These are the Terms and Conditions for the Blundstone Australia Pty Ltd and Dark Mofo 2018 Weekend Experience Giveaway and corresponding promotion.

The Promoter is Blundstone Australia Pty Ltd (ABN 60 009 475 852) of 88 Gormanston Road, Moonah, Tasmania, 7009, telephone 03 6271 2200 (in Australia).

The Supplier is DarkLab Pty Ltd, provider of Dark Mofo, (ABN 61 615 687 566).
Information on how to enter the competition and the prizes form part of these Terms and Conditions. Participation in this competition is deemed acceptance of these Terms and Conditions.

Competition entry is only open to Australian residents aged 18 years or over who can attend the 2018 Dark Mofo Festival, specifically on the weekend of 15-17 June 2018.

Employees (and their immediate families) of the Promoter, Supplier, participating retailers and agencies associated with this competition are all ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

The Competition entry period commences at 11.59pm Australian Eastern Standard Time (“AEST”) on 10 April 2018 and closes at 12:00am Australian Eastern Standard Time (“AEST”) on 8 May 2018 (“Competition Period”).

To be eligible to enter, individuals must purchase a pair of Blundstone leather boots from an authorised retailer (a full list of retailers can be found at www.blundstone.com.au/store/locator).
To enter, individuals must then undertake the following steps during the Competition Period to submit a valid entry:
Visit www.blundstone.com.au/darkmofo
Input the requested details (including first name, last name, email address, telephone number, age and postcode); and
Submit the fully completed entry form so that it is received during the Competition Period.
Entries are deemed to be received at the time of receipt into the competition database and NOT at the time of transmission by the entrant.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). The Promoter also reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the competition or promotion. Errors may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
Incomplete or indecipherable entries will be deemed invalid.
Limit of one (1) competition entry per person, per product purchased, applies. The use of any automated entry software, or any other mechanical or electronic means that allows an entrant to automatically enter the competition repeatedly, is prohibited and will render all entries submitted by that entrant invalid.
There will be one prize draw conducted for the entries received in this competition. The draw will take place at Blundstone Australia Pty Ltd, 88 Gormanston Road, Moonah, TAS 7009 on 9 May 2018 at 11:00am AEST. Winners will be notified in writing via email within two (2) business days of the competition prize draw.
The Promoter’s decision is final and no negotiation or correspondence will be entered into in relation to the competition.
The first valid entry drawn in the competition prize draw will win the prize consisting of:
Two (2) x return economy airfares from the winner’s nearest Australian capital city to Hobart, Tasmania (this prize element is only included if the winner resides in a state other than Tasmania). If the competition prize winner resides in Tasmania, then the airfare component of the prize will not be included and will not be redeemable for cash. The competition prize winner and their one (1) guest need to depart from and return to the same capital city.
2 x 2018 Dark Mofo Winter Feast passes for entry between 15 June 2018 to 17 June 2018.
2 x pairs of Blundstone boots. The boots must be chosen from www.blundstone.com.au. The total value of the two pairs of boots must not exceed $500 AUD.
A VIP tour of Dark Park on 16 June 2018
Two (2) nights’ accommodation in a hotel (of the Promoter’s choosing) located in the Hobart CBD between 15 June 2018 and 17 June 2018;
Car transfer from Hobart Airport to Hobart CBD on 15 June 2018 and a return transfer from Hobart CBD to Hobart Airport on 17 June 2018 will be provided by Blundstone employees, or alternative transfers organised by and at the Promoter’s expense;
The total retail value of the competition Dark Mofo 2018 ticket prizes is $680 and flights & accommodation up to the value of $5,500.
Additional spending money, meals, taxes (excluding airline and airport taxes if applicable), insurance, transport to and from departure point in the competition prize winner’s home location, additional transport or transfers, items of a personal nature, in-room charges and all other ancillary costs are not included and will not be covered by the Promoter.
The competition prize must be utilised between 15 June 2018 to 17 June 2018 to coincide with the 2018 Dark Mofo Festival, and is subject to booking and flight availability (as applicable) with the itinerary to be determined by the Promoter at its absolute discretion. The competition prize winner may be required to present their own credit card at time of any accommodation check-in as security, depending on the accommodation policy.
The prize is subject to the standard terms and conditions of the supplier and providers. Specifically, entry to the 2018 Dark Mofo Winter Feast is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any competition prize winner (and/or his/her companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the competition prize.
In the event the winner does not utilise the competition prize (or an element of the prize) due to reasons beyond the control of the Promoter or Supplier (including, but not limited to, missed flights) then the competition prize (or that element of the competition prize) will be forfeited and will not be redeemable for cash.
In the event of war, terrorism, a state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend or modify a competition prize, subject to any written directions from a relevant regulatory authority.
If any competition prize (or part of any competition prize) is unavailable, the Promoter and Supplier, in its discretion, reserves the right to substitute the competition prize (or that part of the competition prize) with another prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
Competition prizes, or any unused portion of the competition prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
If the Competition prize remains unclaimed by 10:59am AEST on 16 May 2018, an unclaimed competition prize draw or draws (as necessary) will take place on this date at the same time/s and place as the original draws, subject to any directions from the relevant regulatory authorities. Winners, if any, will be notified in writing via email within two (2) business days of the draw.
By entering this competition, entrants are providing their consent to the Promoter to use their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
If this competition is interfered with in any way or is not capable of being conducted as anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the competition, as appropriate.
Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the laws of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of a prize.
As a condition of accepting the competition prize, the winner (and their companion) must sign any legal documentation as and in the form required by the Promoter and/or competition prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

The Promoter collects personal information (“PI”) in order to conduct the promotion and competition and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, competition prize suppliers and, as required, to Australian regulatory authorities.
Competition entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.blundstone.com.au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All competition entries become the property of the Promoter. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
The laws of Australia apply to this competition to the exclusion of any other law. Competition entrants submit to the exclusive jurisdiction of the courts of Australia.
You acknowledge and accept that the Supplier’s role is a facilitator to the Promoter and the Promoter’s competition. The Supplier is not liable for any aspect of the competition prize or any arrangements made between the Promoter and the competition prize winner. The Supplier is held harmless in every respect in connection with the competition Prize and the Promoter’s actions in connection with the Competition.
