NBC Universal – Win A Trip To New York Fashion Week and A Brand new Samsung Galaxy S5

Terms & Conditions.

1. NBC Universal Global Networks Australia (Services) Pty Ltd ABN 76 103 226 026 (NBC Universal) and Samsung Electronics Australia Pty Ltd ABN 63 002 915 648 (Samsung) are the promoters of the “Win a Trip for 2 to New York Fashion Week Competition” (Competition) (together, we, us or our).
2. By entering this Competition, you agree to be bound by these Terms and Conditions.
3. Entry is open only to Australian residents aged 21 and over. Our employees and the employees of our suppliers and agencies associated with this Competition, and the immediate family of all such employees may not enter the Competition (“immediate family” means any of the following: spouse, ex-spouse, de-facto spouse, child or step child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin).

4. This Competition starts at 00:01 AEST on 3 August 2014 and ends at 23:59 AEST on 16 August 2014 (Entry Period). Entries must be received by us during the Entry Period. Entries received after the Entry Period will not be included in the Competition.

5. To enter this Competition, you must:
(a) fill in all the required data fields on the entry form on www.eonline.com/runwaygetaway, including by providing your full name, phone number and email address; and
(b) answer the following question in 25 words or less: Which NYFW designer would you like to have dinner with and what would you ask them?
(hereafter referred to as Entry).
6. Entry is free but you may only enter once.
7. You must personally and manually submit an Entry using an internet browser. We reserve the right to reject an Entry if we believe that an Entry has been created and/or submitted using automated entry means or a computer entry service.
8. To be eligible to win a prize in this Competition, an Entry must not:
(a) infringe the intellectual property or other rights of a third party;
(b) be incomplete or illegible; or
(c) be unlawful, defamatory, abusive, insulting, threatening, obscene, inflammatory, offensive or otherwise contain content which, in our sole discretion, is inappropriate or objectionable.
9. All Entries submitted become the property of the Promoters. Your Entry will not be returned to you. As a condition of entering this Competition, you grant us a licence to use the Entry in any media for an unlimited period for any reason, including, but not limited to, future promotional marketing or publicity purposes. You warrant to us that the Entry submitted is an original work that does not infringe the rights of any third party and agree to indemnify us against all costs and claims by third parties arising from a breach of this warranty. You consent to any use of your Entry which may otherwise infringe your moral rights pursuant to the Copyright Act 1968 (Cth).

10. We reserve the right to verify the validity of an Entry and entrant and to disqualify you for tampering with the entry process or for submitting an Entry that does not, in our sole discretion, comply with these Terms and Conditions.
11. This Competition is a game of skill and chance plays no part in determining the winner. All Entries will be judged individually on their merits based on originality and creativity.
12. Judging will take place at the 10:00am AEST on 18 August 2014 at the NBC Universal office at 1 Munn Street, Millers Point, NSW 2000 Australia (Prize Determination). Entries will be judged by a panel of judges appointed by us.
13. The entrant who submits the most original and creative Entry (as determined by the judges in their sole discretion) will win the Prize (Winner). There will be one (1) Winner in total. The judges’ decision is final and we will not enter into correspondence regarding the result.
14. The Winner will be notified by phone and confirmed via email on 18 August 2014, via the phone number and email address nominated in the Entry (Notification). The Winner will also be published on the Competition at www.eonline.com/runwaygetaway.
15. The Winner must claim the Prize (via phone or return email) within 24 hours from the time of Notification (Claim Period).

