Terms and Conditions
1.

Standard Terms

1.1

Information on how to enter forms part of the terms and conditions of entry.
2.

Who can enter?

2.1

Subject to clause 2.2, entry is open to all Harvey Norman bedding store employees of participating retailers who have completed “5 Millionth Sealy Celebration Training” to Sealy’s satisfaction.

2.2

Employees (including Sealy Sales Consultants) and their immediate families of Madad Pty Ltd, Sealy of Australia (NSW) Pty Ltd, Sealy of Australia (VIC) Pty Ltd and Madad Sales Pty Ltd (all trading as Sealy of Australia) or their related entities are not eligible to enter.
3.

How to enter

The competition commences on 1 August 2014 and concludes on 31 October 2014 (“the Promotion Period”).

3.1

In order to enter, eligible Harvey Norman employees must:

– complete the sale of any Sealy Posturepedic mattress or ensemble;

– complete the details in full of each sale in the “Sealy Celebration Sales Record Form” available in Harvey Norman stores;

Each eligible employee is entitled to lodge one entry per Sealy Posturepedic mattress or ensemble sold during the Promotion Period. All entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter.
4.

Prizes

4.1

Prizes will be awarded across five separate groups:

QLD
NSW/ACT
VIC/TAS
SA/NT
WA

4.2

Each prize group will be eligible to win these Upgrade Your Lifestyle prizes:

1 Designer Shopping Spree ($700 Westfield voucher)
1 Luxury Weekend Getaway ($500 Expedia Voucher)
1 Celebration Experience ($200 Red Balloon Voucher)

4.3

In addition to the individual prize, one store prize will also be awarded. The store prize will be drawn randomly from the same pool of individual entries. The individual drawn will win, for all bedding staff in their Harvey Norman store, a store night out or excursion of their choice valued at $2000. The prize will not be awarded as cash. The night out or excursion must be approved as acceptable by Sealy before it is undertaken.

4.4

In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winner grants Sealy a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner will not be entitled to any fee for such use.

4.5

Delivery of the prize will be to the nominated address of the winner. Delivery of the prize is valid to major metropolitan and regional areas only. If the winners’ delivery address is outside of the major metropolitan or regional areas, the prize will be delivered to the nearest metropolitan or regional centre of the winners nominated address. Possession of the prize will then be the responsibility of the winner.

4.6

The prize cannot be altered in any way, is not transferable and cannot be redeemed for cash. Winners should seek independent financial advice about any tax implications that may arise from the prize winning, but entrants should note that Sealy will be responsible for the payment of any Fringe Benefits Tax assessable on the prize.
5.

Prize Draw

5.1

Each store will forward the completed “Sealy Celebration Sales Record Form” to Sealy and for each Sealy Posturepedic model bed sold, the name of the eligible salesperson will be entered into the draw. For every ten beds sold, an additional five entries will be added to the draw for the employee. This process will be completed by Sealy once the sales record forms are collected.

5.2

The draw will take place on 15 December 2014 and will occur by a random number generator, with each entry assigned a number to be randomly drawn.

5.3

Winner’s eligibility will be verified and winners announced on 15 December 2014. All winners will be contacted by email and telephone and winners will be required to select their preferred prize. A re-draw for a particular prize will occur should a winner be declared ineligible.

5.4

The judges’ decision is final and the Promoter and judges will not enter into correspondence regarding the result.

5.5

It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion.

5.6

It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements.
6.

No Liability

6.1

Madad Pty Ltd (trading as Sealy of Australia) and their associated agencies and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

6.2

Madad Pty Ltd, Sealy of Australia (NSW) Pty Ltd, Sealy of Australia (VIC) Pty Ltd and Madad Sales Pty Ltd (all trading as Sealy of Australia) or their related entities associated with this promotion, will not be liable for any misadventure, accident, injury, loss or claim that may occur:

(a) during the draw;

(b) whilst undertaking any travel won on or connected with their entry into the draw; or

(c) in the participation in any prize;

(d) as a consequence of late, lost or misdirected mail;

(e) due to the broadcast of any program relating to the competition or the publication of any material, including any statements made by staff member, other entrants or any other person;

(f) arising from or related to any problem or technical malfunction of any telephone network or lines or mobile communications network related to or resulting from participation in this promotion; or

(g) due to circumstances outside the Promoter’s reasonable control.

6.3

Subject to State Regulation, in the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions.

6.4

Madad Pty Ltd, Sealy of Australia (NSW) Pty Ltd, Sealy of Australia (VIC) Pty Ltd and Madad Sales Pty Ltd (all trading as Sealy of Australia) or their related entities assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.

6.5

Subject to State Regulation, if for any reason this competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.

6.6

The Promoter and all parties shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
7.

Promoter’s Details

7.1

The Promoter is Madad Pty Ltd, Sealy of Australia (NSW) Pty Ltd, Sealy of Australia (VIC) Pty Ltd and Madad Sales Pty Ltd (all trading as Sealy of Australia) of 1299 Boundary Road, Wacol, Queensland.

7.2

Entry details remain the property of the Promoter. The Promoter is collecting the entrant’s personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying the winners).
