MACCA’S® PRIZE ALARM PROMOTION

You must be 14+ to download and use the Application. Under 18’s must have parental consent. Promotion starts 12:01am (AEDT) 02/12/2015 & ends 11:59pm (AEDT) 26/01/2016. Entry Period starts 12:01am (AEDT) on 02/12/2015 & ends 11:59pm (AEDT) on 26/01/2016 or while stocks of Instant Win Prizes last (Entry Period).

GENERAL

1. The Macca’s Prize Alarm Promotion mobile application (Application) is owned and operated by McDonald’s Australia Limited (ABN 43 008 496 928) of 21 – 29 Central Avenue, Thornleigh NSW 2120 and/or any of its franchisees, affiliates, subsidiaries or related bodies corporate (McDonald’s).

2. By using this Application, you agree to accept these Terms of Use. McDonald’s reserves the right to modify, suspend or terminate the Application without notice to you and/or revise these Terms of Use by updating this page. As you are bound by these Terms of Use each time you use the Application, you should periodically visit this page by accessing Terms of Use link on the Application. If you do not agree to these Terms of Use, you must immediately exit the Application and delete the Application from your device.

3. McDonald’s may from time to time conduct competitions, promotions or offers in connection with the Application, including the Macca’s Prize Alarm Promotion detailed in the second section below (Promotion). You acknowledge that these Terms of Use must be read in conjunction with any terms and conditions of participation in these competitions, promotions or offers, including those terms and conditions of participation in the Promotion identified in the second section below (Promotional Conditions). You are not required to participate in the Promotion in order to use this Application or to activate the alarm functionality on the Application (Alarm), however if you participate in the Promotion, the Promotional Conditions apply in addition to and form part of these Terms of Use. Any additional promotion, competition or offer terms and conditions, including but not limited to the Promotional Conditions, will prevail to the extent of any inconsistency between them and these Terms of Use.

4. You may only use this Application if you are an Australian resident aged 14 years or older and if you are under 18 years of age, with the consent of your parent or legal guardian. The Application may only be used in Australia and McDonald’s makes no representation that it is appropriate or available for use in all locations.

5. You consent to receive in-app communications from the Promoter and other users of the Application (limited to those that you share a personal Facebook connection with). You further consent to receive Facebook notifications from the Promoter and/or other users of the Application (limited those that you share a personal Facebook connection with) in respect of the gifting function outlined in condition 14.

6. If you are the driver of a vehicle (or other form of transport), you must not use this Application while the vehicle (or other form of transport) is moving or is stationary but not lawfully parked. You may only use this Application when the vehicle is lawfully parked. You must comply with all applicable road rules and regulations before and while using this Application. In the interests of safety at all other times, McDonald’s recommends that you only use this Application when it is lawful and safe to do so.

7. To use all features of the Application and for updates, you must enable 3G or 4G and/or Wi-Fi data connection, location services and push notifications on your compatible mobile device. Any costs associated with downloading, installing, accessing and using this Application remain your responsibility and are dependent on the service provider used, however McDonald’s will not charge you to download or use this Application.

8. You must have the bill payer’s consent to use Internet or mobile Internet to use the Application. Some service providers and mobile devices may not provide access to mobile Internet and you must check with their service provider if unsure. Downloading, accessing and using the Application, activating the Alarm and accessing and using mobile content including web-based content will incur data charges. Any external links (such as links clicked through the Apple App Store or Google Play) and Application features that require Internet or mobile Internet connection may also incur data charges. Data charges will remain your responsibility and will vary depending on the Internet service provider, usage plan or mobile carrier used (as applicable). You will need to refer to the terms of the contracts with your mobile carrier, usage plan or Internet service provider (as applicable) for costs. The charges for all data services will appear on your next mobile phone bill and/or Internet bill (as applicable). All general queries relating to carrier rates or mobile or Internet bills should be directed to your mobile phone carrier or Internet service provider (as applicable).

9. Subject to your compliance with these Terms of Use, you are granted a limited, non-exclusive, revocable and non-transferrable licence to install, access and use the Application on mobile devices you personally own or lawfully control. You may only use the Application for your personal and non-commercial use. You may not decompile, reverse engineer, disassemble, convert or authorise any third party to decompile, reverse engineer, disassemble or otherwise convert, the Application to a human perceivable form; distribute or republish the Application in any way; resell, rent, lease or lend the Application; or transfer the Application or any content on the Application to any third party.

MYMACCA’S CLUB ACCOUNT

10. You are not required to register an account via the Application in order to use the Application or to activate the Alarm, however in order to be eligible to participate in the Promotion, you must register a MyMacca’s Club account in accordance with condition 9(a) of the Promotional Conditions (MyMacca’s Club Account). You must log-in to the Application via your MyMacca’s Club Account in order to receive, access, use and/or redeem prizes. All information provided in registering your MyMacca’s Club Account must be current, correct and complete. Incomplete or ineligible Account registrations will be invalid. You are only able to register and maintain one (1) MyMacca’s Club Account and the MyMacca’s Club Account must be in your own name.

11. You are responsible for maintaining the strict confidentiality of your MyMacca’s Club Account details and for any activity under your MyMacca’s Club Account. You agree to immediately notify McDonald’s of any unauthorised use of your MyMacca’s Club Account or password or any other breach of security. It is your sole responsibility to control the dissemination and use of your password, control access to and use of your MyMacca’s Club Account and to notify McDonald’s when you desire to cancel your MyMacca’s Club Account. McDonald’s will not be responsible or liable for any loss or damage arising from your failure to comply with this provision. You must not use another’s MyMacca’s Club Account without permission.