16. If the Winner is unable to comply with these Terms and Conditions and/or does not claim the Prize within the Claim Period, then he or she will be deemed to have forfeited their entitlement to the Prize and we reserve the right to award the Prize to the entrant with the next most original and creative Entry, as determined by the judges on 19 August 2014 at the NBC Universal offices (Unclaimed Prize Determination).
17. The Winner will be notified by phone and confirmed via email on 19 August 2014, via the phone number and email address nominated in the Entry. The Winner must claim the Prize within 24 hours of being notified of the Unclaimed Prize Determination. This process will continue until a winner is determined.
18. It is your responsibility to provide the correct contact details on the Entry and to notify us of any changes to you contact details, in order to receive the Prize. We accept no responsibility should you fail to receive the Prize because of a failure to notify us of a change to these details.
19. The Prize is valued at AU$14,124.95 (incl GST) and consists of:
(a) two (2) x return economy class flights, departing from the Winner’s nearest Australian State capital city on or about 4 September 2014 and returning from New York, New York, USA on or about 11 September 2014. Flights include checked luggage and taxes, RRP AU$6,330.00 (incl GST);

(b) comprehensive travel insurance, excluding pre-existing medical conditions for two (2) x adults under the age of 60, RRP AU$581.00 (incl GST);
(c) return shared airport transfers to accommodation for two (2) x adults, RRP AU$580.00 (incl GST);
(d) five (5) nights’ twin share accommodation in a minimum 3.5 star hotel for 2 adults, RRP AU$3,650.00 (incl GST);
(e) two (2) x tickets to a New York Fashion Week fashion designer show, to be determined at our sole discretion, and access to the E! Lounge on the day of the fashion designer show;
(f) AU$1500.00 spending money;
(g) AU$100.00 transport allowance for travel to and from New York Fashion Week events;
(h) one (1) x Samsung Galaxy S5 and one (1) x Samsung Gear 2, RRP AU$1,298.95 (incl GST);
(i) one (1) x SIM card valid for seven (7) days in the USA, preloaded with AU$85.00 credit; and
(j) an opportunity to post photos and an article on the E! website, subject to our approval;
(collectively, the Prize).
20. The Winner and the Winner’s travel companion must both be aged 21 years or over.
21. The Winner must:
(a) attend a Samsung training session at a date and time determined by us, which will be approximately 5 days after Notification;
(b) and must ensure that the Winner’s travel companion, tags the handle “@SamsungAU” in all content uploaded on social media for the duration of trip; and
(c) use the Samsung Galaxy S5 and Samsung Gear 2 for the duration of the trip.
22. We reserve the right to:
(a) approve all content to be posted on the E! Website; and
(b) review all content posted by the Winner and the Winner’s travel companion on social media in relation to the Competition. The Winner must immediately remove any content if requested by us.
23. In relation to the travel component of the Prize:
(a) the Winner and his/her travel companion must be available to travel between 4 September 2014 to 11 September 2014 (Travel Dates).
(b) the Prize is subject to availability;
(c) the Winner and his/her travel companion must depart from, and return to, the same point of departure and travel together for the duration of the trip;
(d) the Winner and his/her travel companion may extend the trip entirely at the Winner’s and his/her travel companion’s sole cost;
(e) unless expressly stated otherwise in the description of the Prize in these Terms and Conditions, the Winner is solely responsible for all costs and expenses associated with using the Prize including costs associated with:
(i) meeting all government, consular, health and travel requirements applicable to the destination (including obtaining a valid passport, vaccinations and entry visas); and
(ii) all additional taxes, meals, transfers, flights, accommodation, sightseeing or other activities, and spending money not expressly included in the Prize;
(f) Frequent Flyer points (or any similar product) cannot be earned on any flights included in the Prize; and
(g) we make no representation as to the safety or other conditions at the destination and recommend that the Winner consult the website of the Australian Department of Foreign Affairs and Trade (http://www.smartraveller.gov.au/) for travel and consular advice before embarking on international travel.
24. In relation to the accommodation component of the Prize:
(a) the Prize is subject to availability;
(b) the Winner and/or his/her travel companion may be required to provide a valid credit card imprint or cash deposit at check-in for the purpose of covering incidental or other charges at the hotel; and
(c) unless expressly stated otherwise in the description of the Prize in these Terms and Conditions, the Prize does not include the cost of telephone calls, internet access, breakfast, in-room dining, in-room movies, mini bar, gratuities or any other costs or expenses incurred by the Winner, his/her travel companion and/or any of their guests at the hotel.

