Terms & Conditions
1. The Promotion commences at 09.00 [GMT +10] on Thursday 9th
of July, 2019, and concludes at
23.50 [GMT +10] on 20 August 2019 (Competition Period). Entries must comply with these Terms
& Conditions to be valid.
2. Entry is open to Australian residents living in Australia who are 18 years and over. Employees of
the Promoter (including their immediate family members) and employees of agencies associated
with this Promotion, are ineligible to enter.
3. To enter, you must do the following during the Competition Period:
a) Purchase Orchard Road Gold Kiwis at stores and take a digital picture of your receipt showing
that you purchased Orchard Road Gold Kiwis within the Competition Period; and
b) Tell us in 25 words or less what you love about Orchard Road Gold Kiwis by emailing us at
winwithgold@orchardroad.com.au and attach a picture of your receipt to the email (Entry)
4. Subject to and in accordance with these Terms & Conditions, there will be up to one (1) winner
announced every week during the Competition Period (Weekly Prize) and up to one (1) grand
prize winner, to be announced at the end of the Competition Period (Grand Prize).
Each Weekly Prize winner shall receive one (1) $200 ALDI grocery voucher (at an estimated
market value of AUD $200) .
The Grand Prize Winner shall receive one (1) family travel voucher to the Gold Coast valued at
AUD $5,000. The voucher is limited to traveling only to destinations in Gold Coast in Australia,
(the Prize or Prizes, as the context permits)
All taxes (excluding GST) which may be payable as a consequence of receiving a Prize are the
sole responsibility of the winner. If applicable, Prizes will be delivered to winners within 28 days of
judging the Prize winner(s), subject to any delivery or processing delays. Winners will be notified of
any delay.
5. In this Competition, a limit of one (1) Entry per person applies.
6. This Competition is a game of skill. All Entries will be judged individually on their merits based on
skill, creativity and originality.
7. The Weekly Prize shall be judged at the end of each week during the Competition Period. Judging
for the Grand Prize will take place on 22 August, 2019, at Delica Australia Pty Ltd (ACN 125 229
165), trading as T&G Global, 12-14 Trade Park Drive, Tullamarine, Melbourne 3043 VIC, Australia
(Promoter).
8. Entries will be judged by a panel of judges appointed by the Promoter. Prize winners will be
determined at the sole discretion of the judges. All decisions of the judges shall be final and binding
and no correspondence will be entered into. Should there not be sufficient Entries which meet the
judges’ criteria (a decision to be made at the sole discretion of the judges), the Promoter reserves
the right not to award a Prize.
9. Prize winner(s) will be notified by email within 7 days of each judging (Notification Email). The
Promoter will also publish the names of winners on its website at https://orchardroad.com.au/.
Winner(s) must reply to the Notification Email via reply email message to
winwithgold@orchardroad.com.au within 30 days of receiving of the Notification Email with their
full name, date of birth, delivery address and contact number in order to accept the Prize.
10. If any Prize remains unclaimed in accordance with clause 9, the Promoter may deem any winner
as ineligible to receive the Prize. In that event, the Promoter may withdraw the Prize altogether.
11. Prizes are not transferable (other than to immediate family members of the Prize winner/s) and, are
not redeemable for cash. The Promoter is not responsible for any redemption of the prizes and
accepts no responsibility should such redemption result in a lower amount than the estimated
market value attributed to the prizes in these Terms & Conditions.
12. The Promoter assumes no responsibility for any Entry which is not received by it in, or for
inaccurate information contained within an Entry, or for any loss, damage or injury as a result of
technical or telecommunications problems, including security breaches, email glitches or technical
malfunctions. If such problems arise, then the Promoter may in its absolute discretion modify,
cancel, terminate or suspend the Competition.
13. If any Prize or any component of a Prize (as the case may be) becomes unavailable for reasons
beyond the Promoter’s control, the Promoter may substitute a Prize or component of a Prize at the
Promoter’s sole discretion, subject to any written directions from the relevant authorities. Where it
substitutes a Prize or component thereof in accordance with this clause, it will endeavour to ensure
that the substitute Prize or component of the Prize will be of at least equal value to the original
Prize or component of the Prize. Winners will not be entitled to any compensation in the event that
the Prize or component of a Prize has been substituted.
14. All travel bookings must be made a minimum of 30 days in advance of requested departure dates.
All bookings and documentation regarding the Prize must be made via Orbit World Travel or their
agents. Redeeming the Prize is conditional on acceptance of the terms and conditions of travel as
detailed by Orbit World Travel and the relevant airline carrier in accordance with normal travel
practices. The Prize winner must have valid travel insurance for their period of travel.