12. McDonald’s retains the right and absolute discretion to terminate your MyMacca’s Club Account and/or access to this Application without notice to you if McDonald’s believes you are abusing or tampering with the Application in any way, you have breached these Terms of Use or the Promotional Conditions, or you have engaged in any unlawful or other improper misconduct calculated to jeopardise the proper administration of this Application. McDonald’s legal rights to recover damages or other compensation from such an offender are reserved.

SHARING AND USE OF SOCIAL NETWORKING SITES GENERALLY

13. This Application utilises social networking and share functionality (such as Facebook) or contain links to third party sites not owned or controlled by McDonald’s. The Application is in no way sponsored, endorsed or administered by, or associated with, any social media platform or third party site. Your use of any social media platform or third party site is subject to its prevailing terms and conditions of use and McDonald’s has no control over, and assumes no responsibility for, its share functionality or content, privacy policies or practices. You are encouraged to review the terms and conditions of use of each social media platform or third party site before using any share functionality or third party site linked to this Application. By using this Application, you release McDonald’s from any and all liability arising from your use of any share functionality or third party site accessed from this Application. You also understand that any information you communicate via a share functionality or third party site may become publically available and that McDonald’s is not responsible for the conduct of others who may view, collect and use this information.

14. The Application allows you to gift your Instant Win Food Prize(s) (defined in condition 14 of the Promotional Conditions) to any of your friends who have installed the Application and registered a MyMacca’s Club Account (Gift). Gifts cannot be sent to persons who have not downloaded the Application and registered a MyMacca’s Club Account prior to the time of gifting. You and your recipient must also have an active Facebook account in order to send and receive Gifts. By providing a friend with a Gift, you warrant that any and each friend nominated to receive a Gift is known to you personally and that you have permission to send in-app communications and Gifts to such persons.

15. Membership to and use of Facebook generally is subject to the prevailing terms and conditions of use of Facebook at https://www.facebook.com/policies/. The Application and Promotion are in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing their information to McDonald’s and not to Facebook. You are solely responsible and liable for any content or information you transmit to other Internet users. To the extent permitted by law, you agree to indemnify, defend and forever hold harmless, Facebook and its associated agencies and companies, against any and all losses, actions, claims, costs, expenses and damages (of any nature) which may be incurred by you in respect of your use of the Application or participation in the Promotion. Any questions, comments or complaints about the Promotion must be directed to McDonald’s and not to Facebook.

INTELLECTUAL PROPERTY

16. All right, title and interest in all intellectual property rights in and relating to McDonald’s brands, logos, images, buttons, codes, layout, text, content and products and services as displayed on this Application (Brand Features) and the content on the Application (including but not limited to the Alarm functionality) are owned by McDonald’s and/or its licensors and may not be used by you except as permitted in these Terms of Use. Use of the Application will not under any circumstances be taken to constitute a transfer, assignment or grant of any ownership rights in any of the Brand Features or the Application. McDonald’s, on a case by case basis and to the extent required, grants each Participant a limited, non-exclusive licence to use the Brand Features solely for the purpose, and to the extent necessary, to enable a Participant to use the Application and participate in the Promotion.

17. All Promotion advertisements depicting prizes, prize descriptions and/or trade mark references are illustrative rather than definitive and do not imply any association with the Promoter.

DISCLAIMER

18. This entire clause does not apply to any Consumer Guarantee under the Australian Consumer Law or to any liability of McDonald’s for failure to comply with a Consumer Guarantee under the Australian Consumer Law. To the fullest extent permissible by law, the Application and its entire contents are provided on an “as is” and “as available” basis without any warranties of any kind either expressed or implied. McDonald’s disclaims all warranties of merchantability, non-infringement and fitness for a particular purpose. McDonald’s does not make any guarantees and does not provide any undertaking that the Application will be available at all times or that it will be error free, reliable or secure or free from viruses or other harmful components or that any defects will be corrected. McDonald’s disclaims any and all responsibility for any damage or loss that you may suffer or incur as a result of using the Application, whether direct or consequential, including any loss resulting from interference, malfunction, delays, failures or damage that occurs to your device or results from installing, updating or using the Application. You agree that you assume total responsibility and risk for your use of the Application and your sole remedy against McDonald’s for dissatisfaction with the Application or any content is to stop using the Application or such content. This limitation of relief is a part of the bargain between the parties.

19. Certain legislation, including the Australian Consumer Law, may confer rights and remedies on you which cannot be excluded, restricted or modified (“Non-Excludable Rights”). Nothing in these Terms of Use is intended to exclude, restrict or modify your Non-Excludable Rights.

PRIVACY

20. McDonald’s may collect your personal information (including but not limited to your name and email address) to allow you to register a MyMacca’s Club Account and use the Application. If the personal information requested by McDonald’s is not provided, you may not be able to use certain parts of this Application. By registering a MyMacca’s Club Account, you also acknowledge and agree that McDonald’s may use your personal information as set out in conditions 82-88 of the Promotional Conditions (regardless of whether or not you participate in the Promotion). McDonald’s will endeavour to take all reasonable steps to keep secure, accurate, up-to-date, complete and relevant any personal information recorded.

