provide prizes for competitions or offers. We may also disclose your personal information in accordance with these terms and conditions if you are a prize winner or finalist.
