By entering the “The Amazing Race Australia v New Zealand – John West Competition” (“the Competition”), you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents of Australia 18 years of age or older in Australia where the Channel Seven and its affiliated networks (“Affiliates”) signals are received. 2.2 Employees and their immediate families of the Seven Network (Operations) Limited, Simplot Australia Pty Ltd, Hardhat Digital, Mnet Mobile Pty Ltd and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER 3.1 The Competition commences on Monday 4 August 2014 at 22:00 (AEST) and concludes on Monday 13 October 2014 at 22:00 (AEDT) (“the Competition Period”). 3.2 For entry details, viewers must watch The Amazing Race Australia v New Zealand (“the Program”) on the Seven Network (“the Network”) and Affiliates during the Competition Period. There will be a competition segment aired during the Program which will display information on how to enter. 3.3 In order to enter the Competition, viewers must: a) Log on to www.yahoo7.com.au/johnwest; b) Download the ‘The Amazing Race Australia v New Zealand’ app on their smartphone; c) Register within the app to participate providing all mandatory requirements–‐ First Name, Last Name, Email Address, State and Player Name. d) Complete a ‘The Amazing Race Australia v New Zealand’ game in the app. 3.4 Entrants are responsible for paying any download charges applicable to the contract they hold with their carrier. 3.5 Limit of one (1) account can be created per eligible device and per person.
4. PRIZES 4.1 There will be one (1) Major Prize Winner, ten (10) Be Your Best High Score Winners and Seven Hundred (700) Minor Prize Winners who will receive the prize package detailed in clause 4.2. Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken. 4.3 In accepting a prize the winners (and their nominated travel companions where applicable) agree to participate in and co–‐operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winners grant the Promoter a perpetual and non–‐exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use. 4.4 The prize winner (and their nominated travel companions where applicable) agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation. 4.5 It is a condition of accepting the prize that the prize winner (and their nominated travel companions where applicable) must comply with all the conditions of use of the prize requirement and agree to sign any required documentation including release forms as a condition of claiming the prize. The Promoter may require the prize winners (and their nominated travel companions where applicable) to sign a waiver of liability and indemnity in the form determined by the Promoter in its absolute discretion within 6 weeks of being notified as the winner to claim the prize. 4.6 Prizes cannot be redeemed for cash and are not transferable or exchangeable. The travel companions nominated by the Major Prize winner, once nominated are not transferable. 4.7 The prize winner (and their nominated travel companion where applicable) must be 18 years of age or older and must provide valid identification to the Promoter. 4.8 If for any reason any element(s) of the prize(s) are not available, a replacement to equal or greater value may be chosen by the Promoter in their absolute discretion, subject to state government legislation. 4.9 The standard warranty conditions apply for all products. Where applicable, any applications for extended warranty periods or warranty claims are the winner’s responsibility and not that of the Promoter. 4.10 Any costs related to any portion of the prizes, unless stated otherwise, are the responsibility of the winner. 4.11 The Major prize winner and their travel companion must commence and complete their travel within 12 months of the applicable prize draw date (original or unclaimed prize draw) subject to availability at time of booking. There can be no changes made to travel arrangements once itineraries or tickets are issued, including no name changes. Winner must finalise the prize booking within 90 days of the prize draw date. Winner must finalise the prize booking at least 60 days prior to intended travel departure. If the major prize winner does not adhere to the above booking and travel conditions, the prize will be forfeited. 4.12 The Major prize must be taken as stated and no compensation will be payable if the major prize winner is unable to use the prize or element of the prize as stated. 4.13 Any changes made to the booking by the Major prize winner or their travel companions, including extending the trip, are at the major prize winner’s expense and must be arranged by the major prize winner. 4.14 The Major prize winners and their travelling companions must travel on the same flight, at the same time, must depart from the same capital city and are responsible for their own transport from their residence to their nearest capital city (Adelaide/Brisbane/Melbourne/Perth/Sydney) for flight departure to Anchorage, U.S. The Promoter will not be liable for any cost arising from or otherwise related to delays or cancellations to the travel booked by the major prize winner, either to or from the nominated capital city and their residence. All booking and costs related to obtaining, amending or otherwise concerning the travel to/from their residence and the nominated capital city are the responsibility of the major prize winner. 4.15 For clarity, if the Major prize winner and their travel companions live in Tasmania, ACT or NT they are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or Perth). The Promoter will not be liable for any cost arising from or otherwise related to delays or cancellations to the connecting flight(s) booked by the major prize winner, either to or from the nominated capital city and Tasmania, ACT or NT. All booking and costs related to obtaining, amending or otherwise concerning the connecting flight(s) to/from Tasmania, ACT or NT and the nominated capital city are the responsibility of the major prize winner. The major prize winner and his/her travel companion must depart from and return to the same departure point and travel together. Itinerary to be determined by the Promoter in its TARAUNZ John West Competition TCs FINAL.doc Page 3 of 6 absolute discretion. Frequent flyer points will not form part of the major prize. Prize is subject to the standard terms and conditions of individual prize and service providers. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the competition or suspend or modify a prize, subject to any written directions from a relevant regulatory authority. 