21. When you, or anyone using your device, access the Application, McDonald’s may collect information regarding the use of the Application, including but not limited to the number of uses and pages viewed and session duration. You agree that McDonald’s may use this information to analyse and improve its products and services and the Application. You also agree that the information may be collected on McDonald’s behalf by a third party, but that the third party will not be entitled to use this information for any purpose other than to provide it to McDonald’s. This information will not be combined with any personal information collected in accordance with condition 20 of these Terms of Use.

22. The information is passed through to a secure server using encryption technology and stored on secure servers that are protected in controlled facilities, which in some cases may be overseas. McDonald’s employees and data processors are obliged to respect the confidentiality of any personal information held by McDonald’s. However, security of communications over the Internet cannot be guaranteed, and therefore absolute assurance that information will be secure at all times cannot be given. McDonald’s will not be held responsible for events arising from unauthorised access to personal information beyond McDonald’s reasonable control.

23. McDonald’s refers you to its Privacy Policy for more information about the handling of personal information. You can gain access to, update or correct any personal information by contacting McDonald’s in accordance with its Privacy Policy. These Terms of Use will prevail to the extent of any inconsistency between the Privacy Policy and these Terms of Use.

GOVERNING LAW

24. These Terms of Use are governed by and shall be construed and applied in accordance with the laws of New South Wales, Australia and you irrevocably consent and submit to the jurisdiction of the courts sitting in this State to determine any issue arising hereunder.

SECTION 2: MACCA’S® PRIZE ALARM PROMOTIONAL CONDITIONS

1. Information on how to register, participate in the Promotion and prizes form part of these Promotional Conditions. Participation in the Promotion (including registering a MyMacca’s Club Account) is deemed acceptance of these Promotional Conditions. Registration and participation is via Internet or mobile Internet (carrier’s standard data charges apply) enabled Apple iPhone (iPhone 4 or above) and Android compatible mobile devices (minimum iOS6 and Android 4.1, respectively).

2. Unless otherwise indicated, all times and dates specified in these Promotional Conditions are times and dates in Sydney, Australia.

ENTRY AND OVERALL PROMOTIONAL PERIODS

3. The Promotion commences at 12:01am (AEDT) on 02/12/2015 and closes at 11:59pm (AEDT) on 26/01/2016 (Overall Promotional Period). The Overall Promotional Period will be divided into:

promotional days for the purpose of Alarm activations, each commencing at 12:01am (AEDT) and closing at midnight (AEDT) on the same day during the Overall Promotional Period (each, a Promotional Day); and
promotional weeks for the purpose of determining the Weekly Prize winners in accordance with condition 50, each commencing at 12.00am (AEDT) every Wednesday during the Overall Promotional Period (with the exception of the first week which commences at 12.01am) and closing at 11.59pm (AEDT) on the following Tuesday, as set out in condition 50 (each, a Promotional Week).

4. The entry period for the Promotion commences at 12:01am (AEDT) on 02/12/2015 and closes at 11:59pm (AEDT) on 26/01/2016 or while stocks of Instant Win Prizes last (Entry Period). For the avoidance of doubt, the Entry Period will close in the event that all Instant Win Prizes have been exhausted prior to the close of the Overall Promotional Period, subject to any written directions from the relevant authorities. Any Participant that sets an alarm after the Entry Period has closed will only be eligible to receive an entry into the Weekly Prize Draw until the close of the Overall Promotional Period.

ELIGIBILITY

5. Registration and participation in the Promotion is only open to Australian citizens and permanent residents (Australian Residents) aged 14 years or older who remain Australian Residents for the duration of the Overall Promotional Period (Participants). The software providers and developers (and their employees) of the Application and the directors, management and employees (and their immediate families, including their children and wards, and other persons residing in their household) of the Promoter, its related entities, corporations or franchisees, printers, suppliers, providers and agencies directly associated with the conduct of this Promotion are ineligible to register and participate in the Promotion.

6. To claim a Food Prize or Non-Food Prize or enter into a Weekly Prize Draw, Participants must be or become registered members of the MyMacca’s Club (MyMacca’s Club) during the Entry Period and remain registered members for the remaining duration of the Overall Promotional Period in the manner required as set out in these Promotional Conditions. Participants are not required to participate in the Promotion in order to use the Application.

7. To become a registered member of the MyMacca’s Club:

visit https://mcdonalds.com.au/mymaccas and register an account (MyMacca’s Club Account), by providing the Participant’s first and last name, current and valid e-mail address, postcode (and if the Participant wishes, their mobile phone number) and a password and agree to the MyMacca’s Club Terms and Conditions and any other approvals or consents required (MyMacca’s Club Account Registration); and
complete the registration process for a MyMacca’s Club Account by clicking the link in the activation email that will be sent to the Participant’s email address after they have activated their MyMacca’s Account (Activation Email).

8. Participants aged under 18 years must obtain the consent of their parent or legal guardian to register and participate in the Promotion and provide Personal Information about themselves. All registrations of Participants who are under the age of 18 years and who register in the Promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental or legal guardian consent (as and where required) will be deemed invalid. These Promotional Conditions will bind the Participants and any parent or legal guardian who gives their consent (for Participants aged under 18 years). Persons who are aged less than 14 years old are ineligible to enter and participate in the Promotion. Any participation, registrations and attempted prize redemptions of persons who are aged less than 14 years old will be deemed invalid.

