ESSENDON FOOTY TIPPING PROMOTION – Terms and Conditions
ENTRY

1. This document contains the terms and conditions of entry (“these Terms”) into the 2014 Essendon Footy Tipping Competition (“Promotion”). Entry into this Promotion is deemed acceptance of these Terms.

2. The Promoter is Essendon Football Club ACN 004 286 373 of 275 Melrose Drive, Melbourne Airport, 3040 (“Promoter”).

3. The Promotion will be open from 9:00 am Australian Eastern Daylight Saving Time (“AEDST”) on Wednesday 12 March 2014 and will continue until the starting time of the last match of the last Round of the Season (defined below), which will be no later than 11:59 pm Australian Eastern Standard Time (“AEST”) on Sunday 31 August 2014 (“Promotion Period”).

4. Entry is open to all people excluding employees of the Promoter and other agencies, firms or companies associated with this Promotion, and their immediate families. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. Non-Australian Entrants will not be eligible for prizes.

5. To be eligible for the Weekly Prizes, Entrants must be 18 years of age or over.
DEFINITIONS

6. In these Terms, the following meanings apply in addition to terms which are defined elsewhere in these Terms unless the contrary intention appears:

“Comp” (Competition) means a private or public league for entrants to join as individuals.

“Cumulative Margin” means, in respect of an Entrant, the sum of the Margin Differences for all Rounds as at a particular date.

“Draw” means an even score at the conclusion of a Match.

“Entrant” means a person who is eligible to participate in and has submitted an entry into the Essendon Footy Tipping Competition in accordance with these Terms.

“Group means a group of individuals consisting of two or more people, which have agreed to enter the Promotion as a ‘group’.

7. “Judging Location” means the premises located at 275 Melrose Drive, Melbourne Airport, 3040 (“Promoter”).

“Leaderboard” means the Essendon Footy Tipping competition overall ladder of Entrants ranking.

“Margin Difference” in respect of a Margin Game means, for an Entrant that:

a. has correctly tipped a winning team, the difference between the margin nominated by the Entrant for that Match and the actual margin for that Match;

b. has tipped the losing team, the aggregate of the margin nominated by the Entrant for that Match and the actual margin for that Match (e.g. if entrant nominates a margin of 14, and their tipped team looses by 20 points, their ‘Margin Difference’ for the Match will be 34); and

c. has not submitted a tip for that Margin Game, zero.

“Margin Game” means the first Match of each Round in the Season.

“Match” means a single game of AFL Football, which is conducted during the Season;

“Ranking” means where an Entrant ranks or is placed overall in the Essendon Tipping competition.

“Round” means one of the 23 rounds consisting of Matches conducted during the Season.

“Season” means the 2014 AFL Premiership ‘Home and Away’ season of AFL Football consisting of 23 rounds of matches commencing on 14 March 2014.

“Score” means the number of points allocated to an Entrant for the correct tipping of winning teams in each Round in accordance with these Terms.

“Tipping Websites” means the websites of the Promoter at: http://tipping.essendonfc.com.au, accessible on the internet through the World Wide Web or via mobile internet enabled devices.
ENTRY CONDITIONS

8. To register for the Promotion Entrants must during the Promotion Period register their details via the on-line registration form located on the Essendon Tipping Website;

9. The Promoter reserves the right not to accept a registration for any Entrant or to disqualify an Entrant if the Promoter considers that the registration contains anything defamatory or is otherwise inappropriate.

10. An Entrant may only register as an individual or as a member of a Comp.

11. Entrants will have the opportunity, in respect of each Match in each Round of the Season, to tip by:

a. selecting a team that the Entrant expects will win the Match (a Draw cannot be selected); and

b. submitting those selections via the Essendon Tipping Website at which they registered (selections for each Match must be submitted before the scheduled start time of the relevant Match).

12. Eligible individuals who register and submit tips prior to the start of the Promotion Period are still eligible for prizes in this Promotion (subject to any restrictions below) if they consent to these Terms as prompted when they first login to a Tipping Website during the Promotion Period.

13. An Entrant may make or change a tip for a given Match in a Round at any time prior to the scheduled starting time of that Match.

14. Entrants will have the opportunity, in respect of the first Match in each Round of the Season, to tip by selecting the team that the Entrant expects to win and also including the margin by which they expect that their selected team’s score will beat the opponent team’s score for the Margin Game. If the team the Entrant tips scores greater than or equal to the opposition score, their tip is considered successful. This also applies to Pick 5 and Gauntlet comps.
FAILURE TO TIP

15. If an Entrant:

a. does not submit a tip for a given Match in a Round, then the Entrant’s tip for that Match will be deemed to be for the team determined, in the Promoter’s sole discretion, to be the “away team”; or

b. does not submit a tip for Matches in an entire Round, the Entrant’s tips for that Round will be deemed to be those of the teams determined, in the Promoter’s sole discretion, to be the “away teams” up to a maximum of five correct tips for that Round; or

c. enters the Promotion after the commencement of the first Round of the Season, then the Entrant’s tips for those Matches that have been completed will be deemed to be those of the teams determined to be the “away teams” to a maximum of five correct tips for each such Round.
SCORING

16. Subject to the rules relating to failure to tip in Clause 14, Entrants will be allocated one point for each correctly selected winning team for a Match.

