Annual Statements Competition (“Competition”)
Terms and Conditions
1. Information on how to enter and the prizes form part of these Terms and Conditions. Entry into the Competition is deemed acceptance of these Terms and Conditions.
2. The Promoters are MLC Limited (ABN 90 000 000 402) of Level 2, 105-153 Miller Street, North Sydney, NSW 2060, telephone 132 652 and Plum Financial Services Limited (ABN 35 081 812 731) of Level 4, 500 Bourke Street, Melbourne VIC 3000, telephone 1300 55 7586 AFSL 243356 (“Promoters”).
3. Entry is open only to Australian residents aged 18 years or over who either have an MLC Superannuation account or a Plum Superannuation account, receive a communication from either Promoter regarding this Competition, and comply with the specific eligibility criteria relevant to the entry mechanic, as outlined below (“Participants”).
4. Employees (and their immediate family) of the Promoters, their related companies, and agencies associated with this Competition, including but not limited to contractors, agencies, retailers and suppliers (e.g. advertising, marketing and promotional agencies) are not eligible to enter the Competition. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
5. Competition commences 25 July 2014 and entries close at last mail received on 31 December 2014 (for mail entries) and 11.59pm AEDST on 31 December 2014 (for online entries) (“Competition Period”), with valid entry for the Bring Super Back Mechanic dependent on receipt of at least one future employer super contribution by 28 February 2015.
6. To enter the Competition, a Participant with an MLC superannuation must complete one (1) of the following three (3) mechanics:
I. Bring Super to MLC (mechanic is only available to inactive MLC customers i.e. MLC customers who have not had employer contributions made to their MLC superannuation account for at least 12 months):
a) contact their employer and arrange for their future employer super contributions to be entered into their MLC superannuation account between 25 July 2014 and 5pm AEDST on 31 December 2014; and
b) have at least one employer super contribution payment successfully received in their MLC superannuation account by 28 February 2015; OR
II. Provide consent to MLC to find other super funds
a) fully complete the SuperMatch Consent Form and send to MLC Limited, Reply Paid 86614, Kingsgrove NSW 2208 so it is received by last mail on 31 December 2014; OR
b) visit www.mlc.com.au/supermatch, follow the prompts to the SuperMatch Consent Form, fully complete the SuperMatch Consent Form including all requested details and submit, so it is received between 25 July 2014 and 11.59pm AEDST on 31 December 2014; OR
III. Provide permission for MLC to consolidate any of the Participant‟s existing superfund accounts into their MLC superannuation account:
a) fully complete the Request To Transfer Whole Balance of Superannuation Benefits Between Funds Form and send to Reply Paid, MLC Limited, PO Box, 200, North Sydney, NSW 2059, so it is received between 25 July 2014 and last mail received on 31 December 2014; OR
b) visit www.mlc.com.au/consolidate, complete the online Consolidate Form including all requested details and submit, so it is received between 25 July 2014 and 11.59pm AEDST on 31 December 2014.
7. To enter the Competition, a Participant with a Plum superannuation account must complete one (1) of the following three (3) mechanics:
I. Bring Super to Plum (mechanic is only available to inactive Plum customers i.e. Plum customers who have not had employer contributions made to their Plum superannuation account for at least 12 months):
(a) contact their employer and arrange for their future employer super contributions to be entered into their Plum superannuation account between 25 July 2014 and 5pm AEDST on 31 December 2014; and
(b) have at least one employer super contribution payment successfully received in their Plum superannuation account by 28 February 2015; OR

II. Provide consent to Plum to find other super funds
(a) fully complete the SuperMatch Consent Form and send to PLUM, GPO Box 63, Melbourne VIC 3001, so it is received by last mail on 31 December 2014; OR
(b) log into plum.com.au and follow the prompts to consent for the Trustee, PFS Nominees Pty Limited to search for your superannuation, so it is received between 25 July 2014 and 11.59pm AEDST on 31 December 2014; OR
III. Provide permission for Plum to consolidate any of the Participant‟s existing superfund accounts into their Plum superannuation account:
(a) fully complete the Consolidate your superannuation benefits – Transferring to the Plum Superannuation Fund Form and send to GPO Box 63, Melbourne Vic 3001, so it is received between 25 July 2014 and last mail received on 31 December 2014; OR
(b) log into plum.com.au, to complete the online Consolidate Form including all requested details and submit, so it is received between 25 July 2014 and 11.59pm AEDST on 31 December 2014.
The Request To Transfer Whole Balance of Superannuation Benefits Between Funds Form/Consolidate your superannuation benefits – Transferring to the Plum Superannuation Fund Form must contain the full details requested of at least one of the Participant‟s valid superfund accounts. If no funds are able to be consolidated into their MLC/PLUM account for any reason (including failure to provide correct information), the Participant will not receive an entry into the draw for the Consolidate Funds Mechanic (i.e cl. 6(III) and 7(III) above.
By completing and submitting the SuperMatch Consent Form a Participant gives MLC or PLUM (as applicable) consent to use their tax file number to search for information about their superannuation accounts using a facility provided by the ATO.
8. Only one (1) entry permitted per person for each of the above mechanics they complete for one of their MLC/PLUM accounts. For the sake of clarity, a person is eligible to receive a maximum of three (3) entries for any one of their MLC/PLUM accounts, by completing all three (3) entry mechanics outlined above in relation to that account.
9. All entries must be submitted in accordance with the entry instructions.
10. Incomplete, indecipherable or illegible entries will be deemed invalid.
11. Participants (excluding SA residents) are eligible to win one (1) prize only. SA residents are eligible to win more than one (1) prize.
12. If there is a dispute as to the identity of a Participant, the Promoters reserve the right, in its sole discretion, to determine the identity of the Participant.
Prize Draws
13. The prize draw will be conducted on 11 March 2015 at Anisimoff Legal, Level 5, 492 St Kilda Road, Melbourne, Victoria 3004 at 11am AEDST. The winners will be determined by way of a random selection from a computer database containing all entries from eligible Participants. The winners‟ names will be published at www.mlc.com.au on 1 April 2015, and will remain on the website for 28 days. If any winner is from South Australia, that winner‟s name will also be published in The Australian newspaper on 1 April 2015.
14. The first three (3) valid entries drawn from all entries received during the Competition Period will each win $10,000. Each cash prize will be awarded in the form of a cheque made payable to the winner.
15. All winners will be notified by telephone within two (2) days of the draw and in writing.
16. If any prize remains unclaimed three (3) months after the original draw, subject to any directions from a regulatory authority, an unclaimed draw prize will be held at the same draw place and time as the original prize draw for all unclaimed prizes on 12 June 2015. Winners, if any, will be notified by telephone within two (2) days of the draw and in writing. The winners‟ names (if any) will be published at www.mlc.com.au on 24 June 2015, and will remain on the website for 28 days. If any unclaimed prize draw winner is from South Australia, that winner‟s name will also be published in The Australian newspaper on 24 June 2015.

