PARTICIPATION
Information on how to enter and prizes form part of these terms and conditions. By participating, entrants agree to be bound by these terms and conditions. Entries must comply with these terms and conditions to be valid. Promotion is not valid in conjunction with any other special, discount or promotional offer unless indicated otherwise.
Entry is open to Australian residents aged 15 years or over (Entrants). Entrants who are under the age of 18 must seek permission from their parent or guardian to enter and further, the parent/guardian of the Entrant must read and consent to these Terms and Conditions. Parents/guardians may be required to enter into a further agreement as evidence of their consent.
The Promoter is Stuart Alexander & Co Pty Ltd (ABN 43 000 058 677) of Level 3, 1- 3 Smail Street, Ultimo NSW 2007 Australia (Promoter). Employees (and the immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter.
The Pringles, Mentos, Chupa Chups “Win a BMW” Consumer Promotion 2014 (Promotion) commences at 00.01 AEDT on 24/02/2014 and closes at 17.00 AEST on 19/05/2014 (Promotional Period).
ENTRY
To enter the Promotion, Entrants must, during the Promotional Period, spend $5 on any Pringles, Mentos, Mentos Pure Fresh and/or Chupa Chups products in a Participating Independent Supermarket (Qualifying Purchase), and submit a valid entry form in accordance with clause 6. A Participating Independent Supermarket means any independent supermarket nationally, and may include IGA, Supa IGA, Foodland and Foodworks supermarkets, but excludes all Coles and Woolworths branded supermarkets nationally.
To submit a valid entry Entrants must, during the Promotional Period:
(a) visit www.spendfiveanddrive.com.au (Promotional Website);
(b) fully complete the entry form (including entering the receipt number printed on the Qualifying Purchase receipt); and
(c) follow the prompts to submit the entry form.
Entrants must retain their original Qualifying Purchase receipt as proof of purchase during the Promotional Period (Proof Of Purchase). A Limit of one entry per Qualifying Purchase applies. Failure to produce the Proof Of Purchase for a winning entry when requested may, in the absolute discretion of the Promoter, result in invalidation of an Entrant’s entry and forfeiture of any right to a prize. Proof of Purchase must clearly specify the Participating Independent Supermarket from which the Qualifying Purchase was made, the Qualifying Purchase receipt number, and be dated during the Promotional Period but prior to entry.
Multiple entries are permitted subject to the following:
(a) a limit of one (1) entry per person per day;
(b) a limit of one entry per Qualifying Purchase; and
(c) each entry must be submitted separately and in accordance with these Terms and Conditions.
All Entries must be received by the Promoter during the Promotional Period. Entries received after this date will not count towards the Promotion. Records of the Promoter are final and conclusive as to time of receipt. Incomplete illegible or indecipherable entries will be deemed invalid. No further correspondence will be entered into.
Entrants must enter in their own name. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any individual who provides false information, fails to provide information, conspires with others to gain an unfair advantage or who is otherwise involved in any way in manipulating, interfering or tampering with the conduct of this Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
PRIZES AND DRAWS
The prize draws will take place at 14.00 AEST on 26/05/2014 at Handling Matters, 1/3 Green St Brookvale, NSW, 2100, by a representative of the Promoter. The first valid entry randomly drawn will win the Major Prize (Major Prize Winner). The next 50 valid entries randomly drawn will each win a Minor Prize (Minor Prize Winner).
The Major Prize is a new 2014 BMW 116i 5 door automatic car including the business navigation factory option in either silver or red. The Major Prize Winner must choose to receive the Major Prize in either silver or red. The Major Prize includes all on road costs (dealer delivery and statutory charges, 12 months’ registration and stamp duty). The Major Prize does not include comprehensive insurance or any other accessories not specified. There is one Major Prize to be won. The total value of the Major Prize is up to AUD $45,000.
The Minor Prize consists of a BP Gift card to the value of $100.00. There are 50 Minor Prizes to be won.
Total prize pool value is up to $50,000.
Prizes are not transferable and are not redeemable for cash. The Promoter’s decision is final and binding – no correspondence will be entered into. The Promoter accepts no responsibility for late, lost or misdirected entries or other communications. An entry will be deemed void if that entry or the entry process has, in the reasonable opinion of the Promoter, been forged, manipulated or tampered with in any way.
In the event that a Prize is unavailable, the Promoter may substitute a prize of equal or greater value, subject to any written directions from the various lottery authorities. The Promoter accepts no responsibility for any variation in the value of the Prize. All liabilities and costs associated with or arising from winning or using a Prize are the responsibility of the Prize Winner.
Prize Winners will be notified by e-mail and by telephone (using the details provided on the entry form) within two days of the draw and in addition their name (and address if from SA) will be published in The Australian newspaper from 07/06/2014. Prize Winners must claim their prize by responding to the winner notification email by 28/08/2014.
A second chance draw for any Prize which remains unclaimed by a Prize Winner, will be held on 29/08/2014 at the same time and place as the first draw. The Prize Winners will be notified in writing and by telephone within two days of the second chance draw and their name (and address if from SA) published in The Australian newspaper on 08/09/2014.
If a Prize Winner is under 18 years of age, the Prize will be awarded to winner’s parent or legal guardian.

The Promoter is not responsible or liable for any additional costs incurred, loss, damage or injury suffered whatsoever (whether direct or indirect):
(a) as a result of the conduct of a third party prize supplier; or
(b) otherwise as a result of a Prize Winner accepting and/or using a Prize (even if caused by negligence), except for any liability which cannot be excluded by law.
As a condition of accepting a Prize, a Prize Winner must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
It is a condition of the Prize being awarded to the winner that the winner provide to the Promoter their original Qualifying Purchase receipt as Proof Of Purchase during the Promotional Period.