15. The Prize winner is responsible for any amendment fees issued by airlines or suppliers once
booking is confirmed and ticketed. Additional spending money and any other ancillary costs,
including but not limited to insurance and any applicable insurance excesses, are the responsibility
of the Prize winner and his / her nominated travel companions as incurred. It is the winner’s
responsibility to organise transport to / from the airport departure / return point.
16. The Promoter reserves the right to request verification of age, identity, residential address and any
other information from entrants relevant to Entry into or participation in this Competition.
Verification is at the discretion of the Promoter whose decision is final. The Promoter reserves the
right to disqualify any individual who provides false information, fails to provide information,
conspires with others to gain an unfair advantage or who is otherwise involved in any way in
manipulating, interfering or tampering with this Competition.
17. The Promoter shall not be liable for any loss, damage or injury suffered by any Prize winner as a
result of the Prize winner accepting and /or using a Prize, except for any loss, damage or injury
which is due to the negligence or wilful misconduct of the Promoter or which otherwise cannot be
excluded by law.
18. Email entries and communications will be deemed to have been received when received by the
Promoter’s server via the email address or addresses nominated in these Terms & Conditions or
otherwise communicated by the Promoter. Any dispute relating to whether entries have been
received or not will be determined by the Promoter, whose decision is final. The Promoter accepts
no responsibility for late, lost or misdirected Entries.
19. Any Entry that contains content that the Promoter, in its sole discretion, considers to be incomplete,
inaccurate, underage, erroneous, ineligible, offensive, misleading, inappropriate or
incomprehensible will be deemed invalid, as well as any Entry that the Promoter, in its sole
discretion, considers infringing any intellectual property rights or other rights of any person,
corporation or entity.
20. Entrants consent to the Promoter publishing their name and/or associated Entry on the Promoter’s
website and associated social media pages including Facebook, Instagram, and Prize winners
consent to the Promoter using their name, image, Entry, and/or voice for a reasonable period of
time without remuneration for the purpose of promoting this Competition (including any outcome)
and/or promoting any products manufactured, distributed and/or supplied by the Promoter.
21. Entrants agree that ownership of any intellectual property rights in their Entry is assigned to the
Promoter without the payment of any fee or compensation and to the fullest extent possible any
moral rights in the Entrants entry are waived by the Entrant without fee, compensation or payment.
The Entrant agrees to sign any documentation required by the Promoter to give effect to such
assignment as a precondition to being awarded their Prize. To the extent permitted by law,
Entrants unconditionally and irrevocably consent to any act or omission that would otherwise
infringe any moral rights in their Entry.
22. Entrants further warrant and agree that:
a) they will not submit any Content that is unlawful, defamatory, obscene, derogatory,
pornographic, sexually inappropriate, politically incorrect, violent, abusive, harassing, threatening,
racist, ageist, sexist, objectionable with respect to religion, origin or gender, unsuitable for persons
under the age of 18 years, or otherwise unsuitable for publication;
b) all of the Content has been personally created by them, and does not breach any intellectual
property, privacy, publicity or other rights of any third party;
c) they have full authority to grant or assign to the Promoter the rights referred to in these Terms &
Conditions; and
d) they will indemnify the Promoter against all loss, damage and liabilities arising from a breach of
any of the warranties in these Terms & Conditions.
23. The Promoter may, in its sole discretion, determine whether any of the Content will be posted or
remain posted on its websites. The Promoter reserves the right to vet or remove Content from its
websites at any time, without prior notice and in its sole discretion (including if properly notified that
such Content infringes any third party intellectual property rights). Notwithstanding any decision by
the Promoter to post any of the Content on its websites, the terms and warranties set out in these
Terms & Conditions continue to apply.
24. Any personal property rights in entries are owned by the Promoter. Details from entries will be
collected and used for the purposes of conducting this Competition (which may include disclosure
to third parties for the purpose of processing and conducting the Competition) and for promotional
purposes in connection with this Competition.
25. All personal information provided by entering this Competition will be held by the Promoter at 12-14
Trade Park Drive, Tullamarine, Melbourne 3043 VIC, Australia. Under the Privacy Act 1988 (Cth),
you have the right to access and correct any personal information you may have provided. You
may correct any of the personal information details that you have provided by sending your request
together with the correct information to info@orchardroad.com.au. Other than as stated in these
Terms & Conditions, the Promoter will only use this information in connection with this Competition.
26. By entering this Competition, Entrants consent to:
a) the use of their personal information by the Promoter as described in these Terms &
Conditions;
b) the use of their personal information by the Promoter in any media for future promotional,
marketing and publicity purposes without any reference or remuneration to the Entrant, and
c) the receipt of marketing and promotional material from the Promoter.
With reference to clause 26, Entrants may withdraw their consent to the uses of their personal information
and the receipt of marketing and promotional material at any time by contacting info@orchardroad.com.au.