17. In the event of a Match in a given Round being drawn, cancelled, abandoned, not completed or not played for any reason and the AFL does not officially declare a result within one (1) day of the original scheduled date of the Match, it is treated as a win for both teams competing in that Match.
OVERALL RANKING

18. Throughout the Season, the Promoter will maintain a leaderboard which ranks the Entrants from highest to lowest based on their Scores. To determine the ranking of two or more Entrants that have an equal Score, the Entrant with the lower Cumulative Margin will rank higher than other Entrants with corresponding equal Scores (“Ranking”).
WEEKLY PRIZE

19. The Entrant who correctly tips all winners with a margin of zero (0) for each respective Round during the Season will be the winner of the Weekly Prize for that Round. Each winner’s name will be published on http://tipping.essendonfc.com.au within seven (7) days of the end of the respective Round.

20. The winner of each Round will be determined at the Judging Location every Tuesday at 2pm following the Round. Beginning on 14 March 2014 (Round 1). Each winner will be notified in writing within two (2) working days after the end of the respective Round for which they were determined a winner.

21. The winner of each Round will receive from the Promoter x 1 Bomber Shop Gift, valued at $25.00 (inc. GST) (“Weekly Prize”)

22. Entrants that have won a Weekly Prize for a previous Round of the Season will be eligible to win a Weekly Prize again.

23. The total value of the Weekly Prize pool is $575.00 (inc. GST) based on one winner per week for 23 Rounds.

24. Weekly winner will receive an email to claim their prize. In the event that any Weekly Prize has not been claimed within three months of being determined, the winner forfeits their prize and the Weekly Prize will be awarded to the Entrant who would be the winner had the original winner been excluded from winning, as judged at 5:00 pm (local time) at the Judging Location on the next business day being three months and one day after the relevant judging time, subject to any written directions given by State gaming departments. This prize winner will be contacted in writing within 2 days, and their details published on www.tipping.essendonfc.com.au immediately following the relevant judging time
MAJOR PRIZE

25. The Entrant that has the highest Ranking at the end of the last Round of the Season will win the major prize of 1 x Kia Rio Car, valued at $24,559.00 (inc GST and drive away) (“Major Prize”). The prize will be awarded by Kia Motors Australia. However, if there are two or more Entrants with equal highest Ranking, then the Major Prize winner will be the Entrant who submitted their last tip for the last Round of the Season first.

26. The winner of the Major Prize will be determined at the Judging Location at 5:00 pm AEST on 2 September 2014.

27. The Major Prize is valued at $24,559.00 (inc GST and drive away).

28. The Major Prize winner will be contacted in writing within 2 days of the date of being judged a winner, and their name will be published on www.tipping.essendonfc.com.au on and in Essendon Annual Bomber Magazine on 5 September 2014.

29. The Major Prize winners will be contacted in writing within 2 days of the date of being judged a winner, and their names will be published on 5 September 2014.

30. In the event that the Major Prize is not claimed by 2:00 pm AEDST on 9 December 2014, the prize will be awarded to the Entrant who, would be the winner had the original winner been excluded from winning. This prize winner will be contacted in writing and by phone within 2 days and their name published on www.tipping.essendonfc.com.au on 12 December 2014.
PICK 5

31. The first sub-competition of the Promotion, the “Pick 5 Competition” is conducted for Rounds 5 to 23 of the Season (“Pick 5 Rounds”).

32. An Entrant whose tips from Round 5 include 5 correctly selected winners will be automatically added to the Pick 5 Competition (“Pick 5 Entrants”).

33. Pick 5 Entrants will remain in the Pick 5 Competition, so long as they actively tip 5 or more correctly selected winners for each subsequent Pick 5 Round. Tips for each Round end at the start time of the first Match of the respective Round. There will not be a separate tipping section of the Website for the Pick 5 Competition.

34. A Pick 5 Entrant will be eliminated from the Pick 5 Competition where they fail to place their tips for all Matches in a Pick 5 Round, or they tip less than 5 correctly selected winners in a Pick 5 Round.

35. In the event that a team tipped to win by an Entrant ends their relevant Match in a Draw, or if the relevant Match is cancelled, abandoned, not completed or not played for any reason and the AFL does not officially declare a result within one (1) day of the original scheduled date of the Match, the Entrant’s tip for that Match will still be deemed a ‘winning’ tip for the purposes of the Pick 5 Competition.