General
17. The total prize pool value is $30,000.
18. All prize winners can collect their prize from MLC Limited, Reception, 105-153 Miller Street, North Sydney, NSW 2060 Australia or request for it to be sent to their nominated postal address.
19. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize by the time stipulated by the Promoters, then the prize will be forfeited.
20. Prizes are not transferable or divisible.
21. The Promoters collect personal information (“PI”) in order to conduct this Competition and may, for this purpose, disclose such PI to third parties, including but not limited to MLC Limited‟s parent company – NAB (and their related companies), agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoters and NAB will also use and handle PI as set out in their respective Privacy Policies, available at www.nab.com.au or by calling 13 22 65 (1300 363 647 for hearing impaired individuals with telephone typewriters) (for NAB‟s Privacy Policy) and www.mlc.com.au/mlc/im_considering_mlc/personal/footer_tools/privacy_policy (for MLC Limited‟s Privacy Policy) and plum.com.au (for Plum Financial‟s Privacy Policy). In addition to any use that may be outlined in the Privacy Policies mentioned, the Promoters and NAB may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Participant. The Privacy Policies also contains information about how Participants may opt out, access, update or correct their PI, how Participants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. Should a Participant‟s contact details change during the Competition Period, it is the Participant’s responsibility to notify the Promoters and NAB. All entries become the property of the Promoters. The Promoters and NAB will not disclose Participant‟s personal information to any entity outside of Australia.
22. The Promoters reserve the right to request Participants to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency, account holder status and entry considered suitable for verification is at the discretion of the Promoters. If a Participant can‟t provide suitable proof as reasonably requested by the Promoters, the Participant will forfeit any rights to the prize in whole and no substitute will be offered.
23. The Promoters reserve the right to verify the validity of entries and Participants (including a Participant‟s identity, age and place of residence) and to disqualify any Participant who tampers with the entry process, who submits an entry that‟s not in accordance with these Terms and Conditions or who has, in the opinion of Promoters, engaged in conduct in entering the Competition which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoters. Errors and omissions may be accepted at the Promoters‟ discretion. Failure by the Promoters to enforce any of their rights at any stage does not constitute a waiver of those rights.
24. Entries must be received during the Competition Period, with valid entry for the Bring Super Back mechanic dependant on receipt of at least one future employer super contribution by 28 February 2015. The Promoters have no control over telecommunications networks and accept no responsibility for problems associated with them. Entries deemed received at the time of receipt into the Promoters‟ database, not at the time of transmission. Entries submitted using any form of automated entry device or software are ineligible. Entries not fully complying with these Conditions of Entry will be deemed invalid. The Promoters accepts no responsibility for late, lost, incomplete, indecipherable, delayed, corrupted, illegible or misdirected entries whether due to error, omission, alteration, deletion, destruction, transmission interruption, tampering, theft, destruction failure or otherwise. No correspondence will be entered into.
25. Unless expressly stated in these Terms and Conditions, all other expenses become the responsibility of the winner, including any costs associated with accessing the Competition website.
26. By accepting the prize, the winners agree to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned. Participants consent to the Promoters using their name, likeness, image and/or voice in the event they‟re a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoters.

27. The Promoters‟ decision is final and the Promoters will not enter into correspondence regarding the Competition results.
28. As a condition of accepting a prize, each winner must sign any legal documentation as and in the form required by the Promoters and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.
29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia („Non-Excludable Guarantees‟). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoters (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition.
30. Except for any liability that cannot be excluded by law, including the Non-Excludable Guarantees, the Promoters (including their officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoters‟ control); (b) any theft, unauthorised access or third party interference; (c) any entry, prize claim or prize delivery that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any tax liability incurred by a winner or Participant; or (e) taking and/or use of a prize. Liability for any tax (other than FBT) arising out of participation in this Competition (including acceptance of a prize) is the sole responsibility of the Participant. Participants should seek independent financial advice in this regard.
31. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoters, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoters, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoters reserve the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate.
