Promotion: Your Local Fruit Shop Eat The Rainbow
Promotion
Period:
The Promotion opens at 12.01am (AEST) on Wednesday, 4 April 2018 and
closes at 11.59pm (AEST) on Monday, 14 May 2018. Late entries will not be
accepted.
Who can enter: Entry is open only to Queensland and New South Wales residents over the age
of 18 years.
How to enter: To enter the major prize draw, you must;
1. Take a photo of the competition wobbler in participating Your Local
Fruit Shop retail store
2. Upload the photo and tag #YLFS on you Instagram account.
3. Complete the entry form at http://www.yourlocalfruitshop.com.au/win/.
To enter the minor prize draw, you must complete the entry form at
http://www.yourlocalfruitshop.com.au/win/.
All entrants must complete their entry prior to 11.59pm on Monday 14 May
2018 to be eligible. Only 1 entry per person. Winners are determined entirely
by chance.
Prize(s): Major prize:
1 x 12 month supply of fruit and vegetables from a nominated Your Local Fruit
Shop retailer consisting of a weekly supply to the value of $55 per week for 52
weeks. The retail value of prize is $2860.
Minor prizes:
4 x 3 month supply of fruit and vegetable from a nominated Your Local Fruit Shop
retailer consisting of a weekly supply to the value of $55 per week for 12 weeks.
The cumulative retail value of prizes is $2640.
The Prizes are not transferable, and not redeemable for cash. Only 1 prize can
be won per entry.
The total retail value of prizes is AUD$5,500.
Draw Date: The winners will be drawn at 9:00am on Wednesday 16 May 2018 at Brismark
(ABN 96 727 681 765) of Level 2, Fresh Centre, 385 Sherwood Road, Rocklea
Qld 4106. Prizes will be drawn in descending order of value (e.g. major prize first
and then the minor prizes).
Notification
Means:
For the major prize, the winner will be notified through direct message to their
Instagram account by no later than 5pm Wednesday, 16 May 2018.
For the minor prize, the winner will be notified via email and/or mobile phone by
no later than 5pm Wednesday, 16 May 2018.
Publication: The winners will be announced on the Promoter’s Facebook and Instagram
accounts on Friday, 18 May 2018.
Delivery of
Prizes:
Winners will be contacted by phone and provided with details on how to claim
their prize within 1 week of the Draw Date.
To be eligible to enter the Promotion, you must fall within the criteria in the ‘Who can enter’
section of the Promotion Details Table. You must follow the requirements in the ‘How to enter’
section of the Promotion Details Table and submit any entry into the Promotion during the
Promotion Period. Entries submitted after the Promotion Period has closed will not be
accepted.
It is your sole responsibility to ensure the accuracy of the information contained in your entry,
including your contact details.
Your entry must not include any content that contravenes any law, infringes the rights of any
person (including intellectual property rights) or could be considered to be insulting,
inflammatory, defamatory, offensive, or otherwise objectionable or inappropriate.
By submitting your entry, you agree that your entry becomes the property of the Promoter and
you grant a non-exclusive, perpetual, worldwide, royalty-free licence to use and exploit all
intellectual property rights in your entry and agree to the Promoter doing anything to your entry
which may otherwise be an infringement of your moral rights.
The winners of the Promotion will be drawn at random by the Promoter on the Draw Date.
Delivery of the Prizes will occur per the details in the ‘Delivery of Prizes’ section of the
Promotion Details Table. Where a Prize cannot be delivered in accordance with these terms
and conditions within 7 business days of the Draw Date (for example, due to an error in the
address details for the winning entry), the Promoter reserves the right to redraw the winner for
the relevant Prize in accordance with the methods contained in these terms and conditions.
By entering this competition, you authorise and consent for Brismark to take photographs of
you and publish photographs with your name for any lawful purpose, including but not limited
to publicity, print, digital content and media.
By entering this competition, you acknowledge that this Promotion is in no way sponsored,
endorsed or administered by, or associated with, Facebook or Instagram. You release
Facebook and Instagram from any and all claims which may arise in relation to this Promotion.
Collection Notification Statement under the Privacy Act 1988 (Cth)
As part of your entry to this Promotion, you agree to your personal information being collected by the
Promoter and used in accordance with the Promoter’s Privacy Policy (which is available from
http://www.brismark.com.au/cms/index.php/About-Privacy-statement.html or on request from the
Promoter) and the following Privacy Collection Notification Statement:
(a) the Promoter is the party collecting the information in this form. You can contact us at
admin@brismark.com.au or write to us at PO Box 70, Brisbane Markets, Rocklea, Qld,

(b) the Promoter may use the details it collects from you, including any email address you
give to us in relation to your participation in the Promotion:
(1) for your entry into the Promotion;
(2) for any promotional and publicity purposes; and
(3) to send you information and direct marketing communications about our
products, services, events, offers or any other activities (including third party
products, services, offers and events) which we consider may be of interest to
you, and any other purpose described in our Privacy Policy;
(c) some of the information we ask you to provide may be identified as mandatory or
voluntary. If you do not comply with the conditions contained in the ‘How to enter’
section of the Promotion Details Table or the information you provide is incorrect or
incomplete then:
(1) we may not be able to accept your Promotion entry, your entry may be
disqualified, you will not be able to enter the Promotion, or we may be unable
to deliver your prize if you are a winner; and
(2) we will be unable to send you direct marketing communications (unless you
have consented to such communications through other dealings with us);
(d) we may disclose the information provided under this form to third parties that are
related to, or affiliated with, the Promoter, such as any organisation as expressly
covered in our Privacy Policy;
(e) the Promoter’s Privacy Policy (detailed above) also sets out the process as to how you
can access and correct any of your personal information collected in relation to the
Promotion as well as to how you can make a complaint in relation to the Promoter’s
handling of your personal information;
(f) in order to manage and facilitate the Promotion and for the purposes in paragraph b, it
is possible that some of the information collected may be disclosed outside of Australia
including to our IT service providers who may utilise data hosting facilities. You
consent to your information being disclosed to a destination outside Australia for this
purpose, and you understand and acknowledge that Australian Privacy Principle 8.1
will not apply to such disclosures of your personal information.
By continuing with your entry into the Promotion, you indicate that you have read this collection
statement and acknowledge that your personal information will be collected, used and
disclosed in accordance with this collection notice and as otherwise detailed in our Privacy
Policy and, to the extent it is necessary, that you give your voluntary express consent to the
Promoter to collecting, using, storing, disclosing and disposing of your personal information in
this manner.