25. The Prize is not transferable or exchangeable and is not redeemable for cash or other goods or services. The Prize must be taken as a whole and as stated in these Terms and Conditions. No alternative will be provided and no compensation will be payable if the Winner is unable to travel on the Travel Dates or use the Prize as such.
26. The value of the Prize is the recommended retail price as provided by the supplier (inclusive of GST) and is correct as at the start of the Competition. We accept no responsibility for any variation in Prize value.

27. If the Prize becomes unavailable for any reason, we, in our sole discretion, reserve the right to substitute the Prize with a prize of equal or greater value and/or specification.
28. Use of the Prize is subject to the Winner and his/her travel companion complying with any terms and conditions imposed by any third party that is associated with the provision of any part of the Prize in accordance with this Competition (Associated Third Party). The Promoter is not responsible or liable for any loss suffered by any Winner (or his/her travel companion) as a direct or indirect result of any Associated Third Party.
29. We collect personal information in order to conduct this Competition and may, for this purpose, disclose such information to third parties, including, but not limited to, agents, contractors, service providers, Associated Third Parties and, as required, to Australian regulatory authorities. Validity of an Entry is conditional on providing this information to us. We may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you. You should direct any request to access, update or correct information to Samsung and/or NBC Universal. All Entries become the property of Samsung and NBC Universal.
30. We collect your personal information in accordance with each of our privacy policies (available at http://www.nbcuni.com/privacy/ for NBC Universal and at http://www.samsung.com/au/info/privacy.html for Samsung). By entering this Competition, you accept the terms and conditions of each of our privacy policies.

31. The Winner agrees to his/her name being published. The Winner consents, and must procure the consent of the Winner’s travel companion prior to travel, to our use of the name, likeness, image, picture, film, recording, voice, statements, testimonials or quotations of the Winner and the Winner’s travel companion in any media for an unlimited period without remuneration for promotional, marketing and publicity purposes.
32. The Winner participates in this Competition, and uses the Prize, at his or her own risk.
33. We assume no responsibility for any error, omission, interruption, defect, delay in operation or transmission, or loss or damage to data. We make no guarantee of the availability of web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Competition.
34. If this Competition is not capable of running as planned for any reason (including as a result of technical failures, fraud or causes beyond our control), we may, in our sole discretion, cancel, suspend or change the Competition and re-commence it on similar terms, subject to any directions by regulatory authorities.
35. Subject to clause 36, we (including our officers, employees and agents) exclude all liability (including negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under our control); (b) any theft, unauthorised access or third party interference; (c) any Entry that is late, lost, altered, damaged or misdirected (whether or not after our receipt thereof) due to any reason beyond our reasonable control; (d) any variation in Prize value, or in the Prize, to that stated in these Terms and Conditions; (e) any tax liability incurred by a Winner or the Winner’s travel companion; or (f) use of the Prize.
36. Nothing in these Terms and Conditions is intended to exclude, restrict or modify any consumer rights under the Competition and Consumer Act 2010 (Cth) (CCA) or any other legislation which may not be excluded, restricted or modified by agreement. If the CCA or any other legislation implies a condition, warranty or term into the Terms and Conditions or provides statutory guarantees in connection with these Terms and Conditions, in respect of goods and services supplied (if any), our liability for breach of such a condition, warranty, other term or guarantee is limited (at our election), to the extent we are able to do so: (1) in the case of supply of goods, doing any one or more of the following: (a) replacing the goods or supplying equivalent goods; (b) repairing the goods; (c) paying the cost of replacing the goods or of acquiring equivalent goods; and/or (d) paying the cost of having the goods repaired; or (2) in the case of supply of services, doing either or both of the following: (a) supplying the services again; and/or (b) paying the cost of having the services supplied again.
37. These Terms and Conditions are governed by the laws of New South Wales.