HOW TO REGISTER AND PARTICIPATE

9. To register and participate in the Promotion, Participants must, during the Entry Period:

be or become a registered member of MyMacca’s Club as set out in condition 7;
download and launch the Application on a compatible mobile device. The Application is available free of charge and can be downloaded via the Apple App Store for Apple iPhone devices or via Google Play for Android devices, however any costs associated with downloading the Application is the Participant’s responsibility and is dependent on the data service plan used;
follow the prompts on the Application in the manner required to fully and correctly complete and successfully submit the MyMacca’s Club Account login credentials; and
activate the alarm functionality (Alarm) in the manner required on the Application and as described in these Promotional Conditions.

10. Participants must set an Alarm on the Application. When the Alarm triggers at the designated time, the Participants can either snooze the Alarm or swipe “I’m Awake” on the Application. Upon swiping “I’m Awake,” an electronic computerised draw system will be activated that randomly determines whether the Participant has won an Instant Win Prize (defined in condition 14). If the Participant has won an Instant Win Prize, a representative image and description of the relevant awarded Instant Win Prize will appear on the Application to communicate the prize to the Participant. If the Participant has not won an Instant Win Prize during the first Alarm of the relevant Promotional Day, the Participant will receive an image with the following message: “WEEKLY PRIZE DRAW ENTRY”.

11. Participants will be eligible to win an Instant Win Prize or receive a Weekly Prize Draw entry during the first Alarm that triggers on each Promotional Day during the Entry Period with data connection. Any subsequent Alarm that has been set by the Participant on the same Promotional Day during the Entry Period or any Alarm set after the Entry Period has closed will not be eligible to receive an Instant Win Prize and will display the message: “LOOK FORWARD TO A NEW DAY! SET YOUR ALARM FOR TOMORROW FOR ANOTHER CHANCE TO WIN.” Following the close of the Entry Period (if and when stocks of Instant Win Prizes have been exhausted), Participants will only be eligible to receive a Weekly Prize Draw entry during the first Alarm that triggers on each Promotional Day until the close of the Overall Promotional Period with data connection. Any subsequent Alarm that has been set by the Participant on the same Promotional Day during the Overall Promotional Period will not be eligible to receive a Weekly Prize Draw and will display the message: “LOOK FORWARD TO A NEW DAY! SET YOUR ALARM FOR TOMORROW FOR ANOTHER CHANCE TO WIN.”

12. Only one (1) MyMacca’s Club Account per Participant is permitted and each Participant may only register a MyMacca’s Club account in his/her own name.

13. The use of any automated registration or claim, or software or any mechanical, electronic or other means that allows a Participant to automatically register the Application or activate an Alarm repeatedly other than in accordance with these Promotional Conditions is prohibited and will render the MyMacca’s Club Account and all prize claims invalid. Alarms and prize claims generated by script, macro, robotic, programmed or any other automated or other means to manipulate or alter the normal functioning of the Application are prohibited and will result in disqualification of the Participant and their prize claim(s).

PRIZES

14. Participants who are notified that they have won an Instant Win Prize upon swiping “I’m Awake” on the Alarm will receive either:

one (1) food prize (as further described in conditions 17-33 below). The food prize will be awarded in the form of a voucher (Food Prize) that will be automatically assigned to the winning Participant’s ‘Surprise Wallet’ on the Application. The Food Prize will immediately display to the Participant the specific food prize that they are entitled to claim; or
one (1) non-food prize (as further described in conditions 34-48 below) (Non-Food Prizes) that will be automatically assigned to the winning Participant’s ‘Surprise Wallet’ on the Application. The Non-Food Prize will immediately display to the Participant the specific non-food prize that they are entitled to claim,

(each, an Instant Win Prize).

15. Any Participant that does not receive an Instant Win Prize on a particular Promotional Day during the Overall Promotional Period will receive one (1) automatic entry (Weekly Prize Entry) into the relevant Weekly Prize Draw, as set out in condition 50, that will be automatically assigned to the Participant’s ‘Surprise Wallet’ in the Application. Limit applies of one Weekly Prize Entry per Promotional Day, regardless of the number of Alarms activated on a Promotional Day. For the avoidance of doubt, any Participant that sets an alarm after the Entry Period has closed will only be eligible to receive an entry into the Weekly Prize Draw during the first Alarm that triggers on the relevant Promotional Day.

16. Participants are limited to one (1) Instant Win Prize per person per Promotional Day. There is no limit to the number of prize claims that a Participant may submit throughout the Entry Period, however each prize claim must be submitted separately and must independently comply with these Promotional Conditions.

18. To redeem a Food Prize, Participants must:

attend a participating McDonald’s or McCafe restaurant in Australia (McDonald’s Restaurant) within twenty-four (24) hours from time of notification that you have won a Food Prize. For the avoidance of doubt, the twenty-four (24) hour period commences as soon as the Food Prize is randomly distributed from the electronic computerised draw system, as determined in the sole discretion of the Promoter, and not when the Participant discovers the notification in the Surprise Wallet; and
present the Food Prize voucher in the ‘Surprise Wallet’ on the Application on your mobile device to a crew member at that McDonald’s Restaurant when placing or purchasing an order and click the ‘Redeem’ button on-screen in the manner required via the Application with the attention, and in the presence, of the crew member. Screenshots or similar reproductions of the Application are not acceptable. For the avoidance of doubt, the “buy one get one free” vouchers will require the Participant to buy one of the stipulated products in order to receive one free.