36. At the end of the Season the winner of the Pick 5 Competition will be Entrant who remains in the Pick 5 Competition as at Round 23 or the Round before all Entrants are eliminated, whichever is first to occur (“Last Pick 5 Round”). However, if there is more than one Entrant then of those remaining, the Entrant with the highest Ranking after the Last Pick 5 Round will be the winner of the Pick 5 Competition. If there is still more than one Entrant remaining, then of those Entrants, the winner of the Pick 5 Competition will be the Entrant that has the higher Ranking as at the end of the Pick 5 Competition and who was first to register to participate in the Promotion.

37. The Pick 5 Competition winner will be determined at Judging Location on or before 2:00 pm AEST on 2 September 2014

38. The Pick 5 Competition winner will be contacted in writing within 2 days of the judging date, and their name will be published on http://tipping.essendonfc.com.au on 4 September 2014.

39. The winner of the Pick 5 Competition will receive a framed signed team Guernsey and football from the Promoter valued at $1,200 (inc. GST)

40. In the event that the Pick 5 prize is not claimed by 2:00 pm AEDST on 11 December 2014, the prize will be awarded to the Entrant that would have been the winner had the Pick 5 Competition winner been excluded. This winner will be notified in writing by 13 December 2014, and their name will be published on www.tipping.essendonfc.com.au on 16 December 2014.
GAUNTLET

41. The second sub-competition of the Promotion, the “Gauntlet Competition” is conducted for Rounds 11 to 23 of the Season (“Gauntlet Rounds”).

42. The Gauntlet Competition requires Entrants to nominate one (1) tip for each Gauntlet Round (i.e. choose one (1) team they think will win in that Round), until they are eliminated (in accordance with the below) (“Gauntlet Tip”). Tips open for each Gauntlet Round at 9am AEST/AEDST (as applicable) on the Monday of the same week as the first Match of the Gauntlet Round. Tips close for each Gauntlet Round at the start time of the first Match of that respective Gauntlet Round. An Entrant will not be able to submit any further Tips once they are eliminated.

43. In the event that a team tipped to win by an Entrant ends their relevant Match in a Draw, or if the relevant Match is cancelled, abandoned, not completed or not played for any reason and the AFL does not officially declare a result within one (1) day of the original scheduled date of the Match, the Entrant’s tip for that Match will still be deemed a ‘winning’ tip for the purposes of the Gauntlet Competition.

44. Once a winning team nomination has been submitted for a Gauntlet Round, this nomination cannot be changed.

45. A team which has been tipped by an Entrant in one Gauntlet Round cannot be tipped again for a subsequent Gauntlet Round by that Entrant, for the purposes of this Gauntlet Competition.

46. Each Entrant that fails to submit a Gauntlet Tip prior to the start of the first Match in the relevant Gauntlet Round or does not correctly nominate a winning team will be eliminated from the Gauntlet Competition and may not continue to submit their Gauntlet Tip for subsequent Gauntlet Rounds.

47. The winner of the Gauntlet Competition will be the Entrant who is the last remaining Entrant who has not been eliminated. If this occurs prior to the end of Round 23, the Gauntlet Competition will end at that point.

48. If there are multiple Entrants who have not been eliminated from the Gauntlet Competition at the end of the last Gauntlet Round, then the winner will be the Entrant that has the higher Ranking as at the end of the Gauntlet Round. However, if there are still two or more Entrants with equal Ranking after this step, then the winner will be the Entrant (from the remaining group of tied Entrants) who submitted their Gauntlet Competition tip for Round 11 first.

49. The Gauntlet Competition winner will be determined at the Judging Location on or before 2:00pm AEST on 2 September 2014.

50. The Gauntlet prize winner will be contacted in writing within 2 days of the judging date, and their name will be published on http://tipping.essendonfc.com.au on 4 September 2014.

51. The winner of the Gauntlet Competition will receive from the Promoter the Ultimate Inner Sanctum EFC Experience valued at $1,000.00 (Inc. GST).

52. In the event that the Gauntlet prize is not claimed by 2:00pm AEDST on 21 November 2014, the prize will be awarded to the Entrant who would be the winner of the Gauntlet Competition had the original winner been excluded from winning. This winner will be notified in writing by 23 November 2014, and their name will be published on www.tipping.essendonfc.com.au on 25 November 2014.
MINORS

53. If an Entrant is under 18 years, they must have their parent or guardian’s consent to enter the Promotion. The Promoter reserves the right to request this consent in writing. If consent in writing is requested, the winner’s nominated parent/legal guardian will be required to include the words “in consideration of AFL agreeing to admit the Entrant into this Promotion, [name of Parent or Guardian] agrees to be bound by the terms of entry into the Promotion” in such written consent.

54. If a prize winner is under the age of 18 years, the prize will be awarded to the winner’s nominated parent or legal guardian on behalf of the winner.

55. Minors may use the prize, but they must have consent from their parent or legal guardian (which the Promoter may request in writing).