4.16 Unless expressly stated in these terms and conditions all other travel expenses not expressly stated in these terms and conditions become the responsibility of the Major prize winner. The major prize winner and their travel companion are responsible for all expenses including but not limited to spending money, visa costs, vaccinations, transfers, meals, drinks, incidentals, mini–‐bar, in–‐room video, laundry, room service, telephone calls, activities, insurance, energy surcharges, gratuities, services charges, passports and all other ancillary costs. A credit card imprint or cash deposit may be required from the major prize winner at check–‐in to the hotel, for all incidental charges. 4.17 The Major prize winner is responsible for ensuring that all those travelling have valid passports and applicable visas. The Promoter will not be held responsible for any loss or delay that may occur as a result of any passport or visa not being produced in time for travel. The Promoter does not accept any responsibility if the Major prize winner or the major prize winner’s nominated travel companion cannot travel because of non–‐compliance with any passport, visa or immigration requirements. 4.18 The Major Prize is a single event holiday and cannot be separated into different holiday vacations. 4.19 Prize must be taken by 13th October 2015 and is subject to booking and flight availability. Availability cannot be guaranteed during Christmas, Australian/US school holidays and special event periods such as major US public holidays. 4.20 Travel suppliers/airlines to be chosen at the discretion of 33 Degrees Worldwide Pty Ltd (the Prizing Agency). 4.21 In the event that an element of the prize is cancelled or postponed for any reason, the winner forfeits the specified element and no cash alternative offer will be granted in lieu of the part of the prize. 4.22 Compliance with any health or other government requirements is the responsibility of the Major prize winner and their nominated travel companion. 4.23 Travel insurance is compulsory for the major prize winner and guest and is at the expense of the winner. Evidence of valid travel insurance with the highest available coverage for the period is required before the travel documentation can be released. 4.24 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize. 4.25 Full details of prizes can be obtained by telephone the Seven Network in each state on Sydney 02 8777 7777; Melbourne 03 9697 7777; Adelaide 08 8342 7777; Brisbane 07 3369 7777; Perth 08 9344 0777. 5. HOW TO WIN MAJOR PRIZE 5.1a There will be one (1) major prize winner in total drawn from the national pool of entrants who will win the prize package detailed in clause 4.2. (i.e. only first valid entry drawn in the major prize draw will win the major prize). Each entrant who has entered the Competition during the competition period and in accordance with clause 3.3 will be entered in the draw. There will be one (1) winner drawn randomly from the national pool of entries and they will become the winner if their entry complies with these terms and conditions, including in particular clauses 2.1, 2.2, 3.1 and 3.3. Entries that do not contain the information required may be deemed invalid and, in that event, a further draw will be conducted. The draw will take place at Mnet Mobile Pty Ltd, Level 1, 16 Anster Street, Adelaide, South Australia 5000 on Wednesday 15th October 2014 at 10:00 (AEDT) 5.1b Unlimited entries into the major prize draw are permitted during the Competition Period. Every game completed will result into an additional entry into the major prize draw. 5.1c The major prize winner will be notified by email within 2 working days of the draw. The winner’s entry details will be published in the Public Notes section of The Australian newspaper on Monday 20th October 2014. BE YOUR BEST HIGH SCORE PRIZE 5.2a There will be ten (10) Be Your Best High Score prizes in total detailed in clause 4.2 to be won across the Competition period. Each week in the competition period a new game task will be released on the ‘The Amazing Race Australia v New Zealand’ app that will link to The Amazing Race Australia in show tasks and the entrant that receives the highest valid score at the end of each week will win a prize pack, one (1) to be won each week. A weekly “Be Your Best High Score Prize” winner is eligible to win more than one High Score Prize. New tasks will be released at the end of every corresponding episode. GENERAL 5.4 The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result. 5.5 The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. The unclaimed prize winner(s) will be notified by a phone call within 2 working days of the draw, and an email advising the winner(s) of their prize will also be sent. Unclaimed major prize winner(s) names will be published in the Public Notes section of The Australian newspaper on Monday 26 January 2015 if required. 6. NO LIABILITY 6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation. 6.2 Seven Network (Operations) Limited, Mnet Mobile Pty Ltd, Simplot Australia Pty Ltd and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail. 6.3 Seven Network (Operations) Limited, Mnet Mobile Pty Ltd, Simplot Australia Pty Ltd and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur; during any draw; whilst undertaking any travel won on or connected with their entry into the draw; or in the participation in any prize; as a consequence of late, lost or misdirected mail; in relation to failure of an entry to be received by the Promoter on account of technical problems or traffic congestion; arising from or related to any problem or technical malfunction of any computer equipment, software, internet connection, any injury or damage to entrant’s or any other person’s computer software related to or resulting from participation in this competition. 6.4 Simplot Australia Pty Ltd assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available. 6.5 If for any reason this competition is not capable of running as planned, including cancellation of the Program, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to state government legislation. 6.6 The use of any software or any other mechanical or electronic means that gives an entrant an advantage in playing ‘The Amazing Race Australia v New Zealand’ App or manipulates the game results or allows the entrant to enter repeatedly is prohibited and will render all entries submitted by that entrant invalid and any game results obtained by such entrant will not be considered in determining the Be Your Best High Score Prize winner/s. 7.