19. A Participant may, in his or her discretion, gift their relevant Food Prize to a Facebook friend who has installed the Application and has registered a MyMacca’s Club Account (Gift). In order to send a Gift, a participant must click the Gift icon on the relevant Food Prize in their Surprise Wallet and select a friend from the list to receive the Gift. Gifts cannot be sent to persons who have not downloaded the Application, and do not have a registered MyMacca’s Club Account and active Facebook account. By providing a friend with a Gift, a Participant warrants that any and each friend nominated to receive a Gift is known to them personally and that the Participant has permission to send in-app communications and Gifts to such persons. Once a Food Prize has been gifted, the original winning Participant cannot redeem that Gift.

20. Food Prizes must be claimed only whenever the relevant food prize is available for purchase at McDonald’s Restaurants. Hash Brown, Sausage McMuffin, and Bacon and Egg McMuffin Food Prizes must be claimed between 6:00am (local time) and 10:30am (local time) (unless the relevant McDonald’s Restaurant is serving All Day Breakfast). All other Food Prizes must be claimed after 10:30am (local time) until the relevant McDonald’s Restaurant closes or starts serving its breakfast menu.

21. Food Prizes will expire and be forfeited if not presented to a crew member and redeemed within two (2) minutes after the ‘Redeem’ button has been clicked.

22. Participants must ensure that they do not click the ‘Redeem’ button prior to placing an order, as after the two (2) minutes expiry period has lapsed under condition 21 above, the Food Prize will be shown as ‘Redeemed’ on the Participant’s ‘Surprise Wallet’ on the Application and will thereafter be refused by crew for redemption.

23. Participants may only redeem one (1) Food Prize per day. Food Prizes may only be redeemed once.

24. Food Prizes are only redeemable at participating McDonald’s Restaurants and are subject to prevailing terms and conditions of use, including those specified (if any) on the Food Prize vouchers and any relevant expiry periods. Food Prizes cannot be redeemed via McDelivery, Kiosk or MyMacca’s mobile ordering.

25. Food Prizes that are not claimed in the time and manner specified in these Promotional Conditions will be deemed forfeited. No compensation will be payable if a Participant is unable to claim a Food Prize as stated for whatever reason. The Promoter’s decision is final and no correspondence will be entered into.

26. Food Prizes are valid for the individual food/beverage item listed on the voucher and cannot be used in combination to claim or discount any McDonald’s ‘Extra Value Meals’ or any other form of meal deal. Food Prizes cannot be used or redeemed in conjunction with any other offer.

27. Food Prizes are valid for the particular size, type and flavour of the corresponding food item only, and cannot be altered or added to or used in combination to claim or discount any other sized food/beverage item.

28. The Promoter and McDonald’s Restaurants reserve the right to substitute ingredients of any food prize as a result of seasonal, supplier or other variability outside the reasonable control of the Promoter. No requests by a Participant to substitute or vary a food prize will be accepted.

29. A Participant is responsible for ensuring that the food item corresponding to their Food Prize is consistent with their dietary requirements.

30. Redemption of a Food Prize is subject to availability at each McDonald’s Restaurant and the corresponding food prize may not be available at a particular McDonald’s Restaurant. The Promoter accepts no responsibility for a food prize being unavailable at a McDonald’s Restaurant. In the event a food prize is unavailable at a McDonald’s Restaurant, the Promoter may award an alternative food item of equal or greater value in lieu, subject to any written directions made under applicable State or Territory legislation.

31. All additional and ancillary costs not expressly stated, but which may be incurred in acceptance and redemption of a Food Prize, are the responsibility of the Participant who receives the Food Prize. Such additional costs include, but are not limited to, the Participant’s transport to and from a McDonald’s Restaurant.

32. Participants must redeem their Food Prize in accordance with conditions 17-30, otherwise the Food Prize and the corresponding food prize to which it entitles the Participant to claim will be forfeited. Any Food Prizes that are not awarded or not redeemed at the conclusion of the Overall Promotional Period will be forfeited.

33. Electronic and other quality control errors will not invalidate an otherwise valid Instant Win Prize claim. Unless otherwise due to fraud or ineligibility under these Promotional Conditions all instant win prize claims in excess of the advertised Instant Win Prize pool will be met. Food Prizes will only be awarded where the corresponding Food Prize fulfils all of the requirements of the Promoter’s verification tests and procedures. The verification tests and procedures shall be determined by the Promoter in its absolute discretion.

35. Non-Food Prizes cannot be claimed at McDonald’s Restaurants. McDonald’s crew members and managers are only authorised to accept claims for Food Prizes and have no authority to verify any Non-Food Prizes, or to accept any claims for Non-Food Prizes. Non-Food Prizes cannot be gifted via the Application in the manner permitted for Food Prizes.

36. Non-Food Prizes that are not claimed as directed will be forfeited. No compensation will be payable if a Participant is unable to claim a Non-Food Prize as stated for whatever reason. The Promoter’s decision is final and no correspondence will be entered into.

37. All costs not expressly stated, but which may be incurred in acceptance and use of a Non-Food Prize, are the responsibility of the winner. Each winner is only entitled to the relevant prize as outlined in these Promotional Conditions and is not entitled to any additional prizing or cash reimbursement to compensate for any difference in actual prize redemption cost and prize value.

Category A” Prize Claim Procedure

38. To claim a “Category A” Non-Food Prize, a Participant must, within seven (7) days after receiving a notification in the Application’s Surprise Wallet that a “Category A” Non-Food Prize has been won, correctly and successfully follow the directions provided in the applicable directions below. For the avoidance of doubt, the seven (7) day period commences as soon as the Non- Food Prize is randomly distributed from the electronic computerised draw system, as determined in the sole discretion of the Promoter, and not when the Participant discovers the notification in the Surprise Wallet.

39. The Participant will receive notification via the Surprise Wallet on the Application which will contain:

The URL of the relevant Promotional Partner (the Promotional Partner Website); and
A unique prize code (the Unique Prize Code).

40. To redeem a “Category A” Non-Food Prize, the winning Participant must submit the Unique Prize Code on the corresponding Promotional Partner Website within seven (7) days of being notified of winning a Non-Food Prize along with all other details requested via the Promotional Partner Website in the manner required, including, where applicable, the Participant’s first and last name, date of birth, telephone number, postal address, residential address and current and valid e-mail address and, where applicable, agree to the relevant Promotional Partner’s prevailing terms & conditions for the relevant Non-Food Prize. For any Participant under the age of 18, details of the Participant’s parent or legal guardian and confirmation of consent must also be provided.

41. A Unique Prize Code cannot be used to claim more than one (1) prize.

42. If the Unique Prize Code submitted by the Participant has previously been entered on the Promotional Partner Website or the Promotional Partner does not recognise the Unique Prize Code submitted by the Participant on the Promotional Partner Website, the Participant must follow the procedure stated on the Promotional Partner Website.

43. If the Unique Prize Code is successfully submitted, and once the “Category A” prize claim has been received and verified by the Promoter and/or the Promotional Partner (in its or their sole discretion), the relevant prize will be provided to the Participant in the manner specified on the Promotional Partner Website.

“Category B” Prize Claim Procedure

44. To claim a “Category B” Non-Food Prize, a Participant must, within seven (7) days after receiving a notification in the Application’s Surprise Wallet that a “Category B” Non-Food Prize has been won, click “How to Redeem” and provide information that is personal to the Participant in the manner required on the Application redemption form, including their full name, date of birth, postal address, email address and contact telephone number (where applicable) and must sign any releases or documents reasonably required by the Promoter. For any Participant under the age of 18, details of the Participant’s parent or legal guardian and confirmation of consent must also be provided. For the avoidance of doubt, the seven (7) day period commences as soon as the Non-Food Prize is randomly distributed from the electronic computerised draw system, as determined in the sole discretion of the Promoter, and not when the Participant discovers the notification in the Surprise Wallet.

45. For Category B prizes valued $500 and over, a nominated agent of the Promoter will send a claim verification email to the email address provided by the Participant on the Application redemption form within approximately (2) business days after receiving a fully completed and timely Application redemption form (the Claim Verification Email).

46. Participants who are less than 18 years of age at time of Claim Verification Email must have a parent or legal guardian provide their full name, postal address and contact telephone number.

47. IMPORTANT: If a Participant does not receive a Claim Verification Email within two (2) business days of the redemption form being submitted in respect of a Category B Prize valued at $500 and over, the claiming Participant (or their parent or legal guardian where the Participant is less than 18 years of age) MUST telephone the McDonald’s Helpline on (02) 9875 7100 between the hours of 9:00am and 5:00pm on any business day during the Overall Promotional Period.

48. Once a claim for a “Category B” Prize has been completed and verified by the Promoter (in the Promoter’s sole discretion), the relevant prize will be dispatched by post or courier to the Participant’s nominated address (provided upon verification).

49. Additional terms and conditions applicable to Non-Food Prizes are also detailed in Schedule 1 of these Promotional Conditions.

WEEKLY PRIZE DRAW

50. All Weekly Prize Entries received during a Promotional Week will be automatically entered into the corresponding weekly draw (Weekly Prize Draw) at Creata, Unit 6, 3 Central Avenue, Thornleigh NSW 2120 on the date and time set out below (each, a Weekly Prize Draw) to determine one (1) winner for that Promotional Week. Entries for each Promotional Week must be received by the Promoter during the Promotional Week to be eligible for the corresponding Weekly Prize Draw and entries will NOT rollover into any subsequent Weekly Prize Draw(s). 51. Multiple entries into each Weekly Prize Draw are accepted, however each entry must independently comply with these Promotional Conditions. Participants are eligible to win multiple Weekly Prizes. In the event that no Weekly Prize Draw entries are received in a Promotional Week, the relevant Weekly Prize will be awarded in accordance with condition 55.

52. The first eligible entry randomly drawn from all entries in the relevant Weekly Prize Draw will be awarded a prize in the form of a AUD$1,000.00 iChoose Prepaid Gift Card in the name of the winning Participant (or their parent or legal guardian, if any winner is aged under 18 years) (each, a Weekly Prize). Total Weekly Prize value = $8,000.

53. The Weekly Prize winners will be notified in writing via email from the Promoter to the email address nominated by the Participant on the MyMacca’s Club Account on the Application to notify them that they have won a Weekly Prize and detailing verification and delivery information within two (2) days of the relevant Weekly Prize Draw (also, a Confirmation Email). All reasonable steps to notify winners of the results of the Weekly Prize Draws will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

54. The Weekly Prizes are subject to their prevailing terms and conditions of use of iChoose Prepaid Visa and are valid for twelve (12) months from the date of activation. Any Weekly Prize(s) not activated by the date set out in the Confirmation Email or redeemed by this date for whatever reason will be forfeited with no compensation payable. Weekly Prizes are redeemable online at any Australian or overseas merchant worldwide where VISA cards are accepted.

55. Weekly Prizes that are not claimed as directed will be forfeited. No compensation will be payable if a Participant is unable to claim a Weekly Prize as stated for whatever reason. The Promoter’s decision is final and no correspondence will be entered into.

SECOND CHANCE AND UNCLAIMED PRIZE DRAWS

56. A draw will be held to award any Non-Food Prizes valued at over $50.00 which remain unclaimed by 02/02/2016 (Second Chance Draw). The Second Chance Draw will be held at 3.30 PM (AEDT) on 09/02/2016 at Creata, Unit 6, 3 Central Avenue, Thornleigh NSW 2120. Winner(s) drawn in the Second Chance Draw will be notified in writing (via Confirmation Email). All reasonable steps to notify any winner(s) of the results of the Second Chance Draw (if any) will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

57. The Promoter may draw additional reserve entries in the Second Chance Draw (if any) and each Weekly Prize Draw and record them (in order) in case an invalid entry or ineligible Participant is drawn or if any Participant drawn is unable or declines to accept the prize. In the event of an invalid entry or ineligible Participant, or if a Participant drawn is unable or declines to accept the prize within ten (10) days of being successfully notified that they are a winner, that prize will be awarded to the first reserve entry drawn in the Second Chance Draw. If the prize cannot be awarded to the Participant drawn, the Promoter will continue this process until all prizes entered into the Second Chance Draw are awarded. If after this process prize(s) entered into the Second Chance Draw are still not awarded, or if a Participant drawn cannot be notified, the Promoter will hold an unclaimed prize draw in accordance with condition 57.

58. The Promoter may conduct a further draw at the same time (AEDT) and place as the Second Chance Draw (if any) as is necessary on 10/05/2016 in order to distribute any prize(s) over $50.00 (if any) that are unclaimed by that date, subject to any written directions given under applicable State or Territory legislation (Unclaimed Prize Draw). Winner(s) drawn in the Unclaimed Prize Draw will be notified in writing via email. All reasonable steps to notify the winner(s) of the results of the Unclaimed Prize Draw (if any) will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.

PRIZES GENERALLY

59. Each winner of a prize valued at over $250.00 will be published in The Australian on 03/03/2016 (excluding Unclaimed Prize Draw winners). Each winner drawn in the Unclaimed Prize Draw of a prize valued at over $250.00 will be published in The Australian on 2/06/2016.

60. Each prize is valued in Australian Dollars inclusive of GST (if any) as at 30 September 2015. The Promoter takes no responsibility for any variations in the value of a prize.

61. If a prize (or part of a prize) becomes unavailable, for any reason beyond the Promotional Partner or Promoter’s reasonable control (as applicable), then a comparable prize (or part of a prize) of equal or greater value will be awarded in lieu at the Promotional Partner or Promoter’s discretion, subject to any written directions made under applicable State or Territory legislation.

62. Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). Prizes must be taken as offered and cannot be varied. Prizes cannot be used or redeemed in conjunction with any other offer. The Promoter accepts no responsibility for any tax implications that may arise from any prize winnings. Independent financial advice should be sought.

63. All prizes, except Food Prizes, that are won by a Participant who is under the age of 18 years at the time of entry will be awarded on behalf of the Participant to the parent or legal guardian of the Participant who consented to the Participant entering the Promotion.

64. Prizes will be delivered (if applicable) to Australian addresses only.

65. The Instant Win Food Prize values and the maximum number of each Food Prize that may be won are specified in the table set out in condition 17. The maximum total value of all available Food Prizes is up to $9,181,294.22.

66. The Instant Win Non-Food Prize values and the maximum number of each Instant Win Non-Food Prize that may be won are specified in the table set out in condition 34. The maximum total value of all available Instant Win Non-Food Prizes (including Weekly Prizes) is $7,985,771.00

67. The total potential value of all prizes in the Promotion is up to $17,167,065.22.

68. The Promoter accepts no responsibility for any late, deleted or lost prizes, or prizes redeemed by anyone other than the Participant on whose mobile device the relevant prize was won, and will not accept any prize vouchers that have been tampered with in any way. The Promoter accepts no responsibility if a Participant loses or has their mobile device stolen, or it otherwise malfunctions, with the effect that the Participant cannot use their mobile device to redeem a prize (if any). No replacement prizes will be awarded at any time in this event. It is a Participant’s responsibility to ensure that the email address nominated on their MyMacca’s Club Account is and remains current and correct.

GENERAL

69. All of the Promoter’s decisions in respect of the Promotion are final and no correspondence will be entered into.

70. Participants can only register and participate in their own name. Participants who provide incorrect, misleading or fraudulent information are ineligible to register and participate in the Promotion and all Alarm activations and prize claims by a Participant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the sole discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Participant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Participant’s identity, age, residential address, eligibility to register, participate, claim a prize, and any information submitted by the Participant in registering and participating in the Promotion, before issuing a prize (including confirming consent of Participant’s parent or legal guardian and the name, age and address of the parent or legal guardian who gave their consent, where a Participant is under 18 years of age). If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a Participant or prize claims have not been verified or validated to the Promoter’s satisfaction, then the registration of that Participant and any and all Alarm activations and prize claims by that Participant will be ineligible and deemed invalid.

71. The Promoter reserves the right to verify the validity of any and all registrations, Alarm activations and prize claims and reserves the right to disqualify any Participant for: (a) tampering with the Application and/or gifting and/or Alarm process; (b) submitting a MyMacca’s Club Account registration and/or activating an Alarm and/or claiming a prize which is not in accordance with these Promotional Conditions; or (c) if the Participant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. Proof of transmission (including but not limited to screenshots or captures of Alarm activations and Surprise Wallets) does not constitute proof of winning by a Participant.

72. A prize will only be awarded following any winner validation and verification that the Promoter, or its nominated agents, requires in their sole discretion.

73. Claims and registrations will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Claims and registrations received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible claims or registrations will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected claims or registrations. Contact details entered incorrectly via the Application, the MyMacca’s Club website or any Promotional Partner Website by a Participant will deem a claim or a registration (as applicable) invalid.

74. Costs associated with accessing the Application and any Promotional Partner Website remain a Participant’s responsibility and may vary depending on the Internet service provider used.

75. If a dispute arises as to who used the Application or, if applicable, who is eligible to claim a prize, the Application will be deemed to be activated by the authorised MyMacca’s Club Account holder of the current and valid email address provided to the Promoter at time of MyMacca’s Club Account registration and, if applicable, the authorised MyMacca’s Club Account holder will be deemed the prize winner. An authorised MyMacca’s Club Account holder is a natural person who is assigned to an email address by an Internet access provider, online service provider, or other organisation responsible for assigning email addresses for the domain associated with the relevant submitted email address.

76. It is a condition of accepting a Non-Food Prize and Weekly Prize that the relevant winner may be required to sign legal release(s) in a form determined by the Promoter in its absolute discretion. If a winner is under 18 years of age, the winner must ensure that the winner’s parent or guardian also agrees to and signs such legal release(s) (if requested by the Promoter).

77. As a condition of registering and participating in this Promotion, a Participant consents to the Promoter using the Participant’s name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period of time without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the Promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter. The Participant agrees, in the event they are a winner, that the Participant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents and sign any additional documents reasonably required by the Promoter to give effect to this condition.

78. If this Promotion and/or the Application is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion and/or the Application, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or, if necessary, to provide alternative prizes to the same value as the original prizes, subject to any written directions made under applicable State or Territory legislation.

79. The Promoter, its franchisees and associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth)), for any direct or indirect injury, loss and/or damage arising in any way out of the Promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged registrations, entries, prize claims or prizes; and/or (iv) acceptance and/or use of a prize. Applicable manufacturers and/or distributors should be contacted in regards to all prize warranty claims.

80. In the interests of safety, the Promoter requires that Participants only use the Application when it is lawful and safe to do so. Participants found to be in breach of this condition may be disqualified from the Promotion, as determined by the Promoter in its sole discretion. For the avoidance of doubt, a winner can be disqualified after the winner is notified that they have won if the winner is found to have not acted in accordance with these Promotional Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

81. Any attempt, deliberate or otherwise, to cause malicious damage or interference with the normal functioning of the Application or any Promotional Partner Website, or the information on the Application or any Promotional Partner Website, or to otherwise undermine the legitimate operation of this Promotion, may be a violation of criminal and civil laws and, should such an attempt be made, whether successful or not, the Promoter reserves the right to terminate access to the Application and to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Promotional Conditions or any other legal obligation by a Participant, the Participant agrees to indemnify the Promoter for those losses, damages and costs.

82. The Promoter is committed to helping its customers make informed decisions about their food and beverage choices. The Promoter provides healthier food and beverage options for adults and children and ensures nutritional information is easily accessible to its customers. Nutritional information is available on websites, including on the Promoter’s website (www.mcdonalds.com.au), in McDonald’s Restaurants and, wherever possible, on product packaging.

PRIVACY

83. McDonald’s collects, uses and discloses your personal information in accordance with its Privacy Policy at https://mcdonalds.com.au/privacy-policy, Collection Statement at https://mcdonalds.com.au/mymaccas/privacy-collection and as stated in these Promotional Conditions.

84. Selected partners, promotional agents and prize suppliers of the Promoter (depending on the nature of the prize) (Promotional Partners) may require that Participants provide personal information to them in order to process a valid prize claim/redemption. Participants must satisfy themselves with the collection statements and privacy policies of any Promotional Partners, as the Promoter will not accept any responsibility for the collection, use and handling of personal information by Promotional Partners.

85. The Promoter collects personal information about a Participant for the purposes disclosed in its Collection Statement. The Promoter and its Promotional Partners also collect personal information about a Participant to include the Participant in the Promotion, award prizes (where appropriate) and assist the Promoter in improving its goods and services. If the personal information requested is not provided, the Participant cannot participate in the Promotion and is deemed ineligible.

86. A Participant agrees that the Promoter may, in the event the Participant is a winner, publish or cause to be published the Participant winner’s name and locality in any media, as required under the relevant State or Territory lottery legislation.

87. A Participant can gain access to, update or correct any of their Personal Information held by the Promoter by contacting the Promoter’s Privacy Officer at PO BOX 392, Pennant Hills NSW 2120. All Personal Information will be stored at the office of the Promoter and/or its Promotional Partners. A copy of the Promoter’s Privacy Policy in relation to the treatment of Personal Information collected may be obtained by contacting the Promoter. These Promotional Conditions will prevail to the extent of any inconsistency between these Promotional Conditions and the Promoter’s Privacy Policy.

88.
